Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data and Article 52 of Royal Decree 1720/2007 of 21 November, on the adoption of the Law on the Development of Law Organic 15/1999, of 13 December, of Protection of Personal Data, requires that the creation, modification or deletion of the files of the Public Administrations be made by means of general arrangement published in the "Official Gazette" of the State ' or the Official Journal concerned.

In order to comply with the mandate of the Organic Law 15/1999, of December 13, and to assure the citizens of the exercise of their legitimate rights, the regulation of new creation files corresponding to the Spanish Food Safety and Nutrition Agency.

In its virtue, and in exercise of the privileges conferred on me by article 15 of Royal Decree 709/2002, of July 19, by which the Statute of the Spanish Agency for Food Security and Nutrition is approved, I have:

First. -The files of the Spanish Food Safety and Nutrition Agency will be the ones contained in Annexes I and II of this Resolution, the first of which contains a data file of a health character called Occupational Health and Occupational Risk Prevention and the second seven files relating to administrative data.

Second.-The approval of this Resolution does not mean the deletion of any data files of a personal nature, therefore the application of the provisions of Article 20.3 of the Organic Law of Protection of the data.

Third.-The holder of the organ responsible for these files will adopt, the management and organizational measures necessary, ensuring in any case the confidentiality, security and integrity of the data, as well as the (a) to make effective the guarantees, obligations and rights recognised in Organic Law 15/1999 of 13 December, and in its implementing rules, and in Royal Decree 1720/2007 of 21 December of 21 December, approving the security measures for automated and non-automated files containing character data personnel.

Fourth. This order shall enter into force on the day following that of its publication in the "Official Gazette of the State".

HEALTHCARE FILES

Occupational health and prevention of work risks

Purpose:
