Article 23 of Law 51/2007, of December 26, of the General Budget of the State for the year 2008, provides that the total number of places of new income of the public sector staff will be, at most, equal to 100 per 100 of the rate of replacement of staff and which shall be concentrated in the sectors, functions and professional categories which are considered to be a priority or which affect the functioning of the essential public services as a criterion for the guarantee of the stability and improvement of public employment. This limitation shall not apply, among others, to the staff of the Administration of Justice, for which the number of places shall be determined in accordance with the provisions of Law 38/1988 of 28 December of Demarcation and of the Judicial Plant, or Public Administrations with educational competences for the development of the Organic Law 2/2006, of 3 May, of Education, regarding the determination of the number of places for the access to the bodies of teachers. The offer of public employment, in order to advance the commitment to reduce temporality in public employment, will include all posts and places performed by temporary staff who fill vacancies of a structural nature, appointed or hired. in the previous financial year, except those on which there is a reserve of post or are incourses in the provision process. The first subparagraph of Article 23 (3) of Law 51/2007 of 26 December 2008 on the General Budget of the State for the year 2008 provides that the Government, with the limits set out above, may authorise, by means of the offer of public employment, prior to the favorable report of the Ministry of Economy and Finance, on a proposal from the Ministry of Public Administrations and on the initiative of the departments or public bodies competent in the field, the call for new entry vacancies which refer to the staff of the State Civil Administration, its Autonomous Bodies and State Agencies, civil personnel of the Military Administration, its Autonomous Bodies and State Agencies, staff of the Social Security Administration, statutory staff of the Social Security, staff of the Administration of Justice, Armed Forces and State Security Forces and Bodies, and staff of the public entities State Administration of Tax Administration, Nuclear Security Council, Data Protection Agency, and the public entity Lotteries and Stays of the State, as well as the posts and squares that I know they are either temporarily or temporarily performed. Article 23 of Law 51/2007, of 26 December, of General Budget of the State for the year 2008, in the fourth subparagraph of paragraph 3, also states that the Ministries of Public and Economic Administrations and Finance may authorize together the corresponding calls for vacancies or vacant posts of the public entities, bodies and public entities not mentioned above, in compliance with the rate of replacement of staff established in general. As a result, given the particular structure of public employment in this field, only places whose need is considered essential for each public entity or public entity are included in the royal decree, with the call of additional places which, where appropriate, meet the needs of the financial year, while respecting the limit of the rate of replacement of the staff and the conditions for authorisation referred to above. Thus, the offer of public employment for the year 2008 pays attention to those sectors, functions or professional categories that are considered to be priorities for affecting the functioning of essential public services. For these purposes, they are considered to be priorities:

Units of attention to the citizen and the direct delivery of services, which have strengthened their functions in the following areas: foreigners, social security management, tax administration and employment.

Traffic and police. Social policies: immigration, social affairs, with special reference to Gender Equality and Violence, housing and culture. Research. Environment. Penitentiary Institutions. Public finances, control and control of tax fraud and control of public expenditure, as well as actions in the field of statistics. Foreign Service, and International Cooperation, with the aim of continuing to strengthen the presence of the General Administration of the State abroad. Air, Maritime and Land Transport Safety. Information and Communications Technologies, as well as support to the Information Society. Support for the development of Law 39/2006, of 14 December, to promote personal autonomy and care for people in a situation of dependency.

Paragraphs two and three of the aforementioned Article 23 of Law 51/2007, of 26 December 2007, maintain the criterion of not proceeding to the hiring of temporary staff or the appointment of interim officials, except in cases where exceptional and urgent needs, with joint authorization from the Ministries of Public Administrations and the Economy and Finance, indicating that, in any event, these appointments will count for the purpose of fulfilling the maximum limit of 100 per cent of the rate of replacement of staff in the public employment offer corresponding to the same year in which those are produced, and if not possible, in the following offer of public employment.

