Royal Decree 1132/1981 of 24 April on Health and Zootechnical Management of Extensive Pig Holdings was echoed, at the time, in the reality of the traditional commercial exploitation of pig cattle. In addition to the fact that the Community has not yet been able to take the necessary steps to ensure the proper development of this particular production system, it will be able to take the necessary steps to ensure the proper development of this system. the orderly exploitation of the natural productive resources of the corral, and the promotion of the Iberian pig trunk.

Over the years, new concepts of sustainable development, extensiveness, animal welfare, agri-environmental protection, conditionality, and quality and animal health, draw a more complex scenario in which the animal production must find a seat. From this approach, of course, there is no need for the production of swine in the extensive system, without forgetting the dehesa as a territorial base to which, in a traditional way, this type of production was fundamentally linked, it must also be related with the presence, throughout the Spanish territory, of systems associated with the use of natural resources through grazing, mainly linked to the indigenous races of the different autonomous communities.

Consequently, it is necessary to develop, in Article 4 (1) (g) of this royal decree, for reference holdings, as indicated by Article 4 of Law 32/2007 of 7 November 2007 for the care of animals in their exploitation, transport, experimentation and slaughter, by means of the adaptation for those holdings of the provisions for pig holdings in general, in Council Directive 2001 /88/EC of 23 October 2001 amending the Directive 91 /630/EEC on minimum standards for the protection of pigs and the Directive Commission Decision 2001 /93/EC of 9 November 2001 amending Directive 91 /630/EEC on minimum standards for the protection of pigs and on the minimum standards for the protection of pigs from 31 October 2001 protection of pigs.

To this new orientation of livestock farming towards more sustainable models, which the European agricultural model represents, joins the more than possible promotion of this system of production in extensive, derived from the application of the Common agricultural policy after the last reform, which calls for greater orientation of livestock production to the market by decoupling aid schemes in respect of certain types of production.

In addition, it must be borne in mind that in March 2000, Royal Decree 324/2000 was published, of 3 March, laying down basic rules for the management of pig holdings and by which it was intended to adapt the current rules for the management of pig holdings which are intensive in relation to the new reality of the sector in this production system, with the exception of pig holdings in extensive production systems.

It is also worth highlighting the development, in recent years, of new production models that must have a place in one or another production system, always with the appropriate legal context, and perfectly defined in terms of their consideration as extensive or intensive production systems.

The regulatory development of Law 8/2003 of April 24, of animal health, is necessary as regards the health management of extensive pig holdings.

On the other hand, the publication of Royal Decree 479/2004 of 26 March establishing and regulating the General Register of Livestock Holdings (hereinafter REGA) requires the adaptation of the provisions of the General Register of Extensive porcine holdings to the structure and content of the REGA.

Therefore, it is currently necessary that, in the same way as intensive production, a new legal framework for extensive pig production be set up in its broadest sense, based on the principle of integration of this type of production with the physical medium that supports it, and based on the use of agroforestry resources, mainly through grazing, and with respect to the requirements deriving from the Community regulations on animal welfare, hygiene (i) the protection of the environment, as well as animal health. At the same time, it must ensure minimum conditions for holdings throughout the Spanish territory that minimise the health or environmental risks that these holdings may entail for their particular characteristics. To this end, according to the present matter, basic norms are established regarding technical aspects that, taking into account the particularities of this management system, allow the development of a productive activity, balanced and competitive, ensuring that the objective objective of the State competition on the bases is achieved. Accordingly, Royal Decree 1132/1981 of 24 April 1981 on the Health and Zootechnical Management of Extensive Pig Holdings and the concept of those holdings provided for in Royal Decree 324/2000 of 3 March 2001 is repealed by the that basic rules for the management of pig holdings are laid down.

