Royal Decree 1721/2007, of 21 December 2007, establishes the new system of grants and aids to the study, modifying the previously existing centralized management and regulating, with a basic character, the parameters In order to ensure equality in access to these grants and aid to the study without detriment to the regulatory and implementing powers of the autonomous communities. Thus, it lays down the general rules applicable to territorialized fellowships as well as to those whose management corresponds to the State, the economic and academic requirements to be a beneficiary and the principles and conditions of revocation and incompatibility of grants and state aid.

However, due to its quantitative nature, some of the above basic parameters need to be regularly updated so that they are not devalued over time. To these effects, the additional provision of the aforementioned Royal Decree 1721/2007 entrusts to the Government the determination of these variable parameters for each academic year, by means of a royal decree that will be approved annually, after consultation to the Autonomous Communities.

Moreover, the additional provision of Law 24/2005, of 18 November, of reform for the boost of productivity, provides that grants and aid to the study that are called for to follow studies and for the A number of beneficiaries will be directly awarded to both university and non-university students. This royal decree reflects the firm commitment of the Ministry of Education, Culture and Sport, with the social dimension of education, which aims to guarantee, through the policy of scholarships, that no student will abandon their studies. post-compulsory, for economic reasons, thus ensuring social cohesion and equal opportunities, while maintaining the financial effort despite the strict budgetary austerity framework.

In this line, the Government understands that the policy of scholarships, in addition to ensuring equal opportunities for all those who have vocation and skills for the study lack the necessary economic means to It should be an instrument of encouragement to improve the academic performance of students, especially students from the higher levels of the educational system. On the other hand, a transitional provision establishing the system of public prices applicable to the teaching of university management prior to the incorporation of the lines is introduced into Royal Decree 1271/2007. CHAPTER I

General provisions

Article 1. Object.

This royal decree is intended to determine the following quantitative parameters for which the calls for grants and study grants for the academic year 2012-2013 will be governed by the Budget of the Ministry of Education, Culture and Sport:

(a) The amount of the components of the various forms of grants and aid to the study covered by Royal Decree 1721/2007 of 21 December 2007 establishing the system of grants and study aids custom.

b) The income and family equity thresholds above which the right to the perception of grants and study aids disappears.

Article 2. Scope.

1. For the academic year 2012-2013 and, under the corresponding appropriations of the General Budget of the State, grants shall be convened without a specific number of beneficiaries for the following post-compulsory teaching:

c) Professional artistic teaching.

d) Sports Teachings.

e) Language studies conducted in official schools of ownership of educational administrations, including distance learning.

(f) University Teachings adapted to the European Higher Education Area leading to official degrees of Degree and Master's degree, including, where appropriate, those corresponding to the training supplements required for access to the Master and the Degree.

g) University Teachings leading to the official titles of Licentiate, Engineer, Architect, Diplomacy, Master, Technical Engineer and Technical Architect, including training complements for university graduates who wish to pursue official Bachelor's studies.

h) Higher artistic teachings.

i) Higher religious studies.

j) Higher and Grade Military Studies.

2. For the academic year 2012-2013 and, under the corresponding appropriations of the General Budget of the State, aid shall be called for the study without a specific number of beneficiaries for the following lessons:

(a) Access courses and preparation courses for the testing of access to vocational training and specific training courses for access to middle and upper grade training courses taught in schools (a) public and private institutions which have been authorised to teach vocational training.

b) Initial professional qualification programs.

c) Preparation course for access to university of over 25 years taught by public universities.

d) Non-university teaching courses adapted to students with specific need for educational support due to disability and behavior disorder or high intellectual capacity.

CHAPTER II

Scholarships and general-character study aids

Article 3. Studies included.

2. The salary grant will be incompatible with the school material component. The residence component will be incompatible with the displacement components.

3. With the exception of the beneficiaries of the residence component, all other grantees referred to in this article that will be able to study in-person studies in a population of more than 100,000 people will receive, in addition to the components they have right, a supplement of 204 euros.

4. The students of initial vocational qualification programmes may obtain the components of school supplies, travel and schooling and, where appropriate, the supplement to cities. 5. Students registered in institutions referred to in Article 2 (2) (a) may obtain the components of school supplies, travel and, where appropriate, the supplement to the cities. The amounts of these components may be weighted according to the teaching load and the school hours.

