Article 10 of Law 11/2007, of June 22, regulates the creation of electronic headquarters as the electronic address available to citizens through telecommunications networks whose ownership, management and administration is a public administration, body or administrative entity in the exercise of its powers.

Moreover, Article 24 of Law 11/2007, of 22 June, sets out the obligation of the Public Administrations to create electronic records for the receipt and referral of applications, written and communications.

In accordance with Articles 3.2 and 27 of Royal Decree 1671/2009 of 6 November 2009, for which the Law 11/2007 of 22 June 2007, of electronic access of citizens to public services, the headquarters and the electronic register is created by order of the relevant Minister or resolution of the holder of the public body.

In accordance with Article 17.1.s) of the Statute of the State Aviation Safety Agency, approved by Royal Decree 184/2008 of 8 February 2008, the Governing Council of that Agency, in its session of 7 April 2011, agrees:

First. Object.-This resolution aims at the creation of the electronic seat and electronic register of the State Aviation Safety Agency, as well as the determination of its operating system.

Second. Scope and features of the electronic headquarters.

1. The scope of the electronic seat under this resolution extends to the entire State Aviation Safety Agency.

2. The characteristics of the electronic seat of the State Aviation Safety Agency shall be as follows:

(a) All actions, procedures and services that are published in its electronic headquarters shall be carried out through the electronic headquarters.

(b) The reference electronic address of the site shall be https://sede.seguridadaerea.gob.es

(c) The holder of the electronic seat shall be the State Aviation Safety Agency and its technological management shall be the responsibility of the General Secretariat.

(d) The identification of the electronic seat shall be carried out by a registered office, consisting of the certificate of the server where the information is hosted or any other certificate of a secure device or equivalent means in accordance with the provisions of Royal Decree 1671/2009 of 6 November 2009.

e) The electronic headquarters of the State Aviation Safety Agency will be available to all citizens for free and permanent. In particular, it shall be accessible through the general access point of the General Administration of the State provided for in Article 9 of Royal Decree 1671/2009 of 6 November 2009.

3. The State Aviation Safety Agency shall be responsible for the integrity, veracity and updating of the information and the services to which it can be accessed through the electronic headquarters, in the terms of Article 7 of Royal Decree 1671/2007, of 11 of June.

Third. Content and services of the electronic headquarters.

1. The electronic headquarters of the State Aviation Safety Agency shall have the content and services available to the citizens provided for in Article 6 of Royal Decree 1671/2009 of 6 November 2009.

2. In addition, the following information shall be available at the electronic headquarters of the State Aviation Safety Agency:

a) Resolution by which the electronic headquarters is created.

(b) Access to the rules whereby electronic seals are created or the obligation to communicate by electronic means is established, all in the field of actions of the State Aviation Safety Agency.

(c) Calendar of non-working days for the purposes of electronic document submission in the electronic register of the State Aviation Safety Agency.

(d) Technical specifications to which the submission of electronic documents in the State Aviation Safety Agency should be adjusted.

e) Interruptions required for indispensable technical reasons.

Fourth. Access channels.-They will be channels of access to the services of the electronic headquarters of the State Aviation Safety Agency:

a) Electronic access, through its electronic headquarters: https://sede.seguridadaerea.gob.es

b) In-person care, in the offices of the State Aviation Safety Agency.

c) Telephone attention, in telephones that are expressed in the electronic headquarters.

Fifth. Ways to formulate complaints and suggestions.

1. The means for the formulation of complaints and suggestions in relation to the content, management and services offered at the venue created by this resolution shall be in accordance with the following:

(a) In-person filing, or by post, in the register of the Agency or of any public body or body, in accordance with Article 38 of Law No 30/1992 of 26 November 1992 on the legal status of the Public administrations and the common administrative procedure, in the light of the provisions of Article 15 of Royal Decree 951/2005 of 29 July 2005 establishing the framework for the quality of the General Administration of the State.

b) Telematics presentation, through the general mailbox of complaints and suggestions available at the electronic headquarters.

2. It shall not be considered as means for the formulation of complaints and suggestions for advice and technical assistance services to citizens in the use of the applications and systems underpinning the seat, without prejudice to their obligation, when exist, to address the issues raised by citizens.

Sixth. Electronic registration of the State Aviation Safety Agency.

1. The State Aviation Safety Agency shall have an electronic register for the receipt and referral of electronic documents in the field of procedures published at its electronic headquarters, every day of the year, during the twenty-four hours of the day.