On the other hand, it is necessary to incorporate an additional provision for amendment of Article 5 of Royal Decree 1547/2004 of 25 June 2004 laying down rules for the management of farming holdings in the on the requirements for the identification of the species in farming. This amendment will make it possible to adopt, in the identification of animals destined for slaughter, the new transport devices available, which allow for an unambiguous identification of the origin of the animals without the need for Individual identification of transport cages, technically more difficult. Accordingly, Annex III of that royal decree is left uncontained, as the codification included in it is no longer necessary.

In the elaboration of this royal decree, the autonomous communities and the most representative entities of the affected sectors have been consulted.

This royal decree is issued by virtue of the habilitation contained in the fifth final provision of Law 8/2003, of 24 April, of Animal Health.

In its virtue, and on the proposal of the Minister of the Environment, and the Rural and Marine Environment, with the prior approval of the First Vice President of the Government and Minister of the Presidency, in agreement with the State Council and deliberation of the Council of Ministers at its meeting on 17 July 2009,

DISPONGO:

Article 1. Object and scope of application.

1. This royal decree lays down the minimum standards for the zootechnical and health management of pig holdings in the extensive production system, as regards their conditions of territorial base, the food regime of use of own resources, and management and facilities, that allow for the correct development of the livestock activity in the Spanish pig subsector linked to the extensiveness, in accordance with the regulations in force in the field of hygiene, health livestock, identification and registration, animal feed, animal welfare and the environment.

2. Except for this regulation:

(a) The pig holdings in the intensive production system, which are the subject of Royal Decree 324/2000 of 3 March establishing basic rules for the management of pig holdings and, in any case, those exceeding the maximum densities laid down in Article 4 (1) (a).

(b) Special livestock holdings, in point 2 of Annex III to Royal Decree 479/2004 of 26 March 2004 establishing and regulating the general register of livestock holdings, with the exception of the grasses referred to in paragraph 9 of that point 2.

3. Holdings for self-consumption, as defined in Article 2, shall not apply to them as provided for in Article 3, in Article 4.1. (b), (c), (d), (f) and (h), in Article 4.2, or in Article 8.1 of this Royal Decree.

For reduced holdings as defined in Article 2, the requirements laid down in Article 4.2.a shall not apply to them.

4. This royal decree will apply throughout the national territory.

Article 2. Definitions.

1. For the purposes of this royal decree, the definitions set out in Article 2 of Royal Decree 324/2000 of 3 March, in Article 3 of Law No 8/2003 of 24 April 2003 and in the Article 2 of Royal Decree 479/2004 of 26 March 2004.

2. In addition it shall be understood as:

(a) Extensive operating system: that based on the commercial use of animals of the porcine species in a continuous and determined area, characterized by a defined livestock load that will never exceed the (a) by means of grazing, in such a way as to be supplemented by the contribution of agricultural forestry resources, which can be supplemented by the contribution of the Community's agricultural and forestry resources. plant and animal feed materials, constitutes the basis for the feeding of livestock in the bait phase and allow the maintenance of the territorial base, both in economic and environmental aspects.

b) UGM. Major livestock unit: equivalent to an adult bovine.

(c) Extensive self-consumption operation: the purpose of which is to bathe animals for the exclusive use of family consumption, with a maximum annual production not exceeding 5 bait pigs, and without having any effective players.

(d) Reduced extensive exploitation: the holding which houses a maximum number of 5 players, and may maintain a number not exceeding 25 bait animals. In any event, the holding shall not be able to hold a quantity of pigs exceeding the equivalent of 5 UGM.

e) Permanent installations: they are considered as:

1. Aquellas buildings arranged for the maintenance, in some form of confinement, of breeding animals, with or without progeny, during the breeding or breeding period, as well as of the bait pigs, without power (a) to provide, therefore, a capacity of livestock higher than that authorised in the register for the extensive pig holding, according to its zootechnical classification. This maximum authorised capacity shall be a limiting factor for the number of heads that may be used by the holding.

2. º Any building that forms part of the holding and is intended for the shelter of all animals of the holding, according to their maximum capacity, for sanitary or handling purposes.

f) Biosafety: a set of measures that cover both structures of the holding, and aspects of management, aimed at protecting animals from the entry and spread of infectious and parasitic diseases in the exploitation.

