By Order ARM/1744/2011, of 15 June, published in the "Official Gazette of the State" number 149, dated June 23, the marine reserve of Cabo de Gata-Níjar is regulated, and its delimitation and permitted uses are defined. The conditions of practice of the different uses permitted in the marine reserve are laid down in the Annex thereto. In the case of professional fishing, the application of the order since its entry into force has shown an incompatibility with regard to the schedules and the days of activity permitted in this standard and those established in general in the national fishing grounds for the Mediterranean which makes it impossible to comply with the regulation itself, and it is therefore necessary to amend paragraph 2.A of the Annex to that Order ARM/1744/2011 of 15 June 2011 to resolve this situation.

In its virtue, I have:

Single item. Amendment of the Order ARM/1744/2011 of 15 June, which regulates the marine reserve of Cabo de Gata-Níjar, and defines its delimitation and permitted uses.

Point 2.A of the Annex to the Order is amended, as follows:

" A. Professional maritime fisheries.

1. The fishing effort to be carried out by professional fishing vessels in the field of the marine reserve shall comply with the provisions of Article 3.2 of Royal Decree 395/2006 of 31 March 2006 laying down management of the fishing fleet operating with fixed gear and minor gears in the Mediterranean, so the period allowed for fishing with fixed gear or minor gear shall be, for each vessel, five days per week and 16 hours per day. The time of entry and departure of the port will be those established in the corresponding regulations of days and schedules of the activity of professional fishing. In any case, the fishing gear and gear shall be removed from the fishing gear for 41 hours on a continuous basis per week and transported to port.

2. º All the catches that take place within the marine reserve are subject to the limitation of the sizes and species of prohibited catch, according to the regulations that regulate these aspects in the National Caladero of the Mediterranean and the other applicable environmental regulations.

3. The definition and technical measures of the arts and gear permitted in the Marine Reserve are those laid down in the regulations governing them in the national fishing grounds of the Mediterranean. "

Final disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.