2. The electronic register shall have the official date and time of the peninsular territory of Spain and shall consist of the date and time of the transaction in the electronic register. Their synchronisation will be carried out in accordance with the provisions of Article 15 of Royal Decree 4/2010 of 8 January, which regulates the National Interoperability Scheme.

The calendar of non-working days to be determined in the resolution of the Secretariat of State for the Civil Service is applicable, setting the calendar of the business days for the purposes of calculating the time limits in the the scope of the General Administration of the State.

Seventh. Competent Organs.

1. The General Secretariat of the State Aviation Safety Agency is responsible for the management of the electronic register.

2. It is for each of the Directorates as well as the General Secretariat of the State Aviation Safety Agency to approve and modify the relationship of electronic procedures and their corresponding electronic documents in the form of their respective areas of responsibility.

Eighth. Admissible documents.

1. Standard electronic documents or forms corresponding to services, procedures and formalities specified in the electronic headquarters of the State Agency shall be permitted through electronic electronic registration applications. Air Safety. The procedures that can currently be processed by electronic means are listed in the Annex.

2. The electronic register shall automatically reject, where possible, the electronic documents referred to in Article 29.1 of Royal Decree 1671/2009 of 6 November 2009, indicating the reasons for the rejection.

If electronic documents are not rejected by the electronic register, it shall be indicated that the presentation does not prejudge the final admission of the document if any of the reasons for rejection contained in Article 29.1 are present. of the aforementioned royal decree.

3. In order to provide standard electronic documents in the electronic register of the State Aviation Safety Agency, citizens must prove their identity by means of any of the electronic signature systems referred to in Article 13.2 of Law 11/2007, of 22 June, of electronic access of citizens to the public services that are admitted to the headquarters.

Ninth. Submission of supplemental documentation.

1. Where standard electronic documents are submitted, electronic documents may be accepted or required to be submitted to it.

2. Where the citizen has opted for electronic filing and must accompany documents which are not available in electronic form and which, by their nature, are not liable to contribute using the intended digitised copy procedure Article 35.2 of Law 11/2007, of 22 June, may provide the same by non-electronic means.

3. The maximum extension of the additional documents may be limited in accordance with the capacity of the available computer tools and communication channels, enabling them to be presented in a split manner and to inform them at the electronic headquarters. of the State Aviation Safety Agency.

4. Whenever electronic documents are submitted separately to the electronic form, the person concerned must mention the individual registration number or code allowing the identification of the file in which the electronic form is to be supplied. effects.

10th. Interruption of service delivery.

1. Where the carrying out of maintenance work or other technical reasons so requires, stops may be planned for computer systems which affect or temporarily prevent the telematic communications service, which shall be announced by the system itself in advance that, where appropriate, is possible.

2. In the case of unscheduled interruptions, the users of the incident shall be informed and the extension shall be communicated which, where appropriate, exists of the time limits for imminent expiration.

11th. Log of seats in the electronic register.

1. The reception and transmission of standard electronic documents shall give rise to the corresponding seats in the electronic register, using secure telematic means for the performance of the seats and the recovery of the data enrollment.

2. Each seat in the electronic register shall be identified with the following data:

a) An individualized registration code.

(b) The identity of the presenter or recipient and, where appropriate, of the representative, by name, national identity document, NIF, NIE, passport or equivalent. For entities, naming, and NIF.

c) The date and time of submission or referral.

d) The identity of the organ to which the electronic document is directed.

e) Procedure or procedure with which it relates.

f) Extract of the content of the electronic document with indication of the existence, if any, of annexes.

g) Any other information that you consider relevant based on the electronic procedure of the seat.

12th. Receipt of presentation.

1. The electronic register shall automatically issue by the same means a supporting document or receipt supporting the submission of the application, written or communication consisting of a copy of the application. Such a safeguard shall ensure the authenticity, integrity and acceptance of the content of the register by providing the citizens with full evidence of the presentation and content of the presentation.

2. In such cases, the data provided by the person concerned shall be recorded, indicating the date and time of the submission and the number of entries in the electronic register, as well as any other information deemed necessary in this case. function of the telematic procedure of the seat, being configured in such a way as to be printed or archived by the person concerned.

By way of derogation from paragraph 7, those standard documents and forms which are available to citizens on the electronic register of the State Security Agency shall be deemed to have been approved. Air at the entry into force of this resolution.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