6. Students who study languages in Official Schools will be able to obtain the components of school material, displacement and, where appropriate, the supplement of cities.

7. Those who, in accordance with the provisions of Article 18 of Royal Decree 1721/2007 of 21 December 2007, use the specific offer for adult persons or offer of partial tuition may obtain the components for schooling, movement and school supplies and, where appropriate, the supplement to cities. The amounts of these components may be weighted according to the teaching load and the school hours.

8. The students who have completed official studies of Baccalaureate or Vocational Training at a distance may obtain the school material component with the amounts established in this royal decree and under the conditions to be determined in the corresponding call. You can also obtain a maximum amount of 386 euros in travel when you do not reside in the same locality where you are radiating the center of the partner or the extension of the center of the Baccalaureate at a distance, for the assistance programmed by the centre at a distance.

9. The applicable income thresholds for the award of the components of the grants and the study aid provided for in this Article shall be as follows:

(a) For the granting of the compensatory and grant component salary the family income of the applicant shall not exceed the family income threshold 1 set out in this royal decree.

(b) For the granting of the school component, the family income of the applicant shall not exceed the family income threshold

2. The salary grant will be incompatible with the components of material for studies and urban transport. The residence component will be incompatible with the displacement components and these, in turn, are incompatible with the urban transport component.

3. Those who opt for partial tuition and who are in the process of preparing for access to the university in their classroom will be able to obtain only the components of registration, displacement or urban transport and material of study. The amounts of these components may be weighted according to the load and schedule.

4. Students who study non-face-to-face university studies will be able to obtain the study material component, the academic performance component and the tuition component with the amounts established in this royal decree and under the conditions to be determined on the relevant call. In addition, they may obtain a maximum amount of € 386 in travel when they do not reside in the same locality in which they are located in the partner or partner site.

With the exception of the academic performance component, the provisions of the preceding paragraph shall apply to those who undertake the course of preparation for access to the university of over 25 years in non-face-to-face mode.

5. The tuition grant shall include the official public price of the university academic services corresponding to the credits in which the student was first enrolled in the course 2012-2013.

Those appropriations which exceed the minimum necessary to obtain the degree in question shall not be part of the tuition grant.

In the case of students from private universities, the amount of this grant will be equal to the amount of official public prices established for the same degree and curriculum in the public holding centers of its own autonomous community, subject to the conditions set out in the preceding paragraphs.

The compensation to the universities of the amounts of the tuition grant referred to in the preceding paragraphs shall be made in accordance with the provisions of the fourth additional provision of this royal decree.

6. The aim of the end-of-career project is to provide an amount or economic benefit to students of technical teaching and other higher education who require the improvement of the project for the purpose of obtaining the project. title. It shall not apply where the project is set up under the curriculum and whose credits are part of the minimum for obtaining the title or when it is carried out simultaneously with one of the courses of the career. University beneficiaries of the end of career project grant may also obtain tuition and material for study grants.

7. The academic performance component is intended to reward the best academic achievement of university teaching students.

8. The applicable income thresholds for the grant of the components of the grants provided for in this Article shall be as follows:

(a) For the granting of the compensatory and grant component salary the family income of the applicant shall not exceed the threshold 1 set in this royal decree.

(b) For the grant of the residence component, the family income of the applicant shall not exceed the threshold 4 set out in this royal decree. Applicants who obtain the residence component may also receive the components of study material and urban transport.

(c) For the grant of the tuition grant as the sole component, the applicant's family income shall not exceed the threshold 5 set out in this royal decree.

d) For the granting of the component by academic performance the family income of the applicant shall not exceed the threshold 5 set in this royal decree

e) For the granting of the other grant components the applicant's family income shall not exceed the threshold 3 set out in this royal decree.

Article 6. Additional amounts.

The amounts of the grants and the study aids set out in Articles 4 and 5 of this royal decree will be increased in the following amounts:

(a) In accordance with the mandate contained in Article 138.1 of the Constitution, persons receiving a grant with a family home in Spain, or in Ceuta or Melilla, who are required to use transport Sea or air for access to the teaching centre in which you are studying from your home, you will have a further € 442 on the amount of the grant you have received.

b) This additional amount will be of 623 € for grantees with a family home in the islands of Lanzarote, Fuerteventura, Gomera, Hierro and La Palma, Menorca and the Pitiusas. These grant supplements shall also apply to students enrolled in official centres of Baccalaureate at a distance residing on island territory without a partner or partner.

