The Nuclear Security Council is an Ente de Derecho Público, independent of the General Administration of the State, with its own legal personality and its own patrimony and independent of those of the State, created by Law 15/1980, 22 of April, the establishment of the Nuclear Security Council, as the only body responsible for nuclear safety and radiation protection. According to that Law, the public Ente shall be governed by a Statute of its own, drawn up by the Council and approved by the Government, of whose text it shall transfer to the competent committees of the Congress and the Senate prior to its publication.

Royal Decree 1157/1982 of 30 April, approving the Statute of the Council for Nuclear Safety, concretely the structure, organization, functions and legal regime of the Agency according to the forecasts established with general character, in the constitutive law itself, Law 15/1980, of 22 April.

In the time since the adoption of the Statute, there have been multiple reforms in the regulatory framework affecting the Nuclear Security Council, some directly related to its legal system of action, impacting on its Law of Creation, such as the publication of a law on the financing of its activities (Law 14/1999, of 4 May, of Public Fees and Prices for services provided by the Nuclear Security Council), and others, derived from reforms in sectoral laws, such as those which have had an impact on these years in Law 25/1964, of 29 April, on Nuclear Energy, leading all this, to extensive functional changes in the activity of this Body that were collected through a series of adaptations of its Organic Statute, the last of them, produced by Royal Decree 469/2000, of 7 April, amending the basic organic structure of the Nuclear Safety Council.

But it is the approval of Law 33/2007, of 7 November, of reform of Law 15/1980, of 22 April, of the creation of the Council of Nuclear Security, which has led to a further transformation in the legal regime of this Body, developing, among other developments, the legal aspects that allow to strengthen and guarantee the effective independence of it, welcoming the increasing social sensitivity in relation to the environment, institutionalizing the mechanisms necessary to promote and enhance transparency, the participation of society and to strengthen the right of citizens to access relevant information regarding nuclear safety and radiation protection, in line with the requirements of Law 27/2006 of 18 July on the rights of the public Access to information, public participation and access to justice in the field of the environment has been sought, thanks to new elements, such as the establishment of an Advisory Committee on Information and Public Participation, a major credibility and trust in the face of society, introducing, in order to make this commitment effective, a series of measures to reorganise the Agency's competences and resources, with these new foundations.

In order to incorporate the changes introduced by Law 33/2007, of 7 November, in the Law of the creation of the Nuclear Safety Council, it was necessary to proceed to the correlative modification of the current Statute, in a new text to replace the previous one, which will systematize and harmonise the functions currently carried out by the Council, moving the basic rules for the allocation of administrative powers given to it under laws or regulations development of the Nuclear Energy Act, since 1964, and which have so far been lacking a joint or consistent regulation, to a single text.

The final provision of Law 33/2007 of 7 November, which gave the Government the authorisation to approve the amendment of the Statute of the Nuclear Safety Council, is therefore to be complied with.

In the preliminary title of the Statute, ("General provisions") the position of independent Management of the Nuclear Security Council (CSN) is envisaged, reflecting the legal regime to be submitted to it, and which is based on the prevalence of the constitutive law, (Law 15/1980 of 22 April), and its Statute, with the addition of the organizational and legal rules common to the other public bodies linked to the administration State General.

In its title I, the "Functions" of the Agency are established, with a unifying will, systematizing the competences of the CSN in the issuance of preceptive reports, of supervision, inspection, control, technical regulation, and proposal for a sanction, in respect of the action of operators of nuclear and radioactive installations and activities; or their responsibility for the adoption of response measures to nuclear or radiological emergencies, coordinating all aspects related to nuclear safety and radiation protection in these situations; The role of the CSN in providing society, and the institutions (parliaments and governments, national and regional), of periodic information, and also timely, in real time, of the events likely to affect the functioning of the CSN, is developed. of nuclear and radioactive installations or the radiological quality of the environment; or its role of advising the Government, other public administrations and the courts, in matters of its competence, and in collaboration with other Public or private entities, national and international, for a better development of their powers of control and guarantee of the safe operation of such nuclear and radioactive installations and the protection of workers, the public and the environment from the effects of ionizing radiation.

In Title II, the "organisational structure of the CSN" is developed, defining the plenary and the Presidency as "senior management bodies" of this Agency, coordinating their relations on the basis of the principles of cooperation, weighting and respect for the legitimate exercise of the respective powers and without any hierarchical subordination between them, as provided for in Article 4.3 of the Law on the Establishment of the CSN.

Under the direction of the higher bodies, they are located, and are regulated, in the corresponding chapters, as management bodies of the CSN, the General Secretariat of the Council, the Technical Directorates, the Directorate of the Technical Cabinet of the Presidency, and the Subdirections.

Two advisory bodies are incorporated for the Agency: i) the "Advisory Committee", configured in accordance with the guidelines of Article 15 of the Law on the Establishment of the Agency, in the drafting of Law 33/2007, of 7 November, which will issue recommendations to the CSN to promote and improve transparency, access to the information and public participation in matters falling within the competence of the CSN; and (ii) the "Technical Advisory Committees", which are already existing in the previous statutory text, but which are now given a functioning system, in the philosophy that provide support and advice, through specialised technical experts, in the taking of decisions which directly affect the nuclear safety and radiation protection matters, the higher and the steering bodies of the CSN.

As for the "Staff Regulations", Title III has proceeded, as already included in the Statute in force, to the regulation of the Special Corps in which the officials of the CSN, the "Nuclear Security Corps", are attached. and Radiological Protection ".

Finely, in Titles IV and V the aspects relating to "hiring and legal assistance" are regulated, and to the "patrimonial, budgetary, and control of the economic-financial and accounting management" of the CSN, the general provisions affecting it, coming from the basic legislation applicable to the General Administration of the State.

The draft Statute has been drawn up by the Nuclear Security Council, in compliance with the mandate contained in Article 1 of Law 15/1980, of 22 April, in the wording granted by Law 33/2007 of 7 November.

In its virtue, at the initiative of the Minister of Industry, Tourism and Commerce, on the proposal of the Minister of Territorial Policy and Public Administration and the Minister of Economy and Finance, according to the State Council and deliberation of the Council of Ministers at its meeting on 5 November 2010,

Single item. Approval of the Statute of the Nuclear Security Council.

Under the terms of the final provision of Law 33/2007, of 7 November, the Statute of the Nuclear Safety Council is adopted, the text of which is inserted below.

Additional disposition first. Compliance with the rules for the development of the Law on the Basic Statute of the Public Employee, which is dictated by the General Administration of the State.

The provisions of Articles 53 and 54 of the Staff Regulations, which are approved by this Royal Decree, are without prejudice to their adaptation to the rules that are laid down in the development of Law 7/2007 of 12 April of the Basic Statute. Public Employee.

Royal Decree 1157/1982 of 30 April 1982, approved by the Statute of the Council for Nuclear Safety, the fourth additional provision of Royal Decree 1339/1999 of 31 July, approving the Regulation, is hereby repealed. of the National Energy Commission and how many provisions of equal or lower rank are opposed to what is established in this Royal Decree.

STATUTE OF THE NUCLEAR SECURITY COUNCIL

PRELIMINARY TITLE

General provisions

Article 1. The Nuclear Security Council.

The Nuclear Security Council, created by Law 15/1980 of 22 April, is an entity governed by public law, independent of the General Administration of the State, which has its own distinct legal personality and its own patrimony. independent of the State.

Article 2. Legal framework.

1. The Nuclear Security Council shall be governed by the provisions of Law 15/1980 of 22 April and in this Statute.

2. It shall also be governed by the provisions of Law 47/2003 of 26 November, General Budget, which are applicable to it, as well as by Law No 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Rules of Procedure Joint Administrative, in the exercise of the public functions which it has attributed, and, by the provisions of Law 33/2003, of 3 November, of the Patrimony of Public Administrations, and by Law 30/2007, of October 30, of Contracts of the Public Sector.

3. The Nuclear Safety Council shall be governed by Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, in accordance with the provisions of its additional tenth provision.

4. The Nuclear Security Council acts in the development of its activity and for the fulfillment of its aims with organic and functional autonomy, full independence of the Public Administrations and interest groups. It is also subject to parliamentary and judicial control. The resolutions adopted by the Plenary and the Chairman of the Nuclear Security Council in the exercise of the public functions assigned to them shall put an end to the administrative path.

Article 3. Object of the Nuclear Security Council.

The Nuclear Safety Council is the only public body responsible for nuclear safety and radiation protection, in charge of protecting workers, the population and the environment from the harmful effects of nuclear safety. ionising radiation, enabling nuclear and radioactive installations to be operated by the holders in a safe manner, and establishing measures for prevention and correction in the face of radiological emergencies, whatever their origin.

