Law 11/2007, of 22 June, of electronic access of citizens to Public Services, created the concept of electronic headquarters, justified by "the need to clearly define the" headquarters " electronic administrative establishing relationships, promoting a system of identification, authentication, minimum content, legal protection, accessibility, availability and responsibility. " Article 10.1 of the same law defines the electronic headquarters as " that electronic address available to citizens through telecommunications networks whose ownership, management and administration corresponds to a Public Administration, the administrative body or body in the exercise of its powers. ' Paragraph 3 of the same Article states that "each Public Administration shall determine the conditions and instruments for the creation of electronic venues".

On the other hand, Royal Decree 1671/2009, of 6 November, for which the Law 11/2007, of 22 June, of electronic access of citizens to Public Services is partially developed, in addition to regulating this figure in its Articles 3 to 9 specifically determine in Article 3.2 that "the electronic venues will be created by Order of the corresponding Minister or Resolution of the holder of the Public Body, which must be published in the" Official Gazette of the State ", determining the minimum content of this approval rule. This brings to the citizens guarantees of full certainty and security that only partially reached the virtual offices that have so far been channeling the electronic relations with the citizens.

According to the competition that Article 40.5.c) of Law 27/1992, of 24 November, of ports of the State and of the merchant marine, attributes to the Board of Directors of this Harbour Authority, and in exercise of the Powers expressly delegated to this Presidency by that Council, in session held on 26 February 2010, by means of this Resolution is created the Electronic Headquarters of the Port Authority of Avilés.

In compliance with Article 4.3 of Order FOM/716/2009 of 4 March, regulating the composition and functioning of the Ministerial Committee of Electronic Administration of the Ministry of Public Works, this resolution has been informed by that committee.

In its virtue, I resolve:

First. Object.

This Resolution aims at the creation of the Electronic Headquarters of the Port Authority of Avilés, hereinafter the Electronic Headquarters, in order to comply with the provisions of Article 3 of Royal Decree 1671/2009, of 6 of November, for which the Law 11/2007, of 22 June, of electronic access of citizens to Public Services is partially developed.

Second. Features of the Electronic Headquarters.

1. The scope of the Electronic Headquarters is the totality of the administrative units that make up the Port Authority of Avilés.

2. All actions, procedures and services that require the authentication of citizens or the Public Administration in their relations with these by electronic means, as well as those others, will be carried out through the Electronic Headquarters. in respect of which their inclusion in the seat is decided for reasons of effectiveness and quality in the provision of services to citizens.

3. The electronic address of the headquarters shall be: http://sede.puertoaviles.gob.es. There will be a link to the electronic address http://sede.puertoaviles.gob.es from the portal http://www.puertoaviles.es, using secure communications protocols whenever necessary, as specified in article 10.4 of the Law 11/2007, of June 22, electronic access of citizens to Public Services.

4. The ownership of the Electronic Headquarters corresponds to the Port Authority of Avilés.

5. According to article 3.2.c) of Royal Decree 1671/2009, it corresponds to the Computer Unit of the Port Authority of Aviles the technological management of the Electronic Headquarters. It is up to each of those responsible of the administrative units of the Port Authority of Aviles to update the contents and services of the Electronic Headquarters, in accordance with the rules of organization and operation of the Port Authority.

6. The Electronic Headquarters shall include at least the contents related to the third paragraph of this Resolution.

7. They will be channels of access to the services available at the headquarters:

a) For electronic access, over the Internet, with the characteristics defined in this article and in the following.

b) For in-person care, in the offices of the Port Authority, sitas in the Travesia de la Industria 98, of Avilés.

c) For telephone attention, on telephone 985 54 11 11.

8. The information and services included in the Electronic Headquarters shall comply with the principles of accessibility and usability established in Law 11/2007, in the terms established in this field by the regulations in force at any time.

9. The contents published in the Electronic Headquarters will respond to the criteria of safety and interoperability arising from Law 11/2007 and of Royal Decree 1671/2009, as well as of the Royal Decree 3/2010, of 8 January, for which the Scheme is regulated National Safety and Royal Decree 4/2010 of 8 January, which regulates the National Interoperability Scheme.

10. The identification of the Electronic Headquarters shall be carried out by means of a recognized certificate of venue, consisting of the certificate of the server in accordance with the provisions of Royal Decree 1671/2009.

Third. Minimum content and services of the Electronic Headquarters.

1. The minimum contents to be included in the Electronic Headquarters are:

(a) Updated information on the Electronic Headquarters, including the identification of the seat and the identification of the body responsible for its management and administration.

b) Information necessary for the proper use of the site, including the map of the Electronic Headquarters.

c) Electronic advice services to the user for the proper use of the Electronic Headquarters.

d) System of verification of the certificate of the Electronic Headquarters, directly and free of charge.

e) Relationship of electronic signature systems that are admitted or used in the Electronic Headquarters.

f) Resolution of the creation of the Electronic Headquarters.

g) Electronic Record creation resolution.

h) Access to the Electronic Registry of the Port Authority of Avilés.

i) Access to the contractor's profile and other services provided by the Public Sector Contracts Act.

j) Data protection and privacy policy of the Port Authority and liaison with the headquarters of the Spanish Data Protection Agency.

k) Link to the "Official State Bulletin".

l) Report on compliance with the conditions of confidentiality, integrity and availability of information and communications that are made through the Electronic Headquarters.

m) Accessibility information.

n) Link to the General Access Point of the General Administration of the State.

or) Any information or service that the Port Authority of Aviles considers to be of interest or need.

2. The services available to the citizens to include the Electronic Headquarters are:

a) Catalog of paperwork and services available at the Electronic Headquarters.

b) Electronic Services Charter for Electronic Headquarters.

c) Electronic means that citizens can use in exercising their right to communicate with Public Administration.

d) Link to general suggestions and complaints.

e) Access to the file's fulfillment status through the Electronic Record.

f) Port Authority bulletin board.

g) Official date and time, and days officially declared as non-business.

h) System for verifying electronic seal certificates.

Fourth. Means for formulating suggestions and complaints.

1. The means available for the formulation of suggestions and complaints regarding the content, management and services offered at the Headquarters created by this Resolution shall be as follows:

a) Electronic presentation, through the general mailbox of suggestions and complaints of the Electronic Registry of the Port Authority of Avilés available at its Electronic Headquarters.

b) In-person filing, or by post, before the general registration of this Port Authority, in accordance with the procedure laid down in Article 15 of Royal Decree 951/2005 of 29 July, establishing the general framework for quality improvement in the General Administration of the State.

2. No means shall be considered for the formulation of suggestions and complaints of the electronic advice services to the user for the correct use of the Headquarters, without prejudice to their obligation, when it exists, to attend to the problems arising from them. citizens.

Final disposition. Entry into force.

This Resolution will enter into force on the day following its publication in the "Official State Gazette".
