The National Statistics Institute considers training a basic pillar that transcends the organization itself. The promotion and promotion of studies on statistics is important for improving the use of statistical information which the National Statistics Institute provides to other users at the same time as it benefits from research that in this material can be carried out by means other than those of its own resources.

On the other hand, the experience accumulated in recent years has shown that the award of scholarships represents for the National Statistics Institute a source of knowledge of excellent professionals who, after the overcoming the appropriate oppositions, they may end up integrating into the organization itself.

Law 12/1989, of 9 May, of the Public Statistical Function, enables the National Statistics Institute for the research, development, improvement and application of the statistical methodology, for which it is appropriate the Institute is to be awarded annually, by means of a public tender in competitive competition, scholarships for post-graduates who wish to start in the methods and techniques used in statistical research. To this end, the successful recipients of the scholarships will participate in the research tasks and in the training activities that will be established in the various programs that the National Statistics Institute will develop annually.

Therefore, this Ministry has considered it appropriate to draw up an Order establishing the general regulatory bases for the granting of postgraduate scholarships in statistics, in accordance with the regime established by the Law 38/2003, of November 17, General of Grants and the Regulation that develops it, approved by Royal Decree 887/2006, of July 21.

In its virtue and in accordance with the provisions of Article 17 of Law 38/2003, of 17 November, General of Grants, prior to the report of the State Advocate and the Delegation of the National Institute of Statistics, available:

Article 1. Object.

The purpose of this Order is to establish the regulatory basis for the granting of scholarships from the National Statistics Institute (INE) for the training of postgraduates who wish to start in the methods and techniques used in statistical research.

Article 2. Finality of scholarships.

Scholarships are intended to promote and promote statistical research, as well as the development and implementation of statistical processes.

Article 3. Requirements of the applicants.

1. In order to obtain the grant, applicants must meet the following requirements:

a) Poseer full capacity to act, as well as the Spanish nationality or that of a member country of the European Union or the European Economic Area, and be resident in Spain at the time of initiating the enjoyment of the scholarship.

b) Be in possession of the degree of licentiate, engineer or architect, or Grade, which shall have been obtained during the last four years prior to the date of the publication of the Resolution of convocation of the scholarships. The titles obtained must be official or be recognised or validated. In the case of such recognition or validation at the time of application of the grant, the grant of the grant shall be conditional upon the grant of the grant for recognition or validation.

c) To be aware of the payment of their tax obligations and social security in the terms provided for in the current regulations.

d) Do not incur the prohibitions of Article 13.2 of Law 38/2003, of 17 November, General of Grants.

2. The Resolution to call for grants, in establishing the documents and information to be submitted by the interested parties, may be replaced by a declaration responsible for the applicant. In this case, prior to the proposal for the grant of the grant, the presentation of the documentation showing the reality of the data contained in the said declaration must be required, within a period not exceeding 15 years. days.

Article 4. Procedure for the award of grants.

1. The procedure laid down in this Order is that of competitive competition, provided for in Article 22 of Law 38/2003 of 17 December, General of Grants.

2. The procedure for the award of scholarships shall be initiated on its own initiative, by means of a call approved by the Presidency of the INE and published in the Official Gazette of the State, and shall be governed by the provisions of Chapter II. Title I of Law 38/2003, of 17 November, General of Grants, and in accordance with the principles of Law 30/1992, of November 26, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. This Resolution shall lay down the duration of the grants and may provide for an extension, subject to budgetary resources, for six-monthly periods up to a maximum of 24 months, on the basis of a reasoned proposal from the guardian of the training action that will be elevated to the INE Presidency for its resolution.

3. Applications for grants shall be formalised in the official form set out in the Annex to the decision making the call and within the time limit, place and form to be determined in that resolution, in any event, provided for in the telematics of the application and supporting documentation as provided for in Law 11/2007, of 22 June, of electronic access of citizens to public services.

Article 5. Competent bodies for the management, instruction and resolution of the procedure. Deadline for the resolution to be notified.

1. The instruction of the procedure to the General Secretariat of the INE, which shall carry out as many actions as it deems necessary for the determination, knowledge and verification of the data under which the proposal has to be formulated resolution.

2. The assessment of applications shall be carried out by a Commission which shall have the following composition: the holder of the Presidency of the National Statistics Institute, the Director-General for Methodology, Quality and Information Technology and the Communications, the Director General of Planning, Coordination and Statistical Dissemination, the Director of the Office of the Presidency, and the General Secretariat, or persons in whom they delegate. The General Secretariat shall also act as the Secretariat of this Commission.

3. The instructor, in the light of the dossier and of the Commission's report, shall formulate the motion for a resolution, which, duly substantiated, shall be submitted to the body responsible for resolving the procedure.

4. The resolution, which will end the administrative route, will be given by the INE President, will be motivated and published in the Official State Gazette, with the expression of the call, the budget credit program, the identity of the scholarship and the amount of the grants.

