By the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health and Consumer Affairs, compliance with the provisions of the Second Additional Disposition was established, 2, of the Organic Law 5/1992, of October 29, regulating the automated processing of personal data.

Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, provides that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or Official Journal.

By this order, the Order of 21 July 1994 is amended, the file being amended with personal data called "International Health Alerts (ALSAIN)" set out in Annex 1 " The Ministry of Health and Consumer Protection, which is set up by Order SCO/855/2004 of 16 March 2004, extends the Directive of 21 July 1994, which regulates automated files with personal data, managed by the Ministry of Health and Consumer Affairs. The modification of this file responds to the change in its basic structure.

In the processing of this order, the Spanish Data Protection Agency has issued a mandatory report.

In its virtue, I have:

Article 1. Modifying the file.

The file "International Sanitary Alerts (ALSAIN)" is amended as set out in Annex 1 "Health Ficheros" of the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health and Consumer Affairs, set up by Order SCO/855/2004 of 16 March 2004, and the details of which are annexed to this order.

Article 2. Managing and organizing the file.

The head of the body responsible for this file shall, under the top management of the person holding the Ministry of Health, Social Services and Equality, adopt the necessary management and organisational measures, ensuring, in any case, the confidentiality, security and integrity of the data, as well as the conduct to make effective the guarantees, obligations and rights recognized in the Organic Law 15/1999, of December 13, of Data Protection Personal character, and in Royal Decree 1720/2007 of 21 December 2000, which adopted its rules of procedure development.

Article 3. Data cession.

The data contained in these files may only be transferred in the cases expressly provided for by the Law.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

Filename: "International Health Alerts (ALSAIN)"

Purpose of the file: Centralize information regarding international travelers from areas on health alert or health incidents in international transport with possible repercussions on the public health. Health surveillance and control. Statistical uses and health research.

Persons or collective persons on whom data of a personal nature are intended or required to be supplied: International travellers from areas on health alert or on board means of transport international where a health incident has been recorded with possible public health impact.

Personal Data Collection Procedure: External Health Personnel using forms. Notifications from hospital centres and national health administrations and health authorities in other countries.

Data and/or transfers of personal data: To other health agencies or administrations in the cases provided for in Articles 7.6 and 11.2 (f) of the Organic Law 15/1999, of December 13, Protection of Personal Data, and to the health authorities of other countries with the limitations provided for in Articles 33 and 34 of that Law.

e) Epidemiological classification and actions carried out (isolation, quarantine, referral to hospital ...).