TITLE I

Nuclear Security Council Functions

Article 4. Functions of the Nuclear Security Council.

It is for the Nuclear Security Council to exercise all the functions set out in Article 2 of Law 15/1980 of 22 April, as well as the exercise of those other functions which, in the field of nuclear safety, the radiation protection and physical protection, be attributed to it by law with a range of law, regulation or under international treaties.

CHAPTER I

Reporting, enabling, and inspection and control functions

Article 5. Reports from the Nuclear Safety Council to the Ministry of Industry, Tourism and Trade and other Public Administrations.

1. The Nuclear Security Council shall issue the reports prior to the resolutions which the Ministry of Industry, Tourism and Trade adopts, in the matters governed by Article 2.b) of Law 15/1980, of 22 April. The reports issued in the exercise of that function shall be mandatory, in any case, and in addition, binding in the terms established by the Law. It shall also issue the reports provided for in Article 2.9 of Law 25/1964 of 29 April, referred to in Article 2 (k) of Law 15/1980, of 22 April.

2. The report of the Nuclear Safety Board shall be issued in each case within the time limit laid down in the regulatory standard for each procedure, with due regard to the maximum period specified therein for the notification of the decision. The competent body to resolve shall be empowered to agree, in a reasoned manner, to suspend the procedure for as long as it is deemed appropriate to issue the report. The competent body may also, exceptionally and in a reasoned manner, agree to suspend the procedure indefinitely until the report has been issued.

3. The Nuclear Safety Board shall issue the report prior to the decision which the competent authority adopts for the granting of a significant authorisation or modification of an installation or activity which is due to its characteristics or status. could have an impact on a first class nuclear or radioactive installation. Such a report shall be mandatory and binding in the terms laid down in the legislation in force.

4. The reports of the Nuclear Security Council shall be binding and binding on the Autonomous Communities, on the same terms as they are for the General Administration of the State, when the latter have assumed the powers of the General Administration. corresponding.

5. The authorisations or licences to be granted to any general government may not be refused or conditional on security reasons, the assessment of which is the responsibility of the Nuclear Safety Board.

Article 6. Authorisations, licences and favourable assessments.

1. In accordance with Article 2 (i) and (l) of Law 15/1980 of 22 April, the Nuclear Safety Board shall grant and revoke authorisations to entities and undertakings providing services in the field of protection. (a) to grant and renew, by carrying out the relevant tests, the Operator and Supervisor's Licences for nuclear or radioactive installations; likewise, it shall grant the diplomas of Head of the Radiological Protection Service and accreditations to direct or operate X-ray facilities for medical diagnosis purposes.

2. It is also for the Nuclear Security Council to issue, at the request of a party, favourable assessment statements on new designs, methodologies, simulation models or verification protocols related to nuclear safety and the radiation protection referred to in Article 2 (j) of Law 15/1980 of 22 April.

Article 7. Inspection, control and suspension of nuclear and radioactive installations, and of activities, undertakings and entities.

1. In accordance with Article 2 (c), (d), (i) and (r) of Law 15/1980 of 22 April, it is the responsibility of the Council for Nuclear Safety:

(a) Inspect and control nuclear and radioactive installations and the activities, entities and undertakings referred to in points (c), (d) and (i) of that provision; inspect and control installations, equipment, undertakings or activities not subject to the authorisation regime of nuclear legislation referred to in point (r) of that Article, in the event of exceptional or emergency situations; and to inspect regulated practices, activities and entities in Article 2 and in agreement with Royal Decree 783/2001 of 6 July 2001 approving the Regulation on health protection against ionizing radiation.

(b) Agreed to the cessation of the construction of nuclear or radioactive installations and the cessation of the activities listed in Article 2 (c) of Law 15/1980, of 22 April, for the occurrence of anomalies which affect the safety and until such anomalies are corrected, and propose the cancellation of the corresponding authorization if the anomaly is not liable to be corrected.

(c) Agree, in accordance with Article 2 (d) of Law 15/1980, of 22 April, for security reasons, the suspension of the operation of nuclear and radioactive installations and the exercise of activities.

2. The Nuclear Safety Board shall take all necessary measures for the proper implementation of the arrangements set out in the previous paragraph.

3. The Nuclear Safety Board shall, without prejudice to the following paragraph for the cases of manifest danger, adopt the standstill or suspension agreement following the instruction of a procedure in which the hearing shall be given to the owner of the installation or responsible for the activity. That agreement shall specify the technical, administrative or other measures which are deemed necessary for the correction of the anomalies detected and the time limit for their correction.

4. In the event of danger, the Nuclear Safety Board or its inspectors may require the immediate cessation of the works, the operation of the installation or the activity. Furthermore, in exceptional or emergency situations which may affect nuclear safety or radiation protection, the Nuclear Safety Board or its inspectors may require immediate cessation of the operation of the facilities, equipment, undertakings or activities not subject to the authorisation regime of nuclear legislation, taking as many preventive or corrective measures as necessary.

Article 8. Sanctions, warning and warning.

1. In accordance with the provisions of the existing legislation, the Nuclear Safety Council may propose the initiation of a sanctioning dossier with respect to facts which may constitute an infringement in the field of nuclear safety, protection and protection. radiation or physical protection.

2. 3. 4. Article 9. Emergency actions.

1. In accordance with Article 2 (f) and (r) of Law 15/1980 of 22 April, as well as the applicable regulations on nuclear and radiological emergencies, it is for the Nuclear Safety Board to:

(a) Collaborate with the competent authorities in the preparation and approval of the criteria to which the radiological emergency plans and the physical protection plans are to be adjusted, and for the implementation of the external plans emergency.

b) Coordinate, for all aspects related to nuclear safety and radiation protection, measures to support and respond to emergency situations, integrating and coordinating the various agencies and companies public or private whose competition is necessary for the fulfilment of the functions of the Nuclear Safety Board.

(c) Carry out the necessary actions for the prevention and control of exceptional or emergency situations which arise and which may affect nuclear safety or radiation protection, where they originate in installations, equipment, undertakings or activities not subject to the authorisation regime of nuclear legislation, including, where necessary, the direct adoption of protective measures, informing the competent authority.

2. The action of the Nuclear Security Council will be in line with an emergency action plan and will be carried out through an Emergency Response Organization, both of which are approved by the plenary.

CHAPTER II

Regulatory and instruction proposal functions, guides, and circulars of a technical nature

Article 10. Proposal for basic regulation.

The Nuclear Security Council will propose to the government the new regulation and the review of the existing nuclear safety and radiation protection, as well as the regulations on physical protection of nuclear safety. nuclear and radioactive installations and materials, in collaboration with the competent authorities, and which is necessary in accordance with international obligations to be contracted in this field. Within this regulation, the objective criteria for the selection of sites for nuclear installations and for the first category of radioactive materials shall be established, following a report by the Autonomous Communities.

Article 11. Instructions.

1. The technical standards which the Nuclear Safety Council shall lay down in the field of nuclear safety, radiation protection and physical protection shall be referred to as Instructions and shall be binding on the subjects affected by its scope once published in the Official Gazette of the State.

2. In the procedure for drawing up the Instructions, appropriate technical and legal reports shall be issued for the relevant services of the Nuclear Safety Board. In addition, in this procedure, the interested parties will be given a hearing, and the citizens will be informed of the project by means of the appropriate computer and telematic means. Prior to their approval they will be communicated to the Congress of Deputies.

3. In addition, the Nuclear Safety Board, in the field of its powers, may directly refer to the holders of the authorisations, additional technical instructions to ensure, in general, that the conditions and safety requirements for installations and activities, as well as, in particular, for the best compliance with the requirements set out in the relevant authorisation.

Article 12. Security Guides.

1. The Nuclear Safety Board may draw up technical recommendations to the subjects concerned in relation to the existing rules on nuclear safety, radiation protection and physical protection, which shall be referred to as 'Guides'. Security.

2. In the procedure for the preparation of the Security Guides, appropriate technical and legal reports shall be issued for the relevant services of the Nuclear Safety Board. In addition, during the process of preparing them, and through the appropriate computer and telematic means, the citizens will be informed and the corresponding project will be submitted to their comments.

Article 13. Circulars.

The Nuclear Security Council may develop technical documents addressed to those affected by its scope to communicate to them facts or circumstances related to nuclear safety or radiation protection, which shall be referred to as circulars and shall be for information purposes only.

CHAPTER III

Information, advice, and research functions

Article 14. Information to the Government, the General Cortes, the governments and regional parliaments and the local authorities.

1. In accordance with the provisions of Article 11 of Law 15/1980 of 22 April, the Nuclear Safety Council shall transmit annually to both chambers of the Spanish Parliament and to the regional parliaments of those Autonomous Communities in whose territory is based on nuclear facilities, a report on the development of its activities.