CHAPTER III

Mobility grants

Article 7. Studies included.

1. 3. The applicable income thresholds for the granting of the components of the mobility grants shall be as follows:

(a) In order to grant special forms of mobility grant, the family income of the applicant shall not exceed the threshold 1 set out in this royal decree.

(b) For the grant of the general mobility grant without residence, the family income of the applicant shall not exceed the threshold 3 set out in this royal decree.

(c) For the grant of the general mobility grant with residence, the family income of the applicant shall not exceed the threshold 4 set out in this royal decree.

d) For the award of the component by academic performance, the family income of the applicant shall not exceed the threshold 5 set in this royal decree

e) For the grant of the tuition grant as the sole component, the family income of the applicant shall not exceed the threshold 5 set out in this royal decree.

CHAPTER IV

Assistance for students with specific need for educational support

Article 8. Studies included.

1. Study aids and subsidies for students with specific need for educational support due to disability or serious disorder of conduct or associated with high intellectual capacity will be called, which will be studied in the second cycle of Education, Primary Education, Compulsory Secondary Education, Baccalaureate, Mid-and Higher-Grade Training Cycles and Programmes for the attainment of an initial vocational qualification. The subsidies will cover school dining and school transport expenses and will be awarded to students with special educational needs belonging to large families.

3. The amounts set out in the table above for aid or transport subsidies shall be increased by up to 50% where the student has a recognised motor disability of more than 65%.

4. No aid or subsidy shall be granted where the costs to which they serve are sufficiently covered by public services or funds or, where appropriate, by aid granted to the centres to finance the service concerned. In the level of early childhood education, no aid will be granted for school supplies.

5. The students with high intellectual abilities can obtain, in the terms provided for in Article 11 of Royal Decree 1721/2007, of December 21, an aid of up to 913 euros for the payment of the expenses derived from the registration and assistance to specific programs for this collective.

6. The applicable income thresholds for the granting of the components of the study and subsidy support for students with specific need for educational support shall be as follows:

(a) For the granting of such aid, the family income of the applicant shall not exceed the threshold 3 set out in this royal decree.

(b) In order to grant the subsidies, the income and family assets shall not be treated.

CHAPTER V

Income and family equity thresholds

Article 9. Family income thresholds.

1. In accordance with the provisions of paragraph e) of the first provision of Royal Decree 1721/2007 of 21 December 2007 establishing the scheme for grants and aid for the study of a personalised study, the family income threshold for the 2012-2013 shall be fixed in the calls approved by the Ministry of Education, Culture and Sport and the competent educational administrations which have taken over the full exercise of the powers provided for in that royal decree.

The Ministry of Education, Culture and Sport will fund scholarships subject to the lower end of the range set out in the table below, including the tuition grant component in the terms set out in the Additional provision fourth. 5. 6. In the event that the call is resolved, the number of trainees will be lower than the 2011-2012 academic year plus 10%, the Ministry of Education, Culture and Sport will be able to progressively raise the family income thresholds, without exceeding 10%. If this rise in thresholds affects threshold 1 or threshold 5, the funding commitments of the Ministry of Education, Culture and Sport shall be understood as adapted to the new parameters.

Article 10. Calculation of family income.

1. Family income for the purposes of grant or aid shall be obtained by aggregation of the income of each of the family members who obtain income of any kind, calculated as indicated in the following paragraphs and compliance with the rules governing the Income Tax of the Physical Persons. For the purposes of grants and grants for the study of the 2012-2013 course, the financial year 2011 shall be computed.

2. For the determination of the income of the computable members who have filed a declaration for the Income Tax of the Physical Persons, they shall proceed as follows:

(a) The general tax base shall be added to the tax base of the savings, excluding all negative net balances of capital gains and losses for financial years prior to 2011 and the negative net balance of Capital returns from 2008, 2009 and 2010 to be integrated into the tax base of savings.

b) This result will subtract the resulting quota from the autoliquidation.

3. For the determination of the income of other computable members who obtain their own income and have not filed a declaration for the Income Tax of the Physical Persons, the procedure described in point (a) above and of the result will be reduced to account payments made.

