Commission Directive 2007 /49/EC of 26 July 2007 amending Council Directive 2003 /91/EC of 6 October 2003 laying down detailed rules for the application of Directive 2003 /91/EC for the purposes of Article 7 of the Directive 2002 /55/EC of the Council, with regard to the characteristics which the examinations must analyse at least and the minimum conditions for examining varieties of certain species of horticultural plants, replaces Annexes I and II to the Directive 2003 /91/EC of the Council of 6 October 2003, which was incorporated into national law by the Order APA/530 /2004 of 13 February amending the Regulations for the registration of Varieties in the Register of Trade Varieties, corresponding to horticultural species, cereals, maize, oilseeds and textiles, potatoes, fodder, pratenses, lawns and leguminous beans and beets. As a result of the above, it is necessary to amend the Regulations on the Registration of Varieties of Horticultural Species, approved by the Order of 23 May 1986, by incorporating into our internal order the Directive. Commission Regulation (EC) No 71/2008 of 26 July 2007. Annexes E and F to the Regulation are hereby replaced. In the preparation of this Order, they have been consulted, the Autonomous Communities and the sectors affected. In its virtue, I have:
Single item. Amendment of the Order of 23 May 1986 approving the Regulations for the Registration of Varieties of Horticultural Species.
Annexes E and F to the Order of 23 May 1986 on the Regulation on the Registration of Varieties of Horticultural Species are hereby replaced by those set out in the Annex to this Order.
Single transient arrangement. Varieties which are in the process of admission.
Those varieties which, before 1 November 2007, have commenced official examinations for admission to the Register of Varieties, may be accepted if they comply with the provisions laid down in this order or, where appropriate, by means of the above provisions.
Single end disposition. Entry into force.
This Order will enter into force on 1 November 2007.
