Royal Decree 1221/2009 of 17 July 2009 laying down basic rules for the management of holdings of extensive pig cattle and amending Royal Decree 1547/2004 of 25 June 2004 laying down detailed rules for the management of pig holdings lay down the rules for the management of farming holdings, set up a new legal framework for extensive pig holdings, in accordance with the requirements arising from different national provisions, as well as from the rules Community policy on animal welfare, hygiene and animal health, and environmental protection. In this way, it set out minimum conditions aimed at minimising the health and environmental risks that this type of farm may entail.

In the text of Royal Decree 1221/2009, of July 17, certain errors and omissions have been identified, which must be amended for the proper development of livestock activity. Accordingly, this amendment will make it possible to correct the error detected in relation to the established capacity limits for each of the groups in which the extensive pig holdings are classified. It will also make it possible to amend the omission of the equivalence in UGM of pigs from 20 to 50 kg, and the omission of the possibility of transporting animals from a farm along with bait animals from the same holding, destined for slaughterhouse.

Given the marked technical nature of this rule, it is considered appropriate to be adopted by royal decree.

In the process of this royal decree, the autonomous communities and representative entities of the affected sectors have been consulted.

In its virtue, on the proposal of the Minister of the Environment, and the Rural and Marine Environment, with the prior approval of the Minister of the Presidency, in agreement with the Council of State and after deliberation of the Council of Ministers in its Meeting of the day 3 September 2010,

DISPONGO:

Single item. Amendment of Royal Decree 1221/2009 of 17 July 2009 laying down basic rules for the management of holdings of extensive pig livestock and amending Royal Decree 1547/2004 of 25 June 2004 laying down the rules for the application of the rules of the the rules for the management of the farming sector.

One. Article 3 (2) is worded as follows:

" 2. Classification for its productive capacity: the extensive pig holdings are classified according to their productive capacity, expressed in UGM, in accordance with the equivalences established for each type of livestock under Article 4.1.a) .1 the following way:

a) Group first: holdings with a capacity of up to 120 UGM, with a maximum of 37 UGM to the players.

b) Second group: holdings with a capacity of more than 120 UGM and up to 360 UGM, with a maximum of 112 UGM for the players.

c) Third group: holdings with a capacity of more than 360 UGM and up to 720 UGM, with a maximum of 225 UGM to the players.

The autonomous communities may modulate the maximum capacity provided for in paragraph c), depending on the characteristics of the areas in which the holdings are located, the circumstances of production or other conditions which can be determined by the competent body of those conditions, without in any case being able to increase the said capacity for application to bait by more than 20 per cent. '

Two. Article 4 is amended as follows: point (a) of paragraph 1 (a) and point (e) of paragraph 1 (e) of paragraph 1 are worded as follows:

" 1. The stocking density of extensive pig holdings shall not exceed the limit laid down for each holding in the Register of holdings provided for in Article 7 and shall not exceed the density of 15 pigs bait/hectare (2.4 UGM/ha), or its equivalent according to the following table:

1. º1 Cerda with piglets up to 23 Kg: 0.30 UGM.

1. º2 Reorder Cerda: 0.14 UGM.

1. º3 Pig from 20 to 50 Kg: 0.10 UGM.

1. º4 I lose more than 50 kg: 0.16 UGM.

1. º5 Verraco: 0.30 UGM.

Animals of different categories may be maintained, always in accordance with the equivalences described in this section, and within the maximum densities established. "

" 4. With a general character and with the exception of duly justified and authorized exceptions, the movement of detour animals is permitted only for the purpose of breeding centres for rerouting or directly to slaughterhouse. In any case, the lorries must be properly washed and disinfected and loads shared with other categories of pigs, except where in the means of transport the animals are only transported from diversion to animals of bait from the same holding for slaughter. '

Final disposition first. Competence title.

The present royal decree has the character of basic state regulations, and is dictated by the provisions of Article 149.1.13. of the Constitution, for which exclusive competence in the field of bases is attributed to the State coordination of the general planning of economic activity, except as for the amendment of Article 4 (1) (a), which is issued pursuant to Article 149.1.23. of the Treaty on European Union, which is the subject of Article 4 (1) (a) of the Treaty. Constitution which the State attributes exclusive competence in the basic legislation on protection of the Article 4 (1) (e) of the Constitution, which gives the State the exclusive competence on the basis of the provisions of Article 4 (1) (e) of the Constitution, which is given in accordance with Article 149.1.16 (1) of the Constitution. general coordination of health.
