Key Benefits:
Royal Decree 404/2010 of 31 March 2010 regulating the establishment of a system for the reduction of contributions by professional contingencies to undertakings which have contributed in particular to the reduction and prevention of occupational accidents, as laid down in Article 2 (2), that the design and content of the computer file shall be specified in its implementing and/or development provisions by means of which the managing bodies or the mutual entities shall send the Directorate-General for the Management of Social Security-the non-binding proposal refers to this provision, in order to grant or refuse the incentive requested by the respective protected undertakings.
For their part, the only transitional provision of the royal decree referred to in paragraph 3 of this Article provides that the limit values and the volume of contributions to be taken into account for the incentive for the financial year 2009 shall be fixed by Order of the Ministry of Labor and Immigration.
It is necessary, therefore, to develop the aforementioned royal decree as regards the aspects mentioned, together with other questions necessary for the proper application of the provisions in it.
On the other hand, in accordance with Article 20 of the Organic Law 15/1999 of 13 December on the protection of personal data, two other computer files relating to related materials are created. with the contents of this order.
This order is made in use of the powers conferred by Article 5.2 of the recast text of the General Law of Social Security, approved by the Royal Legislative Decree 1/1994, of 20 June, in relation to the established in the final provision of Royal Decree 404/2010 of 31 March 2010.
In its virtue, I have:
Article 1. Approval of the computer file for the presentation of the report-proposal by the managing or mutual entities.
The non-binding report-proposal of the managing and mutual entities of occupational accidents and occupational diseases of the Social Security referred to in Article 7.2 of Royal Decree 404/2010 of 31 March 2010 the establishment of a system for the reduction of contributions by professional contingencies to undertakings which have contributed, in particular, to the reduction and prevention of accidents at work, considered, where appropriate, by the claims referred to in that provision shall be in accordance with the computerised file for which characteristics and content are collected respectively in the first provision and in Annex I.
Article 2. Limit values and trading volume applicable for the financial year 2009.
1. For the financial year 2009, the limit values for general claims and extreme claims rates to be taken into account for the calculation of the applicable incentive shall be those set out in Annex II.
2. The minimum volume of contribution by professional contingencies to be reached during the period of observation referred to in the single transitional provision of Royal Decree 404/2010 of 31 March 2010 shall be as provided for in Article 2.1.b).
Article 3. Requirements.
1. For the purposes of Article 2 (1) (e) of Royal Decree 404/2010 of 31 March 2010, only those sanctioning decisions which have become final during the period of observation shall be taken into account when the applicant is considered to be in the same subject directly responsible for the infringement. In the case of serious infringements, they shall be taken into account only when they have been repeated during the observation period. It shall be understood that there is reiteration where the number of serious infringements exceeds two during the observation period.
2. For the purposes of Article 2.1.g. 3. of the actual decree in relation to the existence of road mobility plans within the undertaking, it shall be considered as one of the measures to prevent accidents at work on the basis of the improvement of the the means of transport.
3. The certificate of quality of the organisation and operation of the system of prevention of the undertaking referred to in Article 2.1.g. 5. of Royal Decree 404/2010 of 31 March of 31 March of 31 March of 31 March of 31 March internationally accepted, may be issued by an entity or body duly accredited by the National Accreditation Entity (ENAC), or by any other existing certification company, in cases where the accreditation by that person.

5. For the purposes of Article 2.1 of the said royal decree, and at the request of the undertaking, the delegate or delegates of prevention shall express their conformity with the certification of the undertaking referred to in the preceding paragraph, in the terms set out in paragraph 3 of that Annex III. They may also express their disagreement and provide written submissions.
When there is an inter-centre committee on health and safety at the enterprise, the compliance of the prevention delegates may be expressed by those of those delegates who are part of it.
6. In cases where there is no evidence of the compliance of the prevention delegates and there are allegations of prevention, the Directorate-General for the Management of Social Security shall, without prejudice to continuing the processing of the company's application, In any case, it shall forward the file to the Directorate-General for Labour Inspection and Social Security for further verification.
Article 4. Submission and processing of applications.
1. In accordance with Article 2.2 of Royal Decree 404/2010 of 31 March, a single application shall be submitted for all listing account codes with the same code of activity for the purposes of listing: accidents at work and occupational diseases.
2. In the event that the undertaking is protected by the professional contingencies of its employees by more than one managing or mutual entity, it shall make a single application in that in which it has the cover of its listing account code. principal. The application shall include the total number of shares in the undertaking due to temporary incapacity and permanent incapacity, death and survival arising from professional contingencies, as well as the total investments made.
In the event of more than one economic activity being carried out for the purposes of contributions for accidents at work and occupational diseases, the applications for each economic activity shall be carried out in the managing body or mutual in which the oldest quotation account code is covered. 3. In the light of the request made by the undertaking, the managing body or the mutual entity shall forward to the Directorate-General for Social Security Management the non-binding report-proposal referred to in Article 7 of Royal Decree 404/2010 of 31 December March. To this end, the requirements referred to in paragraphs (a), (e), (f) and (g) of Article 2.1 of that royal decree shall be presumed to be fulfilled when the certification referred to in Article 2.4 thereof is duly completed. This is without prejudice to the provisions of Article 3.6 of this order in relation to the referral of the file to the Directorate-General for Labour Inspection and Social Security in the cases in which, failing to establish the conformity of the prevention, there are allegations of prevention.
4. In the event that a company has trading account codes in more than one management or mutual entity at the time of the incentive application, the total amount of the incentive shall be paid by each of them on the basis of the following: the quotas for each listing account code.
Article 5. Partnership to another mutual.
The insufficiency of mutual resources for the payment of the entire incentive corresponding to the company, will empower the company to denounce the association agreement in the terms and time limits set out in article 62.2 of the Regulation on the cooperation of mutual occupational accidents and occupational diseases, approved by Royal Decree 1993/1995 of 7 December 1995, even if the convention has been the subject of exceptional extension of the in accordance with the provisions of the first transitional provision of Royal Decree 38/2010, of 15 January, for which the regulation is amended.