Article 3. Classification of extensive pig holdings.

1. Zootechnical classification: taking into account their zootechnical orientation, the pig holdings in the extensive system shall be classified in the following categories:

(a) Selection: those that direct their activity mainly to the production of breeding animals of breed or hybrids. They can be:

1. Race selection, regulated in Royal Decree 2129/2008 of 26 December, establishing the National Program for the Conservation, Improvement and Promotion of Livestock breeds.

2. Selection of hybrids, referred to in Royal Decree 1108/1991 of 12 July, on zootechnical standards applicable to hybrid breeding pigs.

(b) Multiplication: those which direct their activity mainly to the multiplication of breed or hybrid animals from the holding of selection, the main purpose of which is to obtain animals intended for the reproduction, through the application of the corresponding zootechnical and sanitary programs, being able to generate their players for self-replacement.

Players used in these holdings shall be entered in the herd-books or in the official records concerned, which are regulated in the provisions referred to in the first and second subparagraph of the preceding paragraph.

(c) For breeding purposes: those which guide their activity to re-collect future players from a single holding approved for the sale of players, the destination of which is reproduction or, marginally, the stage of finish or bait.

(d) Production: those that direct their activity mainly to the production of piglets for fattening and slaughter, and can generate their players for self-replenishment. They may also be used for the sale of players, as a secondary activity of the holding, provided that it has the corresponding authorisation by the competent authority. In the case of their productive activity, they are classified as:

1. A closed cycle, when the entire production process, i.e. birth, breeding, recycling and bait, takes place on the same holding, using only one's own production.

2. Open cycle, when the production process is limited to the birth and breeding of the piglets, and can extend the same to the recría, for its subsequent bait in other authorized holdings. However, in this type of operation, part of the production of piglets will be able to carry out the entire production process.

(e) "bait" means those dedicated to the breeding and fattening of animals for slaughter to the slaughterhouse. Exceptionally, the competent authority of the autonomous community where the holding is located may authorise the departure of the animals to another extensive holding of bait, exclusively for the seasonal use of natural resources, in a period prior to their slaughter.

2. Classification for its productive capacity: the extensive pig holdings are classified according to their productive capacity, expressed in UGM, according to the equivalences established for each type of livestock in Article 4.1.a) 1 of the next form:

a) Group first: holdings with capacity up to 37 UGM.

b) Second group: holdings with a capacity of 38 to 112 UGM.

(c) Third group: holdings with a capacity of 113 to 225 LU.

The autonomous communities may modulate the maximum capacity provided for in paragraph c), depending on the characteristics of the areas in which the holdings are located, the circumstances of production or other conditions which may be they can be determined by the competent body of those bodies, without in any case being able to increase that capacity by more than 20%.

Article 4. Minimum conditions for extensive pig holdings.

1. Of a general nature.

a) Livestock density.

1. The stocking density of extensive pig holdings shall not exceed the limit laid down for each holding in the Register of holdings provided for in Article 7 and shall not exceed the density of 15 pigs bait/hectare (2.4 UGM/ha), or its equivalent according to the following table:

1. º.1. Sow with piglets up to 23 Kg: 0.30 UGM.

1. º.2. Replacement sow: 0.14 UGM.

1. º.3. Pork from 50 to 150 Kg.: 0.16 UGM.

1. º.4. Verraco: 0.30 UGM.

Animals of different categories may be maintained, always in accordance with the equivalences described in this section, and within the maximum densities established.

2. When this livestock load is exceeded for extensive holdings, the holding shall be considered within the scope of Royal Decree 324/2000 of 3 March, even if the animals are in a Open-air production regime.

3. The competent bodies of the autonomous communities may reduce the burden to be authorised in the framework of their respective territorial areas on the basis of, at least, agronomic, environmental and orographic criteria.

