Child oral health is a first-order goal in the context of modern health policies. The preventive approach and the activities that have been applied since the first years of life are key to the success of the health programs. The promotion of healthy habits, the prevention of major dental pathologies and their early detection through annual reviews constitute a set of actions of recognized utility in the general health of individuals. Bucodental pathologies have a high prevalence in the population, affecting the quality of life in both the infant and the adult stages. They also relate to other more serious health problems if they are not properly treated.

According to the data from the latest Oral Health Survey in Spain (year 2005), the proportion of caries-free subjects is 64 percent in the age group between five and six years, 53 percent at 12 years, and 40 percent for 15-year-olds.

This situation has been tried to overcome thanks to the remarkable efforts made by different health administrations, especially in recent years, to extend the coverage and preventive services and care in the children's population.

The Ministry of Health and Social Policy, as the head of the policy for the management of benefits and coordination of related activities, through the Directorate-General for Vocational Management, Cohesion of the System National of Health and High Inspection, considers that the incorporation of these services of oral care to the children, has shown an important increase in the number of children free of caries, one of the essential objectives of the programs of health of this type.

With the objective of improving the equity in the oral health of the children and adolescents of seven to 15 years, the Ministry of Health and Social Policy, within the Plan of Health Oral Dental Health elaborated in 2007, and presented to the Interterritorial Council of the National Health System on October 10, 2007, promoted in 2008 and 2009, through the direct grant of grants to the autonomous communities, the realization of activities in dental health children to achieve a minimum coverage of 62 percent of two distinct cohorts each year.

These grants to the Autonomous Communities in the years 2008 and 2009 were regulated by Royal Decree 111/2008 of 1 February and Royal Decree 1464/2009 of 18 September for the promotion of health activities child bucodental on the population groups of seven and eight years and seven and 10 years respectively.

With the grant of the subsidies regulated by this royal decree, it is intended to continue the promotion of activities for the oral dental health during the year 2010, within the same objectives, orienting these activities to two new cohorts, those aged seven and 12 years.

In its virtue, on the proposal of the Minister of Health and Social Policy, with the report of the Ministry of Economy and Finance and after deliberation of the Council of Ministers at its meeting on April 30, 2010,

DISPONGO:

Article 1. Object.

1. This royal decree aims to regulate the direct grant of a grant to the Autonomous Communities and the National Institute of Health Management (INGESA), for the implementation of activities to promote the use of children's dental health during Year 2010.

2. These activities to promote children's oral health care in 2010, are aimed at children who are aged or seven or 12 years old.

Article 2. Activities to perform.

The activities for the promotion of child dental health to be subsidised shall consist of an annual review, the minimum preventive and care content of which is set out in Annex I, which shall be applied individually on the basis of criteria. optional.

Article 3. Concession procedure.

1. The subsidies regulated by this royal decree are singular in virtue of the provisions of Articles 22.2.c) and 28.2 and 3 of Law 38/2003 of 17 November, General of Grants, given the special interest it entails for the System National of Health Care for Child Dental Health.

2. The concession shall be made directly by resolution of the Secretary-General of Health.

Article 4. Legal regime.

The subsidies regulated by this royal decree will be governed, in addition to what is established by this rule, as provided for in Law 38/2003, of 17 November, General of Grants and the General Regulations of Grants, approved by Royal Decree 887/2006 of 21 July, except as regards the principles of advertising and competition, as well as the other rules of administrative law applicable to them.

Article 5. Beneficiaries.

It will be beneficiaries of the subsidies regulated in this royal decree the autonomous communities that participate in the promotion of activities for the children's health in the year 2010.

Article 6. Obligations of the beneficiaries.

The beneficiaries will be subject to the obligations provided for in Article 14 of Law 38/2003 of 17 November, General Grants, and in particular the following:

a) Carry out the activity for which the grant has been granted. The purpose of the grant shall be deemed to be fulfilled where the autonomous community establishes the destination of the funds received for the activities provided for in Annex I to this royal decree.

b) Present the corresponding justification in the terms provided for in Article 10 of this royal decree.

Article 7. Funding.

The grants under this royal decree will be financed from the budget of the Ministry of Health and Social Policy for the year 2010, and its endowment will be 12,000,000 euros.

Article 8. Amount of the grants.