Article 11. Deductions from family income.

In the course 2012-2013, the following family income deductions will apply:

(a) 50% of the income contributed by any computable member of the family other than the principal breadwinners.

(b) € 500 for each sibling, including the applicant, living in the family home, in the case of large families of general category and € 765 for large families of special category, provided that they are entitled to this benefit. Where the applicant himself is the holder of the large family, the quantities indicated shall be taken into account in relation to the children who make up the family. This deduction will be up to € 2,000 in the call for assistance for students with specific need for educational support.

(c) € 1,811 for each sibling or child of the applicant or the applicant himself who is legally recognised, of a degree equal to or greater than 33%. This deduction shall be EUR 2,881 if the disability is of a degree equal to or greater than 65%. This deduction will be up to € 4,000 in the call for assistance for students with specific need for educational support.

(d) € 1,176 for each sibling of the applicant under 25 years of age or the applicant himself who curse university studies and resides outside the family home, where two or more students are resident outside the home. family on the basis of university studies.

e) The applicable family income threshold shall be increased by 20% when the applicant is an absolute orphan and under 25 years of age.

Article 12. Indicative thresholds for family assets.

1. Any family income calculated in accordance with Articles 10 and 11 shall be refused the grant or aid applied for in the course of 2012-2013 when the indicative thresholds for family assets set out below are exceeded:

(a) The sum of the cadastral values of the urban estates belonging to the computer members of the family, excluding the usual dwelling, shall not exceed € 42,900. In the buildings located in the Comunidad Foral de Navarra, the cadastral value will be multiplied in every case by 0.50.

(b) The sum of the cadastral values of the rustic estates belonging to the family members of the family may not exceed € 13,130 for each member of the computable member.

c) The sum of all the reduced net income of the capital furniture plus the net positive balance of all profits and property losses belonging to the family members excluding the grants received for the purchase or rehabilitation of the usual dwelling and, where appropriate, the basic emancipation income shall not exceed EUR 1,700.

No account shall be taken of the effects referred to in this paragraph in cash or in kind prizes for participation in games, competitions, raffles or random combinations up to the limit of EUR 1,500.

In any event, the elements indicative of the assets shall be computed in accordance with the provisions of the Income Tax rules of the Physical Persons by their value at December 31, 2011.

2. Where there are several elements indicative of the heritage described in the previous section of which the family members are available, the percentage of the value of each element shall be calculated with respect to the corresponding threshold. The grant shall be refused if the sum of the above percentages exceeds 100. However, if the number of trainees is lower than the 2011-2012 increase by 10%, the Ministry of Education, Culture and Sport will be able to determine that the provisions of this paragraph do not apply.

3. The grant or aid to the study requested shall also be refused where the economic activities of the family members of the family have a total of the total amount of eligible economic activities in direct estimation and in agricultural, livestock and forestry activities in objective estimation, in 2011, exceeding € 155,500.

Additional disposition first. Academic requirements for students from other higher education.

In the higher degree and Master studies not integrated in the university and other studies organized by credits, the academic requirements required for obtaining a scholarship will be those established for students. In these higher studies not integrated in the university and organized by academic courses, it will be required, for the purpose of obtaining a scholarship, that the applicant enrol for complete courses. In this case, this requirement shall not be required for a single time when the applicant has a lower number of credits or subjects to complete his studies, in which case they must be registered with all of them.

Additional provision second. Specific measures to compensate for the disadvantages of university students with disabilities.

1. The amount of the components to be determined from the grants and the study aid fixed for the university students, with the exception of the one on the tuition grant, may be increased by up to 50% when the applicant is affected by the a disability of 65% or more, legally qualified.

No aid shall be granted where the costs to which they serve are sufficiently covered by public services or funds.

2. The deductions provided for in the family income specified in Article 11 (b) and (c) for pupils with specific need for educational support shall also apply to university students of an equal degree of disability. or more than 65%, legally qualified.

3. The number of credits from which the grant applicants are to be registered and which will be established in the corresponding calls, will be reduced in the case of legally qualified disabled students, reducing the burden of (a) Lective necessary to meet the registration requirement by 50%, at most, when the applicant is affected by disability of a degree equal to or greater than 65%.