(b) Extension of holdings: Extensive pig holdings shall be settled on an always continuous area which shall have a minimum size of 1 hectare, according to SIGPAC or equivalent registration system the competent bodies of the Autonomous Communities.

c) Power:

1. The Verracos, the breeding females and the piglets up to the weaning, may be maintained in suitable facilities, subject to feed programmed during the breeding phase. However, free access to the field and natural resources of the holding of the players shall be ensured, as appropriate in accordance with their physiological status.

2. Unweaned pigs, breeding and recycling up to 100 kilograms of live weight must be maintained with a food regime which, allowing the supply of feed suitable for its biological development phase, ensures its stay. in the field and access to the natural resources of the holding.

3. The feeding on the bait will be formed by grazing, use of stubble tooth and silvicultural products, and supply of those foods that have traditionally been used in each region to complete the bait of the pigs and shall be supplemented, where appropriate, with feed suitable for the physiological time of the animals being exploited.

4. The provisions of the three preceding paragraphs are without prejudice to the establishment of other products within the framework of the quality standards for certain products of the Iberian pig or other products of the porcine species. conditions in relation to the food, depending on the description of the product on the labelling.

(d) Infrastructures: Extensive pig holdings will have sufficient facilities to accommodate the animals under appropriate conditions, in accordance with their needs in the different production stages. In addition, in order to maintain hygienic and sanitary conditions, the holding shall have:

1. Cercas: the surface of the pig holding shall be closed perimeter with a fence or equivalent system that prevents the uncontrolled transit of animals and vehicles.

2. Access: All the tickets assigned to the reception of transport vehicles of animals or of any other type, will have an effective system for the disinfection of the wheels and the rest of the vehicle. They shall also have an appropriate system for the disinfection of the footwear of operators and visitors.

3. Deitations: the disposal of the permanent installations of the holding, tools and equipment will enable, at all times, the performance of an effective disinfection, deflating, disintering and deraising.

4. Facilities for isolation or sequestration: the holdings shall have permanent facilities which permit the isolation or abduction, where for health reasons, of all the animals of the holding, of the maximum registered capacity.

5. Control of visits: an effective system of control or registration of visits shall be carried out on the holdings, in which all those that occur in the area of the permanent facilities are recorded and which allows the identification of vehicles entering or leaving the vehicle.

6. "Use and dressing room": in the holdings, the cleaning and handling tools and the staff's wardrobe will be exclusively used for each operation, and the necessary sanitary and sanitary measures will be available for the staff to carry out work on them and the use of the tools used in them cannot transmit diseases.

e) On healing.

1. Health programmes: extensive pig holdings shall apply and maintain health programmes and standards against the main diseases of the species subject to official control, approved by the authority competent and controlled and applied by the authorised or authorised veterinarian.

2. Elimination of by-products: holdings shall have a system for the collection and storage of carcasses and other by-products of animal origin not intended for human consumption, with a view to their removal and disposal, which shall be carry out, in any case, in accordance with the provisions of Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down the health rules for animal by-products not intended for human consumption human consumption.

3. Those holdings which sell animals intended for reproduction in order to carry out this activity must be classified as free or officially free from the diseases listed in Annex I.

4. Only movement of animals from diversion to breeding centres of breeding shall be permitted to divert or directly to a slaughterhouse. In any case, the trucks must be properly washed and disinfected, and shared loads with other categories of pigs will be prevented.

f) Management and rotation programme: The management measures to be applied in the extensive pig holdings must ensure adequate use of the entire physical environment, taking advantage of the natural resources of the exploitation under the terms of paragraph 1 (c) of this Article, establishing systems of rotation and rational use thereof, and avoiding overexploitation phenomena that result in deterioration of the support ecosystem.

For this purpose, a management and rotation program, approved for each operation by the competent authority, shall be established with the periodicity that it establishes. The maximum stocking density in each case shall be determined on a yearly basis, in accordance with the limits laid down in paragraph 1 (a) of this Article. The management programme shall also include the mention of the breed or breeds of the animals on the holding.

