The Governing Council of the State Aviation Safety Agency agreed at its meeting of 24 March 2009, to delegate the exercise of the competence conferred on this body by Article 17.1.n) of the Statute of the State Agency of Air Safety (AESA), approved by Royal Decree 184/2008 of 14 February 2008, at the Director of the Agency.

In accordance with Article 13.3 of Law 30/1992, of 26 November, of a legal regime of public administrations and of the common administrative procedure, the publication in the "Official Gazette of the State" of the said agreement, the text of which is inserted below.

ANNEX

According to Article 17.1.n) of the Statute of the State Aviation Safety Agency (AESA), approved by Royal Decree 184/2008 of 14 February, it is the role of the Governing Council to " agree to the exercise of the actions and the resources that correspond to the entity in defense of the interests before the Public Administrations and the judicial organs of any order, without prejudice to the provisions of article 20.c) of Law 29/1998, of July 13, regulatory of the jurisdiction administrative-litigation ".

Moreover, Article 25 of the Statute provides that the Director is the highest executive body of the Agency, and is responsible for the management and management of the Agency. In accordance with Article 26 (t) of the Staff Regulations of the Agency, it is established to " carry out the other powers and functions conferred upon it by this Statute and any other applicable rules, as well as those delegated to it, in its Case, the President or the Governing Council. "

The Statute of the State Aviation Safety Agency, approved by Royal Decree 184/2008, of 14 February, hereinafter AESA, establishes as governing bodies of the same the President and the Council Rector, and as executive body, the Director of the Agency, who shall be responsible for the management and day-to-day management of the Agency.

Once the Agency has been put into operation, the delegation of some of the necessary powers should be delegated to ensure the smooth functioning and efficiency of the administrative procedures which the Agency support.

Consequently, in accordance with the provisions of Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, meeting the Council of the AESA, in accordance with the provisions of the additional provision of Law 6/1997 of 14 December 1997 on the Organization and the Functioning of the General Administration of the State, and Article 26 of the Statute of the State Aviation Safety Agency, Approved by Royal Decree 184/2008 of 8 February 2008, by that Council, it is available:

First. Delegation of powers.-The exercise of the following powers, attributed by the EASA Statute to its Board of Directors, is delegated to the Director of EASA:

Agree to the exercise of the actions and the resources that correspond to the entity in defense of the interests before the Public Administrations and the judicial organs of any order or jurisdiction, without prejudice to the Article 20 (c) of Law 29/1998 of 13 July, regulating the administrative-administrative jurisdiction.

Second. This delegation includes the powers to decide and to resolve any impact that arises after the exercise of the actions and the resources that correspond to the entity.

Third. The system of delegation established is without prejudice to the powers of management and control which correspond to the President and the Governing Council.

Fourth. The delegation of powers contained in this resolution shall enter into force on the day following its publication in the Official Gazette of the State.
