Paragraph two of the fifth final provision of Organic Law 9/2011, of July 27, of rights and duties of members of the Armed Forces, amended Law 39/2007 of 19 November of the military career, adding a New paragraph 1 to the sixth additional provision, Access to the Military Body of Health in the medical specialty. This modification, in essence, makes it possible to enter the body and specialty, and therefore, in the Military School of Health, without prior university degree; in this case, the training of medical officers comprises, on the one hand, the general, specific and technical military training, and, on the other hand, the official graduate degree in Medicine. This modification is based on the need to improve the scarce collection of human resources in a critical specialty such as that of Medicine, to which we have to add the presence of the Armed Forces in numerous scenarios outside of our borders.

In the Regulations for the entry and promotion and management of training in the Armed Forces, approved by Royal Decree 35/2010, of January 15, no entry is foreseen without requiring prior university degree to the Military Body of Health, nor how training should be ordered when teaching is accessed without a qualification requirement, so both aspects are required to be defined.

In order to enable the teachings leading to obtaining the degree of Graduate in Medicine, the Center located in the Madrid Defense Schools Group has been integrated into the university system of the defense and I know signed with the University of Alcalá the convention of membership to impart them.

Moreover, the sixth final provision of the aforementioned Organic Law 9/2011 of 27 July also amended Law 8/2006 of 24 April of Troop and Marineria, in order to facilitate the internal promotion of soldiers and sailors to the military training of training for incorporation to the scale of non-commissioned officers, reducing to one year the requirement of time of services, extreme that also extends for the promotion to the officers. It seems appropriate and appropriate to apply the same criterion as regards the reduction of service times, so that the non-commissioned officers can participate in the selection processes by promotion at the official scales.

Measures of a transitional nature are also established to facilitate the promotion of non-commissioned officers, where certification requirements are required, increasing the years of age-limits exemption.

Therefore, it is necessary to introduce the necessary modifications in order to adapt this standard to both the new possibility of income, and to the lower demand for time of services established by the Law Organic 9/2011, July 27.

In its virtue, on the proposal of the Minister of Defense, with the prior approval of the Minister of Finance and Public Administrations, according to the State Council and after deliberation by the Council of Ministers at its meeting of the July 27, 2012,

DISPONGO:

Single item. Amendment of Royal Decree 35/2010 of 15 January, approving the regulation of entry and promotion and management of training in the Armed Forces.

The Royal Decree 35/2010, of 15 January, is amended, approving the regulation of entry and promotion and management of training in the Armed Forces in the following sense:

One. Paragraph 2 of the first provision of Royal Decree 35/2010, of 15 January 2010, is amended as follows:

" 2. General and specific military training to be incorporated at the level of officers of the General Corps of the Army of the Earth can be completed at the following military training centers:

a) Infantry Academy.

b) Cavalry Academy.

c) Academy of Artillery.

d) Academy of Engineers. "

Two. A new additional provision, fourth, is added to Royal Decree 35/2010, dated 15 January, with the following wording:

" Additional provision fourth. Access to the scale of officers of the Military Corps of Health, major specialty Medicine with acquired credits.

1. If the call is available, it will also be possible to access by direct income or by promotion to the military training centers of training for the access to the scale of officers of the Military Corps of Health, major medical specialty, when have been exceeded, at least 120 ECTS from the degree of graduate in medicine or, in his case, 160 credits from that of Licention in Medicine. The age limit for participation in the selection process is determined not to meet or have been 25 years of age in the year the call is published.

