By the Order of 21 July 1994, in which files were regulated with personal data managed by the Ministry of Health and Consumer Affairs, compliance, in the field of the department, was established in the the second provision of the Organic Law 5/1992 of 29 October, regulating the automated processing of personal data. Article 20.1 of the Organic Law 15/1999, of 13 December, on the Protection of Personal Data, provides that the creation, modification or deletion of the files of public administrations may be made only by means of provision published in the Official Journal of the State or Official Journal. In order to comply with the provisions set out in that article and to complete the relationship of files with personal data managed by the Ministry of Health and Consumer, it is necessary to be regulated by this provision. The Spanish Data Protection Agency has issued a report on this order. In its virtue, I have:

First. -The contents of Annex II "Administrative Character Ficheros" of the Order of 21 July 1994, for which files are regulated with personal data managed by the Ministry of Health and Consumption, with the creation of the file whose data are listed as Annex I of this order.

Second.-The organ of the Administration responsible for the file and the administrative unit to which the rights of access, rectification, cancellation and opposition of the file in the Annex can be exercised. II. Third.-The transfer of data in the files listed in Annexes III and IV is specified. Fourth. The holder of the body responsible for the file listed in Annex I shall, under the top management of the Minister for Health and Consumer Affairs, take the necessary management and organisational measures, ensuring, in any event, that the confidentiality, security and integrity of the data, as well as the drivers to make effective the guarantees, obligations and rights recognized in Organic Law 15/1999, of December 13, of Protection of Personal Data, and in its (a) rules for development, and in Royal Decree 994/1999 of 11 June 1999 on the adoption of the Regulation on the security of automated files containing personal data. Fifth.-The data contained in the file listed in Annex I may only be transferred in the cases expressly provided for by the law.

Sixth. This order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX I National Consumer Institute

Filename: General directory. Purpose of the file: Communications and external contacts established by the National Consumer Institute. Persons or groups on whom data of a personal nature are intended to be obtained or which are required to supply such data: Natural persons with whom the National Institute of Consumption enters into communication or contacts in the exercise of the functions entrusted to it. Procedure for the collection of personal data: Directly of the natural persons with whom the Institute enters into communication or contacts or through the public administrations that facilitate the data of the contact. Basic file structure: Database. Personal data included in the file: Name and surname, address, position, management center, telephone, fax, e-mail. Transfers of personal data and/or transfers of data that are provided to third countries: Data transfer for the exercise of the functions for which they have been collected. Organ of the Administration responsible for the file: Instituto Nacional del Consumo, Calle Príncipe de Vergara, 54. 28006 Madrid. Administrative unit to which the rights of access, rectification, cancellation and opposition may be exercised: Head of Administration Area of the National Institute of Consumption, Calle Príncipe de Vergara, 54. 28006 Madrid. Security measures with level indication: Basic.

ANNEX II National Institute of Consumption

The sections relating to the organ of the administration responsible for the file and the administrative unit to which various rights can be exercised are modified, from the file called "Consultations and Claims CEC", with N. of registration 2062420191, which are worded as follows:

" Body responsible for the file: Ministry of Health and Consumer Affairs, National Consumer Institute, European Consumer Centre.

Administrative unit to which the rights of access, rectification, cancellation and opposition may be exercised: European Consumer Centre. "

ANNEX III National Institute of Consumption

The data transfers section of the file called "Queries, claims and consumer arbitration" is amended, with the registration number 2073190471, which is worded as follows:

" Recessions of personal data and/or transfers of data that are provided to third countries: to how many agents can intervene in the voluntary procedure under the terms set out in Article 11 of the Organic Law 15/1999, of 13 December, of Protection of Personal Data. "

ANNEX IV National Institute of Consumption

The section of data transfers from the file called "Companies attached to the consumer arbitration system" is amended, with the registration number 2073190497, which is worded as follows:

" Recessions of personal data and/or data transfers that are provided to third countries: Data transfer for the purposes of advertising and disclosure of accession, when the employer or professional is a natural person, transfer to the Arbitration Boards of Consumers, to the legitimate interested parties and to those who intervene in the procedure in the terms laid down in Article 11 of the Organic Law 15/1999, of 13 December, on the Protection of Data of Character Staff. "
