Royal Decrees 55/2005, of 21 January, establishing the structure of university teaching and regulating the official university studies of Grade, and 56/2005, of the same date, by which the Official university studies of Posgrad, partially modified by Royal Decree 1509/2005, of 16 December, have come to shape a new ordination of the Spanish official university teaching, according to the lines (a) general principles of the European Higher Education Area and in accordance with the provisions of the Article 88.2 of the Organic Law 6/2001, of 21 December, of Universities. For its part, Royal Decree 55/2005 has repealed Royal Decree 1496/1987 of 6 November 1987 on obtaining, issuing and approving university degrees, without prejudice to its application to the above teachings, for what is necessary establish, in compliance with the mandate contained in Article 3.1 of Royal Decree 55/2005, the requirements in respect of format, text and procedure for the issue of official university degrees in all the national territory by the Spanish universities. However, although in the present course 2006-2007 there has been the introduction of the first official teachings leading to the acquisition of the new official titles of Master and Doctor, the effective beginning of the delivery of the Degree lessons will not take place until 2008-2009, so this Order only addresses the regulation necessary to issue the new Master and Doctor's official titles corresponding to the teachings that have been implemented in accordance with the provisions contained in the Royal Decree 56/2005 of 21 January. In accordance with the provisions of Annexes I and II, the models for the issue of the new Master's and Doctor's titles and Annexes III and IV, as laid down in this standard, present the models for the issue of such certificates. when they correspond to the joint programmes developed between Spanish or Spanish universities and foreign universities referred to in Article 7 of Royal Decree 56/2005 of 21 January. Finally, Annex V incorporates the model of the European Supplement to the Master's degree. In its virtue, in the use of the competition attributed by article 3.1 of Royal Decree 55/2005, prior to the report of the Council of University Coordination and with the prior approval of the Minister of Public Administrations, I have:

CHAPTER I

General rules

Article 1. Object.

This Order aims to regulate the requirements and the procedure for the issue of the official university degrees of Master and Doctor, in compliance with the provisions of article 3.1 of the Royal Decree 55/2005, of 21 January, establishing the structure of university teaching and regulating the official university studies of Grade.

Article 2. Scope.

The provisions contained in this Order will apply to the issuance of official university degrees of Master and Doctor by Spanish universities, throughout the national territory.

Article 3. Official Master's and Doctor's degrees.

1. They are official university degrees of Master's and Doctor's who credit the complete overcoming of the second and third cycles, respectively, of the official university studies with academic and professional validity throughout the territory national.

2. These certificates shall be issued, on behalf of the King, by the Rector of the University in which the studies giving the right to obtain them have been completed, in accordance with the requirements regarding their format, text and the procedure for issuing them. set out in this Order. 3. The name of the official Master's degree will be that of "Master University" and that of the official university degrees of Doctor will be "Doctor", with these denominations being reserved exclusively for each one of them.

Article 4. Records of official university degrees.

1. In the Ministry of Education and Science and in all universities there will be the National Register and the University Records of the issuing of official university degrees.

2. Access to these Registers, which contain personal data, will be carried out in the terms laid down in Article 37.3 of Law 30/1992 of 26 November, of the Legal Regime of Public Administrations and of the Procedure Common Administrative Law, and in Organic Law 15/1999, of 13 December, on the Protection of Personal Data.

CHAPTER II

Issuing of Master and Doctor's Official College Titles

Article 5. University Master's degrees.

1. The specific name of the official title of the Master's degree shall be that which appears in the list of titles of new establishment whose teachings are official and lead to the obtaining of the corresponding title, which shall be published in the Official Gazette of the State in accordance with Article 5 of Royal Decree 56/2005 of 21 January.

2. The material issue of these titles shall, together with the mention of their specific name and the express reference to their status as Master University teachings, refer to their official character and validity throughout the national territory, as well as, where appropriate, express reference to the subject matter, in accordance with the model provided for in Annex I.

Article 6. Doctor's titles.

1. The official title of Doctor will include the name "Doctor/a by the University" followed by the name of the University in which the doctoral thesis and the name of the program were approved.

2. The material expedition of these titles will contemplate, together with the mention of their denomination and the reference expresses to their condition of teaching of Doctorate, allusion to their official character and validity in all the national territory, according to the previewed model in Annex II. 3. The words 'cum laude' may be included, as appropriate, in accordance with the provisions of Article 13.4 of Royal Decree 56/2005 of 21 January concerning the defence and assessment of the doctoral thesis. 4. The words "Doctor européus" may also appear on the front of the title of Doctor, provided that the circumstances provided for in Article 14 of Royal Decree 56/2005 of 21 January are met.