In order to speed up the temporary hiring referred to in the previous paragraph and to respond adequately to the urgency and indefelable need that justify them, the system of lists of candidates for the selection of staff acting in accordance with the terms set out in the Resolution of 21 November 2007, of the General Secretariat for Public Administration, establishing the procedure for the approval and management of lists of candidates of the Corps of the General Administration of the State, whose selection is entrusted to the Standing Committee of Selection. This possibility may also be used in duly justified cases, prior to the authorization of the General Administration of the Civil Service, in the rest of the Corps and Escalas included in the offer. Article 23 (4) of Law 51/2007, of December 26, of the General Budget of the State for the year 2008, sets out the requirement for joint prior authorization from the Ministries of Public Administrations and the Economy and Finance for the recruitment of permanent or temporary staff abroad, either in accordance with local legislation or under Spanish law. This royal decree establishes the principles that must govern the planning of human resources, as well as the criteria that should guide the selection processes of the candidates that best meet the needs of the administration. D I S P O N G O:

Article 1. Approval of the offer of public employment.

1. In compliance with the provisions of article 70 of Law 7/2007, of 12 April of the Basic Staff Regulations, and of Article 23 of Law 51/2007, of December 26, of the General Budget of the State for the year 2008, the public employment offer for 2008 in the terms set out in this royal decree.

2. The selective processes resulting from the offer of public employment for 2008 will apply to the Order APU/3416/2007, of 14 November, establishing the common bases that will govern the selective processes for entry or access in Bodies or Escalations in the General Administration of the State. The specific bases of each process should be published in the "Official State Gazette" before 1 May 2008. The first exercise of the selective processes resulting from this offer will begin before 15 June 2008. Calls for work personnel under the II Single Convention for Labour Personnel of the General Administration of the State shall be governed by the provisions of Articles 29, 30 and 31 of that Convention. Calls from the rest of the workforce shall be in accordance with their respective conventions. The calls must be made favourably by the Directorate-General for the Civil Service. For these purposes, the ministerial departments shall send the specific bases of the processes to that Directorate-General, before 1 March 2008. The use of available electronic and electronic means will be encouraged for the streamlining of all these procedures. 3. The selective processes shall comply with the timetable set out in the preceding paragraphs, except for those exceptional cases, which shall be authorised by the Directorate-General for Civil Service. They shall be governed by the principles of effectiveness, efficiency and annuality. The new staff shall take possession of their seats, or shall be appointed officials in practice, in the financial year 2008.

Article 2. Quantification of the public employment offer.

The public employment offer includes the needs of human resources, with budgetary allocation, to be provided through the incorporation of new income personnel, in accordance with the provisions of the in the annexes of this royal decree.

According to the provisions of article 70.1 of Law 7/2007, of April 12, of the Basic Staff Regulations, and Article 23 (3) of Law 51/2007, of December 26, of the General Budget of the State For 2008, exceptionally to meet the needs of oversold, up to 10 per cent of the overall total of the amounts in the present public employment offer for Bodies and Scales of the General Administration of the State. Article 3. Human resource planning.

1. 2. The same objective will inspire the operations of relocation of personnel by the procedures provided for in the General Regulation of Income, Provision of Jobs and Professional Promotion, approved by Royal Decree 364/1995, of March 10. 4. Rerevenue to the active service by temporary staff of officials in administrative situations which does not entail a reserve of employment shall, where appropriate, be produced in centres, agencies and territories in need of staff and preferably in posts occupied by interim staff. 5. The General Secretariat for Public Administration may establish criteria for mobility, through participation in merit competitions, for those who are assigned to certain areas of priority care, specific needs of each area and the overall planning of human resources.

Article 4. General application criteria in the selective processes.

According to Law 7/2007, of the Basic Staff Regulations, the following guiding principles for access to public employment and the acquisition of the service relationship are indicated: a) In the selection of its staff, the The General Administration of the State shall ensure in addition to the constitutional principles of equality, merit and capacity, the principles of: a. b. Transparency c. Impartiality and professionalism of the selection bodies and their members. d. Independence and technical discretion in the performance of the Organ of Selection. e. Adequacy between the content of the selective processes and the functions or tasks to be developed. f. Agility, without prejudice to objectivity, in selective processes.

(b) The selective processes shall be open and shall guarantee free competition, without prejudice to the provisions of the internal promotion and the positive discrimination measures provided for in this royal decree.

