Order EDU/1603/2009 of 10 June, establishing equivalences with the degrees of Undergraduate in compulsory secondary education and of Bachiller regulated in the Organic Law 2/2006, of 3 May, of Education recognising the learning acquired by adults, by promoting their continuity in education and training, in order to provide them with a quantitative and qualitative improvement in employment.

Article 6 of that order provides that applications for equivalences for professional purposes from other studies not covered by it shall be addressed to the competent authority of the relevant Autonomous Community and require a mandatory and binding report from the Ministry of Education in the event that the Ministry of Education has not established the relevant criteria to be applied for its resolution.

Since the entry into force of the order and after the study of the applications for equivalences not contemplated in it, have been established, with the participation of the units responsible for this task in the different Communities Autonomous, new criteria of equivalence for professional purposes with the degrees of Undergraduate in Secondary Education Obligatory and of Bachiller, which are being applied by the educational administrations through individualized resolution. In view of the fact that some of these criteria may be accredited with documents of easy recognition, it has been considered appropriate to incorporate them in order to simplify administrative procedures in this way by eliminating the need for issue such individualized resolution.

Royal Decree 1892/2008 of 14 November 2008 governing the conditions for access to formal university teaching and the procedures for admission to Spanish public universities in their additional provision (1) (c), which may be carried out by the proof of access who are in possession of the certificate certifying that they have passed the Pre-University Course.

On the other hand, through the Resolution of the General Directorate of the Teachings of 16 October 1978 the implementation by the Directors of the Baccalaureate Institutes was arranged, the validation of ecclesiastical studies for incorporation into the third course of Unified and Polivalent Baccalaureate.

Also, to study the studies leading to the title of Primary Teacher, the only access requirement was to have completed the Elementary Baccalaureate. This Master's degree was later approved to that of Diplomacy and some of these Masters have taught and continue to teach classes in the first two courses of compulsory secondary education.

In these cases, it seems appropriate to recognize the equivalence to all the effects of the studies completed with the degree of Graduate in Compulsory Secondary Education or from Bachiller.

For all of the above, in its virtue, consulted the Autonomous Communities within the Conference of Education and prior report of the School Council of State, and with the prior approval of the Third Vice President of the Government and Minister for Territorial Policy and Public Administration, I have:

Single item. Amendment of the Order of the EDU/1603/2009 of 10 June, establishing equivalences with the degrees of Undergraduate in compulsory secondary education and of Bachiller regulated in the Organic Law 2/2006, of May 3, of Education.

1. New wording is given to Article 2 of Order EDU/1603/2009 of 10 June 2009, in the following terms:

" Article 2. Equivalence to all effects.

1. The equivalence of partial studies of the Unified and Polivalent Baccalaureate of Law 14/1970, of 4 August, General of Education and Financing of Educational Reform, with the degree of Graduate in Secondary Education Mandatory to all effects, provided that you have a maximum of two pending subjects in the set of the first two courses of the Unified and Polivalent Baccalaureate.

2. The equivalence of 6 full courses of Humanities and at least 1 of Philosophy, or 5 of Humanities and at least 2 of Philosophy, of the ecclesiastical career with the degree of Undergraduate in Secondary Education Required for all intents and purposes is established.

3. The equivalence of the Certificate of accreditation of having passed the Preuniversity Course established in the Law of 26 February 1953, on the Management of the Middle Teaching, with the title of Bachiller of the Organic Law 2/2006, of 3 of May, Education, for all intents and purposes.

4. The equivalence of the official title of Master or Master of Primary Teaching is established, with the title of Bachiller for all intents and purposes. "

2. New wording is given to Article 3 of Order EDU/1603/2009 of 10 June 2009, in the following terms:

" Article 3. Equivalence for professional purposes with the degree of Undergraduate in Compulsory Secondary Education.

1. The improvement of the test of access to the professional teaching of plastic arts and design of medium or higher grade, to the professional training of medium or higher grade, to the sports teachings of middle or higher grade or to the teachings Higher arts for over nineteen years, will be equivalent to the degree of Undergraduate in Compulsory Secondary Education, to the only effects of access to public and private employment, provided that one of the following is credited requirements:

a) Haber has exceeded all the subjects of the first two courses of compulsory secondary education.

b) To have completed the average grade cycle and to have exceeded a number of professional modules whose duration is at least half the total duration of the cycle.

(c) Having completed the upper grade cycle and having exceeded a number of professional modules whose duration is at least one-third of the total duration of the training cycle.

d) Have exceeded at least 10 ECTS credits from higher artistic teachings.

e) Credit foreign studies involving a level of education equivalent to that required in the Spanish education system to be incorporated into the third course of compulsory secondary education.

f) You have exceeded all levels of level I of secondary education for adults.

2. They are equivalent to the degree of Undergraduate in compulsory secondary education, to the only effects of access to public and private employment, the elementary Bachelor's degrees derived from the plans of studies prior to Law 14/1970, of August 4, or, failing that, exceeding:

(a) Four full courses of Baccalaureate for any of the plans of studies prior to Law 14/1970, of 4 August, without tests as a whole or without revalidation,

b) Five full years of Technical or Labour Baccalaureate, without set or invalid evidence,

c) Four full courses of Ecclesiastical career Humanities.

3. The Certificate of Primary Studies derived from Law 17/07/1945 of Primary Education and Law 21/12/1965 of Reform of Primary Education, will be equivalent to the only effects of access to public and private jobs, to the degree of Graduate in Compulsory Secondary Education.

