Pursuant to Articles 8.2.a) and 10.1 and Law 39/2006 of 14 December of the Promotion of Personal Autonomy and Care for Persons in a Situation of Dependence, the Territorial Council of the System for Autonomy and Attention to Dependence, agreed at its meeting of June 1, 2010, the framework of interadministrative cooperation and criteria for the allocation of credits of the General Administration of the State for the financing during 2010-2013 of the the agreed level, provided for in Law 39/2006 of 14 December, on the Promotion of Personal Autonomy and Attention to Persons in Dependence Situation.

At its meeting of 9 July 2010, the Council of Ministers approved the Agreement establishing the financial commitments resulting from the agreement of the Territorial Council for the Autonomy and Attention to the Dependency on the criteria for the allocation of appropriations by the General Administration of the State for the financing, during the period 2010-2013, of the services and economic benefits of the agreed level, provided for in Law 39/2006, of 14 December, to Promote Personal Autonomy and Care for People in a Situation of Dependence.

Approved by the Council of Ministers at its meeting of 10 June 2011, the Agreement updating the variables provided for in the Inter-Administrative Cooperation Framework and criteria for the allocation of appropriations for the General government of the State for the financing during 2010-2013 of the agreed level, and the distribution of credits of the General Administration of the State is approved, for the financing during the exercise 2011 of the agreed level foreseen in the Law 39/2006, of 14 December, of the Promotion of Personal Autonomy and Attention to Persons in Situation of The publication in the 'Official Gazette of the State' of the said distribution, as set out in the Annex to this Resolution, is appropriate.

ANNEX

Agreement to update the variables provided for in the Inter-administrative Cooperation Framework and criteria for the allocation of credits from the General Administration of the State for financing during 2010-2013 of the level agreed, and the allocation of appropriations of the General Administration of the State, for the financing during the financial year 2011 of the agreed level provided for in Law 39/2006, of 14 December, of Promotion of the Personal Autonomy and Attention to the People in a dependency situation

I. Introduction

Article 8.2.a) of Law 39/2006, of 14 December, of the Promotion of Personal Autonomy and Attention to Persons in Dependence (hereinafter "the Law"), provides that, without prejudice to the powers of each one of the members ' public administrations, corresponds to the Territorial Council of the SAAD, in addition to the functions that it expressly attributes to it this Law, " to agree the Framework of Interadministrative Cooperation for the development of the Law previewed in the Article 10 ".

Likewise, article 10.1 determines that " within the Territorial Council of the System for Autonomy and Attention to Dependence, the General Administration of the State and the Autonomous Communities will agree on the Framework for Cooperation Interadministration to be developed through the corresponding Conventions between the General Administration of the State and each of the Autonomous Communities. "

Article 32.3 states that " the conventions, which may be annual or multiannual, shall include criteria for allocation taking into account the dependent population, geographical dispersion, insularity, returned emigrants and other factors, and may be reviewed by the parties. "

In the first three years of the law, the establishment of the criteria for the distribution of credits for the agreed level has been made on a provisional basis and a limited period of validity for the financial year. course.

however, in order to achieve greater stability within the framework of the SAAD Territorial Council at its meeting on 1 June, a framework for inter-administrative cooperation and a set of criteria for the allocation of appropriations was agreed. General Administration of the State, which contained criteria whose validity extends over the period 2010-2013. This is an agreement that was reported favourably by all the advisory bodies of the System: the SAAD Advisory Committee, the National Council of the Elderly, the National Disability Council, and the State Council of Non-Governmental Organizations of Social Action.

In this way, valid distribution criteria were agreed for the successive financial years until 2013, with the criteria to be used to carry out the distribution of the funds being collected in the framework of cooperation. credits, their percentage weight, and the data to be taken into consideration in relation to each criterion, which will be the most current available from the sources mentioned in it, except in those criteria whose source is the data of the System The Committee of the European Parliament, the Committee of the European Parliament, the Committee of the European Parliament, the Committee of the European of each exercise.