2. Likewise, the Nuclear Security Council will keep the government, the Congress of Deputies and the Senate, the governments and the autonomous parliaments, and the Ayuntamos concerned, promptly informed of any circumstances or events that may affect the the safety of nuclear and radioactive installations or the radiological quality of the environment anywhere within the national territory.

For this purpose, information shall be provided for any event or incident that corresponds to a significant security impact, in accordance with the criteria established by the Nuclear Safety Board.

Information will also be provided on the detection of abnormal levels of radioactivity in the environment anywhere in the national territory, once confirmed, as well as those exceptional situations which are present and which may affect nuclear safety or radiation protection, where they have their origin in facilities, equipment, undertakings or activities not subject to the authorisation regime of nuclear legislation.

3. The system of hearings of the Nuclear Security Council, before the competent parliamentary committee, shall be as provided for in Article 11 of Law 15/1980 of 22 April.

Article 15. Advertising of actions, information to public opinion and participation of citizens.

1. In compliance with Articles 2 (n) and 14 of Law 15/1980 of 22 April, the Nuclear Safety Council shall respect in its action the principle of transparency and inform citizens of all relevant facts. relating to the operation of nuclear and radioactive installations, whether inside or outside the facilities, in particular in respect of their safe operation, the radiological impact on persons and the environment, the events and incidents that have occurred, as well as the corrective measures taken to prevent their reiteration. The information shall be made public by the Nuclear Safety Board by means of any computerised and telematic means ensuring its maximum dissemination.

2. Furthermore, the Nuclear Safety Council shall give publicity to the agreements adopted by it, with clear exposure to the matters dealt with, the reasons for the agreement and the outcome of the vote, by means of computer and telematic means. ensure maximum dissemination. By the same means, publicity shall be given, inter alia, to the Instructions and Security Guides approved by the Council, the minutes of the plenary sessions and the Advisory Committee, the minutes of inspection, the Encomienda Conventions formalised with the Autonomous Communities and the Annual Report to Parliament.

3. Information to be disseminated by the Nuclear Safety Board shall be kept up to date and shall be transferred to the public after it has been resolved on the confidential aspects of its content and, where appropriate, respecting the provisions of the The Organic Law 15/1999, of 13 December, of Protection of Personal Data.

4. The provisions of this Article shall not apply when any of the legal grounds for refusal of access to information are met, in accordance with Law 27/2006 of 18 July, which regulates access rights to information, public participation and access to justice in the field of the environment.

5. The Nuclear Security Council shall pay particular attention to the performance of its tasks to the consultation and participation of civil society and all stakeholders in the field of nuclear safety and radiation protection.

6. In accordance with Article 14 (4) of Law 15/1980 of 22 April, the Nuclear Security Council shall promote and participate in the Information Committees and in any other information forums constituted or constituted in the the environments of nuclear installations, by promoting, through them, the dissemination of information, in particular the information on events that have occurred, and participation in preparedness for emergency situations.

Article 16. Advice to the Government, the Public Administrations and the Courts.

1. The Nuclear Security Council shall exercise the advisory role in the field of nuclear safety, radiation protection and physical protection, the Government, the Public Administrations and the Courts, upon request.

2. As a general rule, the Nuclear Safety Council will be related to the Government and the General Administration of the State through the Ministry of Industry, Tourism and Trade, but in cases where this is legally provided for. shall do so to the competent department on the grounds of the matter. Neither the staff nor the members of the plenary may request or accept instructions from any public or private entity in connection with the exercise of the functions of the Nuclear Security Council, as defined in Article 2 of Law 15/1980, of 22 April, and other relevant provisions.

3. The advice to the Autonomous Communities shall be carried out through the Presidency of the Autonomous Communities.

4. Relations with any other bodies or entities, as well as with the Courts, shall be articulated through the person who has the superior authority of the courts.

5. Without prejudice to the foregoing, the Nuclear Security Council may, in such cases as it deems appropriate, be directly addressed to all the bodies of the Public Administrations and Entities being aware of the matters in which it is appropriate. to speak to the Council.

Article 17. Health conditions.

The Nuclear Safety Board shall collect accurate information and advise, where appropriate, on the conditions which may arise in persons from ionising radiation arising from the operation of nuclear installations. or radioactive.

Article 18. Research Plans.

It is up to the Nuclear Security Council to establish and follow up on nuclear safety and radiation protection research plans.

CHAPTER IV

Coordination functions with other agencies, entities or administrations and other functions

Article 19. Relations with foreign organizations and international organizations.

1. The Nuclear Safety Board shall exercise the functions conferred on it in Article 2 (n) and (o) of Law 15/1980 of 22 April and may propose to the Ministry of Foreign Affairs and Cooperation the appointment of members of the Nuclear Safety Board. Spanish delegations attending meetings of Organs or Committees or who are accredited to international organizations with competence in matters of nuclear safety, radiation protection and physical protection.

2. It may also propose to the Government, through the Ministry of Foreign Affairs and Cooperation, the conclusion of Treaties concerning matters of competence of the Council with other States or International Organisations. It may also propose to the Ministry of Foreign Affairs and Cooperation the appointment of members of the Spanish delegations to intervene in the process of negotiation of such Treaties.

Article 20. Communication of security-related facts.

1. The facts which the natural or legal persons at the service of the nuclear and radioactive installations are required to bring to the attention of the Nuclear Safety Council pursuant to Article 13 of Law 15/1980 of 22 April, shall be communicated to the General Secretariat of the Nuclear Safety Board, which shall forward it to the Technical Directorate responsible for the matter. 2. In accordance with the provisions of Article 8a of Royal Decree 1836/1999 of 3 December 1999. Prior to the adoption of the Resolution of the procedure, the holder of the installation and the communication of the facts shall be heard, to whom the decision is to be finally taken.

Article 21. You start the Autonomous Communities.

1. In accordance with the provisions of the additional provision of Law 15/1980 of 22 April 1980, the Nuclear Safety Council may entrust to the Autonomous Communities the carrying out of activities of a material, technical or service nature. their competence.

2. The entrustment of such activities shall be governed by the provisions of Article 15 of Law No 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure, with the responsibility of the Council of Nuclear safety to approve the general criteria for the exercise of these tasks and to dictate how many acts or resolutions of a legal nature are necessary to support or to integrate the specific material activity object of entrusts and monitoring the development of the same.

3. TITLE II

Nuclear Security Council structure

CHAPTER I

Organs of the Nuclear Security Council

Article 22. Top management bodies.

According to the provisions of Law 15/1980 of 22 April, the top management bodies of the Nuclear Security Council are the Plenary and the Presidency, which will act in the exercise of their respective powers with respect to the to the principles set out in Article 4.3 of the said Law 15/1980 of 22 April.

Article 23. Other management and advisory bodies.

1. They are the governing bodies of the Nuclear Security Council, under the direction of the Presidency and the Plenary, the General Secretariat of the Nuclear Safety Council, the Technical Directorate for Nuclear Safety, the Technical Directorate for Radiological Protection, the Directorate of the Technical Cabinet of the Presidency and the Subdirectorates referred to in Articles 39 and 40 of this Statute.

2. The Advisory Committee and the Technical Advisory Committees are the advisory bodies of the Nuclear Security Council.

CHAPTER II

The Plenary

Section 1-The competence and composition of the plenary session

Article 24. Powers of the plenary session.

1. It is for the plenary of the Nuclear Security Council, as a collegiate management body, to exercise all the functions of the resolution, advisory, supervisory and regulatory functions in the field of nuclear safety and radiation protection provided for in the Article 2 of Law 15/1980 of 22 April. It also corresponds to the exercise of any other functions attributed to the Nuclear Security Council, as the only body responsible for nuclear safety and radiation protection. The plenary shall adopt all the necessary arrangements for the proper implementation of these tasks.

2. It is also for the exercise of the following powers:

(a) Approve the rules for the development of the regulatory provisions of its operating system contained in this Statute.

b) Approve regulatory and regulatory policy initiatives that, prior to the commencement of their processing, are submitted for approval by members of the plenary, or by the governing bodies of the Nuclear Security Council.

c) Approve the preliminary draft budget, establish guidelines for its implementation, and carry out the monitoring and monitoring of its compliance, without prejudice to the internal control to be carried out by the General Intervention of the State administration, in accordance with the terms laid down in Law 47/2003 of 26 November, General Budget, in accordance with the provisions of Article 67 of this Statute.

d) Approve the Strategic Plan, the Annual Plan of Work, the Plan of Research and Development, the Plan of Action for Nuclear and Radioactive Emergencies, the Equal Opportunities Plan for Women and Men, the Plan of publications, the Training Plan and the Social Action Plan.

e) Examine the annual accounts once audited by the General Intervention of the State Administration and before its surrender to the Court of Auditors.

f) Approve the annual report on the development of the activities of the Nuclear Security Council.

g) Report the proposal for the appointment of the Secretary-General of the Council and the Technical Directors of Nuclear Safety and Radiological Protection.

h) To be heard in the appointment of the Director of the Technical Cabinet of the Council Presidency.

i) Name and separate the Subdirectors.

j) Designate the Vice President of the plenary session among its members.

k) Report the proposal for the designation of national or foreign experts from the Advisory Committee and the Technical Advisory Committees.

