Organic Law 15/1999 of 13 December on the Protection of Personal Data sets out in Article 20 that the creation, modification or deletion of files of public administrations containing data of a character staff will have to be made by means of general provision or agreements published in the "Official State Gazette" or corresponding official journal.

The Ministry of Industry, Tourism and Trade has published the Order ITC/1977/2006, dated June 15 (B.O.E. No. 148, 22) and Order ITC/3667/2007, dated November 30 (B.O.E. No. 300, of December 15) in which files containing personal data of the Department are collected, as well as those of bodies assigned or dependent on it.

On the other hand, both Royal Decree 438/2008 of 14 April, approving the basic organic structure of the Ministry of Industry, Tourism and Trade as well as its development, Royal Decree 1182/2008, of July 11, by The development of the basic organic structure of the Ministry of Industry, Tourism and Commerce, they introduce changes in the aims of the Ministry, assigning them new competences and attributing to other units some of the exercises by the Ministry time.

This affects, among other things, the cast of files that contain personal data whose ownership corresponds to this Department. Together with the need to update the files that remain in the Ministry, it is necessary to publish a new order that will update the relationship of existing files by creating, modifying or, if necessary, deleting some of them the purpose of adapting them to the needs of normal day-to-day management.

Article 3. Deleting files.

The files of ownership of the Ministry of Industry, Tourism and Commerce containing personal data and of public bodies assigned or dependent on it, related to Annex III, are deleted.

Any provisions of equal or lower rank are repealed to be opposed to the provisions in this order.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
