The Order of the Ministry of the Presidency of January 26, 2001 established the rules for the technical inspection of motor vehicles and trailers attached to the then Directorate General of the Civil Guard, today Directorate General of the Police and the Civil Guard, in the field of the latter Body.

This Order was developed, on the one hand, by the provisions of the second paragraph of Article 2 of Royal Decree 2042/1994 of 14 October 1994 on the technical inspection of vehicles and, on the other hand, of the The provisions of Royal Decree 1987/1985 of 24 September 1985 on the installation and operation of vehicle roadworthiness tests.

The first of the Royal Decrees cited has been amended by Royal Decree 711/2006 of 9 June, amending certain Royal Decrees relating to the technical inspection of vehicles and to the approval of vehicles, parts and parts thereof and the General Regulation of Vehicles, approved by Royal Decree 2822/1998 of 23 December 1998, is also amended.

And, the second of them, has been repealed by Royal Decree 224/2008, of February 15, on general rules for the installation and operation of the vehicle technical inspection stations.

The changes carried out by both Royal Decrees as regards the roadworthiness of vehicles makes it necessary to adapt the content of the said Order of the Ministry of the Presidency of 26 January 2001 to the same.

In the light of the above, this order is being dictated, which will replace the Order of the Ministry of the Presidency of 26 January 2001 in its entirety, the content of which, in addition to having been adapted to those amendments regulations, has been updated in accordance with the new structure of the Ministry of the Interior, in particular, after the previous Directorates-General of the Police and the Civil Guard have joined in a single Directorate General, since the approval of the Royal Decree 991/2006, of 8 September, of basic organic structure of the Ministry of the Interior, today regulated in Royal Decree 1181/2008 of 11 July 2008.

In addition, some new features have been incorporated, including the following:

The motor vehicles and trailers attached to the Civil Guard may pass the corresponding technical inspection in other public entities other than the Civil Guard and the Armed Forces in territory.

When such vehicles are abroad on international missions, they will be able to pass the corresponding technical inspection at the facilities of the Spanish Armed Forces in that country or by other means that meet the appropriate conditions, such as entities similar to foreign ITV stations or diagnostic machines.

In this way, the problem of the technical inspection of these vehicles is solved, especially given that the presence of the Civil Guard in these types of missions is increasing, which has involved a notable increase of the car park highlighted outside the national territory.

For reasons of proximity and economy, vehicles attached to the National Police Corps may pass their periodic or extraordinary inspections on the ITV stations of the Civil Guard, if previously requested and authorized, without the need for a prior collaboration agreement.

Under the second paragraph of Article 2 of Royal Decree 2042/1994 of 14 October 1994, on the proposal of the Ministers of the Interior and Industry, Tourism and Trade, I have:

Article 1. Place of conduct of the roadworthiness test of vehicles.

1. The technical inspection of motor vehicles and trailers attached to the Civil Guard, when they are on national territory, may be carried out:

(a) On the ITV stations of the Civil Guard, hereinafter ITV/GC, fixed or mobile.

b) On the ITV stations of other public institutions when previously requested and authorized.

c) On private ITV stations.

2. Where such vehicles for their special characteristics cannot pass through the line of inspection of the stations referred to in the preceding paragraph, they shall be inspected outside the conditions laid down by the Mobile Material Service. the Civil Guard.

3. The technical inspection of vehicles and trailers attached to the Civil Guard when they are abroad may be carried out, after authorization of the Mobile Material Service of the Civil Guard, as follows:

(a) With portable diagnostic machines of the Civil Guard and with technical means of the Spanish Armed Forces, upon request and authorization of these. Such technical inspections shall have the same effects and validity as the inspections carried out in Spain.

However, within thirty days after the vehicle returns to the national territory, a technical vehicle inspection must pass at any of the stations specified in paragraph 1 of this Article.

b) Entities similar to the ITV stations, workshops or using foreign diagnostic machines, when there is no Spanish media available for them. Such inspections shall only have effects and validity in the foreign country in which they were carried out.

These vehicles in order to be able to circulate on a national territory must pass a technical vehicle inspection at one of the stations specified in paragraph 1 of this article.

Article 2. Plazos for the conduct of roadworthiness testing of vehicles.

1. The periodic technical inspection of the vehicles shall be carried out at the following frequency:

(a) Motorcycles, three-wheel vehicles, quadricycles, quads, three-wheel mopeds and light quadricycles:

Age:

Up to four years: exempt.

Over four years: Biennial.

b) Two-wheel motor cycles:

Age:

Up to three years: exempt.

Over three years: biennial.

(c) Vehicles dedicated to the transport of persons, excluding those listed in the headings (a) and (b), with a capacity of up to nine seats, including the driver, motorhomes and vehicles:

Age:

Up to four years: exempt.

From four to ten years: biennial.

For more than ten years: yearly.

(d) Ambulance and school transport vehicles, with a capacity of up to nine seats, including the driver:

Age:

Up to five years: yearly.

Over five years: half-yearly.

(e) School vehicles for drivers, dedicated to the transport of persons with up to nine seats, including the driver, including motorcycles, three-wheel vehicles, quadricycles, quads, mopeds and Light quadricycles:

Age:

Up to two years: exempt.

Two to five years: annual.

Over five years: half-yearly.

