The Regulation on the registration of varieties of horticultural species, approved by the Order of 23 May 1986, lays down the characteristics to be observed in the identification tests, and the specific conditions and the methodology for the performance of these tests, indicating, in turn, the precise tests for the determination of the agronomic value or the use, in the species in which this evaluation is required for the registration in the Varieties Registry Commercial of varieties of such species. This Regulation incorporated Commission Directive 2003 /91/EC of 6 October 2003 laying down detailed rules for the application for the purposes of Article 7 of Council Directive 2002/55/EC in respect of the characters which the The examination of certain varieties of vegetable species, which has been amended several times, must be analysed at least and the minimum conditions for examining certain varieties of vegetable species. Annexes I and II have been amended by Commission Directive 2008 /83/EC of 13 August 2008, and it is therefore necessary to amend the Order of 23 May 1986 in order to incorporate the said Directive into Spanish law. In the preparation of this order, they have been consulted, the autonomous communities and the sectors affected. In its virtue, I have:

Annexes E and F to the Order of 23 May 1986 approving the Regulation on the registration of varieties of horticultural species shall be replaced by those set out in the Annexes to this order.

Single transient arrangement. Varieties which are in the process of admission.

Those varieties which have begun official examinations, for admission to the Common Catalogue of Horticultural Plants, before 1 November 2008, may be accepted if they comply with the provisions of the Order. (a) of 23 May 1986 approving the Regulation on the registration of varieties of horticultural species which were in force before this amendment.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