(c) The selective processes of those Bodies and Scales that present a common trunk and similar topics, may be convened in a unitary manner with common courts and selection bodies. Programmes, tests or modules of selective courses common to different bodies or scales of the General Administration of the State may be established, where the nature of the processes and the functions to be performed by the General Administration, after agreement of the Departments concerned. (d) Testing and selective programmes should be geared to the selection and assessment of skills and skills associated with jobs in such a way that, when the nature of the functions to be carried out is recommended, the exercises of a practical nature, the psychotechnical or aptitude tests and the selective courses and, where appropriate, may be completed by conducting interviews, reducing the weight of the tests based on the mere memoristic exposure. Participation in courts and selection bodies of persons with disabilities will be promoted in those processes in which there is reserve shift for this group. h) Take advantage of the possibilities offered by technological advances in the field of selective processes, enhancing the electronic submission of applications and providing information through the Internet. For these purposes, the different Ministries and Organisms that offer places will include in their website an address dedicated to selective processes, in which they will collect each of the calls and the acts that are derived from them, incorporating, where possible, the relations of applicants admitted and excluded, as well as the relations of approved in each of the exercises, with an indication of the document proving their identity, surname, name and, where appropriate, province of examination in accordance with the current rules on data protection. (i) Selective processes that provide for testing with alternative responses shall make the corrective templates public. (j) The selective testing subjects derived from this Offer will include in the public policy issues, special reference to social policies, among them the policies of equality and gender-based violence. (k) According to the provisions of Royal Decree 522/2006 of 28 April 2006, the contribution of photocopies of identity documents to the administrative procedures of the General Administration of the State and its agencies is deleted. Article 5. Persons with disabilities.

The measures for the integration of persons with disabilities will be continued in the terms of the provisions of article 59 of Law 7/2007, of 12 April of the Basic Staff Regulations. A quota of not less than five per cent of the places offered to be covered by persons with disabilities shall be reserved, as defined in Article 1.2 of Law 51/2003 of 2 December 2003 on equal opportunities, non-discrimination and universal accessibility of persons with disabilities, provided that they overcome the selective processes and demonstrate their disability as well as the compatibility of the performance of their functions, so that, progressively, the two percent of the total troops in the General Administration of the State.

Annex I to this royal decree sets out the reservation of places in bodies, scales or categories whose activities or functions are compatible, to a greater extent, with the possible existence of a disability. The number of reserved places will be included in the corresponding specific bases of the calls. Places reserved for persons with disabilities who remain deserted in the free access process cannot be added to the general shift, adding up to 5% of the following offer, up to a maximum limit of 10%. In the internal promotion processes, the places reserved for disabled persons who remain deserted will be accumulated to those of the general shift.

Article 6. Internal promotion.

1. With the aim of promoting internal promotion, within the framework of article 18 of Law 7/2007 of the Basic Staff Regulations, up to 4,869 places will be convened for the different groups and subgroups of professional classification of the staff. career official, with the distribution by bodies and scales set out in Annex II. These selective internal promotion processes may be jointly convened with the ordinary calls for new revenue, or by means of an independent call.

3. Internal promotion shall be carried out by means of selective processes that ensure compliance with the constitutional principles of equality, merit and capacity as well as those referred to in Article 55.2 of Law 7/2007 of 12 April of the Staff Regulations. Public Employee Basic.

According to the second transitional provision of Law 7/2007, of 12 April, of the Basic Staff Regulations of the Public Employment, the workforce has fixed that the entry into force of the same is performing personnel duties. Article 7. Staff of the General Administration of the State.

The places that are called for the labor personnel listed in Annex I of this royal decree, will in any case be subject to the provisions of article 9.2 of the Basic Staff Regulations and in Article 15 of the Law 30/1984 of 2 August of Measures for the Reform of the Civil Service.

Prior to the call for selective testing for entry into the workforce positions set out in Annex I, the existence of budgetary allocation should be credited.

Article 8. Staff linked to the external service.

1. The recruitment of permanent or temporary staff abroad, in accordance with local legislation or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public and Economic and Finance the procedure laid down jointly by the two departments, provided that there is a budgetary allocation for vacant posts.