Article 7. Titles corresponding to joint programs between Spanish and Spanish universities and foreign universities leading to the obtaining of official degrees of Master's or Doctor's.

1. The issue of the official degrees of Master's or Doctor's Degree obtained after the second or third cycle, respectively, of the joint programmes between two or more Spanish universities, as provided for in Article 7.3, In addition to the provisions of this Order, it shall be governed, in addition to the provisions of this Order, by the provisions of the Convention to which the respective Universities have subscribed which, in any event, shall determine the University which shall be responsible for the processing and archiving of the students ' files, as well as the processing, the issue of material, registration and delivery to the persons concerned.

The issuance of such securities shall be governed by the provisions of this Order, and shall include in each title the express reference to the universities participating in the Convention, in accordance with the provisions of this Agreement. Annexes III and IV. 2. The issue of the official degrees of Master's or Doctor's degree obtained after the second or third cycle, respectively, of the joint official programs between Spanish and foreign universities, According to the provisions of Article 7.4 of Royal Decree 56/2005, it shall be governed, in addition to (a) the provisions of this Order, as laid down in the Convention which the respective Universities have concluded for those purposes. In the official title of Master's Degree or Doctor issued by the Spanish University which has signed the Convention, the express mention of the participating universities shall be included, in accordance with the models provided for in Annexes III and IV. 3. Where the issue of the title corresponds to the foreign university, the Convention shall stipulate that a reference to the official title of the Spanish Posgrad shall appear in that title. In any case, the title must be presented to the Spanish University that signed the Convention, so that it includes a diligence indicating the official title of Posgrad that corresponds and proceeds to its registration. The foreign securities obtained in accordance with the provisions of this Article may not in any case be the subject of an approval for a Spanish academic degree or degree under Royal Decree 285/2004 of 20 February 2004. the conditions for the approval and validation of foreign certificates and studies of higher education.

CHAPTER III

Master and Doctor's official university degree expedition procedure

Article 8. Request.

1. Once the university studies leading to obtaining an official degree of Master's degree or Doctor have been completed, the person concerned may request the issue of the title at the University in which the studies have been completed. The file for the award of the title shall consist of the following documents: (a) Instance of the data subject applying for the title, in accordance with the model established by the corresponding University, in which he shall, where appropriate, record a request express of issue of the same in bilingual text, in accordance with the provisions of Article 12 of this Order.

(b) Academic certification of the University Centre to ensure and specify the improvement of the data subject concerned and, where appropriate, how many requirements are required in relation to the curriculum or the programme concerned, with an indication of the date of completion of the programme. The certification must also include the date of approval of the corresponding title. (c) Accreditation of the identity data of the data subject, in the terms of Royal Decree 522/2006 of 28 April 2006, which suppresses the contribution of photocopies of identity documents in the administrative procedures of the General administration of the State and its related or dependent public bodies. (d) Certification that the person concerned has satisfied the rights of issue of the title.

2. The titles of Master and Doctor shall have full effect from the date of payment of the rights of issue of the same. In accordance with Article 3.1 of Royal Decree 55/2005 of 21 January 2005, the person concerned may, as soon as the corresponding duties are paid, apply for the issue of a provisional supplementary certification which shall be replaced by the official title, as long as the material issue is not produced, and shall have the same value for the exercise of the rights attached to the title. Such certification shall include the essential data to be included in the relevant title.

Article 9. Communication to the National Register of Titles.

1. In relation to the official titles which they issue, the Universities shall conform to the rules of organization and procedure of the University Records of official titles established in this respect.

2. To this end, the Technical Secretary-General of the Department will give the appropriate instructions on computer procedure and documentary verification, in order to constitute the corresponding database in connection with those of the Universities.

Article 10. Characteristics of the support and format of official university degrees.

1. The card holder of the official titles of Master University and Doctor, of identical size for all of them, will be of special material with certain keys of authenticity, normalized in format UNE A-3, according to the requirements technical and security to be determined by the Technical Secretary-General of the Department.

