Resolution Of July 24, 2009, From National Parks, Which Establishes The Composition Of The Committee Of Permanent Hiring Of National Parks.

In accordance with the provisions of Article 295 of Law 30/2007 of 30 October, of Public Sector Contracts, and Article 21 of Royal Decree 817/2009 of 8 May, for which the aforementioned Law is partially developed 30/2007, with the aim of constituting a Permanent Contracting Table to assist the contracting authority of the autonomous body National Parks, I have:

First.-The Contracting Board of the autonomous body Parks National is constituted on a permanent basis, with the functions assigned to it in Law 30/2007, of October 30, of Contracts of the Public Sector, in that of the Royal Decree 817/2009 of 8 May, for which the aforementioned Law 30/2007 is partially developed, as well as the other complementary, consistent and specific rules on the matter.

In negotiated procedures where there is no need to publish notices of invitation to tender, the establishment of the Bureau shall be of the powers of the contracting authority.

Second. -The Permanent Contracting Bureau of the autonomous body National Parks will have the following composition:

I. President:

a) Holder: The Deputy Director of the autonomous body National Parks.

b) Substitute: A Head of Area of the autonomous body National Parks, in accordance with the following order,

1. The Head of the Economic, Administrative and Interior Management Area.

2. The Head of Legal and Personal Area.

3. The Network's Head of Planning and Technical Programs.

4. The Head of Resource Tracking Area and Centralized Programs

5. The Head of the Network Projection and Development Area.

6. The Head of the Area of Heritage and Environmental Education.

II. Secretary:

a) Holder: The Head of Recruitment and Interior Regime Service.

b) Substitute: An official of the autonomous body National Parks designated by the President of the Recruitment Board.

III. Vowels:

Legal designation:

a) A representative of the State Legal Service in the Ministry of the Environment, and the Rural and Marine Environment.

(b) The Financial Controller of the State General Intervention in the autonomous body National Parks or, failing that, the Financial Controller appointed by the Chief Executive Officer.

Free designation:

c) The Area Chiefs of the autonomous body National Parks, which may be replaced by an official assigned to their Area.

The alternate Chair, the alternate Secretary and the alternate Vocals shall act in the event of vacancy, absence, illness or other legal cause preventing the attendance of the holders.

Third. -For the valid constitution of the Bureau the absolute majority of its members must be present, and in any case the President, the Secretary and the two Vocals of legal designation, for having attributed the functions corresponding to the legal advice and economic-budgetary control of the autonomous body National Parks.

Fourth. -All members of the Recruitment Board will have a voice and vote, except for the Secretary who will only have a voice.

Fifth. -When the specialty of the contracts so advises, they will be able to constitute for this Presidency singular and distinct hiring tables, introducing changes in the members that do not come legally imposed and that be those who assist the contracting authority in the award of specific contracts.

Sixth. -When required by the nature of the contract to be awarded, the President or the Vocals of the Contracting Board may propose the incorporation to the same of the necessary specialized officials or advisors, according to the nature of the matters to be dealt with, which shall act with a voice but without a vote, without the consideration of members of the Contracting Bureau, or any other function than to inform and advise them in a non-binding manner to their constituents.

Seventh. -Given the character of the collegiate body of the Bureau of Recruitment, the rules set out in Chapter II, Title II of Law 30/1992, of 26 November, of the Legal Regime of the Administrations, shall apply to it. Public and the Common Administrative Procedure.

Eighth.-The Resolution of 22 November 2004, of the Presidency of the autonomous body Parks National, is repealed, amending the constitution of the Permanent Contracting Bureau of the said body and establishes its composition, as well as the resolution of 9 June 2005, of the Presidency of the autonomous body Parks National, amending the one of 22 November 2004, concerning the Permanent Contracting Bureau of the aforementioned body.

Ninth. This Resolution shall enter into force on the day following its publication in the "Official State Gazette".