5. The maximum period for resolving and notifying the decision of the procedure shall be three months from the day following the day of the end of the period for the submission of applications. The expiry of the maximum period provided for, without notification of the decision, legitimises the parties concerned to understand their request for the grant of aid.

Article 6. Assessment criteria.

The following criteria will be used for the award of grants:

a) Languages: Knowledge of documented English, French or German. Maximum 10 points.

b) Haber attended to the selective processes of the statistical bodies of the INE. Maximum 10 points.

c) Experience in statistical activities. Maximum 10 points.

d) Further training and research work. Maximum 10 points.

e) Titulations related to the area of statistical knowledge. Maximum 15 points.

f) Documentally accredited computer science knowledge. Maximum 15 points.

g) Personal interview about the suitability of the candidates. Maximum 30 points.

In case of a tie in the aspirants ' score, the total score obtained in the academic record will be taken into account.

Article 7. Amount of the grants.

The monthly total amount of each grant will be € 898.43 in 2010, and can be established in the successive annual Resolutions for the convocation of scholarships, a percentage increase equal to that provided for in the preliminary draft Law of General State budgets for staff serving the public sector. The payment shall be made in twelve monthly instalments for the said quantity, in proportion to the actual amount of the grant, to which the discounts and retentions that come in accordance with the provisions in force shall apply. In the case of an extension, the monthly total amount of each grant may be increased, depending on the available budgetary resources, in order to match the amount set out in the corresponding annual Resolution of the call for grants for this exercise.

Fellows will be beneficiaries of health care insurance and accidents in charge of the National Statistics Institute.

Article 8. Obligations of the beneficiaries.

Fellows assume the obligations set out in general terms in Article 14 of Law 38/2003 of 17 November, and in particular:

(a) They will participate in the statistical programs established by the National Statistics Institute, attending meetings and activities to be determined. Within a maximum of three months, from the end of the grant, they must present a report on the knowledge acquired and the statistical programmes in which they have participated. This memory must be submitted to the scholarship guardian.

b) The beneficiary will be obliged to provide as much information as requested by the Court of Auditors, the General Intervention of the State Administration or the National Statistics Institute itself to verify the compliance with the conditions or requirements laid down for the award of grants.

(c) The beneficiary's failure to comply with the requirements and obligations established on the occasion of the award of the grants, as provided for in Article 37 of Law 38/203 of 17 November 2001, Grants shall, without prejudice to any other liability to which it may be incurred, be subject to the obligation to refund the amounts unduly paid.

Article 9. Conditions and Incompatibilities.

1. The enjoyment of the scholarships referred to in this Order shall be incompatible with the concurrent obtaining of any grants or aid granted by public or private bodies, Spanish or foreign, for the same purpose.

In the event that the beneficiary is enjoying other aid previously granted, he must present supporting documents proving his resignation from that aid at the beginning of the period of enjoyment of the aid. this Order.

2. In no case shall the grant and enjoyment of the scholarships involve any work or statutory relationship between the grantee and the body.

3. The application of the grants and their subsequent acceptance, in the event of an award, will imply the acceptance of the provisions in these bases and in the corresponding call.

Article 10. Measures to ensure the good end of scholarships.

1. Amendment of the grant resolution of the grant. Any alteration of the conditions taken into account for the grant of the grant and, in any event, the concurrent obtaining of other scholarships in the field of statistics, granted by other administrations or entities, public or private, national or (a) the obligation to refund the amounts received shall be carried out without prejudice to any other responsibilities which may be incurred.

2. Refund of the amount of the grant. The reimbursement of the amounts received in respect of the grant, and the requirement of interest for late payment, from the moment of payment of the grant to the date on which the origin of the refund is agreed, in the cases provided for in the Article 37.1 of Law 38/2003 of 17 November, General of Grants, and in accordance with the procedure laid down in Articles 41 to 43 of that Law.

3. Incorporation of alternates. The instructor shall, with the proposal for a decision on the award of grants, raise a supplementary list of alternates, in order of priority, in the case of resignations or revocations, in the first six months of training.

Article 11. Responsibility and sanctioning regime.

The beneficiaries of the grants regulated in this Order will be subject to the responsibilities and sanctioning regime which, on administrative infractions in the field of grants, establish Articles 52 to 69 of the Law 38/2003, November 17, General Grant.

Single additional disposition. Applicable Regulations.

The grant of these grants is governed, in addition to the provisions of this Order, as provided for in Law 38/2003 of 17 November, General of Grants, and in its Rules of Procedure approved by Royal Decree 887/2006, 21 of July.

Single repeal provision. Regulatory repeal.

This Order repeals Order ECO/2594/2003 of 24 July, approving the regulatory basis for the award by the National Institute of Statistics of postgraduate scholarships in Statistics, as well as provisions of equal or lower rank are opposed to the provisions of the Order itself.

Final disposition first. Powers of development.

The INE Presidency is empowered to dictate how many resolutions it deems necessary for the implementation of this Order.

Final disposition second. Entry into force.

This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.