The competent authorities of the autonomous community may establish a procedure to control compliance with approved management programs.

g) Animal welfare: To the extensive pig holdings covered by this royal decree, the Royal Decree 1135/2002 of 31 October on minimum standards for the protection of pigs shall apply to them. Article 3 (3), as well as points 2 and 5 of Chapter I of the Annex to that royal decree, shall apply only to the permanent installations of the extensive holdings.

If, for reasons duly justified from the prophylactic or therapeutic point of view, the castration of a female is to be performed, such an operation must be certified and performed by a veterinarian, with anaesthesia and analgesia extended.

(h) Environmental requirements: In addition to the above mentioned in previous paragraphs on environmental protection, the management of sprouts from the permanent facilities of the extensive pig holdings, shall be carried out by the use of any of the procedures provided for and under the conditions laid down in Article 5.Un.B.b., of Royal Decree 324/2000 of 3 March.

2. For newly-established pig holdings: The extensive pig holdings to be installed after the entry into force of this royal decree shall comply with the conditions laid down in paragraph 1. of this article, the following requirements:

a) Location:

1. In application of the provisions of Article 36.1 of Law 8/2003 of 24 April, and in order to prevent or minimize the spread of infectious and parasitic diseases and to preserve their health status, the Newly created extensive pig holdings, from their permanent facilities dedicated to the shelter of animals, to the nearest permanent facilities housing animals from other pig holdings, the minimum distance 1 of the Royal Decree 324/2000, of 3 March, for the safety of the the different groups according to their productive capacity, according to the definition of the groups established in the present royal decree. The autonomous communities may increase or decrease this distance according to the special agronomic, orographic and environmental characteristics of the location of each holding, and also according to their installed capacity, in in relation to the distances established for the group first. This safety distance will also be established in the aforementioned Royal Decree 324/2000 of 3 March, in respect of slaughterhouses, meat industries, processing establishments or disposal of carcasses and other by-products of animal origin not intended for human consumption, and for the concentration centres of pigs.

The minimum distances established shall not apply between permanent facilities which host animals from extensive pig holdings and slaughterhouses which slaughter species other than ungulates domestic as well as between those holdings and the meat industries, provided that, in the opinion of the competent authority in the field of animal health, both holdings and slaughterhouses or industries have adequate isolation systems. health in accordance with current regulations.

2. Without prejudice to the minimum distance to be provided by national and regional regulations, the permanent facilities for newly created holdings must be located at a distance greater than 100 meters of the important public roads, such as railways, highways, highways and highways of the National Network, and more than 25 meters from any other public route.

b) Infrastructures:

1. The holdings installed after the entry into force of this royal decree must also be designed to prevent the entry of vehicles other than feed, loading and unloading of animals, and removal of sprouts and purines and dead animals. These operations must be carried out from outside the holding, through an external loading dock, the carrier's entry being totally prohibited. The outer spring shall be washed and disinfected after loading/unloading each batch of pigs.

2. However, where the location of the holding so requires, the entry to the holding of the vehicles referred to in the preceding paragraph may be permitted provided that, in addition to the perimeter fence required in paragraph 1.d) .1. the permanent installations of the holding are included in a fenced enclosure. In this case, the aforementioned loading and unloading operations shall be carried out from outside the fenced enclosure.

Article 5. Identification of the animals.

1. The identification of the animals shall be carried out in accordance with the provisions of Royal Decree 205/1996 of 9 February establishing a system for the identification and registration of bovine, porcine, ovine and caprine animals, as to any additional identification established in the health programs against certain porcine diseases.

2. The animals shall be marked with the code of the holdings by which they pass, and must arrive at the slaughterhouse, where appropriate, identified with the code corresponding to the holding of immediate origin.

Article 6. Exploitation log book.

1. As provided for in Article 4 of Royal Decree 205/1996 of 9 February, the holders of holdings must carry out an updated book of registration approved by the competent authority, hereinafter referred to as 'the competent authority'. log book.