4. The accreditation before the competent organ of the Autonomous Community, having gathered in its day the conditions for obtaining the Certificate of Primary Studies derived from the Law 17/07/1945 of Primary Education and the Law 21/12/1965 of Reform of Primary Education, will be equivalent to the only effects of access to public and private jobs, to the degree of Undergraduate in Compulsory Secondary Education.

For the resolution of this equivalence the competent authority of the Autonomous Community shall apply the criteria set out in Annex I of this order.

For applications which do not demonstrate compliance with the requirements of any of the criteria set out in that Annex, the competent authority of the Autonomous Community concerned shall require a mandatory report and binding to the Ministry of Education for resolution.

5. Overcoming the test of access to the university for over twenty-five years will be equivalent to the degree of Undergraduate in Compulsory Secondary Education, to the only effects of access to public and private jobs. "

3. New wording is given to Article 4 (3) of Order EDU/1603/2009 of 10 June 2009, in the following terms:

" 3. The passing of the test of access to the university for more than twenty-five years shall be equivalent to the title of Bachiller, to the sole effects of access to public and private employment, provided that any of the following requirements are established; or either be in possession of the degree of Undergraduate in Secondary Education or equivalent for academic purposes or for professional purposes, or have exceeded at least 15 ECTS credits from university studies.

In this case, the equivalence with the degree of Undergraduate in Secondary Education Required for professional purposes obtained according to the provisions of Article 3.5 of this Order shall not be valid. "

4. A new paragraph 5 is added to Article 4 of Order EDU/1603/2009 of 10 June 2009, in the following terms:

" 5. The accreditation before the competent authority of the Autonomous Community, by means of any of the official documents listed in Annex II, of the improvement of certain studies of artistic teachings, shall be equivalent to the title of Bachelor, to the only effects of access to public and private jobs. "

5. A new paragraph is added to Article 6 of Order EDU/1603/2009 of 10 June 2009, in the following terms:

" Individual equivalence resolutions which, in any case, shall be issued by the relevant educational administration, shall justify the resolution issued indicating the criterion or report issued by the Ministry of Education to be applied. "

6. A new additional provision is added fifth to Order EDU/1603/2009.

" Additional disposal fifth. Certification of higher education.

The references in this order relating to the improvement of 10 or 15 ECTS credits must be replaced by the overcoming of subjects which together at least the sixth or fourth part, respectively, of the the number of credits allocated to the first course, or the exceeding of at least two annual or four monthly courses, in the case of studies prior to those covered by Royal Decree 1393/2007 of 29 October 2007, for which the the ordination of official university teaching, and in Royal Decree 1614/2009, of 26 of October, for which the ordination of the higher artistic teachings regulated by the Organic Law 2/2006, of May 3, of Education is established. "

This order will take effect the day following your publication in the "Official State Bulletin".

ANNEX I

Criteria for the accreditation of having met in their day the conditions for obtaining the certificate of primary studies applicable to Article 3.4

1. Born until 1954 inclusive: Accreditation of six years of compulsory schooling and having an average score of not less than five in the last course, by means of completed education or similar document.

2. Born from 1955 to 1960 inclusive: Accreditation of eight years of compulsory schooling and having an average score of not less than five, by means of a book or a duly completed schooling or similar document

3. Card for the Cultural Promotion of Adults or Certification issued, in their day, by the Provincial Inspection of Primary Education, where the overcoming of the tests carried out for obtaining the Certificate Studies is sufficient Primary.

4. Official certification issued by the corresponding educational administration or by the Center where it obtained the Certificate of Primary Studies with the "Good" of the Inspection, in which the data of the Certificate of Primary Studies, by have obtained it in their day, not being in possession of it by loss or other causes.

5. Official certification of having passed the test called by the Ministry of Education to obtain the Certificate of Primary Studies.

6. Literal birth certificate of the Civil Registry, in which the annotation of having obtained the Certificate of Primary Studies is collected.

7. Certification of the Institute of Middle Education (I.E.S.) to have approved the second general or occupational baccalaureate course as provided for in Article 14 of the Decree of 21 March 1958 on obtaining the Certificate of Primary Studies ("BOE" 4-IV-1958)

8. Certification of the Institute of Middle Education (I.E.S.) to have enrolled in the test of access to the third degree of high school, according to article 15 of Decree 3013/1966, of 17 November ("BOE" 5-XII-1966).

9. Official certification of having exceeded the period of adaptation to the vocational training of the teachings regulated in the Order of 22 July 1971 ("BOE" 19-X-1971).

ANNEX II

Official documents for the accreditation referred to in Article 4.5

1. Title of Professor of Music in the corresponding specialty, regulated in Decree 2618/1966, of September 10.

2. Professional title of music or dance of the Organic Law 1/1990, of October 3, of General Ordination of the Educational System.

3. Diploma of Singer of Opera, issued under Decree 313/1970, of January 29.

4. Supporting documents of the complete improvement of official dance studies, prior to the implementation of the Organic Law 1/1990, of 3 October, of General Management of the Educational System, issued by the music conservatories, the dance conservatories and schools of dramatic art and dance, with an express indication of having completed the teachings that constitute the curriculum.

5. Titles or diplomas corresponding to the teaching of music and of dramatic art to which the equivalence to the degree of qualification for teaching purposes has been granted, by royal decree:

Music:

a) Professional title of music of the plan of 1942.

b) Higher diploma of specialization for soloists regulated in Decree 313/1970, of January 29.

Dramatic Art:

a) Professor's degree and professional title of theatrical actor of the 1942 plan.

b) Dramatic art diploma regulated in Decree 2607/1974, dated August 9.