2. The four-year 2007-2010 plan to support the External Action in the terms set out in Order AECI/2783/2006 of 7 September 2006 will be continued.

Article 9. Fixed employment in the Public Entities and Public Entes.

During 2008, the hiring of fixed labor personnel will be limited to covering those vacancies that are considered essential for the normal functioning of public entities and public entities. The joint authorization of the Ministries of Public Administrations and the Economy and Finance referred to in the third subparagraph of Article 23 (3) of Law 51/2007 of 26 December of General Budget of the State for the year 2008, will be performed according to the following singular procedure, consisting of two phases:

1. Article 10. Temporary job consolidation.

Calls for consolidation of employment may be made to positions or positions of a structural nature corresponding to their different Bodies, Escalas or Categories, which are endowed in budgetary terms in the terms set out in the the fourth transitional provision of Law 7/2007, of 12 April, of the Basic Staff Regulations.

Article 11. Temporary staff.

During the year 2008, the hiring of temporary staff, and the appointment of interim officials, within the scope of Article 23 of Law 51/2007, of December 26, of General State Budgets for the year 2008, except in exceptional cases and to cover urgent and non-deferred needs, and prior to the joint authorization of the Ministries of Public Administrations and Economy and Finance. For the rest of the bodies and scales will be necessary authorization from the General Directorate of the Civil Service.

Article 12. Staff of the Administration of Justice, Bodies of Teaching Officers and Statutory Staff of Social Security.

1. Pursuant to Article 23 (3) of the Treaty. Article 13. Certificate of insufficient human resources.

Additional provision second. Human resources in the field of air and land transport safety.

Additional provision third. Participation in selective testing courts.

In accordance with the provisions of this Regulation, they may not be part of selection commissions or of the courts of selective testing for entry into bodies or scales of officials or categories of work personnel, who have the consideration of a high position in accordance with the provisions of Law 5/2006 of 10 April, of regulation of conflicts of interest of the members of the Government and of the High Charges of the General Administration of the State.

Additional provision fourth. Selective process management starts.

Only if there were no lists of possible candidates from the ordinary selective processes, within the meaning of Article 15 of Law No 30/1992 of 26 November 1992, of the Legal Regime of the Administrations Public and of the Common Administrative Procedure, for reasons of effectiveness and prior to the favourable report of the Directorate-General of the Civil Service, the material management of the selective tests of the acting official staff may be entrusted to the Ministries or bodies of which the posts to be covered by the Member States are dependent Interim officials.

2. The competence for the call for selective testing for fixed labour personnel included in the II Single Convention for the staff of the General Administration of the State, for the procedures for free access and internal promotion, it is the responsibility of the Directorate-General for the Civil Service, which may entrust the management to the various ministerial departments, as provided for in Article 30 of the said Convention. 3. The material management entrusted to the two preceding paragraphs shall be carried out in the following activities: receipt of requests for participation in the selective tests; proposal of the resolutions declaring the approval of the lists of admitted and excluded persons and the place and date of commencement of the first financial year, as well as the list of candidates excluded, indicating the causes of exclusion; proposal of the members to form the courts Test qualifiers; management of the operational necessary for the material development of the exercises; receipt of the documents proving the conditions of capacity and conditions required in the calls referred to in Article 23 of the General Staff Regulations to the Service of the Administration General of the State and Provision of Jobs and Professional Promotion of Civil Servants of the General Administration of the State, approved by Royal Decree 364/1995, of March 10, and any other procedures related to the activities of the selective process, the management of which is entrusted, provided that it does not alter the ownership of the competition and the substantive elements of its exercise. The expenditure incurred by the management of these items shall be borne by the budgetary section of the Ministry or Agency entrusted with the management. The term of validity of the management procedures shall be determined in the previous report of the Directorate-General of the Civil Service in the event of paragraph 2 of this provision and in the Resolution of the General Secretariat for Administration Public to be determined by the Ministry or Agency entrusted with the management in the case of paragraph 3 of this provision. The management mandate does not entail the transfer of ownership of the powers or the substantive elements of their exercise. It is the responsibility of the competent body or in which the competent body has delegated acts or decisions of a legal nature to support or to integrate the particular material activity covered by this management mandate.

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