2. The registration book shall be carried out manually or in computerised form, available on the holding and accessible to the competent authority, at the request of the competent authority, keeping the data for the period determined by the competent authority and any case may not be less than the last three years of the holding or, where appropriate, three years after the end of the holding, in which case it shall also be available for consultation by the competent authority, at the address of the last holder of the holding, or at the head office of the institution the holder, or of the one who had succeeded in the exercise of the livestock activity. In the event of cessation of all livestock activity of the holding holder, the registration book shall be deposited where the competent authority orders.

3. The log book shall contain at least the data set out in Annex II to this Royal Decree, without prejudice to any other information provided by the current legislation.

Article 7. Register of holdings.

1. The Directorate-General for Agricultural and Livestock Resources of the Ministry of the Environment, and the Rural and Marine Environment, the General Register of extensive pig holdings, is hereby established as part of the General Register of livestock holdings. (REGA), as set out in Article 3 of Royal Decree 479/2004 of 26 March 2004, to which it shall comply with regard to its content and operation. This register shall contain the information relating to all the extensive holdings located in Spain.

2. The autonomous communities shall register in a register the extensive holdings which are located in their territorial area, in accordance with the provisions of Royal Decree 479/2004 of 26 March 2004, which shall contain at least all the information provided for in this Article. set out in Annex II to that Royal Decree, except in paragraph B11 thereof, and in accordance with the classifications laid down in Article 3 of this Royal Decree.

3. In the case of holdings registered exclusively for bait, in accordance with Article 3.1.e), where, for climatic reasons, the natural resources for feeding animals cannot be used for a longer period For three consecutive years, they may be registered, at the discretion of the competent authority, in spite of the provisions of Article 3.7 of Royal Decree 479/2004 of 26 March, in respect of the discharge of the holding.

Article 8. Obligations of the holders.

Without prejudice to the obligations arising from the application of the current rules, the holders of extensive pig holdings must:

1. Submit, to the competent bodies of the Autonomous Communities, with the periodicity they establish, the management and rotation program provided for in Article 4 (f) of this royal decree for approval, as well as to declare the total area of the extensive porcine holding, by submitting the supporting documentation of the same, in accordance with the procedure laid down by the competent authority.

2. To provide the competent authority, in accordance with the deadlines laid down in Article 4 of Royal Decree 479/2004, of 26 March 2004:

(a) The information necessary for the registration of their holding, including at least the data referred to in paragraphs A. 2, 3 and 5 and in paragraphs B. 2, 6, 7, 9, 10 and 12 to 15 of Annex II to that Royal Decree, specifying the following data:

1. º For paragraph A. 5 (Type of operation concerned): whether it is production and reproduction, or pasture.

2. º For paragraph B. 6 (zootechnical classification), according to the categories set out in Article 3.1 of this royal decree.

3. º For paragraph B. 7 (Indication of whether or not self-consumption): indication, where appropriate, whether it is a self-consumption or reduced exploitation.

4. º For section B. 10 (Classification according to productive capacity), according to the groups set out in Article 3.2 of this royal decree.

5. º For paragraph B. 12 (Census and date of update): census at the time of registration, distinguishing categories of animals and with indication of the breed, as defined in paragraph 2.c) of this article.

6. º For paragraph B. 15 (Maximum capacity): established in accordance with the annual management program submitted in accordance with Article 4 (1) (f).

(b) Information relating to changes that occur in the data on your holding.

(c) The information concerning the total census of the animals, kept on the holding during the census period, being understood as such the period from 1 January to 31 December, inclusive, of the year prior to the communication of the census.

For these purposes, total census shall mean:

1. For the holdings referred to in Article 3 (1) (a), (1) (b) and (d), the sum of the total number of breeding animals (sows, restocking and boars) present in the Community shall be considered as a total census. holding on 1 January, plus the number of breeding animals which entered the holding and minus the number of breeding animals which left the holding, during the period from 1 January to 31 December, both inclusive, plus the total number of piglets, bait pigs and recrairies which have left the holding for the purpose of other holdings or slaughter during the census period. In this case, the total census shall be broken down into the following categories: bait, piglets, recria/transition, sows, restocking and verracies. For each of these categories, the breed to which the animals belong shall be indicated, distinguishing:

Iberian swine and their crosses.