2. The cards will carry the National Shield in the upper left corner. They shall be numbered by means of alphanumeric series, the control of which shall be the units responsible for the process of issuing the securities. 3. The Universities shall adopt, for the titles they issue, the attributes, colors, orlas and other graphics they deem suitable, without any limitations other than those established in this Order. They will also be able to incorporate titles that they issue their own shield or others, never in greater size than the National Shield. 4. The titles will be printed all of their text, as well as the signature of the Rector of the corresponding University. Non-printed registration shall not be permitted, except for the signature of the person concerned and the person responsible for the official title of the university. 5. Each University, prior to its delivery to the person concerned, will carry out in the title a dry stamping of the reason of its choice, equal to all the titles it issues. It will send a sample of this reason to the General Subdirectorate of Titles, Convalidations and Homologations of this Department, for the purposes of knowledge and control of authenticity.

Article 11. Title customization.

1. The official university degrees of Master and Doctor shall include in its front, in addition to the particulars indicated in other articles of this Order, the following data: (a) It expresses the title to which the title is issued in the name of the King, with the formula set out in the Annexes to this Order.

(b) Name and surname of the person concerned, as listed in his national identity card or passport. (c) Place and date of birth, as well as nationality of the person concerned. (d) the place and date of issue of the title, which shall be the date of the certification of the payment of the rights for that issue. e) Signature of the person concerned, of the official of the unit of official titles of the University, and of the Rector of the University. (f) Where appropriate, the words 'cum laude' and the words 'Doctor européus' shall be included. (g) Mention of the legal causes which, where appropriate, affect the effectiveness of the title. Where appropriate, it shall be recorded in the case of the issue of a duplicate, as well as the reasons for the issue. (h) Official keys of the title being issued. The first shall be composed of the codes corresponding to the University, the Center, and the number of the University Register. The second corresponds to the number assigned by the National Register of Titles.

2. On the back of official university degrees, the same data relating to the alphanumeric key of the support, University and Centre codes, number of university register of official titles and number of the National Register will be recorded. of Titles, in order to identify the two parts of the title. It shall also include the place and date of issue of the title, and the signature of the official of the official title unit of the University.

Article 12. Language of official university degrees.

Official university degrees will be issued in Spanish and, where appropriate, in the other official languages of the Autonomous Communities. Universities located in Autonomous Communities with their own official language shall issue the titles in bilingual text, in a single document drawn up in Spanish and in the other official language of the corresponding Autonomous Community, both texts printed with the same font type and size. The legend "Juan Carlos I, Rey de España" will be printed exclusively in Spanish.

Additional disposition first. European Supplement to the Title.

Once the university studies leading to the official degrees of the Master's or Doctor's degree have been exceeded, the person concerned may apply at the corresponding university, the issue of the European Supplement to the an agreement with the model set out in Annex V.

Additional provision second. Titles of the Universities of the Catholic Church.

1. In accordance with the provisions of the Fourth Additional Provision of Organic Law 6/2001, of 21 December, of Universities, the obtaining, issuing and the effects of the titles corresponding to studies taught in universities of the Church Catholic, will conform to the provisions of the Agreements between the Spanish State and the Holy See.

2. The official university degrees of Master and Doctor obtained in the aforementioned universities for the improvement of studies that have recognized civil effects, will be issued by the corresponding Rector in the name of the King, adjusting to the established in this Order for official titles.

First transient disposition. Titles corresponding to previous teachings.

The issue of the official Doctor's titles corresponding to the teachings prior to those established in accordance with the provisions of the Royal Decrees 55/2005 and 56/2005 will be carried out in accordance with the rules set out above in force, contained in Royal Decree 778/1998 of 30 April 1998.

Second transient disposition. Transitional arrangements for the accreditation of identity data.

As long as the actions that allow the universities to access the Identity Data Verification System are not concluded, the interested party must accompany the request referred to in Article 8 of this Order of a photocopy of the national identity document or equivalent document.

Final disposition first. Competence title.

This Order is dictated by the provisions of Article 149.1.30. of the Constitution and in accordance with the authorization contained in Article 3.1 of Royal Decree 55/2005, and is applicable throughout the territory of the country. national.

Final disposition second. Application.

The Secretary of State for Universities and Research and the Technical Secretary General are hereby authorized to issue the instructions necessary for the application of this Order in the field of their respective competences.

Final disposition third. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

European Supplement to the University Master Title

1. Data from the titled.

4.4 Rating system.

In the Spanish university system, the scores are based on the absolute score on 10 points obtained by the student in each subject or research work, according to the following scale: Susthought: 0- 4.9. Approved: 5-6.9. Notable: 7-8.9. Outstanding: 9-10. Registration of honor: it implies getting outstanding, plus a special mention. A subject is considered to be superseded from "approved". The distribution of the ratings has been: Approved x%, Notable x%, Outstanding x%, Honor Matriculation x%. 4.5 Overall Rating of the entitled person.
