The Royal Decree 343/2012, of 10 February, which develops the basic organizational structure of the Ministry of employment and Social Security, provides, in its article 11.1. r) and s), which corresponds to the General technical secretariat the formulation of the national statistical Plan and annual programs that develop in the field of the Department as well as the planning coordination and momentum of the statistical activity in the Department and institutional coordination in statistical matters with the National Institute of statistics, with other ministerial departments, with other public administrations and with international bodies, functions that had already assigned.
To facilitate the realization of the indicated functions was created, in the bosom of the formerly Ministry of labour and Social Affairs, in order TAS/2387/2007, of 27 July, the Statistics Department Commission, as a collegiate body involving bodies and dependent of the agencies involved in the realization of statistical operations and whose mission is the advise the governing body having assigned competencies in statistical matters and facilitate the coordination with those bodies and agencies.
The current Ministry of employment and Social Security is closely involved in statistical and of great social importance, whose realization involves the different bodies and agencies dependent on it. Therefore, it is necessary to have, increasingly, with the support of an organ of the characteristics of the aforementioned Statistical Commission. However, to ensure its effectiveness, it is essential to adapt its regulation to the new competence and organic structure of the Department, as well as to point out some of its functions to fit the demands in this matter.
This ministerial order is pronounced under cover in the articles 12.2. to), 38 and 40 of the law 6/1997, of 14 April, organization and functioning of the General Administration of the State.
By virtue of, prior approval of the Minister of finance and public administration, have: article 1. Nature, assignment and purposes.
The Statistical Commission of the Ministry of employment and Social Security is an organ collegiate, than those provided for in article 40.1 of law 6/1997, of 14 April, organization and functioning of the General Administration of the State, attached to the Secretariat General Technical Department, whose aim is to advise indicated governing body in the exercise of its competence in statistical matters as well as facilitate the coordination of statistical activities of the different organs of the Department, its autonomous bodies and the management entities and common services of the Social security dependent or attached to the same.
Article 2. Functions.
The Statistical Commission has the following functions: to) promote the updating of the inventory of statistical operations of the Ministry, and contribute to the determination of which will be regarded as statistics for State purposes and therefore are to be included in the national statistical Plan (PEN) and annual programs that develop it, according to the statistical needs of the Department as well as ensuring compliance with provisions in the NSP.
(b) to ensure compliance with provisions of law 12/1989, of May 9, public statistics function, and, in particular, by the rules relating to the secret statistics in the statistics for State purposes assigned to the Ministry.
(c) to facilitate the coordination of statistics of the Department activities and the transmission of information to committees and groups work in the statistical field in which the Department is represented, as well as the agreements signed in statistical terms by the Ministry.
(d) collect information of new statistical projects and methodological changes and information which may be relevant statistical units producing statistics from the Department, as well as to make proposals for the improvement and implementation of the same.
(e) meet the administrative registers and information systems of the activities of the Department, its projects of implantation, revision or withdrawal, as well as boost their statistical exploitation.
(f) encourage the integration of statistical information systems, homogenizing and standardizing the conceptual and methodological aspects of the statistics, especially in terms of definitions, statistical units, classifications, nomenclatures and codes.
(g) establish guidelines and promote appropriate dissemination of the results of the statistics of the Ministry, as well as their respective methodologies, ensuring compliance with the calendar set out in the annual programmes of the national statistical Plan.
(h) any other functions entrusted by the holder of the Statistical Department.
Article 3. Composition.
1. the Statistical Commission will have the following composition: Chairman: the owner of the General technical secretariat.
Vice President: The head of the General Department of statistics.
Members: One representative of each of the following bodies, agencies, and entities of the Department, appointed by the holder of the same and that, to the extent possible, will be staff of the units responsible for statistical operations of the national statistical Plan: the Cabinet of the Minister.
The Cabinet of the Secretary of State employment.
The Office of the Secretary of State of the Security Social.
The technical Office of the General Secretariat for immigration and emigration.
The technical Cabinet of the Secretary of employment and Social Security.
The General directions of the Ministry and other governing bodies, to the extent that they are involved in the production and analysis of the statistics produced in the Department.
Autonomous bodies, the managing bodies and common Social security services, attached to the Department.
In addition, because of the specific functions that are attributed in the statistical field, will be represented the following governing bodies: the General Sub-Directorate of the information technologies and communications, represented by an official.
Subdirectorate General of statistics, with three members appointed by the Presidency, one of whom shall act as Secretary of the Committee with voice but without vote.
Also, participate a representative of the National Institute of statistics, proposed by the chairmanship of that body.
Article 4. Operation.
1. the Statistical Commission may act in part-session or Standing Committee.
2. the plenary will meet as often as required, provided that its President to convene or requested to do so by the third part of members and, at a minimum, once a year in order to inform the statistical activity in the previous year, and report on which will be developed in the coming year for inclusion in the annual work programme of the Statistical Plan of the Department.
3. the Permanent Commission shall be constituted by the following members of the House: President: the head of the General Department of statistics.
Members: A representative of the Secretary of State for employment, the Secretary of State of the Social Security, and the General Secretary of immigration and emigration, designated by the owner of the aforementioned organ.
Secretary: A representative of the General Statistics Office, with voice but without vote.
Any of the members of the plenary may attend the meetings of the Standing Committee, upon call of the President of the same.
4. the functions of the Permanent Commission will be facilitate the accomplishment of the functions that correspond to the plenary of the Commission and carry out any function that is assigned to them by the plenary.
5 may constitute, also well by the plenary or by the Standing Committee, working groups to carry out specific work that they decide to tackle. For this purpose, the Commission may request the assistance of professionals or institutions that can contribute to better compliance with the purposes intended by their knowledge or experience.
6. both the Chairman of the plenary as the Standing Committee may invite to the meetings of the Commission if they see fit, with voice but without vote, officials of the Department, representatives of the National Institute of statistics and other ministerial departments, administrations and institutions, as well as experts, depending on the specifics of each meeting.
7. the Commission may hold meetings by electronic means, in accordance with the provisions of the first additional provision of law 11/2007, of 22 June, electronic access of citizens to public services.
Article 5. Legal regime.
The Commission shall be governed by the provisions of chapter II of title II of law 30/1992, of 26 November, legal regime of public administrations and common administrative procedure, as well as, where appropriate, by the rules of internal regulations emanating from the Commission itself.
Sole additional provision. No increase in public spending.
The functioning of the Statistical Commission will not lead to increase in public spending and will be attended with those media personal, technical and budget assigned to the governing body that is integrated.
Sole repeal provision. Repeal legislation.
Hereby repealed the order TAS/2387/2007, of 27 July, which regulates the Commission of statistics of the Ministry of labour and Social Affairs.
First final provision. Application and development powers.
It empowers the General technical secretariat to issue precise instructions for the development and implementation of this order.
Second final provision. Entry into force.
This order shall enter into force the day following its publication in the "Official Gazette".