Other races.

2. For the holdings listed in Article 3 (1) (c) and (1) (e), the total number of animals which have left the holding for other holdings or for slaughter during the census period. In this case, the total census shall be broken down into the following categories: bait, piglets, recria/transition, sows, restocking and verracies. For each of these categories, the breed to which the animals belong shall be indicated, distinguishing:

Iberian swine and their crosses.

Other races.

3. The total census shall be communicated before 1 March of each year, indicating the total census of the previous year. Without prejudice to the above, the competent authority may update the census of holdings, in the light of the administrative action it takes in these holdings.

3. To provide adequate information and training, in the field of biosecurity and animal welfare, to operators, in accordance with the content established by the competent authority.

Article 9. Authorisation and registration of new holdings

In order to be authorised, the newly created holdings must have been registered in the Register of extensive pig holdings. For these purposes, they must prove compliance with the requirements laid down in this royal decree and in any other implementing legislation, at the request of the competent authority.

Article 10. Inspection and control.

1. The relevant inspections to verify compliance with the conditions and requirements laid down in this provision correspond to the competent bodies of the Autonomous Communities.

2. The Ministry of the Environment, and the Rural and Marine Environment, in collaboration with the autonomous communities, will implement coordination mechanisms that will ensure a homogeneous application of this royal decree throughout the national territory, on the basis of a risk analysis that considers health and environmental criteria, among others.

Article 11. Sanctioning regime.

1. In the event of non-compliance with the provisions of this royal decree, the regime of infringements and penalties applicable in accordance with the provisions of Law 8/2003 of 24 April 2003 on Animal Health and Royal Decree 1945/1983 of 22 December 1983 shall apply.

Council also adopted a resolution on the common position of the Council of the European Union in June.

2. In case of non-compliance with the provisions of Article 4.1.g) and concordant of this royal decree, the regime of infringements and penalties applicable in accordance with the provisions of Law 32/2007 of 7 November, for the care of animals on their holding, transport, experimentation and slaughter.

3. In the event of non-compliance with the provisions of Article 4.1.h) and concordant with this royal decree, the regime of infringements and penalties applicable in accordance with the provisions of Law 10/1998 of 21 April of Waste, or, in his case, in the Royal Legislative Decree 1/2001, of July 20, for which the recast text of the Water Law is approved.

4. The provisions of the above paragraphs shall apply without prejudice to the environmental, civil, criminal or other responsibilities that may be incurred.

Single additional disposition. Amendment of Royal Decree 1547/2004 of 25 June 2004 laying down rules for the management of farming operations.

Royal Decree 1547/2004 of 25 June 2004 laying down rules for the management of farming farming is amended as follows:

One. Article 5 shall be replaced by

following:

" Article 5. Identification of the animals of the species in farming.

1. Animals of the species in farming which leave a livestock holding shall do so on sealed transport devices so that, in order to open them, the destruction of the seal is essential.

2. For this purpose, any system used for the movement of animals between holdings shall be understood as a transport device, including cages, boxes or other elements for the transport of animals containing the load and ensuring, at all times, a clear separation between animals of different origins in the transport vehicle used.

3. Where the transport vehicles used contain animals from a single origin and with a single destination, it shall be sufficient to seal the passenger compartment of the vehicle which houses all the animals as a whole.

4. In the case where the animals come from different sources, each shipment will be associated with a different movement document.

5. Seals shall be of a single use, not reusable, shall be made of unalterable material, proof of falsification, and shall bear an indelible and legible mark which shall unequivocally identify the holding of origin of the animals in question. the species of farming carried out in accordance with paragraph 7 (a).

6. By way of derogation from the above paragraph, animals of the species of farming whose destination is different from slaughter in slaughter must be individually identified before leaving the farm with the code of the holding of origin. by an indelible and easily legible mark, which may consist of a crotal or a atrial tattoo. In cases where it is not technically possible to carry out such individual identification, the provisions of paragraphs 1 to 5 shall be fulfilled.

