The Resolution of 15 May 2007 of the Hydrographic Confederation of the Ebro on the modification of the rules of navigation on the occasion of the expansion of the zebra mussel and the new classification of reservoirs of the Ebro basin, ordered the publication in the "Official Gazette of the State" of two years containing the rules of navigation and classification of reservoirs currently in force. These were published, together with that resolution, in the "Official State Gazette" of 19 June 2007.

By agreement adopted in the Governing Board of the Ebro Hydrographic Confederation, meeting at its meeting of 26 January 2006, the amendment of the rules of navigation contained in the annexed to the Resolution of 15 of May 2007 to add the ban on the use of two-stroke engines in the inland waters of the Ebro basin from January 2010.

With date of January 15, 2009 the Area of Water Quality has proposed the modification of the rules of navigation mentioned to include in them the prohibition of the engines of two times of carburization agreed in Junta Government.

In accordance with the provisions of Articles 23.1.b), 24.a), 51.a) and 78 of the Recast Text of the Water Law, the granting of authorizations for navigation in reservoirs and rivers and their regulation is the responsibility of the Watershed organisms.

Article 4 of the Water Framework Directive (Directive 2000 /60/EEC) states that "Member States shall implement the necessary measures with a view to progressively reducing pollution from substances". priority and to phase out or phase out discharges, emissions and losses of priority hazardous substances. "

In the exercise of its powers in the field of administration and control of the hydraulic public domain, the Basin Agency must meet the objectives of protection that the Law marks and, in particular, the objectives of protection of the quality of water. Thus, in the exercise of these powers, it must be as provided for in Article 92 (a) of the Recast Text of the Water Law, which states as one of the objectives of the protection " to prevent deterioration, protect and improve the state of aquatic ecosystems as well as terrestrial ecosystems and wetlands that are directly dependent on aquatic ecosystems in relation to their water needs. "

The provisions of Article 92a should also be laid down as regards the prevention of the deterioration of the state of surface water bodies as environmental objectives for surface water.

As it is a modification of the rules published in the "Official Gazette of the State", in order to enable them to be more widely distributed, the publication of the present in the same official journal will be ordered.

Consequently, by virtue of the above and in order to enable the greater dissemination of these rules of navigation and classification of navigable among the citizens, this Presidency of the Hydrographic Confederation of the Ebro resolves:

First and only. -Amend navigation standards in the Ebro basin, approved by Resolution of 15 May 2007, of the Ebro Hydrographic Confederation ("BOE" of 19 June 2007) and order its publication in the "Official State Gazette".

A new paragraph is included in Annex I to the Resolution of 15 May 2007:

" C) Two-stroke engines of carburization.

The use of two-stroke engines in the inland waters of the Ebro basin from January 2010 is prohibited. No new navigation authorisations shall be issued for vessels with such engines from January 2009. '