2. On the scale to be applied in the competition phase, the appropriations exceeded shall be valued. '

Three. Paragraphs 5 and 7 of the fifth transitional provision of Royal Decree 35/2010 of 15 January 2010 are amended as follows:

" 5. In the calls for the years 2012 to 2018 inclusive, the non-commissioned officers of the General and Marine Corps of the Marine Corps holding the required certification as referred to in Article 17.1.b) .2. of the Regulation which approve, may be granted for promotion for change of scale or body, for places to be determined in the annual provision, being exempt from age limits. "

" 7. To participate in the selection processes that are called during the years 2012 to 2018 inclusive, to be incorporated by promotion for change of scale, at the level of officers of the Military Musicians ' Body, the official musicians remain exempt from the age limits laid down. "

Four. A second paragraph is added to the fourth final provision of Royal Decree 35/2010, of 15 January, with the following wording:

" The norms that the Minister of Defense will dictate to regulate the selection processes for the entry into the military training centers without requiring prior university degree for incorporation At the level of officers of the Military Body of Health, major medical specialty, they will take, with those adaptations that are necessary, as reference the ones that are determined for the direct income and for promotion without requirement of qualification university for access to the scale of officers of the General and Marine Infantry. "

Five. Article 5 (6) of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is worded as follows:

" 6. The incidence of the contest in the maximum final score that can be obtained by the opposition, may not be greater than 10 percent in the direct income, nor the 30 percent in the change of scale or body. This will not apply to the selection system used for admission to the training of officers and non-commissioned officers of the General and Marine Corps, as well as those of officers of the Military Corps of Health, major medical specialty, where prior university degree requirements are not required, which shall be governed by the rules governing the corresponding selection processes. "

Six. Article 6 (2) of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is read as follows:

" 2. The number of places for direct income in the training of officers of the General Corps, Marine Corps and the Military Corps of Health, major specialty Medicine, when no qualifications are required university, shall be higher than those established for incorporation at scale. "

Seven. Article 7 (1) of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is read as follows:

" 1. For the purposes referred to in Article 43.1 of the Organic Law 6/2001 of 21 December, of Universities, the public universities to which the university of the defence centres are attached shall include, in their offer of teaching and places, as additional places, those approved by the Council of Ministers in the annual provision to cure the university teachings that allow the incorporation at the scales of officers of the General Corps, Marine Corps and Military Corps of Health, major specialty Medicine, when not required for admission prior university degree. "

Eight. Paragraphs (a) and (b) of Article 8.6 of the Rules of Procedure for the entry and promotion and management of training in the Armed Forces are amended, as follows:

" (a) For the direct entry without requiring prior university degree in the military training centers to be incorporated at the scales of officers of the General and Marine Corps, as well as the The Military Body of Health, a major medicine, and the corresponding admission to the university centres of the defence, the allocation of the places will be carried out according to the note of admission which, in each case, corresponds according to the provisions of Royal Decree 1892/2008 of 14 November 2008, fixing the weighting of the materials of the specific phase or modules that are valued at 0,1.

The Assistant Secretary of Defense will be able to raise this parameter, up to 0.2, in those he considers most suitable for the success of the corresponding study plans. The values, and the subjects and modules concerned, must be made public before 31 March of the year preceding the year of the test of access to official university teaching.

(b) For direct income without requiring a university degree or professional training, in the military training centres to be incorporated at the level of officers and non-commissioned officers of the General Bodies and Marine, as well as the Military Corps of Health, major medical specialty, and the corresponding admission in the centers that impart teachings of the general education system, to the formula used to determine the note of the admission of a new sum to be added which, in accordance with the provisions of Article 56.7 of the Law of the military career, value the time served in the Armed Forces. The score to be awarded for this concept shall not exceed 0,5 points. "

Nine. Paragraph (d) of Article 15.4 of the Rules of Accession and Promotion and Planning of Training in the Armed Forces is amended, which is read as follows:

" (d) Have completed the following service times on their scale at the date of incorporation into the relevant training military training centre:

1. Military complement: 2 years.

2. Sub-Officers: 1 year.

3. Troop and marinery: 1 year. "

Ten. Paragraph (b) of Article 16.1 of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is read as follows:

" b) To join the different scales of officers of the Army of the Earth, Navy, and Army of the Air Force, and of the Armed Forces ' Common Corps:

1. No direct income without prior requirement of degree of university degree to the Military Corps of Health, major medical specialty: 20 years.