Additional provision third. Extension of university studies.

In those cases where the applicable requirements and conditions permit the enjoyment of a grant for one or two years more than those laid down in the curriculum of the corresponding university degree, the convocation may establish that the amount of the grant awarded for the last of these additional courses is 50% of the components which would have been awarded to it, with the exception of the tuition grant covering the whole of the credits for which you are registered for the first time.

Additional provision fourth. Compensation to the universities for the tuition exemption.

1. During the course of 2012-2013, the Ministry of Education, Culture and Sport will provide universities, in terms of compensation of public prices for academic services, for students who are exempt from their payment, an amount per pupil equal to that of the public price set for the corresponding title in the course 2011-2012, updated by 1%, in accordance with the provisions of Article 7 (2) of Royal Decree-Law 14/2012 of 20 April 2011, of measures to rationalise public expenditure in the field of education.

2. In the case of new qualifications which did not exist in the course of 2011-2012, the Ministry of Education, Culture and Sport will compensate universities for the amount corresponding to the public prices set in the course of 2011-2012 for the same degree of experimentality in its Autonomous Community, as updated in the terms set out in the previous paragraph.

3. The Ministry of Education, Culture and Sport will compensate the University on the basis of the number of trainees enrolled in the so-called Mastères with a differentiated price, with the exception of those who enable the exercise of a regulated profession. amount not paid by the scholarship student up to a maximum of € 2,100.00.

4. Where the amount contributed by the Ministry of Education, Culture and Sport to the university is lower than the cost of the tuition grants, in the terms defined in Article 5 (5) of this royal decree, calculated at the price (a) the public authorities set up by the Autonomous Community for the period 2012-2013 shall be responsible for compensating the university for the difference so that the recipient of the grant is effectively exempt from any economic obligation.

Additional provision fifth. Academic requirements for the 2013-2014 course.

In the remaining Master's studies, the average note will be 7.00 points. In both cases it will be required to have exceeded all the credits in the first course.

In addition, starting from the 2013-2014 course, to obtain any grant component, first-course students from Baccalaureate will have to prove that they have obtained an average score of 6.00 points in the fourth course of education. Compulsory secondary or proof of access, if any. Students in the first course of higher education courses must show that they have obtained 5.50 points in the second course of Baccalaureate, test or access course respectively.

Students in second and subsequent non-university post-compulsory teaching courses organised by subjects or subjects must prove that they have passed, at least, all subjects or subjects in the previous course, with the exception of one.

Students in second and subsequent non-university post-compulsory teaching courses organised by modules will have to prove that, in the course of the past, a number of modules involving 85% of the modules have been completed. total hours of the course they would have been enrolled in.

Second transient disposition. Co-financing agreements.

Exceptionally for the course of 2012-2013 the Autonomous Communities that have initiated the negotiation for the transfer of the functions and services in the field of management of scholarships and aids to the study personalized, in accordance with the provided for in the fourth additional provision of Royal Decree 1721/2007 of 21 December 2007, may, by means of an agreement with the Ministry of Education, Culture and Sport, agree to the call for and co-financing from their own budgets 50% of the grants awarded to students whose family income is located within the the interval set out in Article 9 (1) and (5) of this royal decree.

Final disposition first. Title and character of basic legislation.

This royal decree is of a basic nature and is dictated under the first and third rules of Article 149.1 of the Constitution, which reserve the State the competence to lay down the basic rules for the development of the right to education, in order to ensure the equality of all Spaniards in their exercise.

Final disposition second. Amendment of Royal Decree 1721/2007 of 21 December 2007 establishing the system of grants and aid for personalised assistance.

The Royal Decree 1721/2007 of 21 December 2007 establishing the scheme for grants and personalised aid is amended in the following terms:

One. A new point (c) is added to Article 9 (1) of Royal Decree 1721/2007, with the following wording:

" c) Meet the following academic requirements:

1. Students of Official Masters:

-The first course students of Masteres who enable for the exercise of a regulated profession will have to credit an average score of 6.50 points in the previous studies that give them access to the master. In the remaining Master's studies, the average note will be 7.00 points. For these purposes, the average notes from technical teaching studies shall be multiplied by the coefficient 1,17.

-The second course students of Masteres who enable for the exercise of a regulated profession will have to credit an average score of 6.50 points in the first course. In the remaining Master's studies the average note will be 7.00 points.