(l) to authorize, on a prior basis, the acquisition of the real estate of the Nuclear Security Council, in accordance with the provisions of Article 36.1.n.

m) Authorizing the proposal for the conclusion of international cooperation agreements or agreements, as well as the conclusion of agreements and contracts which, by reason of their size or importance, is determined by the agreement of the Full.

n) Approve the basis of the calls for the selective procedures for access to the Nuclear Safety and Radiological Protection Corps.

r) Approve the criteria to which the Function Encomienda agreements must be adjusted with the Autonomous Communities.

s) To exercise any other jurisdiction that is necessary for the proper performance of the functions assigned to it by the current regulations.

3. The Plenary Session may delegate to the President or the General Secretariat the exercise of its functions, in accordance with the provisions of Article 13 of Law 30/1992 of 26 November.

4. The plenary session may agree to the establishment of the internal working committees for the exercise of the specific tasks to be determined and in respect of which the final decision corresponds to the plenary session. Those committees may adopt their own rules of operation. The chair of these committees shall be a member of the plenary session, who shall report to that body.

Article 25. Composition, appointment and duration of the mandate.

1. The plenary session, the senior management body of the Nuclear Security Council, is made up of a president and four members.

2. The Chairman and the Directors of the Nuclear Security Council shall be appointed among persons of known solvency in the matters entrusted to the Nuclear Security Council, in the terms laid down in Article 5.1 of Law 15/1980, of 22 April, the establishment of the Agency.

3. The President and the members of the Nuclear Security Council shall be appointed by the Government, by means of Royal Decree, on the proposal of the Minister of Industry, Tourism and Trade, after the person proposed for the position before the of the Congress of Deputies, which will deal with the candidate's capacity. Article 26. The Counselors.

1. Corresponds to the Directors:

a) Attend with voice and vote to the plenary sessions and participate in the debates.

b) Discuss, challenge or defend reports and opinions, proposing their modification, acceptance or dismissal, being withdrawn or left on the table or having a background expanded.

c) Exercise their right to vote and formulate, where appropriate, a particular reasoned vote when they disagree with the opinion of the majority.

d) to be responsible for the management of matters which, in the opinion of the plenary session, given its entity or special nature, are to be considered to be addressed or addressed directly by the Counsellor or Directors to be appointed and, where appropriate, to prepare opinions on cases in which they are appointed as rapporteurs by the plenary session.

e) Submit requests and suggestions for inclusion on the plenary agenda, as well as regulatory policy initiatives or proposals for new regulations, in accordance with Article 24.2.b, which have followed the procedure provided for in that Article, for inclusion on the agenda of the plenary session.

f) Represent the Nuclear Security Council in those acts or meetings in which the President agrees, upon acceptance.

g) Act as Vice President or Secretary when appropriate.

2. Members shall have full access to all information on the Agency. The request for information may be made directly or through the General Secretariat of the Council.

Article 27. Incompatibilities.

1. The charges of President and Directors are subject to the regime of incompatibilities of the High Charges of the General Administration of the State established in Law 5/2006, of April 10, of regulation of the conflicts of interests of the members of the Government and of the High Charges of the General Administration of the State, and in its implementing provisions, as well as in the Agreement of the Council of Ministers of 18 February 2005, for which the Code of Good Government of the Members is approved of the Government and the High Charges of the State Administration.

2. When they cease to be in office and for the following two years they may not engage in any professional activity related to nuclear safety and radiation protection.

Article 28. Duty of stealth.

Members of the plenary session shall keep the secrecy, even after their duties have ceased, of any confidential or confidential information that they have been aware of in the performance of their duties.

Article 29. Eesc.

1. The Chairman and the Board of Directors of the Nuclear Security Council shall cease for the reasons set out in Article 7 of Law 15/1980 of 22 April.

2. For the purposes provided for in the last paragraph of Article 7.1 of Law 15/1980 of 22 April, the Secretary-General of the Nuclear Security Council shall communicate to the Congress, in respect of the President or Counsellor, who is in a situation of extension. in the performance of their duties, the date on which the extension exceeds six months.

Article 30. Remuneration and economic compensation.

1. The remuneration of the President and the Directors of the Nuclear Security Council shall be determined by the Minister of Economy and Finance in accordance with the procedure laid down for the High Charges of entities governed by public law.

2. By virtue of the limitation imposed by Article 27.2 of this Statute, in the event of termination of the age of seventy years, the expiry of the term of office, resignation or permanent incapacity for the exercise of his or her duties, the The President and the members of the Nuclear Security Council shall be entitled to receive, from the month following that in which their termination occurs, for a period equal to the period of their term of office and the limit of two years. Section 2-Operation of the plenary session

Article 31. Sessions.

1. The plenary session will meet in ordinary and extraordinary sessions.

At least one session will be held every 15 days.

2. The holding of extraordinary sessions shall be agreed by the President on his own initiative or upon request by at least two members.

Article 32. Constitution.

1. For the valid constitution of the plenary session for the purposes of the holding of meetings, deliberations and adoption of agreements, at least three members shall be required to be present, one of whom shall be the President or who replaces him as Vice-President.

2. The members of the Council must attend the meetings in person. Without prejudice to this, the plenary session may constitute and adopt agreements using electronic means, in accordance with the provisions of the first provision of Law 11/2007 of 22 June 2007, which provides for the electronic access of citizens to Public Services. In any case, the system used shall ensure a multi-directional confidential communication in real time and ensure the unambiguous identification of the respective member and the authenticity of their vote in the same act.

3. The plenary session shall be attended by the Secretary-General of the Nuclear Security Council, with a voice but without a vote, who shall act as secretary of the collegiate body.

Article 33. Call and order of the day.

1. The meeting shall be convened by the Secretary of the Plenary, on the order of the President, at least forty-eight hours in advance of the scheduled time for the commencement of the meeting and with the indication of the day and the place of conclusion of the meeting. However, the plenary session shall be validly constituted when the President and all the members are present, and they shall agree unanimously.

2. The special session shall be convened by the Secretary of the Plenary, on the order of the President, and shall be held within a period of not less than forty-eight and not more than seventy-two hours from that call.

3. The agenda for plenary sessions shall be drawn up by the President, taking into account the requests of the other members, at least 70 and two hours in advance.

4. No matter which is not on the agenda shall not be the subject of deliberation or agreement unless all members of the plenary are present and the urgency of the matter is declared with the favourable vote of all members.

Article 34. Debates and votes.

1. It is for the President of the plenary to direct the deliberations and to moderate the debates, granting and withdrawing the use of the word, guaranteeing the participation of all the members on an equal footing and ensuring respect for the principle of contradiction and reasonably necessary replication shifts.

2. Any Counsellor may request that the deliberation be deferred on any particular matter until the next session, expressing the causes for it. The President shall refuse such a request in the case of an urgent matter which has been declared as such in accordance with the provisions of Article 33.4, or which has already been dealt with in two previous sessions.

3. The President shall have the power to agree to the conclusion of the debate when he considers that the matter is sufficiently addressed.

4. The plenary session shall adopt its agreements by a majority vote of the members present. The President will, if necessary, address the draws with his/her vote of quality.

5. Members of the plenary session of the majority agreement may vote in writing within forty-eight hours, expressing the reasons for the vote.

Members who vote against and those who abstain will be exempt from the responsibility that, if any, could be derived from the agreements adopted.

Article 35. Minutes of meetings.

1. The Secretary-General shall draw up the minutes of the meetings by giving faith to the content of the agreements adopted.

2. The minutes shall necessarily express the attendance, the agenda of the meeting, the circumstances of time and place, the matters dealt with, the reasons for the agreement adopted and the outcome of the vote.

3. They shall, at the request of the respective members, make the vote against the agreement adopted, the abstention and the reasons justifying them or the vote in favour. Furthermore, any member has the right to request the full transcript of his speech or proposal, provided that he or she contributes to the act, or within the time limit indicated by the President, the text that corresponds faithfully with his intervention, This is stated in the minutes or by joining the minutes.

4. The minutes shall be approved in the same or the following session, but may, however, be issued by the Secretary-General certifying the agreements adopted, without prejudice to the subsequent approval of the minutes.

