TEXT

Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data (LOPD) states that the creation, modification or deletion of the files of the Public Administrations may only be made by means of a general provision published in the Official Journal of the State or the corresponding official journal. In addition, the additional provision of the LOPD orders the Public Administrations responsible for files to approve the provision to create the same or to adapt the existing provision to the provisions of the Law itself.

In the Autonomous Body National Parks it is necessary to approve the relevant provision of file regulation for the adequacy of the same to the LOPD, in the terms established in article 20.2 of the LOPD and Article 54 of Royal Decree 1720/2007 of 21 December 2007 approving the Development Regulation of the LOPD.

The particularity of the Autonomous Body National Parks needs to distinguish files whose ownership lies with the Agency but which are directly managed by a Park or Center (specific entry and exit registers Parks and Centres, video surveillance files in specific installations, authorizations defined in the area of a Park or Centre, etc.) For this reason, these files are specified in the annex, distinguishing the National Park or the Center responsible for its management.

In its virtue, and in order to comply with the legal mandate of article 20 of the LOPD, on the creation and modification of files containing personal data managed by the Autonomous Body National Parks, and to assure the managed exercise of their legitimate rights, and having been submitted to the previous report of the Spanish Agency for Data Protection, I have:

First. -The files of the National Park National Parks will be the ones contained in the annex of this Order. It details those files managed directly by the National Parks and Centers, concreting the Park or Center responsible for its management.

Second.-The files listed in the Annex shall be governed by the general provisions and instructions detailed for each of them and shall be subject, in any case, to the laws and regulations of higher the range to apply to them.

Third.-The approval of this Order does not imply the deletion of any personal data files, so the application of the provisions of Article 20.3 of the LOPD is not necessary.

Fourth. This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.

Madrid, 17 September 2009. -Minister for the Environment, and Rural and Marine Environment, Elena Espinosa Mangana.