2. Non-university post-compulsory teaching students:

-First-course students in Baccalaureate must prove to have obtained an average score of 5.50 points in the fourth course of compulsory secondary education or proof of access, if any. Students in the first course of higher education courses must show that they have obtained 5.50 points in the second course of Baccalaureate, test or access course respectively.

-Students in second and subsequent non-university post-compulsory teaching courses organised by subjects or subjects must prove that they have passed at least all subjects or subjects in the course previous, with the exception of one.

-Students in second and subsequent non-university post-compulsory teaching courses organised by modules must prove to have exceeded, at least, in the previous course a number of modules involving 85% of the the total hours of the course in which they were enrolled.

The requirements set out in this letter will also apply to applicants for special mobility grant modalities. "

Two. Article 23 (1) of Royal Decree 1721/2007 shall be worded as follows:

" Those who are enrolled for the first time in the first degree course of studies must accredit a note of access to the University of 5.50 points, excluding the qualification obtained in the specific phase, in the event that access through the test of access to the official university teaching degree for those who are in possession of the title of Bachiller or equivalent, or a note of 5,50 points in the test or in the teaching that allows them access to the University in another case.

Four. Article 27 (1) of Royal Decree 1721/2007 is hereby amended as follows:

" The applicants for first-degree scholarship from the studies leading to an official degree of Master's degree must have obtained an average score of 6.50 points in the academic record corresponding to the previous university studies giving access to them. For these purposes, the average notes from technical teaching studies shall be multiplied by the coefficient 1,17.

In the case of the Masteres that enable for the exercise of a regulated profession the average note referred to in the previous paragraph shall be 6.00 points. For these purposes, the average notes from technical education studies shall be multiplied by the coefficient 1,17. '

Five. Article 35 (1) (a) of Royal Decree 1721/2007 is hereby amended as follows:

" (a) Destinate the grant or aid for the purpose for which it is granted, by means of such registration, attendance at class, presentation to examinations, payment, if any, of the costs for which it has been granted, as well as the provision of the service or implementation of the practice which has led to its award. The beneficiaries of such grants shall, in addition, exceed 50 per 100 of the appropriations or subjects in which they were registered. Failure to comply with the latter obligation shall result in the reimbursement of all the components of the grant with the exception of the tuition grant. "

Six. Article 38 of Royal Decree 1721/2007 is hereby amended as follows:

" The scholarships and study aids regulated in this royal decree will be incompatible with any other benefits of the same nature and purpose, unless the Ministry of Education, Culture and Sport declares the compatibility in sufficiently motivated cases. '

Seven. The single transitional provision of Royal Decree 1721/2007 becomes the first transitional provision. Paragraph 8 of this transitional provision shall be worded as follows::

"It will be required that the applicant has exceeded in the course preceding that for which 90% of the credits enrolled are requested by the grant if it is a study of the Areas of Arts and Humanities and of Sciences Social and Legal; 80%, in case of studies of the Areas of Health Sciences and Sciences and 65% in the case of Engineering and Architecture teaching. "

Paragraph 12 of this transitional provision is worded as follows:

" It will be understood that the academic requirements are met by students who obtain an exceptional academic achievement. In order to determine whether there is exceptional use of the student, the percentage increase of credits registered in respect of the minimum number of the students to whose registration is required by paragraph 1 shall be calculated. The percentage of credits to be overcome in these cases to obtain scholarship will be determined by the following mathematical formulas:

Eight. A second transitional provision is added to Royal Decree 1721/2007 with the following wording:

" Second transient disposition. Public prices of university teaching in extinction.

Until their extinction occurs, the public prices applicable to the teachings of the previous university management leading to the obtaining of the official degrees of Diplomacy, Master, Technical Architect, Engineer Technician, Licentiate, Architect or Engineer will be determined by the Autonomous Communities within the limits established by the General Conference of University Policy, and respecting the intervals established for the teaching of Grade in the Article 81.3 (b) of the Organic Law 6/2001, of 21 December, of universities. "

Final disposition third. Regulatory development.

It is up to the Minister of Education, Culture and Sport in the field of their competences to dictate the rules that are precise for the application and development of what is established in this royal decree.

Final disposition fourth. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
