The General Director of the General Mutuality of Civil Servants of the State, the General Manager of the Judicial Mutual General and the General Secretariat of the Social Institute of the Armed Forces, have signed, dated 16 September, In June 2009, a joint resolution on the follow-up to Royal Decree 2130/2008 of 26 December 2008 regulating the procedure for applying the deductions corresponding to the supply of medicinal products for human use mutual assistance of officials, in compliance with the provisions of their supplementary provision only.

ANNEX

Joint Resolution of the General Mutuality of Civil Servants of the State (MUFACE), the Judicial Mutual General (MUGEJU) and the Social Institute of the Armed Forces (ISFAS) for the follow-up of Royal Decree 2130/2008, December 26

Since the approval of Royal Decree-Law 5/2000 of 23 June, of Urgent Measures to Contain Pharmaceutical Spending, regulatory adjustments have been taking place in order to apply the discounts and deductions established there. and proceed to its update in the field of the National Health System. Currently, and in development both of the standard referred to as of Law 29/2006, of July 26, of guarantee and rational use of the medicines and medical devices, and of the Royal Decree 823/2008, of 16 May, for which the margins are established, deductions and discounts corresponding to the distribution and supply of medicinal products for human use, the procedure for the application of discounts has been regulated in the case of medicinal products dispensed with the General Mutual Society of Civil Servants of the State (MUFACE), to the General Judicial Mutuality (MUGEJU) and the Social Institute of the Armed Forces (ISFAS).

Royal Decree 2130/2008 of 26 December 2008, which regulates the above mentioned procedure, makes the previous forecast effective and in its single additional provision provides that within four months of the entry into force of the a Joint Resolution of the three Mutualities will be adopted, in which the procedures, deadlines, means and precise technical requirements will be established to carry out the follow-up of the planned operation and to carry out the studies corresponding to the different extremes affecting the joint mutual ambit in this terrain.

In its virtue, according to the powers conferred in Article 11.2, k) of Royal Decree 577/1997, of 18 April, establishing the structure of the governing bodies, administration and representation of MUFACE, in Article 14 (3) (g) of Royal Decree 1206/2006 of 20 October on the composition and functioning of the governing bodies, administration and representation of the General Judicial Mutuality, and Article 18 of the Rules of Procedure General of the Social Security of the Armed Forces, approved by Royal Decree 1726/2007, 21 of December, respectively, resolves:

1. For the purposes of applying Article 1 (3) of Royal Decree 2130/2008 of 26 December 2008, the Administrative Mutualities shall establish, before the month of August of this year, the relationship of Pharmacy Offices which during the year 2007, and in average monthly, they have had a total turnover from public funds of the National Health System and subject to discounts of more than 33,282.09 €. For their determination the appropriate interadministrative cooperation with the Ministry will be established Health and Social Policy as well as the appropriate terms of collaboration with the General Council of Official Colleges of Pharmacists.

2. The three Mutualities will advance in the establishment of similar guidelines as regards the process of invoicing of the prescriptions, thus facilitating the procedures as far as possible. On the other hand, and in accordance with the provisions of Royal Decree 2130/2008, in the monthly invoices issued by the Provincial Colleges of Pharmacists from September 2009 to the Mutuality of Civil Servants of the State, to the Judicial General Mutual and the Social Institute of the Armed Forces, the amounts of the deductions applicable to the billing of medications must be specified.

3. For the purposes set out in the unique additional provision of the Royal Decree of Reference, and in order to enable the necessary checks from September 2009, the General Council of the Official Colleges of Pharmacists shall be required to carry out a single monthly submission to the three Mutuals of the information resulting from the processing of the prescriptions of each of them. The computer support will contain the files that were previously sent separately to each one, broken down by Mutuality.

4. MuFACE, Mugeju and ISFAS will be responsible for the preservation and analysis of the information derived from the procedure for the application of the discounts made in their respective invoices.

5. A follow-up committee is set up by a representative of each of the three Mutual Societies, which will be responsible for supervising the procedure for applying the discounts regulated in Royal Decree 2130/2008, as well as, in its case, for the development of proposals for improvement.

6. The General Council of Pharmaceutical Officers will be proposed to set up a joint Commission for the study of the specific impact of the implementation of the Royal Decree of Reference and the establishment of proposals in relation to the possible dysfunctions which could be observed in their case. The objective of such collaboration would be, in the light of the situation appreciated, the approach of the adjustment schemes that could be appropriate in the terms of the incidence of the one. It is estimated that a first evaluation could be carried out from the data for the first three months of effective implementation of the standard.
