Resolution Of January 11, 2010, The General Direction Of The Merchant Marine, On Accreditation Of Psycho-Physical Fitness For The Management Of Recreational Craft.

By Resolution of 5 January 2009, of the Directorate General of the Merchant Navy, for which various acts of material execution are issued for the implementation of the provisions of the Order of 26 October 2001, for which the the conditions for the government of recreational craft are regulated, it was established in its third paragraph, that the overcoming of the medical recognition that is determined in article 18 of the Order FOM/3200/2007 will be credited:

1. On an official form certifying physical fitness, in accordance with the requirements for the issue of the driving licence.

2. In replacement of the original certificate, as referred to in the preceding paragraph, a certified photocopy of the medical examinations in force for the boarding, issued by the Social Institute of the Navy, or those issued by doctors may be presented military personnel in which the ability to sail from the military applicant is accredited.

Taking into account the above, and for reasons of safety, homogeneity and greater warranty, the General Direction of the Merchant Navy, in application of the provisions of the first paragraph of the third paragraph, which is cited, resolves:

First. From the implementation of this Resolution, it will be required, hereafter, that the accreditation of psycho-physical fitness for the management of recreational craft be carried out by the Drivers (hereinafter CRC), similarly to drivers of ordinary (non-professional) permits for motor vehicles.

The CRCs shall communicate to the DGMM email referred to in the third paragraph of this Resolution that they are aware and abide by it and shall carry out the acknowledgments, reports and statements in accordance with the provisions of this Resolution, indicating in the communication the name of the Center, its location, holder of the Center, telephone, e-mail and registration number in the Registry of the General Directorate of Traffic.

In addition to the above, it will be possible to present a certified photocopy of the medical examinations in force for the boarding, issued by the Social Institute of the Navy, or those issued by military doctors in which the fitness to navigate the applicant military.

Second. -CRC must make a medical history, in which the results of the scans will be recorded, according to the picture of diseases and deficiencies that are cause of refusal or of establishment of adaptations to the vessel or of restrictive conditions for the navigation of Annex I, and shall be signed by each optional with its partial report. In the light of those results, the Director of the CRC shall issue the fitness report or not, as appropriate, in a form adjusted to the official model of Annex 2, which shall bear a recent photograph of the person concerned, on which the signature of the director and the seal of the Center.

Third.-In the General Direction of the Merchant Navy (hereinafter DGMM), a database of refusals and adaptations and restrictive conditions will be created, to which the CRC will communicate such cases in the format of Annex 3, Thus, it is avoided that those who do not obtain a CRC, an aptitude report, will see another hiding, sometimes, the disease or deficiency that will motivate the refusal. To this end, the negative reports and those establishing adaptations or CR shall be communicated on the same day of their issuance, by email to the DGMM at the following address: psicofisico.dgmm@fomento.es

Fourth. The discrepancy between the two centres would be similar to those of drivers of motor vehicles, either by the provincial health authority or, where appropriate, by a third Centre designated for the purpose by the DGMM.

Fifth. -In each case (which must be numbered correlatively starting with the number 1 at the beginning of each calendar year, -p. e.: 0001/10-), in which the data of the claimant (filiation, DNI, domicile, date of birth, sex and type of permission) are recorded, the self-declaration-Annex 4-of the complainant shall be included stating the truth about his state of health and not have concealed the existence of diseases or deficiencies, while giving their consent to the conduct of the relevant tests and examinations.

Sixth. It will not be necessary to carry out a new recognition for those citizens who credit that it has not been more than two years of the date of obtaining or renewing their permission to drive terrestrial vehicles to motor in They shall submit a copy of the said permit.

However, a review of the eye vision will be necessary for the purpose of differentiating the colors, especially green and red, to be performed in a CRC.

Seventh. -In replacement of the provisions of the previous paragraph, photocopy of the medical recognition in force for the boarding of the professionals of the sea, issued by the Social Institute of the Navy, may also be presented. those issued by military doctors certifying the ability to sail from the military applicant.

Eighth. -This Resolution will be applicable to the month of its publication, until then, not only the new certificates, but also those contained in the Resolution of 29 December 2008, of the General Directorate of the Merchant Navy, for which ordinary theoretical examinations are convened to obtain degrees for the government of recreational boats and nautical motorcycles.

Ninth. -This Resolution replaces the provisions of the third paragraph of the Resolution of 5 January 2009, of the Directorate General of the Merchant Navy, for which various acts of material execution for the application are made of the provisions of Order FOM/3200/2007 of 26 October 2009 (BOE No 24 of 28 January 2009).