2. Non-income for promotion without prior requirement of university degree qualification to the Military Corps of Health, major specialty Medicine: 27 years.

3. º direct income with prior requirement of degree of university degree: 30 years, except for the fundamental specialty of Medicine of the Military Body of Health and for the fundamental specialty of Management of the Body of Musicas Militares, which is established in 33 years, or 37 in the case of requiring to be in possession of a specialist medical degree.

4. Ingress by promotion with prior requirement of university degree: 35 years, except for the fundamental specialty of Medicine of the Military Body of Health and a fundamental specialty of the Directorate of the Military Music that is established in 37 years. "

Once. Article 17.2 of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is worded as follows:

" 2. To participate in the selection processes to cure the training teachings to be incorporated into the different scales of officers of the Army of the Earth Army, the Army of the Navy and the Army of the Air, and the Common bodies of the Armed Forces except the Military Musicians ' Body shall be required official university degrees and valid throughout the national territory to be established in the corresponding convocation, from among the which are set out in Annex II and which are determined by the Minister of Defence in accordance with that Annex.

In the selection processes for entry without requiring a university degree for the incorporation at the level of officers of the Military Body of Health, a fundamental specialty of Medicine, the same will be required qualifications requirements set out in paragraphs 1 (a) (1) (a) to (1) for direct income, and (1) (b) (1) for income per promotion. "

Twelve. Article 22.7 of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is worded as follows:

" The maximum number of credits resulting from the integration, based on the dual subjects or subjects, of the two curricula required to be incorporated at the General and the General Corps ' official scales. Marine infantry, entering without official graduate degree, will be 380. Where pre-qualification requirements for entry are required, the general military training curriculum, specific and for the acquisition of the essential specialty, shall not exceed 152 ECTS. '

Thirteen. Article 23 of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is worded as follows:

" Teaching training to be incorporated into the different scales of officers from the Army of the Earth, Navy, and Army of the Army of the Army of the Air will require the improvement of a plan of general, specific, and technical training studies to complete the training accredited with the qualifications required for admission. It will have a minimum duration of an academic year. "

Fourteen. Article 24 of the Regulation on the entry and promotion and management of training in the Armed Forces is amended as follows:

" 1. In general, the teaching of training to be incorporated at the level of officers of the Armed Forces ' Common Corps will require the improvement of a plan of general, specific, and technical training of military training. accredited training with the qualifications required for admission. It will last for an academic year.

2. In the case of direct admission or promotion without requiring prior university degree for access to the level of officers of the Military Corps of Health, major medical specialty, training education will require the improvement of two curricula, one of general, specific and technical military training, and another, corresponding to the official university degree of graduate in medicine. The total of the teaching will be ordered in six academic courses. In this case, it shall be in addition to the application as set out in paragraphs 3 and 5 of Article 22 above. '

Fifteen. Article 28.b (3) of the Regulation on the entry and promotion and management of training in the Armed Forces is amended, which is worded as follows:

" 3. Different scales of officers from the Intrend Corps and Engineers of the Army of the Earth, the Navy and the Air Force, the Armed Forces ' Common Corps and the complement military: it will not be less than 8 weeks, except for the scale of officers of the Military Corps of Health, a major medical specialty, where the time has been entered without the requirement of prior university degree to which the provisions of paragraph 1 apply. '

Sixteen. The second subparagraph of paragraph 2 is amended. Official University Titles, Annex II of the Regulation on the entry and promotion and management of training in the Armed Forces, which is worded as follows:

" To enter the military training centers for the formation of officers of the General and Marine Corps, the official degrees of Graduation must be attached to the branches of knowledge of Engineering and Architecture, Science, and Social and Legal Sciences linked to the economy and the management and administration of companies. "