5. Once approved, the minutes will be signed by the Secretary, with the approval of the President and will be given to them through the computer and telematics of the Nuclear Security Council.

6. They shall be kept together with the minutes, opinions and documents supporting the agreements adopted.

CHAPTER III

From the President and the General Secretariat of the Nuclear Security Council

Article 36. The President.

1. The Chairman of the Nuclear Security Council, which shall be the plenary session and the Advisory Committee, shall exercise the following powers:

a) Ostend the institutional representation of the Nuclear Security Council.

b) Present the preliminary draft budget to the plenary session and, once approved by this body, refer it to the Ministry of Industry, Tourism and Trade, for transfer to the Ministry of Economy and Finance and integration into the State generals.

i) To exercise the management, government and disciplinary regime of personnel serving the Nuclear Security Council.

j) Ensure that the decisions taken by the plenary are complied with and that the Presidency is expressly entrusted with it.

k) Approve the expenses of the services, authorize their commitment and settlement and order the corresponding payments.

(l) Exercise the powers on the generation of appropriations and budgetary changes contained in Articles 53.2 and 63.2 of Law 47/2003 of 26 November, General Budget, and the other provisions of that rule attributed.

m) Approve and render the annual accounts, once examined by the plenary.

n) To acquire, with the authorization of the Plenary, real estate or rights on the same, prior to the favorable report of the Minister of Economy and Finance, and to request from the Ministry of Economy and Finance the attachment of goods and rights for the fulfilment of the purposes of the Nuclear Security Council, and the disattachment of such rights when they cease to be necessary.

t) Exercise any other functions inherent in his or her status as President of the Plenary, and as Chairman of a State Public Sector entity, in terms of the applicable regulations.

2. In cases of vacancy, absence or illness, the President shall be replaced by the Vice-President, in the absence of the Vice-President, by the longest-serving Counsellor and, at the same age, by the oldest member.

3. The President may delegate the exercise of his powers in accordance with the provisions of Article 13 of Law No 30/1992 of 26 November 1992. In the event that the delegation is made in a Counsellor, the acceptance of the delegation made shall be a necessary requirement. The plenary session shall be informed of all the delegations of powers by the President.

Article 37. The General Secretariat of the Nuclear Security Council.

1. The Nuclear Security Council shall be assisted by the General Secretariat of the Council, which is the body of management to which it is responsible, under the immediate direction of the President, within the framework of the agreements adopted by the Plenary, and the guidelines issued by the internal committees set up by that plenary, as provided for in Article 24 (4) of this Statute, the provision of services common to the Nuclear Safety Board.

2. The holder of the General Secretariat shall act as plenary secretary and shall attend the sessions of that body with a voice but without a vote. In the case of a vacancy, absence or illness, the minor counsellor shall be replaced by the person who, given his status as a member of the plenary session, shall act with a voice and vote. He shall also act as secretary of the Advisory Committee.

3. It is for the holder of the General Secretariat of the Council for Nuclear Safety, as Secretary of the Plenary Session, to exercise the following functions:

(a) Attend the President and the Directors in the handling of the affairs and demarches of their duties and in the preparation of the plenary meetings.

b) Advise on the legality of matters and issues to be submitted to the plenary.

(c) Call for plenary sessions at the order of its President.

(d) to receive the acts of communication of the members of the plenary, addressed to that body and therefore the notifications, requests for data, or any other kind of writing from which they must be aware.

e) Draft and sign the minutes of the sessions and issue certifications of the agreements adopted by the plenary.

f) Custodian of the files and documents of the plenary.

g) Exercise how many other functions are inherent in your status as the secretary of the collegiate body.

4. It is the responsibility of the General Secretariat of the Nuclear Security Council, the direction, impetus, coordination and supervision of the activities of all the bodies of the Nuclear Security Council, as well as the provision of the services common to it and, in the exercise of the following functions:

a) Legally advise on all matters related to the functions and activities of the Agency.

b) To process and report regulatory proposals, Instructions and Security Guides projects.

c) To process and report the procurement files and conventions held by the Nuclear Security Council.

d) Develop the preliminary draft budget, assume the economic and financial management, accounting and assets of the Nuclear Security Council, manage the recognition, collection and extinction of fees and other rights, and payment and cash services, and the drawing up of annual accounts.

e) Report on the proposal for a resolution of the appeals against acts of the Plenary and the President and the proposal for a resolution of the previous complaints addressed to the Nuclear Security Council.

f) Manage the registry, archive and documentation services and the security and surveillance services of the Nuclear Security Council facilities.

g) Manage the Nuclear Security Council's computer and telematics media, as well as information systems that support corporate processes.

h) Give to the Nuclear Security Council the necessary communications systems, and develop and maintain IT security policies and systems to protect their functioning.

i) Coordinate the development and monitoring of the strategic plan, plans and work programmes, and the implementation of quality improvement measures that are entrusted to it.

j) Develop process assessment and audit mechanisms and conduct the independent internal evaluation of the Agency.

k) Develop the proposal for an annual work plan for the bodies of the Nuclear Security Council and direct its implementation once approved.

l) Develop and submit to the plenary for approval, the Annual Report on the activities of the Nuclear Safety Council.

m) Manage the internal regime of the services and dependencies of the Nuclear Security Council, the equipment of the administrative units, the preservation and operation of the buildings and their facilities, the supplies and the inventory of the movable property.

n) Set the service inspection programs.

n) To hold the direct leadership of the staff, without prejudice to the functions of the plenary and the president.

or) Authorize service commissions, with and without the right to compensation, from the staff of the Nuclear Security Council.

p) Develop the circumstantial relationship of officials from the Nuclear Safety and Radiological Protection Corps.

(q) Raise the proposals on staff and the management of the services of the Nuclear Security Council to the plenary session.

r) Propose plans for staff training, social action, prevention of occupational risks and equal opportunities for women and men.

s) Maintain relationships with the Organ of participation and staff representation.

(t) How many staff and service management functions are attributed to the Sub-secretaries of the Ministerial Departments under the rules of public service and which are not attributed to another organ of the Council of Nuclear Security in this Statute.

u) Coordinate and evaluate the inspection activities of nuclear and radioactive installations.

v) Make the proposal, management and evaluation of the research and development plans and programmes promoted by the Nuclear Security Council.

5. The head of the General Secretariat shall be appointed by the Government, on a proposal from the Minister for Industry, Tourism and Trade, and after a favourable report from the plenary session. The position of Secretary-General may not be held by persons over the age of seventy.

6. The Secretary-General shall be subject to the same incompatibilities as is established with regard to the President and the Directors in Article 27 of this Statute and shall be entitled to receive the financial compensation provided for in the Articles 30.2 and 30.3 of the same. The Secretary-General shall, as provided for in Article 28 of this Statute, keep stealth.

7. Your cessation will occur for any of the following reasons:

a) For seventy years.

b) At your own request.

c) To be understood in any of the incompatibilities provided for in the Constitutional Law of the Council.

d) By decision of the Government through the same procedure established for his appointment.

8. The remuneration of the Secretary-General of the Nuclear Security Council shall be authorized by a joint report of the Ministries of the Presidency and of the Economy and Finance, in the form established in the laws of the General Budget of the State.

9. The General Secretariat of the Nuclear Safety Council depends, as management bodies, on the Technical Directorate for Nuclear Safety and the Technical Directorate for Radiological Protection, with the legal regime, structure and functions that are regulated in the Articles 38 and 39 of this Statute.

10. They are also directly dependent on the General Secretariat of the Council, the Sub-Directorates and Units whose regulation is contained in Article 40 of this Statute.

CHAPTER IV

From the Technical Directorates for Nuclear Safety and Radiological Protection

Article 38. Technical Directions for Nuclear Safety and Radiological Protection.

1. The holders of the Technical Directorates for Nuclear Safety and Radiological Protection shall be appointed by the Government on a proposal from the Minister for Industry, Tourism and Trade, following a favourable report by the Nuclear Safety Board.

2. The holders of such management bodies shall be subject to the same incompatibilities as laid down in respect of the President and the Directors in Article 27 of this Statute. Their remuneration shall be authorized by joint report of the Ministries of the Presidency and of the Economy and Finance, in the form established in the laws of the General Budget of the State.

3. They shall also be kept in accordance with the terms laid down in Article 28 of this Statute.

Article 39. Functions and structure of the Technical Directorates.

1. The following functions are the responsibility of the Technical Directorate for Nuclear Safety:

(a) Develop the motions for resolutions on matters referred to in Article 2 of Law 15/1980 of 22 April concerning the safety of nuclear installations and the transport of nuclear or nuclear substances; radioactive materials, with the exception of medium and low activity radioactive waste storage facilities and decommissioning facilities.

b) Carry out the assessment, inspection and control of the facilities and activities referred to in the preceding paragraph.