Since all the necessary information is already known, and in accordance with the aforementioned cooperation framework approved last year 2010, the distribution criteria should be updated, in order to make the allocation of the appropriations of the agreed level for the current financial year 2011.

In the General Budget of the State-Social Security Budget-in the Expenditure Budget of the Institute of Older and Social Services, the budget appropriations for the financing of the agreed level are contemplated. of the System for Autonomy and Attention to Dependence.

II. Multiannual criteria for the allocation

appropriations

In accordance with the framework of cooperation approved last year 2010, the structure based on the existence of three economic funds is maintained, each of which is assigned a percentage weight in the distribution of the funds. credits identical to that established last year.

Likewise, and in accordance with the provisions of Paragraph II of the Cooperation Framework approved last year 2010, concerning the multiannual criteria for the distribution of appropriations, the same criteria for distribution and its weight in the distribution. The weight of the criterion 'Potentially dependent population', the rate of which is to be determined, is only amended in accordance with the provisions of paragraph II of that paragraph in the light of the question concerning the annual application of the criteria for distribution. In the case of the distribution, the distribution is reduced from 55% to 20% of the General Fund's appropriations and is increased in a way that is correlated to the weight of the distribution factor "Individual Care Programmes", which goes from 18.90% to 53.9% within the Fund. For all this, the credits of the agreed level of protection are distributed as follows:

a) General Fund, with 80% of the total.

b) Compensation Fund, with 10% of the total.

c) Agreement Compliance Fund, with the remaining 10%.

(a) The General Fund, with 80% of the total available, is destined, as well as the other two funds, to contribute to the financing of the System for Autonomy and Attention to Dependence.

The variables that modulate the content of this fund are related to the characteristics of the territory and to the management performed by each Autonomous Community on a given date, taken as a reference for the whole.

Potentially dependent population: The distribution index corresponding to this variable has been calculated from the distribution of the Spanish population by Autonomous Communities, weighting the population under 65 years of age. 20.57%, the population aged between 65 and 79 years to 26.48% and the population aged 80 years and over to 52.95%. These weights correspond to the age distribution of the applicants for assessment of the situation of dependency recorded at 1 January 2011.

Transposition of the Territorial Council agreements into the autonomous rules: This index will be variable for each Community according to the number of agreements reached by the Territorial Council in each economic year and its effective transposition, if appropriate, into the autonomic rules.

III. Economic quantification resulting from the application of the criteria for the allocation of appropriations for the financial year 2011

The General Administration of the State shall finance the minimum level of guaranteed protection, in accordance with the provisions of Royal Decree 614/2007 of 11 May, on the minimum level of protection of the System for Autonomy and Attention to the A dependency guaranteed by the General Administration of the State, as amended by Royal Decree 99/2009 of 6 February.

2. For the financing of the level of protection agreed, provided for in Article 7 of the Law, in the 2011 financial year, the General Administration of the State contributes to the financing of the SAAD with a budget appropriation of € 283,197,420 to be distributed in accordance with the above criteria.

3. The Autonomous Communities that participate in the level of protection agreed, will contribute to the financing of the System for Autonomy and Care to the Dependence with an amount at least equal to that provided by the General Administration of the State for the minimum and agreed level.

4. The agreements with each of the Autonomous Communities shall determine the actions to be financed with the appropriations of the agreed level of protection, in accordance with Article 10 (4), and the application of the criteria of the the intensity of the services and the amounts of the economic benefits, agreed by the Territorial Council and approved by Royal Decree of the Government.

5. Payment will be done as follows:

75% within the month following the adoption of the present allocation of appropriations by the Council of Ministers, following a demonstration of will by the Autonomous Communities, to formalize with the General Administration of the Status of the agreement referred to in the previous point, in the terms provided for in this agreement.

The remaining 25% to the signing of the Convention.

6. The justification of the commitments arising from the collaboration agreement between the General Administration of the State and each of the Autonomous Communities, for the development of the Inter-Administrative Cooperation Framework and the level of funding At the end of the financial year and no later than 31 March of the following financial year, the minimum level of protection guaranteed by the General Administration of the State shall be carried out in accordance with the conditions laid down for such effects in the collaboration convention.