The maximum amount of the grant for each Autonomous Community and INGESA has been calculated by distributing the total budget allocation according to the population of seven and 12 years of each, according to the data of the Municipal register for the year 2008 published by the National Statistics Institute, as specified in Annex II.

Article 9. Procedure and time limits for the submission of applications.

The beneficiaries will present a memory of activities to which the funds will be applied, signed by the competent body of the Ministry responsible for Health with the rank of Directorate General or by the General Secretariat for Health Care. Health in the case of INGESA. The presentation of the memory shall imply acceptance of the grant. The responsible declaration set out in Annex III shall also be accompanied by these unavoidable requirements for the grant of the grant. The documentation must be presented in the general register of the Ministry of Health and Social Policy within a maximum of 30 calendar days from the following to the publication of this royal decree in the "Official Gazette of the State".

Article 10. Payment of the grants and justification scheme.

1. The amounts to be paid by the Ministry of Health and Social Policy will be effective in two payments:

(a) The first, in the amount of 50% of the total subsidy for each beneficiary (Annex II), shall be considered as an advance on account, without prejudice to the fact that, once the amount of the subsidy is justified, grant, the relevant settlement is practised and the corresponding payment or debit is made.

(b) The second, for the amount of the remaining amount, after receipt and conformity of the certification of the number of cases effectively included, as at 30 November 2010, in the activities listed in Annex I. The data shall be present in the form of a table in accordance with the model presented in Annex IV, and shall be sent to the General Secretariat of the Portfolio of Services and New Technologies of the Ministry of Health and Social Policy, in order to verify the performance of the those activities contained therein. If the coverage of 62% is achieved, the whole grant will be paid. If any of the beneficiaries do not reach the intended coverage, the amount proportional to the coverage achieved shall be paid.

In the same way, the corresponding amount will be returned from each autonomous community, in the case of not having reached 50 percent of the expected coverage.

Certification shall be issued and duly certified by the competent authority of the health department with the rank of general management or by the General Health Care Subdirectorate in the case of INGESA.

2. The autonomous community shall have 10 calendar days from the date indicated in the preceding paragraph to provide the aforementioned certification, considering as justification by the beneficiaries of the fulfillment of the objective of the grant and the material application of the funds received, in line with the provisions of Article 30 of Law 38/2003 of 17 November, without prejudice to the submission to the relevant verification.

Article 11. Refit.

The refund of the grant will be required, with the interest of the corresponding delay from the moment of payment of the grant, in the cases and in the terms provided for in Articles 36 to 43 of Law 38/2003, of 17 November.

Single additional disposition. Competence of the National Institute of Health Management in relation to Ceuta and Melilla.

The references in this standard are made to the Autonomous Communities, they will be understood to be made to the INGESA in relation to the cities of Ceuta and Melilla.

Final disposition first. Competence title.

This royal decree is dictated by the provisions of article 149.1.16. of the Spanish Constitution, which attributes to the State exclusive competence in the field of bases and general coordination of health.

Final disposition second. Term of validity.

The term of validity of this royal decree will be extended throughout 2010.

Final disposition third. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

ANNEX I

Activities to be performed for the promotion of child dental health during the year 2010

Basic dental care for children included in the activities for the promotion of child dental health during the year 2010, includes an annual review whose minimum content will observe the following preventive measures and care:

Health instructions on diet and oral health, accompanied by training in oral hygiene, to children and their parents or guardians.

Application of topical fluorine, in accordance with the fluorination policy of each autonomous community and the individual needs of each child.

Annual review of the health status of the oral cavity, including radiographic scanning when the child's degree of dental pathology requires prior written consent from parents or legal guardians.

Seals of fissures or pits in permanent parts.

Shutter in permanent tooth parts. When caries are detected, their stage and rate of progression will be assessed and if the injury is considered irreversible, it will be sealed.

Pulp (endodontic) treatments of permanent tooth pieces with irreversible pulpairwise lesions that can be repaired. In case of not being able to be repaired will be performed their exodontics.

Exodoncias of temporary pieces.

Tartrectomies when detecting extrinsic stones and/or pigmentations in permanent dentition that are incompatible with gingival health.

Treatments of incisors and permanent canines in case of disease, malformations or trauma, without prejudice, in the case of trauma, from the responsibilities of third parties in the payment of treatment.

Follow-up, in cases advised by the physician, to ensure the correct clinical evolution of the minor's dental health.