(c) Develop proposals for the opening of sanctioning cases and for the adoption of coercive measures, in the cases covered by Law 25/1964 of 29 April on Nuclear Energy, in the areas of their competence.

(d) Initiate, instruct and resolve proceedings initiated under communication by natural or legal persons at the service of nuclear and radioactive installations referred to in Article 20 of this Regulation. Statute, in matters of its competence.

e) Propose the technical standards and research projects necessary for the best performance of their functions.

f) To support the Technical Directorate of Radiological Protection on nuclear safety issues.

2. The following functions are the responsibility of the Technical Directorate for Radiological Protection:

(a) Develop the motions for resolutions in the matters referred to in Article 2 of Law 15/1980 of 22 April concerning the radiation protection of persons, the control and monitoring of the radiological quality of the the environment, the radioactive installations, the control of radiation sources, the companies providing technical radiation protection services, the management of radioactive waste on average and low activity, decommissioning and decommissioning of nuclear and radioactive installations, and emergencies and physical protection plans; and also to deal with the proposals of the Autonomous Communities with an Agreement on Duties in relation to the matters entrusted to them.

b) Carry out the assessment, inspection and control of the facilities and activities referred to in the preceding paragraph.

(c) Develop proposals for the opening of sanctioning cases and for the adoption of coercive measures, in the cases covered by Law 25/1964 of 29 April on Nuclear Energy, in the areas of their competence.

(d) Initiate, instruct and resolve proceedings initiated under communication by natural or legal persons at the service of nuclear and radioactive installations referred to in Article 20 of this Regulation. Statute, in matters of its competence.

e) Propose the technical standards and research projects necessary for the best performance of their functions.

f) Support the Technical Directorate for Nuclear Safety in the issues of radiation protection.

3. The following Subdirections depend on the Nuclear Security Technical Directorate:

(a) The Subdirection of Nuclear Facilities, to which the exercise of the following functions corresponds:

1. Conduct assessments and inspections, as well as formulating proposals, concerning nuclear power plants, fuel production or nuclear treatment plants, and transport of substances nuclear or radioactive materials.

2. Conduct control and monitoring of facilities and activities, referred to in the previous paragraph, including operational experience, and propose the appropriate coercive measures.

3. To maintain a permanent supervision of the activities of the holders at the site of the nuclear power stations, by means of the resident inspectors posted to them.

4. To collaborate with the competent authorities regarding safeguards, when required.

b) The Engineering Subdirection, which corresponds to the exercise of the following functions:

1. Evaluate and inspect the design, construction, and operation of the structures, systems, and components of nuclear facilities, depending on their importance to security and their contribution to risk.

2. To evaluate and inspect the neutronic, thermo-hydraulic and criticality aspects related to the design, construction and operation of the nuclear facilities, as well as the recharging proposals and the behavior of the fuel.

3. Evaluate and inspect the maintenance and management programs of aging nuclear facilities.

4. º Evaluate and inspect the characteristics of site sites to determine their influence on the safety of installations.

(c) The Nuclear Technology Subdirection, which corresponds to the following functions:

1. Evaluate and inspect the test-ablisist analysis of the facilities ' risk and their application to the safety of the facilities and to the greater effectiveness of the regulatory activity.

2. Evaluate and inspect, topics related to training, human factors, and the management system of the headlines, including quality management.

3. Propose the granting and renewal of the licenses for the operating personnel of the nuclear facilities, referred to in paragraphs a.1.) and c. 5th).

4. Develop new methodologies and tools for facility security assessment.

5. Conduct assessments and inspections, and formulate proposals, relating to spent fuel and high-activity waste management, as well as facilities for the storage of the spent fuel.

4. The following Subdirections depend on the Technical Direction of Radiological Protection:

(a) The Environmental Radiological Protection Subdirection, to which the following functions correspond:

1. Conduct assessments and inspections, as well as formulate proposals for the radiological protection of the public and the environment, the radioactive fuel cycle facilities and uranium mines, the decommissioning and decommissioning of nuclear and radioactive facilities in the cycle and the management of low and medium-activity waste.

2. Take control of the facilities and activities referred to in the previous paragraph and propose, where appropriate, the coercive measures that correspond.

3. To monitor and control the radiological quality of the environment throughout the Spanish territory and inside and outside the nuclear and radioactive facilities and to assess the environmental radiological impact of the facilities and of any other activity that could generate it. Perform control of the appropriate entities and facilities required to perform these functions.

4. Propose the granting and renewal of the licenses for the operating personnel of the facilities referred to in paragraph 4 (a) .1 of this Article.

5. Make proposals concerning the control of exposures due to natural radiation and for the management of waste generated in installations that process natural radioactive materials.

6. Make proposals regarding the control of contaminated areas and on post-accidental situations and situations of enduring exposure.

(b) The Subdirection of Operational Radiological Protection, to which the following functions correspond:

1. Carry out assessments and inspections, as well as make proposals for radioactive installations, except those for fuel cycle, for the radiation protection of workers and for the undertakings they provide technical services for radiation protection. Perform the technical coordination of the activities carried out by the Autonomous Communities with the Nuclear Safety Council's Function Encomienda Agreements in these areas.

2. Conduct the control and monitoring of the activities and facilities referred to in the previous paragraph and propose the appropriate coercive measures.

3. Propose the training programmes, the approval of courses and programmes, as well as the granting and renewal of diplomas and licences which demonstrate the training in the field of radiation protection of the operating personnel of the radioactive installations (other than those of the fuel cycle) and of undertakings providing services of radiation protection technicians.

4. Manage the dosimetric control of exposed workers, as well as the activities attributed to the Council in relation to the operational protection of external workers at risk of exposure to ionising radiation by intervention in a controlled area.

5. To make proposals for the radiation protection of patients undergoing diagnostic or treatment procedures with ionising radiation, and to participate in the studies carried out in this field, in collaboration with health authorities.

6. Take control over the technological and physical security of authorized radiation sources and manage the national inventory of high-activity radioactive sources.

c) The Subdirection of Emergencies and Physical Protection, to which the following functions correspond:

1. Conduct assessments and inspections regarding emergency management, internal emergency plans and physical protection of nuclear facilities, activities and materials, and propose the applicable criteria in these materials to the radioactive installations and materials.

2. To collaborate with the authorities in the preparation and approval of the criteria to which the radiological emergency plans and the physical protection plans have to be adjusted, and for the implementation of the external plans of the emergency.

3. To maintain the operational human, organizational and technical means of the Nuclear Security Council, necessary to deal with situations of radiological emergency, whatever its origin, and to manage the coordination of the actions of the Nuclear Security Council in such situations.

4. To carry out the actions that correspond to the Nuclear Security Council in collaboration with national and international authorities for the prevention of illicit trafficking, the radiological control at borders and the prevention of nuclear or radiological crime, as well as Council actions aimed at the recovery and control of orphan radioactive sources.

CHAPTER V

From the Subdirections and Dependent Units of the General Secretariat

Article 40. Sub-Directorates and Dependent Units of the General Secretariat.

1. The General Secretariat of the Council for Nuclear Safety depends on the administrative and legal bodies necessary for the fulfilment of its objectives, and in particular the following Subdirections:

(a) The Subdirection of Personnel and Administration, which corresponds to the exercise of the functions conferred on the General Secretariat, in points (c), (d), (f), (m) (n), (o), (p), (q), (r), (s) and (t) of Article 37 (4) of the This Statute.

(b) The Information Technology Subdirectorate, which corresponds to the exercise of the functions assigned to the General Secretariat, in points (g) and (h) of Article 37 (4) of this Statute.

(c) The Subdirectorate of Legal Counsel, to which it corresponds, in addition to coordinating and managing the relations with the judicial bodies and the defense of the Nuclear Security Council before them, the advice in law and the report on the tasks assigned to the General Secretariat in points (a), (b), (c) and (e) of Article 37 (4) of this Statute.

2. The General Secretariat also relies on the following Units, with the membership and the level of remuneration to be determined in the employment relationship:

(a) The Planning, Evaluation and Quality Unit, which is responsible for the exercise of the functions conferred on the General Secretariat in points (i), (j) and (k) of Article 37 (4) of this Statute.

(b) The Inspection Unit, which corresponds to the exercise of the functions assigned to the General Secretariat in point (u) of Article 37 (4) of this Statute.

(c) The Knowledge Research and Management Unit, which corresponds to the exercise of the functions assigned to the General Secretariat in point (v) of Article 37 (4) of this Statute, as well as the development of the the tasks of knowledge management and the promotion of the exploitation and dissemination of their results; the preparation of proposals for technical training programmes in the areas of nuclear safety, radiation protection and physical protection; and results.

CHAPTER VI

From the organs of assistance to the Presidency and the Councillors

Article 41. Assistance bodies to the Presidency and to the members.

1. The Presidency of the Nuclear Security Council shall be assisted by a Technical Cabinet responsible for fulfilling the specific tasks entrusted to it by the President, as well as those relating to the activities of the Plenary as a collegiate body.

2. The Director of the Technical Cabinet shall be appointed by the Chairman of the Nuclear Security Council, heard by the Plenary, and shall have an organic level of Deputy Director, automatically ceasing when the holder of the charge on which he/she ceases ceases.

3. Members shall, on a temporary or permanent basis, have the means and technical advice to enable them to take decisions with the utmost knowledge, objectivity and independence.

4. The staff of direct support and advice to the President and the Directors shall have the status of any staff, in accordance with the terms laid down in Article 12 of the Basic Staff Regulations.

CHAPTER VII

From the Advisory Committee for Information and Public Participation

Article 42. Functions of the Advisory Committee.

1. In accordance with Article 15 of Law 15/1980 of 22 April, it is for the Advisory Committee to exercise the following functions:

a) Issue recommendations to the Nuclear Security Council to ensure and improve transparency.

(b) Propose to the Nuclear Security Council measures that encourage access to information and citizen participation in matters of the competence of the Nuclear Security Council.

2. Recommendations and proposals issued by the Advisory Committee shall not be binding on the Nuclear Safety Board.

Article 43. Composition of the Advisory Committee and mandate of its members.

1. They are members of the Advisory Committee, the President, the Secretary of the Committee and those mentioned in article 15 of Law 15/1980, of 22 April.

2. The Chair and the Secretary-General of the Committee of the Nuclear Security Council are the Chair and the Secretary-General of the Committee. In the event of absence, vacancy or illness, the Chairman of the Committee shall be replaced by the Vice-Chair of the Nuclear Security Council, and the Secretary, by the member of the Committee appointed by the Chair. Members of the Nuclear Security Council may attend the meetings of the Advisory Committee, with a voice but no vote. Similarly, the holders of the Technical Directorates may attend when they are deemed to be relevant.

3. The national or foreign experts referred to in Article 15 (2) (l) of Law 15/1980 of 22 April, to be integrated into the Advisory Committee, shall be appointed by the President of the Council for Nuclear Safety, favourable report of the plenary session.

4. The members of the Advisory Committee shall remain in office for a term of four years, renewable for the same period for successive periods, except in the case of representatives of the public administrations whose permanence as members of the Committee will be based on the permanence in the position.

5. The members of the Advisory Committee must attend the sessions in person and will be reimbursed for the expenses of travel, accommodation and maintenance that this assistance will cause them in accordance with the provisions of Royal Decree 462/2002, of 24 May, on compensation for service reason.

Article 44. Operating system.

The working arrangements of the Advisory Committee shall be in accordance with the provisions of this Statute and, in addition, to the provisions on the functioning of collegiate bodies provided for in Chapter II of Title II of the Law 30/1992, dated November 26.

Article 45. Sessions, convocation and agenda.

1. The full Advisory Committee shall meet at least once a semester in ordinary session, upon a call made at least 15 days in advance. The plenary session may also be held in extraordinary session, when the President decides, or at the request of half, one of its members, with a minimum of seventy-two hours in advance.

2. The ordinary call shall be made by the Secretary, on the order of the President, and shall include the time, day and place of the meeting to be held, as well as the agenda of the session and the specific documentation on the topics to be discussed.

3. The agenda may be extended or additional documentation shall be submitted by the Secretariat for up to 48 hours before the session is held.

4. The ordinary sessions may be the subject of deliberation and, where appropriate, of agreement, any matter not on the agenda, provided that all members of the Committee are present and the urgency of the matter is declared by the vote. favorable for the majority.

5. The Advisory Committee may obtain from the Nuclear Safety Board such information as it deems necessary for the exercise of its function.

Article 46. Quorum for the establishment and adoption of agreements.

1. The presence of the President and the Registrar, or of persons who replace them, and of at least two-thirds of their members, shall be required for the valid constitution of the Committee on a first call.

It will be possible to open a second call, with a temporary distance of thirty minutes, requiring the presence of the President and the Secretary, or of the persons who replace them, and of three fifths at least, of the members of the Committee

2. The agreements shall be adopted by a majority of the votes of the members present, with the President being drawn on the basis of their vote of quality. The vote shall be secret if a third of the members of the Committee present so agree.

CHAPTER VIII

From the Technical Advisory Commissions

Article 47. Technical Advisory Committees.

1. In accordance with the provisions of Article 4.5 of Law 15/1980 of 22 April, the Plenary Assembly may set up external technical advisory committees, which shall act as an assistance organ for the exercise of their functions. The Commission shall draw up the reports, evaluations and technical studies requested by the plenary session, which shall not be binding on the latter.

2. The appointment of the members of the Committees is the responsibility of the Chairman of the Nuclear Security Council, following a favourable report by the plenary session, among persons who have a recognized solvency in the fields of nuclear safety, technology, protection (a) radiological and environmental, medical, legislation or any other connection with the former, as well as in energy in general or industrial safety. The Commissions shall be composed of a maximum of 10 experts.

3. The Commissions shall be convened at the initiative of its President, with the frequency necessary for the fulfilment of its purposes, adjusting its operation as provided for in this Article and, in the absence of applicable rule, to the provisions of the Law 30/1992, dated 26 November.

4. In order to carry out their work, the Commissions may obtain from the Nuclear Security Council or other entities the necessary collaboration.

5. The participation of experts shall be remunerated in accordance with the provisions of Royal Decree 462/2002 of 24 May on compensation for the service.

6. Without prejudice to the above paragraphs, the plenary may agree to the establishment of an ad hoc Advisory Committee for the exercise of the specific technical advisory functions to be determined. The Advisory Commission will be automatically dissolved once it meets the specific task assigned to it.

TITLE III

From staff to the Nuclear Security Council service

CHAPTER I

General provisions

Article 48. From the staff of the Council.

The personnel serving the Nuclear Security Council shall consist of:

a) The official staff.

b) Work personnel, either fixed, for indefinite or temporary time.

c) The eventual staff.

Article 49. Staff arrangements.

1. Personnel serving the Nuclear Security Council may be a career or employment officer.

2. In any event, the exercise of the functions involving direct or indirect participation in the exercise of public powers or in the safeguarding of the general interests of the State and of the general public exclusively to career officials.

3. The career civil servant of the Nuclear Security Council shall be governed by the provisions of Law 7/2007 of 12 April of the Basic Staff Regulations and the other rules applicable to the official staff of the General Administration of the State, without prejudice to the specificities provided for in this Statute.

4. The labour force shall be governed by labour law, by the conventionally applicable rules and by the provisions of the Basic Staff Regulations applicable to it.

5. The selection of work staff shall be carried out by means of procedures to ensure the guiding principles contained in Article 55 of Law 7/2007 of 12 April of the Basic Staff Regulations.

6. The selective systems of fixed labour personnel shall be the opposition, the opposition, or the merit assessment contest.

7. It shall be for the Chairman of the Nuclear Safety Board to agree to the appointment of staff by the formalisation of contracts, on the basis of the conditions of capacity and requirements required in the call.

8. The Chairman of the Nuclear Security Council may appoint up to a maximum of five advisers and other staff in accordance with the terms laid down in the Basic Staff Regulations for the performance of trusted or advisory functions. (a) the budget allocation for this purpose shall be taken into account. In addition, each Counsellor may appoint and cease an adviser to perform such duties, as well as propose to the Presidency the appointment and termination of two persons with administrative support functions. Both the appointment and the eesc shall be free, in any event where the cessation of the President or Counselor to whom the function of trust or advice is provided occurs.

9. The staff of the Nuclear Safety Board shall be required to keep stealth, even after their duties have ceased, of any confidential or confidential information which they have been aware of in the performance of their duties.

Article 50. Sub-directors.

The Deputy Directors will be freely appointed and terminated in their jobs, by agreement of the Plenary, on a proposal from the Chairman of the Nuclear Security Council, based on principles of merit and capacity, competence (a) professional and experience, and criteria of suitability, carried out by means of procedures which guarantee the publicity and concurrency, between career officials of group A, Subgroup A1, of those referred to in Article 76 of the Basic Staff Regulations The Public Employee. Their designation shall be carried out by means of procedures which ensure advertising and remain in active service in their respective bodies.

Article 51. Management of posts.

1. The Nuclear Security Council will have a working relationship of official staff, and another employment relationship of the workforce.

2. In the list of posts of official staff, the posts to be carried out by official staff, as well as the names of posts, professional classification groups, bodies or scales, if any, shall be recorded by official staff. which are attached, the provision systems and the supplementary remuneration.

Article 52. Provision of jobs.

1. The provision of posts of official staff shall be carried out by means of the procedures for competition and free designation with a public call, in accordance with the provisions of the employment relationship. In any event, the posts of the Deputy Directors shall be provided by the system of free designation.

2. The provision of employment staff positions shall be carried out in accordance with the provisions of the relevant applicable collective agreements and, failing that, by the system of provision of career civil servants ' posts.

3. The corresponding calls for the provision of jobs shall be approved by resolution of the Chairman of the Nuclear Security Council, in similar terms to those established for the General Administration of the State.

4. The Nuclear Safety Board shall determine the content of the calls and select their staff by means of their own selection bodies, which shall ensure the principles of equality, merit, capacity, publicity, access to employment of persons with disability and equal treatment between men and women.

5. Personnel serving the Nuclear Security Council shall be entered in the Central Register of Personnel of the General Administration of the State or in that State which is established at any time by the legislation in force.

Article 53. Professional career.

Official staff providing services at the Nuclear Safety Board shall be recognised as having their right to progression within an evaluable professional career, in accordance with the provisions laid down in Law 7/2007, of 12 April, of the Basic Staff Regulations. The Council Plenary shall approve the professional career system of such official staff, taking into account, in particular, the specificity of the Nuclear Safety and Radiological Protection Corps.

Article 54. Performance evaluation.

In the framework of human resources policy, and in accordance with the principles laid down in Law 7/2007 of 12 April of the Basic Staff Regulations, an evaluation system will be established to serve as an instrument objective for the assessment of the performance of the job, for the purposes of remuneration and professional career of the staff at the service of the Agency. The relevant evaluation system, which will enable the collective income of the units to be assessed, as well as an individual assessment of the performance of each job, will be approved by the plenary.

CHAPTER II

From the Nuclear Safety and Radiological Protection Corps

Article 55. Legal regime.

1. The technical staff of the Nuclear Security Council shall be composed of the officials of the Nuclear Safety and Radiological Protection Corps, which constitutes a special body, and is integrated into two Escalas: Superior Scale and Technical Scale, classified in Group A, Subgroup A1 and Subgroup A2, respectively, of those listed in Article 76 of the Basic Staff Regulations.

2. The system of entry, provision of posts, administrative situations, professional promotion, mobility, incompatibilities and other rights and duties of the officials of the Nuclear Safety and Radiological Protection, will be the same as the of officials of the General Administration of the State, governed by its provisions of general application, without prejudice to the specificities contained in this Statute, derived from the functional scope of that body.

Article 56. Functions.

1. Officials of the Higher Scale of the Nuclear Safety and Radiological Protection Corps shall perform functions of management, study and evaluation, inspection and control, proposals and reports, relating to missions which are legally and regulations competence of the Nuclear Security Council, developing any other superior administrative character that is required.

2. The officials of the Technical Scale of the said Corps will perform functions of support and collaboration in which they correspond to the officials of the Higher Scale, as well as those of study and evaluation, inspection and control and proposals and reports they are entrusted, appropriate to the requirements and tests required for entry on this Scale.

Article 57. Selection.

1. The selection of candidates for entry into the Nuclear Safety and Radiological Protection Corps shall be made by means of opposition, which shall be governed by the basis of the convocation approved by the Plenary.

2. For the entry into the Nuclear Safety and Radiological Protection Corps, in any of the two Scales that integrate it, it will be necessary to be in possession of the undergraduate degree or Graduate. Likewise, and in the terms provided for in the third transitional provision of Law 7/2007, of 12 April, of the Basic Staff Regulations, they will enable the official university degrees of Doctor to be entered on the Higher Scale. Graduate, Engineer or Architect and for the entry in the Technical Scale the official university degrees of University Diplomacy, Technical Engineer and Technical Architect, corresponding all of them to the previous university ordination.

3. The candidates for entry into the Nuclear Safety and Radiological Protection Corps which once exceeded the selective tests, in accordance with the requirements of the call, would have to follow a training program or period of practice, they will be appointed officials in practice by the President, with the rights to be determined in the public service rules of the General Administration of the State.

4. Beyond the training programme or the traineeship period, candidates qualified as eligible shall be appointed as career officials by the President of the Council.

Article 58. Training.

1. The Nuclear Security Council shall promote the mechanisms and instruments necessary for the permanent formation, improvement and technical specialization of the officials of the Nuclear Safety and Radiological Protection Corps, which have the duty to attend, when specifically designated, courses which may be organised on matters relating to the activities of the Nuclear Safety Board.

2. The courses of specialization or training followed by the officials, as well as the certificates of aptitude or diplomas obtained, shall be recorded in their personal file and in the Central Register of Personnel of the General Administration of the Status.

Article 59. Circumstantial relationship.

1. Every five years, by means of a resolution of the Secretary-General of the Nuclear Security Council, the relationship of the officials of the Nuclear Safety and Radiological Protection Corps shall be updated, which shall include at least the following: information:

a) Name and last name.

b) Date of entry.

c) Administrative Situation.

d) Position, position, or destination that you perform.

(e) General number in the relationship of officials.

TITLE IV

Contract and legal assistance scheme

Article 60. General arrangements for procurement.

1. The Nuclear Security Council will adjust its contractual activity to the provisions of Law 30/2007 of October 30, of Public Sector Contracts, with its contracting regime being the own of a Public Administration.

2. In accordance with Article 8.2 of Law 15/1980 of 22 April, the Nuclear Safety Council shall take the necessary measures to ensure that persons or undertakings by the contract are respected by the contract of independence. during the provision of its services. Under no circumstances may it contract the services of persons or undertakings associated with those affected by the services under contract.

Article 61. Legal assistance.

Legal assistance to the Nuclear Security Council, consisting of advice and representation and defence in the Council's judgment, may be the responsibility of the State Lawyers in the State Legal Service, by formalizing the appropriate agreement to the effect in the terms provided for in Law 52/1997 of 27 November of Legal Assistance to the State and Public Institutions.

The Nuclear Security Council may also agree with other entities to provide such legal assistance.

TITLE V

Heritage, budgetary, control of economic and financial management regime

Article 62. Heritage.

1. The Nuclear Security Council shall have its own patrimony, independent of the assets of the General Administration of the State, consisting of the set of assets and rights of which it is a holder.

2. The Nuclear Security Council shall also enjoy the assets of the State Heritage which are assigned to it for the purpose of its fulfilment.

3. The economic resources with which the Nuclear Security Council will count for the fulfilment of its purposes are integrated by the following goods, rights and revenues:

(a) The goods and rights that constitute their assets and the products and income thereof.

(b) The income from the rates and public prices regulated in Law 14/1999 of 4 May.

(c) The allocations to be established annually from the General Budget of the State.

d) Other than legally liable to be attributed to you.

4. In accordance with Article 9 of Law 33/2003 of 3 November 2003, the management, administration and exploitation of the assets and rights of the State's Heritage which are of the ownership of the Nuclear Security Council or which are Under the terms of the present Statute and the Law of 3 November 2003, the provisions of this Statute are subject to the provisions of this Statute.

Article 63. Own goods.

The Nuclear Security Council may acquire all kinds of property and rights for any of the modes admitted in law and in accordance with the procedures laid down in Law 33/2003 of 3 November. The acquisition of real estate or property rights will require the prior favorable report of the Ministry of Economy and Finance.

Article 64. Collection.

1. The management and collection of the fees, public prices and any other public resources whose tax management is attributed to the Nuclear Security Council, corresponds to the said Body, being able to use for the effectiveness of the same the Administrative procedure for aaward.

2. The Nuclear Security Council may agree with the State Administration of Tax Administration to collect the executive period of its public right resources in the form provided for in the General Rules of Collection approved by the Royal Decree 939/2005 of 29 July.

Article 65. Budget.

1. The Nuclear Safety Board shall draw up the preliminary draft budget annually, subject to the provisions of Law 47/2003 of 26 November, General Budget, which it shall forward, through the Ministry of Industry, Tourism and Trade, to the Ministry of Economy and Finance, for its elevation to the Government and subsequent referral to the General Cortes in the General Budget of the State.

3. The implementation and modification of the budget of the Nuclear Security Council shall be governed by the provisions of Law 47/2003 of 26 November, General Budget, which are applicable to it.

4. The Nuclear Security Council may have management bank accounts for all types of income and payments in the Banco de España and in commercial banking.

Article 66. Accounting.

The accounting of the Nuclear Security Council shall be governed by Title V of Law 47/2003 of 26 November, General Budget. Article 67. Economic and financial control.
