The importance of the damage caused by the severe floods in several Autonomous Communities, with special impact on those in Andalusia and Extremadura, in the last month of 2009 and during the first months of 2010, makes it difficult to implement within the prescribed period of the works and services to be carried out by local corporations and entities dependent on or linked to a Local Administration and initiated in the financial year 2009 under the issued by the State Employment Public Service pursuant to the Order of the Ministry of Labour and Social Affairs of 26 October 1998 laying the foundations for the award of grants by the National Institute of Employment in the field of collaboration with local authorities for the recruitment of workers (a) workers who are unemployed in the construction of works and services of general and social interest, under Royal Decree 939/1997 of 20 June, regulating the affectation to the programme of promotion of agricultural employment, of credits for investment Public administrations in the Autonomous Communities of Andalusia and Extremadura and in rural areas depressed.

To mitigate these damages, various measures have already been established through Royal Decree 344/2010 of 19 March, extending the deadline for the implementation of Law 3/2010 of 10 March, approving urgent measures to alleviate the damage caused by forest fires and other natural disasters occurring in several Autonomous Communities and Royal Decree-Law 2/2010 of 19 March 2010 on the reduction of the minimum number of actual days listed for access the unemployment allowance or agricultural income in favour of the affected agricultural workers for floods in the Autonomous Communities of Andalusia and Extremadura.

The Order of the Ministry of Labour and Social Affairs, of 26 October 1998, already provides, in Article 4 (1) (e), that the works or services to be carried out may be carried out in full within the calendar year of the financial year. the budget in which the cooperation is produced, unless exceptional, duly justified causes are found to determine the impossibility of execution within that period, in which case the works and services may be approved provided they can be completed within the first six months of the following financial year. However, these deadlines are insufficient in the light of the extraordinary circumstances outlined above, which have led to a substantial halt in the execution of the approved works or services, with the consequent impact on the the unemployed workers participating in the same, who see the period of employment reduced, and, where appropriate, the possibility of access to unemployment benefits or allowances, and to agricultural income. The objective of improving the employability of the unemployed participants is also altered.

For all of this, prior to the report of the State Advocate in the Department and the Delegation of the State General Intervention in the Public Service of State Employment, I have:

Extension of the deadline for the completion of works and services of general and social interest, initiated in the financial year 2009, in the framework of the programme for the promotion of agricultural employment for the Autonomous Communities of Andalusia and Extremadura and in depressed rural areas.

2. The provisions of this order shall apply in respect of the municipalities affected by the serious floods in the month of December 2009 and during the first months of 2010 and listed in the Annex to Royal Decree 344/2010 of 19 December 2010. In the decisions referred to in paragraph 1 and, where appropriate, in the case of calls made by the State Employment Public Service which gave rise to the same, the time limit for the completion of the works or services shall be referred to. established in this order, without prejudice to the provisions of the previous paragraph in respect of the municipalities not included in the Annex to Royal Decree 344/2010 of 19 March 2010.