7. The operating code shall be indicated:

(a) In the seals and in the earphones, in accordance with the structure and in the order laid down in Article 5 of Royal Decree 479/2004 of 26 March 2004 establishing and regulating the General Register of livestock holdings.

b) In the atrial tattoo by:

1. º Two digits identifying the province, according to the National Statistics Institute's coding.

2. º Three digits identifying the municipality, according to the codification of the National Statistics Institute.

3. º Up to seven digits that uniquely identify exploitation within the municipality.

In the case of animals intended for intra-Community trade or for export to third countries, the tattoo shall be completed with the indication 'ES' at the beginning of the sequence of letters and numbers. '

Two. Annex III is without content.

First transient disposition. Update of the register of the extensive pig holdings already established.

The holders of extensive pig holdings existing prior to the entry into force of this standard shall apply to the competent authority of the autonomous community within a period to be determined by the latter and never before. more than 24 months after the publication of this royal decree, the regularization of his situation in the Register. However, the competent authority of the autonomous community may make such regularisation of its own motion.

Second transient disposition. Adaptation of already established extensive pig holdings.

Existing extensive pig holdings prior to the entry into force of this royal decree shall be adapted to the infrastructure and facilities conditions required by Article 4.1 (d), (g) and (h) within the time limit set by the competent authority of the autonomous community, which shall not exceed 24 months from the entry into force of this royal decree.

Single repeal provision. Regulatory repeal.

Repealed:

(a) Royal Decree 1132/1981 of 24 April on Health and Zootechnical Management of Extensive Porcine Holdings.

(b) Article 2.2.b of Royal Decree 324/2000 of 3 March laying down basic rules for the management of pig holdings.

Final disposition first. Competence title.

The provisions of this royal decree will have the character of state basic regulations, in accordance with the provisions of Article 149.1.13. of the Constitution, which attributes to the State the competence on the bases and the coordination of the general planning of economic activity, with the exception of paragraphs 1 (d), 1 (e), 1 (g), 2 (a) and 2 (b) of Article 4 and the relevant sanctioning system, which are given in accordance with Article 149.1.16. Constitution, which attributes exclusive competence to the State on the basis and general coordination of the health, and points (a), (f) and (h) of Article 4.1, which are given in accordance with the provisions of Article 149.1.23. of the Constitution which gives the State exclusive competence in basic legislation on the protection of the environment.

Final disposition second. Ability to modify.

The Minister for the Environment, and the Rural and Marine Environment are empowered to amend the content of the Annexes, in order to adapt them to Community legislation.

Final disposition third. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

Minimum content of the exploitation log book

The exploitation log book will contain, in general, the following data.

a) Operating code.

b) Name, operation address, and geographic coordinates.

c) Holder and address identification, including NIF, CIF, and telephone.

(d) zootechnical classification of the holding, in accordance with the provisions of Article 3.1.

e) Inspections and controls: date of completion, motive, number of minutes (if any) and identification of the current veterinarian.

f) Maximum capacity broken down by the following categories: bait, piglets, recria/transition, sows, restocking and verracs.

g) Entry of batches of animals: date, number of animals and category to which they belong, code of the holding of provenance and number of guide or health certificate or transfer document.

h) Output of batches of animals: date, number of animals and category to which they belong, code of the holding of destination, including slaughterhouse, or place of destination and number of health certificate or certificate move.

i) Incidents of any infectious or parasitic disease, date, number of affected animals, and measures for their control and disposal, if any.

j) Total census of animals during the previous year, broken down by the following categories: bait, piglets, recria/transition, sows, restocking and verracs, and with indication of the breed, according to the information communication provided for in Article 8.2.c.

k) Replacing, where appropriate, the means of identification of the animals due to the loss or deterioration of the animals.

(l) Name, surname and signature of the representative of the competent authority who has checked the registration, and the date on which it has carried out such verification.
