Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of files of Public Administrations may be done only by means of General provision published in the Official Journal of the State or the corresponding official journal. For its part, Article 53.1 of Royal Decree 1720/2007, of 21 December, approving the Regulation on the development of the Organic Law 15/1999, of 13 December, on the Protection of Personal Data, determines that when the A provision relates to the organs of the General Administration of the State or to the entities or bodies linked or dependent on it, the form of a ministerial order or the decision of the holder of the entity or body shall be corresponding.

By Order FOM/676/2003 of February 11, and Order FOM/1190/2005 of April 25, the update of the relationship of automated files of a personal nature of the Department was carried out. After these orders, it is necessary to incorporate and modify new files to the existing relationship. Thus, on the one hand, five new files are created and on the other, two files of the existing ones are modified.

It is considered convenient to indicate that the newly created files and the existing ones adopt the basic level qualified security measures, with the exception of the Tacographer Ficheros and General Registry of Offenders who adopt the average level. In the event that the File Consultations and Claims may incorporate specially protected data related to the content of the query or claim, this information will not be incorporated into the automated part of the file, in the Article 81 (5) (b) of the Royal Decree 1720/2007, of 21 December, approving the Implementing Regulation of the Organic Law 15/1999 of 13 December on the Protection of Personal Data.

In its virtue, prior to the report of the Spanish Agency for Data Protection, I have:

Article 1. Incorporation of files.

In Annex I of this order the files of new creation are related that are to be incorporated to the set of files of personal data of the Ministry of Development, in the terms and conditions set in the Organic Law 15/1999, of 13 December, and its implementing regulation adopted by Royal Decree 1720/2007 of 21 December.

In Annex I, the organs responsible for these files are indicated and, in addition, for each of them, the following ends are included: name of the file, services or units for the exercise of the rights of access, rectification, cancellation and opposition, purpose and uses, personal or collective affected, source of data, collection procedure, basic structure, planned data communications, international data transfers, security level and treatment system.

Article 2. Updating files.

In Annex II of this order are those files that have undergone some modification since their registration in the General Data Protection Registry of the Spanish Data Protection Agency.

Single end disposition. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