(f) Vehicles dedicated to the transport of persons, including school and child transport, with capacity for 10 or more places, including the driver:

Age:

Up to five years: yearly.

Over five years: half-yearly.

g) Vehicles and sets of vehicles dedicated to the transport of goods or things, of MMA ≤ 3,5 Tm (maximum authorised mass less than or equal to 3,5 Tm):

Age:

Up to two years: exempt.

Two to six years: biennial.

From six to ten years: annual.

Over ten years: half-yearly.

h) Vehicles dedicated to the transport of goods or things, of MMA > 3.5 Tm:

Age:

Up to ten years: annual.

Over ten years: half-yearly.

i) Towed Caravans of MMA > 750 kg.

Age:

Up to six years: exempt.

Over six years: biennial.

(j) Agricultural tractors, self-propelled agricultural machinery, agricultural trailers and other special agricultural vehicles, other than motorcultors and equipment:

Age:

Up to eight years: exempt.

Eight to sixteen years: biennial.

Over sixteen years: yearly.

(k) Special vehicles, such as tankettes, tactical or those intended for self-propelled works and services and machinery, excluding those whose construction speed is less than 25 Km/h:

Age:

Up to four years: exempt.

From four to ten years: biennial.

For more than ten years: yearly.

2. Vehicles listed as historic shall be subject to periodic inspections under the conditions laid down by the Mobile Material Service of the Civil Guard, with the exception of vehicles of collection in which the condition of historical, which shall be subject to periodic technical inspection according to the frequencies corresponding to it in accordance with the provisions of this Article.

3. In the case of mixed vehicles, the frequency of the applicable inspection shall be the most restrictive among those for the transport of persons or goods applicable to the vehicle in question.

Article 3. Inspections that can be performed on ITV/GC stations.

At ITV/GC stations the following inspections may be performed:

(a) The periodicals of the vehicles set out in Article 2 of this order.

(b) Those other extraordinary circumstances as advised by special circumstances, and which shall be determined by the Mobile Material Service of the Civil Guard.

Article 4. Result of the technical inspection of vehicles.

The result of the technical inspection will result in one of the following situations depending on the defects found:

a) Favorable inspection: If vehicles exceed inspection, without defects.

b) Favorable inspection with slight defect: If minor defects (DL) are found that do not disable the vehicle for circular, a new inspection is not necessary, but they must be remedied within the shortest time.

c) Unfavourable inspection: The vehicle has serious defects (DGs) which disable it for public roads, except for transfer to the workshop and return to the ITV station for further inspection. This new inspection shall be carried out within a period not exceeding six months.

(d) Negative inspection: The inspection shall be classified as negative when the vehicle is accused of very serious defects (DMG) of such a nature that its use constitutes a danger to its occupants or to other road users public. In this case, the transfer of the vehicle from the station to its destination shall be carried out by means other than the vehicle itself, with the same actions as for the unfavourable technical inspections.

Article 5. Report of the outcome of the technical inspections

1. The result of the technical inspections shall be recorded, by the entity making it, on the ITV card or certificate of characteristics.

2. In all cases where a vehicle is inspected at an ITV/GC station, a report shall be issued, the model and characteristics of which are defined in the Annex to this order, which, like the ITV card or certificate of characteristics, shall be be signed by the technical officer of that station.

3. The model of inspection report shall consist of an original, which shall be held by the appropriate station, and two copies which shall be sent to the unit, centre or body to which the vehicle is awarded. One of these two copies will be incorporated into the vehicle documentation and, the other copy, will be filed in the Major Plana or Mobile Material Detachment.

4. All inspections and their results shall be recorded in the register of vehicles authorised for that purpose in the Civil Guard and shall be communicated to the competent authorities in the field of traffic and industry, if the vehicle has regular registration in addition to the officer.

5. In all cases, the defect ratio observed in the inspection shall be certified in the official vehicle technical inspection report.

6. All vehicles which have favourably passed the roadworthiness test shall be required to carry the latest inspection report, which shall be displayed by the driver to the authorities of the traffic surveillance authority who so request.

Article 6. Collaboration of other stations

For reasons of proximity and economy, the ITV/GC stations will be able to service the vehicles of other institutions such as Armed Forces and National Police Corps, if previously requested and authorized by the Civil Guard Mobile Material.

Additional disposition first. Extra application

In those aspects not established in this order, it will be applicable, with an extra character, the provisions of the Royal Decree 2042/1994 of 14 October, which regulates the technical inspection of vehicles and the Royal Decree Decree 224/2008 of 15 February on general rules for the installation and operation of technical vehicle inspection stations.

Additional provision second. Preparation of studies and statistics

Information resulting from the technical inspection of motor vehicles and trailers attached to the Civil Guard will allow for the production of studies and statistics on the results of inspections and deficiencies detected in the same, due to their state of conservation, operation and other causes, for each model and according to their age.

Single repeal provision. Regulatory repeal.

The Order of 26 January 2001 is hereby repealed, laying down the rules for the Technical Inspection of Motor Vehicles and Trailers attached to the Directorate General of the Civil Guard, as well as of the same or lower range are opposed to the provisions of this order.

Final disposition first. Regulatory enablement.

The Director-General of the Police and the Civil Guard is hereby authorized to give, within the scope of his powers, the instructions necessary for the execution and development of the provisions of this order.

Final disposition second. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
