Royal Decree 482/2009 of 3 April 2009, which calls for the elections of Members of the European Parliament, sets out in Article 1 the convening of such elections for the next day of June 7, 2009.

On the other hand, the Organic Law 5/1985 of 19 June of the General Electoral Regime, within its Title VI, of the special provisions for elections to the European Parliament, regulates electoral expenses and grants in the Article 227, paragraph 4 of which states that ' the amounts referred to in the preceding paragraphs refer to constant pesetas. By Order of the Ministry of Economy and Finance, the updated amounts are fixed within five days of the call. "

The realization of the grants for electoral expenses, when expressed in constant pesetas-an expression that has to be understood today in constant euros-requires the application of the rates of deflation that are determined by the applicable consumer price index in each case.

In its virtue, I have:

Article 1. Update criteria.

The updating of the amounts fixed for subsidising the expenditure incurred by the electoral activities, as provided for in Article 227 (1) of the Organic Law 5/1985, of 19 June, in writing given to the Organic Laws 8/1991 of 13 March and 13/1994 of 30 March shall be verified by application to the quantities referred to in that Article of the corrective deflationary coefficient of the consumer price index (CPI).

Article 2. Amount of grants.

The quantities referred to in the preceding paragraph shall be as follows:

a) Subsidy of EUR 32,202.22 for each seat obtained.

(b) Grant of EUR 1,07 for each of the votes obtained for each candidature, one of whose members, at least, has obtained a seat of Deputy.

Article 3. Limit of electoral expenses.

The limit of the electoral expenses will be the one that will be multiplied by 0.19 euros the number of inhabitants corresponding to the population of law in the electoral sections where it has been requested that the dissemination of the ballots.

Article 4. Grant for direct shipping costs.

In addition to the previous articles, the amount of the grant to the parties, federations, coalitions or groupings, of the electoral expenses incurred by direct and personal sending to the voters, in at least one Autonomous community, electoral envelopes and ballot papers or electoral propaganda and publicity, shall conform to the following rules:

(a) EUR 0.15 per voter shall be paid, provided that the application has obtained at least one Member and at least 15 per 100 of the valid votes cast.

(b) EUR 0.11 per voter shall be paid, provided that the application has obtained at least one Member and at least 6 per 100 of the valid votes cast.

(c) EUR 0.03 per voter shall be paid, provided that the application has obtained at least one Member and at least 3 per 100 of the valid votes cast.

(d) EUR 0,02 per voter shall be paid, provided that the candidature has obtained at least one Member and at least 1 per 100 of the valid votes cast.

(e) The amount of the subsidy shall not be included within the limit laid down in Article 3, provided that the actual performance of the activity referred to in this paragraph has been justified.

Single end disposition. Entry into force.

This Order shall enter into force on the day of its publication in the Official Gazette of the State.
