In the framework of the austerity plan for public spending and the restructuring plan of the General Administration of the State, the government has taken several decisions during 2010. Royal Decree 495/2010 of 30 April, approving the basic organic structure of the ministerial departments, abolished 30 senior posts, including the Directorate General for International Relations of the Ministry of Foreign Affairs. Education.

Subsequently, Royal Decree 1313/2010, of October 20, restructured the ministerial departments, in order to facilitate the development of the political program of the Government and to achieve maximum efficiency and rationality in its action.

By Royal Decree 1366/2010 of 29 October, the restructuring of the ministerial departments was continued and the basic organic structure of the Ministry of Education was established in Article 7. "the proposal and implementation of the Government's policy in the field of education, vocational training and universities".

Consequently, the organic structure of the Ministry of Education needs to be adapted to the situation described. To this end, it has been chosen to distribute the functions of the suppressed General Directorate of International Relations between the Secretary of State for Education and Vocational Training and the General Secretariat of Universities, with the consequent change. of the General Subdirectorates that perform them.

Moreover, in accordance with Article 18.2 of Law 6/1997 of 14 April, and according to the jurisprudential interpretation of this precept, it is considered appropriate, for a better exercise of its functions and for the attention of the the characteristics of these, to enable the appointment of the head of the Directorate General for the Care, Participation and Employability of University Students to be carried out in favour of the persons who have the characteristics described in the eighth additional provision. In this regard, it is settled case-law of the Supreme Court that the exception to the civil service provided for by such a provision must be based on the specific characteristics of the functions attributed to the general management, which make it advisable not to limit access to the ownership of the management body to officials, extending it to persons who may be suitable for their performance. Within these limits, the margin of discretion or discretion of the Council of Ministers is expressly recognized in order to appreciate what unique characteristics they advise to make use of that power to exempt the general rule of the condition of official to be general manager.

Effectively, the University Strategy 2015, approved by the Council of Ministers of 30 January 2009, defines the future model of the Spanish university system, which will require a new system of governance, in which the The active participation of students will be decisive. The scenario drawing up the European Higher Education Area calls for a new figure of the student as an active subject of his/her training process, with an assessment of the work in and out of the classroom, and the support of the teaching activity and systems tutorials. Since the beginning of this process, in the Bologna Declaration, the participation of students has been continuously underlined in the Declarations that have been shaped, and at the Berlin Ministerial Conference in 2003, the role of the students in the public management of higher education was expressly recognized.

To try to respond to this new demand, the Government approved the Statute of the University Student (Royal Decree 1791/2010, of December 30), which incorporates important new developments in relation to the presence of the students in university life. On the one hand, this provision contemplates an extension of the participation of students in the government of universities and in the design of university policy. Moreover, the Statute attaches particular importance to the activities of guidance and comprehensive care for students, which are set up as a right and, consequently, as a service that universities must organise and provide.

It should be emphasized that the core of the functions entrusted to the General Directorate of Attention, Participation and Employability of University Students is concerned with the implementation of this Student Statute. University. The novelty of these activities that the fulfilment of this task entails explains that, at present, there is no collective of officials attached to the A1 group of qualifications, neither in the teaching field (university and non-university), nor in the university (administration and service personnel), or in the field of general administration, whose initial training is specifically geared to the design and management of these channels of participation and collective representation in the government of public institutions or the organization and coordination of care services to students.

In these circumstances, the ideal profile to exercise the functions attributed to the Director General of Care, Participation and Employability of University Students does not rest in the membership of a body or scale assigned to a certain qualification group, but in the accreditation of a professional experience that is not specifically associated with any civil servants. This circumstance makes it necessary to extend the profile of suitable candidates for the position of Director General for Care, Participation and Employability of University Students to any person who accredits a professional experience in the articulation of processes of collective participation in the government of public institutions and in the organization and coordination of care services and educational guidance. The aim is to be able to take advantage of the skills and experience of people who have developed their career in the public or private sector, having acquired an essential experience in the implementation of new processes and services at the university level.

In its virtue, at the initiative of the Minister of Education, on the proposal of the Minister of Territorial Policy and Public Administration and after deliberation of the Council of Ministers at its meeting on 18 February 2011,

DISPONGO:

Article 1. General organization of the department.

1. The Ministry of Education is the department of the General Administration of the State responsible for the proposal and implementation of the Government's policy in education, vocational training and universities.

It is also up to the Minister of Education, the proposal to the Government of the Spanish position in the international field and the European Union in the matters of the department.

2. The powers conferred on this royal decree shall be understood in coordination and without prejudice to those corresponding to other ministerial departments.

3. The Ministry of Education, under the top management of the head of the department, develops the functions that legally correspond to him through the following upper and managerial bodies:

(a) The Secretary of State for Education and Vocational Training.

b) The General Secretariat of Universities.

c) The Assistant Secretary for Education.

4. As an organ of political and technical support to the Minister there is a Cabinet, with an organic level of Directorate General with the structure established in Article 16 of Royal Decree 1366/2010, of 29 October, for which the organic structure is approved basic of the ministerial departments.

5. The following are the bodies responsible for advising and/or participating in the Ministry of

:

(a) The School Board of the State, which relates to the Ministry through the Secretariat of State for Education and Vocational Training, and which shall exercise the functions conferred upon it by Article 32 of Organic Law 8/1985, July 3, Law on Education, and Royal Decree 694/2007 of June 1, which regulates the School Council of the State.

b) The Council of Universities, which is related to the Ministry through the General Secretariat of Universities, and which will exercise the functions attributed to it in Article 28 of the Organic Law 6/2001, of 21 December, universities.

6. They are consultative bodies of the State, attached to the Ministry of Education, through the Ministry of Education and Vocational Training, the following:

(a) The Superior Council of Art Teachings, which will exercise the functions attributed to it by the Organic Law 2/2006, of 3 May, of Education, and Royal Decree 365/2007, of 16 March, which regulates the Higher Council of Teachings Artistic.

b) The State Observatory of School Coexistence, which will perform the functions attributed to it by Royal Decree 275/2007, of 23 February, which creates the State Observatory of School Coexistence.

7. It is administratively related to the Ministry of Education and the Institute of Spain and the Royal Academies integrated in it.

Article 2. Secretary of State for Education and Vocational Training.

1. The Secretary of State for Education and Vocational Training shall exercise, in respect of the units dependent on it, the powers provided for in Article 14 of Law 6/1997 of 14 April of the Organization and the Functioning of the Administration State General.

Also, it is up to you to perform the following functions:

(a) The top management of the competencies that correspond to the department in the field of education and vocational training.

(b) The direction and impetus of international relations in the field of education and vocational training, as well as the follow-up of the actions of the European Union in this field, and in particular assistance to the Minister in the preparation of meetings of the Council of the European Union, without prejudice to the powers of the Ministry of Foreign Affairs and Cooperation.

c) The management, evaluation and innovation of the teachings referred to in Law 2/2006, of 3 May, Organic Education, as well as the fulfilment of the obligations of the public authorities in matters of education, implementation of vocational qualification and educational innovation programmes and the promotion of equal opportunities in access to education.

(d) the programming and management of education in the field of territorial competence of the Ministry of Education, the development and dissemination of educational guidance derived from existing legislation in the field of education; (a) special arrangements, the drawing up of the rules on state competence relating to educational establishments, as well as the promotion of vocational training and the basic academic management of their teaching.

e) The coordination between higher education, artistic and sports training and university teaching.

f) Promoting equality policies, non-discrimination and universal accessibility in the field of their competencies.

g) The impetus and coordination of relations with the Autonomous Communities and local authorities in the field of education.

(h) The functions provided for in the current legislation corresponding to the State's high inspection.

i) The direction of the policy of teaching staff and the elaboration of the foundations of the legal regime of the teaching public function.

j) The elaboration of proposals for general provisions in the areas of their competence, as well as the relations and consultations with the autonomous communities and the legal operators concerned during their processing.

2. The following management bodies are dependent on the Secretary of State for Education and Vocational Training:

a) The Directorate-General for Territorial Evaluation and Cooperation.

b) The Directorate-General for Vocational Training.

3. As a body of immediate assistance to the Secretary of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 16 of Royal Decree 1366/2010 of 29 October, approving the organic structure of the ministerial departments.

4. It is directly dependent on the Secretary of State for Education and Vocational Training the Deputy Director-General for International Cooperation, who will perform the following functions:

(a) Relations with foreign and international bodies and authorities in matters falling within the competence of the department, without prejudice to the powers of the Ministry of Foreign Affairs and Cooperation.

b) the coordination and monitoring of the actions of the Department related to the European Union in the areas of competence of the department, without prejudice to the powers of the Ministry of Foreign Affairs and Cooperation.

c) The functions related to the services of the department abroad, framed in the Consejeries, Attachaduras and in the Directorates of the Ministry's existing programs in different countries, as well as the management of the Spanish state-owned teaching centers abroad.

(d) Coordination and, where appropriate, the management of international cooperation programmes, of a bilateral or multilateral nature in the areas of competence of the department.

Article 3. Directorate-General for Evaluation and Territorial Cooperation.

1. It is for the Directorate-General for Evaluation and Territorial Cooperation to perform the following tasks:

(a) The promotion and promotion of the relations of coordination and cooperation with the Autonomous Communities and local corporations, in the field of education, and the promotion of the exchange of information between the different Educational administrations, as well as the planning, management and monitoring of cooperation programmes and agreements with the autonomous communities.

e) Coordination and support for the peripheral units of the Department in Ceuta and Melilla, the programming and management of teaching, the functioning of the teaching centres and the coordination of personnel policy teacher in the field of territorial competence of the Ministry of Education.

(f) The promotion of standards for teaching centres, the development of the basic legal system of foreign centres teaching teaching in Spain, in the field of their competences, as well as the management of the register state of teaching centres and the creation of private teaching centres abroad.

g) Basic academic management of Child Education, Primary Education, Compulsory Secondary Education and Baccalaureate and the promotion of the rules on access systems and procedures for admission to the university, in coordination with the General Secretariat of Universities.

h) The basic academic ordination of special regime teachings and the development and dissemination of educational guidance derived from the legislation in force in these teachings, and the adaptation of artistic teachings higher than the European Higher Education Area.

i) The elaboration of the basic regulations in the field of educational concerts, the establishment of guidelines and the minimum modules of the concerted education.

j) Support and innovation programmes aimed at the compensation of inequalities, educational inclusion, attention to disadvantaged sectors in the field of education or care for other areas of social interest.

k) The establishment of guidelines for the issuance of official Spanish titles and the management of the Central Register of non-university titles and the registration of academic titles and non-university professionals.

(l) The approval of the equivalences of scales of qualifications of foreign degrees and studies, in the field of their competences and the approval and validation of these in the field of their competences.

m) The design, planning and direction of the scholarship policy and study aids aimed at students who are taught in the Organic Law 2/2006, of May 3, of Education.

n) The administrative and economic-financial management of textbooks programmes as well as other specific aid for non-university teaching not subject to the general system, which have as their object regulated teachings in The Organic Law 2/2006, of 3 May, of Education (LOE). q) The elaboration of the State System of Education Indicators, and the carrying out of research and evaluation studies of the educational system and the dissemination of information that offer both actions.

2. The following units with an organic level of general sub-direction depend on the Directorate-General for Evaluation and Territorial Cooperation:

(a) The Subdirectorate-General for Territorial Cooperation, which shall exercise the functions assigned to the Directorate-General in paragraphs (a), (b), (e) and (f) of paragraph 1.

(b) The Subdirectorate-General for Academic Management, which shall exercise the functions assigned to the Directorate-General in paragraphs (g), (h), (k) and (l) of paragraph 1.

(c) The Subdirectorate-General of Inspection, which shall exercise the functions assigned to the Directorate-General in paragraphs (c) and (d) of paragraph 1.

(d) General Subdirectorate of Alumni, Participation and Equality, which shall exercise the functions assigned to the Directorate-General in paragraphs (i), (j), (m), (n) and (n) of paragraph 1.

(e) The Institute of Evaluation, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (o), (p) and (q).

Article 4. Directorate-General for Vocational Training.

1. It is for the Directorate-General for Vocational Training to perform the following tasks:

(a) The basic academic management of vocational training courses in the education system and the establishment of vocational training qualifications.

b) The development of the foundations of the legal system of the teaching public function and the coordination of the policy of the teaching staff.

c) The establishment of guidelines for the issuance of official Spanish vocational training certificates.

(d) The approval of the equivalence of qualification scales of foreign qualifications and studies of vocational training, as well as the resolution of convalidations and equivalences between studies of vocational training of the system Spanish education.

e) The elaboration of the training offer applicable to the territory of management of the department in the field of vocational training and initial vocational qualification programmes.

(f) Information, advice and design of strategies in the field of vocational guidance and training, and the development and implementation of plans for the improvement and promotion of vocational training, as well as measures to promote policies for equality, non-discrimination and universal accessibility.

(g) The management and promotion of international relations in the field of vocational training and guidance, participation and collaboration in these matters at European level, as well as the management of support from the Social Fund European.

(h) The management of adult education and the development of the training offer applicable to the department's management territory in this field.

i) The design and development of measures that guide learning throughout life, both through regulated and non-regulated teaching activities.

j) The coordination and organization of Distance Education, as well as the development of teaching materials for this education.

k) The elaboration and implementation of plans for the improvement and promotion of adult education, as well as measures that promote equality policies, non-discrimination and universal accessibility.

l) Participation and collaboration in European and Ibero-American adult education programmes.

m) The development and dissemination of curriculum materials and other supporting documents for teachers, the design of models for the training of teaching staff and the design and implementation of specific programmes, in collaboration with Autonomous Communities, intended for the scientific and didactic updating of teachers.

n) The development and promotion of research, innovations, studies and reports on education and the realization and editing of publications and materials on education, according to the department's editorial program.

n) The elaboration and coordination of actions and regulations for the adoption and development of the Spanish Qualifications Framework, as well as the promotion of actions and regulations for the adoption and development of the Spanish Framework of Qualifications for Higher Education, in coordination with the General Secretariat of Universities.

o) The development and dissemination of materials in digital and audiovisual support in all areas of knowledge, in order to make information and communication technologies an ordinary instrument of work in the classroom for teachers of the various educational stages.

p) The implementation of specific training programmes, in collaboration with the Autonomous Communities, in the field of application in the Information and Communication Technologies classroom.

q) The maintenance of the Department's educational resources portal and the creation of social networks to facilitate the exchange of experiences and resources among teachers.

r) The updated development and maintenance of the National Catalogue of Professional Qualifications and the corresponding modular catalogue of vocational training.

s) The development of the necessary support instruments for the assessment and accreditation of professional skills acquired through work experience and non-formal training pathways.

2. The following units with an organic level of general sub-direction depend on the Directorate-General for Vocational Training:

(a) The General Secretariat for Guidance and Vocational Training, which shall exercise the functions assigned to the Directorate-General in paragraphs (a), (b), (d) and (e) of paragraph 1.

(b) The General Underdirection of Lifelong Learning that shall exercise the functions assigned to the Directorate-General in paragraphs (h), (i), (j), (k) and (l) of paragraph 1.

(c) The Institute for Vocational Training, Research and Educational Innovation to perform the functions assigned to the Directorate-General in paragraphs (m), (n) and (n) of paragraph 1.

(d) The Institute of Educational Technologies which shall exercise the functions assigned to the Directorate-General in paragraphs (o), (p) and (q) of paragraph 1.

(e) The National Qualifications Institute, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (r) and (s).

Article 5. General Secretariat of Universities.

1. The General Secretariat of Universities shall exercise, in respect of the units dependent on it, the powers provided for in Article 16 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

Also, it is up to you to perform the following functions:

(a) The design, planning, coordination, support and supervision of activities related to the management, programming and management of the State General Administration in the field of higher education, as well as the ordering of access tests.

b) The direction and impetus of international relations in the field of higher education, as well as the follow-up of the actions of the European Union in this field, without prejudice to the competences of the Ministry of Foreign Affairs and Cooperation.

c) The development of the European Higher Education Area and participation in the definition of the Ibero-American Knowledge Space.

d) The coordination of training and mobility programmes and actions to be developed in the different units of the General Secretariat.

e) The development of university policy, in coordination with the Council of Universities.

f) The impetus and coordination of relations with the Autonomous Communities in university matters, through the General Conference of University Policy.

g) The preparation and coordination of the standards of development in its field of competence of the Organic Law 4/2007, of 12 April, amending the Organic Law 6/2001, of 21 December, of Universities.

h) The planning, coordination and evaluation of the lines of action and programmes of the 2015 University Strategy, except in the areas of R & D + i where they will be carried out in collaboration with the Ministry of Science and Innovation.

i) The promotion of equality policies, non-discrimination and universal accessibility in the field of their competencies.

j) The promotion and promotion of efficient management of universities in the framework of a fair, sustainable and shared funding system with the Autonomous Communities.

k) The promotion of the basic regulation that favors the implementation of the measures of prevention of occupational risks in the universities that allows the improvement of the level of quality.

l) The promotion of collaboration in the field of scientific research, development and technological innovation of universities with other public and private research and innovation agencies.

n) The elaboration of the proposals for general provisions in the areas of their competence, as well as the relations and consultations with the autonomous communities and the legal operators concerned during their processing.

n) The development of programs aimed at the management and development of university infrastructures and support for teaching, which will facilitate greater efficiency and effectiveness.

o) The promotion and support of the creation of technological base companies arising from the research projects of the universities and the introduction of stimuli for the empowerment of the entrepreneurial culture and the management of the processes of academic incubation, in coordination with the Ministry of Science and Innovation's General Secretariat of Innovation.

p) Collaboration in the coordination of inter-ministerial relations that are necessary to ensure a coherent and integrated approach to issues related to education, research and transfer of knowledge in the university field.

(q) to resolve the remedies which are brought against the decisions of the management bodies which are directly dependent on it and whose acts do not exhaust the administrative route, as well as the appeals against the resolutions of the National Evaluation Committee of the Investigative Activity.

2. The following management bodies depend on the General Secretariat of Universities:

a) The General Directorate of University Policy.

b) The Directorate General for Care, Participation and Employability of University Students.

3. The following bodies are directly dependent on the General Secretariat of Universities with the rank of Subdirectorate General:

(a) The General Sub-Directorate of University Analysis, Studies and Foresight, which will perform the following functions:

1. The elaboration of the memories and statistics derived from the cooperation within the framework of the Council of Universities and the General Conference of University Policy referred to in the Regulations of the two bodies, without prejudice to the powers of the Secretariat.

2. º The support and assistance to the University Observatory of Grants and Aid to the Study, provided for in the second twenty-second provision of the Organic Law 4/2007, of 12 April, amending the Law of the Organic Law 6/2001, of 21 December, from Universities.

c) The General Subdirectorate for Modernization and University Internationalization, which will perform the following functions:

4. The promotion of the participation of Spanish universities in the European Programs related to the modernization of universities, their institutional strengthening and strategies to promote excellence.

The Ministry of Education is attached to the Autonomous Body of European Educational Programmes, through the Directorate General for Care, Participation and Employability of University Students, and the National Agency for Evaluation and Accreditation, through the General Directorate of University Policy.

5. They are administratively related to the Ministry of Education through the General Secretariat of Universities:

a) The National University of Distance Education.

b) The International University "Menendez Pelayo".

6. The College of Spain in Paris depends on the Ministry of Education through the General Secretariat of Universities.

Article 6. Directorate General for University Policy.

1. It is up to the Directorate-General for University Policy to perform the following functions:

(a) The design and planning of university teaching in relation to the competencies that correspond to the General Administration of the State.

b) The preparation of the competition rules of the General Administration of the State regarding university education and access to and admission to the university.

(c) The development of the European Higher Education Area and the promotion of the actions necessary for the adaptation of university degrees.

d) The impetus of the actions and regulations that correspond to the Department in relation to the Spanish Framework of Higher Education Qualifications.

e) The establishment of the conditions and requirements for the verification and accreditation of official Spanish university degrees, degree, master and doctorate and for their registration in the Register of Universities, Centers and Titles This is the additional 20th of the Organic Law 4/2007 of 12 April, amending the Organic Law 6/2001, of 21 December, of Universities, as well as the processing and promotion of the corresponding procedures of verification and accreditation. 2. They depend on the General Directorate of University Policy for the following general sub-directions:

(a) Subdirectorate-General for Academic Coordination and Legal Regime, which shall exercise the functions assigned to the Directorate-General in paragraphs (a), (b), (c), (e) and (g) of paragraph 1.

(b) General Subdirectorate of Qualifications and Recognition of Qualifications, which shall exercise the functions assigned to the Directorate-General in paragraphs (d), (f), (h) and (i) of paragraph 1.

(c) General Subdirectorate of the Training and Mobility of the Teacher, who shall exercise the functions assigned to the Directorate-General in paragraphs (j), (k) and (l) of paragraph 1.

(d) General Subdirection of the Teacher and Teaching Innovation, which shall exercise the functions assigned to the Directorate-General in paragraphs (m), (n) and (n) of paragraph 1.

3. It relates administratively to the Ministry of Education, through the Directorate General of University Policy, the National Evaluation Commission of the Research Activity, regulated in Royal Decree 1086/1989, of 28 August, on remuneration of university teachers.

Article 7. Directorate General for Care, Participation and Employability of University Students.

1. It is up to the Directorate General for Care, Participation and Employability of University Students to perform the following functions:

(a) The implementation of a comprehensive care system for students and university graduates within the framework of the European Higher Education Area, which responds to their needs and demands in the new educational context and social.

b) The promotion of specialized care programs for prospective students, university students, and graduates.

c) The coordination between university teaching and higher education, artistic and sports training.

d) The drive of an inclusive educational environment for attention to diversity and attention to their specific needs.

e) The development of information, training and guidance programmes adapted to the different profiles to facilitate the transition from pre-university stages to the university environment, the choice of university studies, learning process and academic performance and reducing educational failure and dropout rate.

f) The development of information, training and guidance programmes for students in their final phase of studies and graduates to facilitate the transition to the national and international labour market.

g) The development and management of programs to promote employability and entrepreneurship in the university field.

h) The promotion of interaction with the Tutorial Action programmes and the different services of the students and graduates of the Universities to carry out the information, training and guidance actions university, both in the educational process and in the process of professional incorporation of students and graduates.

i) The promotion of action programmes for the participation of students in university life at both political, associative and academic, cultural, social, voluntary or any other activities that contribute value to their comprehensive training.

j) The impetus and implementation of the University Students ' Statute and the Council of State University Students, as well as the incorporation of means and instruments adapted to the participation and improvement of the communication in the student field.

k) The promotion of specific care programmes for university graduates with the aim of facilitating loyalty processes, professional career and access to continuing training.

l) The drive to open and connect the University and the Society through comprehensive care programs for students and graduates.

m) The programming, management and evaluation of the programme to support the activities of student organisations, including communication, mobility and participation in international activities.

n) The design, planning and direction of scholarship policy and study aids to students who are teaching university teaching.

n) The administrative and economic-financial management of the general system of grants and aid to the study, as well as other specific aid not subject to this general system, under the direction of the Secretary of State for Education and Vocational training or the General Secretariat of Universities, depending on whether they have the object of teaching in Organic Law 2/2006, of 3 May, of Education, or in Organic Law 6/2001, of 21 December, of Universities.

o) The promotion of student mobility within the European Union, through the design, planning and, where appropriate, management, of action programmes of a national nature or participation in the design and planning of European action programmes.

p) The promotion of mobility in the international field beyond the community of students and university graduates in coordination with other specialized agencies and institutions.

q) The promotion of the coordination of scholarship programs and aid to the study promoted by the different Public Administrations and by private entities and institutions.

r) The management and promotion of the University Students ' Scholarship, Aid and Academic Performance Observatory.

s) Monitoring, monitoring and evaluation of compliance with the obligations of beneficiaries of grants and public support.

t) The programming and management of actions to promote the excellence of students in transition to the university stages, as well as the convocation, award and delivery of the national awards to the study at the levels university.

2. They depend on the Directorate General for Attention, Participation and Employability of University Students the following general sub-directions:

(a) Subdirectorate-General for Student, Guidance and Professional Insertion, which shall carry out the tasks assigned to the Directorate-General in paragraphs (a), (b), (c), (d), (e), (f), (g), (h), (i), (j), (k), (l) and (m) of the paragraph 1.

(b) Subdirectorate-General for Grants, Aid and Student Mobility, which shall carry out the tasks assigned to the Directorate-General in paragraphs (n), (n), (o), (p), (q), (r), (s) and (t) of paragraph 1.

Article 8. Deputy Secretary for Education.

1. The Deputy Secretary of Education, holds the ordinary representation of the Ministry and the management of its common services, as well as the exercise of the powers referred to in Article 15 of Law 6/1997 of 14 April of the Organization and Operation of the General Administration of the State, and in general, the exercise of the following functions:

a) Support and technical advice to the Minister in the elaboration and approval of the department's action plans.

b) The elaboration and coordination of the Department's general plans for budgetary, personal and remuneration policy, assets, buildings and infrastructure, economic programming and control budget.

c) The impetus, coordination, support and supervision of the department's general provisions-making activities, as well as the efforts related to its publication.

(d) The direction, impetus and management of the functions related to the handling of the affairs of the Council of Ministers, the Government's Delegation Committees and the General Commission of Secretaries of State and Undersecretaries.

e) The promotion and coordination of the relations of the Ministry of Education, with the courts, with the other departments of the General Administration of the State, with the Delegates and Subdelegates of the Government and with the other peripheral organs.

(f) The direction of the inspector's function on the departments, agencies and agencies dependent on the department, in particular as regards the staff, procedure, economic regime, facilities and facilities of the departments, without prejudice to the functions corresponding to the educational inspection.

g) Management of administrative services, rationalisation and computerisation, statistics, administrative information and documentation and the dispatch of cases not attributed to competition from other higher bodies of the department.

h) The coordination of the department's actions in the field of gender equality.

i) The articulation of the department's administrative relations with the Institute of Spain and the Royal Academies integrated in this.

2. In particular, the Secretariat shall perform the following tasks:

(a) The study and economic report of acts and provisions with economic-financial impact on expenditure and revenue budgets.

b) The determination of the structure of the programmes and sub-programmes in which the activity of the department is carried out, the preparation and processing of the annual preliminary draft budget, the monitoring of the implementation of the appropriations budget and the processing of its amendments.

c) Monitoring the degree of achievement of objectives with respect to programmes and actions to be determined in the annual State Budget Law.

d) The analysis and coordination of how many financial resources the department has allocated, as well as the coordination and monitoring of the implementation of European or international funds for programmes or programmes projects of the department and its agencies, without prejudice to the functions assigned to other bodies and bodies of the department.

e) The elaboration of the personnel policy assigned to the department and, in particular, its planning and management, by means of the forecast of needs; the proposal of offer of public employment, selection and provision; the proposal of changes in the relationship of jobs; the provision and monitoring of staff expenditure, as well as all aspects arising from the application of the rules in this respect, the provision of staff and remuneration and payroll.

h) The relationship with trade union organizations and other representative professional associations.

i) The functions of enabling and paying the ministry, except in cases where the specific procedures of actions of a particular unit of the ministry require placing in them a payment box of its own. It shall also exercise the powers relating to the central unit of the department.

j) The internal system of the department's central services, the equipment of the administrative units, the preservation, intrend, operation and safety of buildings, supplies, training and updating the inventory of their movable property, as well as the supervision of the Ministry's works projects, where appropriate.

k) Assistance and support to the procurement table.

(l) the property management of the buildings which the department uses for any title, except that it is directly attributed to another body or body, as well as the preparation of the reports and technical studies on those or on any other building when required.

3. It is up to the Assistant Secretary for Education, the Technical General Secretariat, to exercise the powers provided for in Article 17 of Law 6/1997 of 14 April, of the organization and operation of the General Administration of the State, as well as the provided for in Article 9 of this royal decree.

4. The following units with organic level of general subdirection are also dependent on the Subsecretariat:

(a) The Budget Office, which shall exercise the tasks assigned to the Secretariat in paragraph 2 (a), (b), (c) and (d), in addition to those corresponding to its specific rules.

(b) The General Staff Subdirectorate, which shall exercise the functions assigned to the Subsecretariat in paragraphs (e), (f), (g) and (h) of paragraph 2.

(c) The General Staff, which shall exercise the functions assigned to the Subsecretariat in paragraphs (i), (j), (k), (l), (m) and (n) of paragraph 2.

(d) The General Subdirectorate for Information and Communications Technologies, which shall exercise the functions assigned to the Subsecretariat in paragraph 2 (n).

5. The following units with organic level of general sub-direction are also dependent on the Subsecretariat:

(a) The Technical Cabinet, as an organ of support and immediate assistance to the Assistant Secretary.

(b) the Department's General Inspection of Services, which is responsible for the implementation of the departmental inspection programmes and the assessment of the functioning of the dependent centres and agencies; or assigned to the department, as well as the other functions assigned in the current regulations.

6. They are attached to the Education Secretariat, with the functions assigned to them by the provisions in force, and without prejudice to their dependence on the Ministries of Justice and the Economy and Finance, respectively, the following bodies General sub-direction organic:

a) State advocacy.

Article 9. Technical General Secretariat.

1. The Technical General Secretariat is the governing body of the Department which exercises the powers provided for in Article 17 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, and in particular the The following functions:

a) The elaboration and proposal of the department's legislative program and the coordination and momentum of its implementation once approved.

(f) The registration of the agreements signed by the department with other public administrations, companies and bodies, both public and private, that are excluded from the scope of Law 30/2007, of Contracts Public Sector.

g) The processing and proposal for the resolution of administrative appeals against the provisions and acts of the department and its dependent bodies, of the procedures for the review of trade, of complaints of liability and of claims prior to the civil court.

h) The processing and proposal for the resolution of the procedures for exercising the right of petition.

(i) Relations with the courts and courts of justice, for the purposes of referral of the files and documents they request, the receipt of their notifications and the preparation of the execution of their judgments, without prejudice As provided for in the current regulations on representation and defense in the State and other public institutions.

o) The management of the competencies of the Ministry of Education in respect of foundations whose protectorate corresponds to this department.

2. The following units with an organic level of general sub-direction depend on the Technical General Secretariat:

(a) The Technical Vice-Secretary-General, who shall perform the tasks assigned to the Technical Secretariat in paragraphs (a), (b), (c), (d), (e) and (f) of paragraph 1.

(b) The Subdirectorate-General for Resources, which shall carry out the tasks assigned to the Technical Secretariat in paragraph 1 (g), (h) and (i).

(c) The Bureau of Statistics, which shall exercise the functions assigned to the Technical General Secretariat in paragraphs (j), (k) and (l) of paragraph 1.

(d) The General Secretariat for Documentation and Publications, which shall exercise the functions assigned to the Technical Secretariat in paragraphs (m) and (n) of paragraph 1.

3. It also depends on the Technical General Secretariat, with the level to be determined in the relation of jobs, the Division of Foundations and Attention to the Citizen, which will exercise the functions attributed to the Technical Secretariat in the (n) and (o) of paragraph 1.

Additional disposition first. Removal of organs.

1. The General Directorate for Training and University Orientation is hereby deleted.

2. The following units with organic level of general sub-direction are deleted:

a) Subdirectorate General of Modernization and Promotion of University Research.

b) General Secretariat for University Coordination.

Additional provision second. No increase in expenditure.

The application of this royal decree will be made without an increase in the operating costs of the respective management bodies and will not increase public expenditure.

Additional provision third. Peripheral organization of the department.

The peripheral units of the Ministry of Education in the cities of Ceuta and Melilla depend on the department through the Ministry of Education and Vocational Training.

Additional provision fourth. Functional areas of high education inspection.

The functional areas of the High Inspection of Education integrated in the respective Government Delegations and governed by Royal Decree 1330/1997, of August 1, and other rules that apply to them, are functionally dependent of the Ministry of Education through the Directorate-General for Territorial Evaluation and Cooperation.

Additional provision fifth. Supply of the heads of the management bodies.

In cases of vacancy, absence or illness, the following regime of higher organs and managers of the department is established:

(a) The holders of the organs referred to in Article 1.3 shall replace each other, following the order in which they are mentioned, unless the Minister establishes another order of replacement.

b) The Directors-General and the Technical Secretary-General of the department will be replaced by the Deputy Directors General of their dependency, following the order in which they appear mentioned for the first time in this royal decree, unless the hierarchical superior common to all of them expressly establishes another replacement order.

Additional provision sixth. Regulatory references to deleted organs.

The references that are made in the legal order to the organs that are deleted by this royal decree will be understood to be those that are created, replaced or assume their competences in this same norm.

Additional provision seventh. Subrogation in the obligations of the College of Spain in Paris.

From the moment of its constitution, the " Fondation College d' Espagne. Cité Internationale Universitaire de Paris " shall be subrogated to the rights and obligations of the College of Spain in Paris and, in particular, to the rights and obligations arising from employment and service relations, in accordance with the provisions of its Statute.

Additional disposition octave. Exception in the appointment of Directors-General.

In consideration of the specific characteristics of the functions of this management body, in accordance with the provisions of article 18.2 of Law 6/1997 of 14 April, the appointment of the head of the Directorate-General for Attention, Participation and Employability of University Students may also be carried out among persons who do not have the status of an official, provided they demonstrate a professional experience in the articulation of participation processes collective in the government of public institutions and in the organization and coordination of educational care and guidance services.

Single transient arrangement. Units and positions of lower rank to General Subdirection.

1. The units and jobs with a lower organic level to the General Subdirectorate will continue to remain and will be paid from the same budgets, until the corresponding job relationship of the Ministry is approved. of Education adapted to the organic structure that is approved by this royal decree.

2. The units and posts of work in the organs removed by this royal decree shall be provisionally attached, by means of a resolution of the Deputy Secretary, until the new employment relationship, to the new bodies, is in force. regulated in this royal decree, depending on the attributions they have assigned.

Repeal provision. Regulatory repeal.

Royal Decree 1086/2009 of 3 July 2009 is repealed and the basic organic structure of the Ministry of Education is modified and developed and the provisions of equal or lower rank are contrary to the provisions of the this royal decree.

Final disposition first. Amendment of Royal Decree 1366/2010 of 29 October, approving the basic organic structure of the ministerial departments.
