Law 12/2015 of 24 June on the granting of Spanish nationality to Sephardies originating in Spain establishes a special procedure for the granting of Spanish nationality by letter of a nature to the Sephardies originating in Spain, as well as through the second provision, the telematic nature of the procedure and the application of an established fee for the application of the opening and processing of the file corresponding.

On the other hand, paragraph 4 of the seventh additional provision of Law 19/2015, of July 13, of measures of administrative reform in the field of the Administration of Justice and the Civil Registry establishes the payment of a fee by the initiation of the procedure to obtain the Spanish nationality by residence, which is carried out in Royal Decree 1004/2015 of 6 November, approving the Regulation governing the procedure for the acquisition of Spanish nationality by residence.

Finally, the Resolution of 10 November 2015 of the Directorate-General for Records and Notary sets out the rules on the management and payment of the fee for the submission of applications in Spanish nationality by residence and letter of nature for sefardies originating in Spain, and in the same one is approved the Model 790-Code 026 of autoliquidation of the rate and instructions.

The purpose of this resolution is to establish the application of the procedure for the presentation of the authorization and the conditions for the payment by telematic of the administrative fees of the Ministry of Justice 790. code 026.

In order to provide greater ease for the citizen, and in recognition of the right to engage with the Public Administrations using electronic means and to make payments by these means, as stated in the Article 6 of Law 11/2007, of 22 June, of electronic access of citizens to public services, is intended to facilitate the procedure of payment of this fee by means of telematics. To this end, the fee shall be settled by means of the electronic form available to those interested in the portal of the Ministry of Justice.

The Resolution of 10 January 2008 by the Under-Secretary of Justice established the procedure for the submission of self-validation and the conditions for the payment by telematic of the administrative fees of the Ministry of Justice. It is therefore considered necessary to amend this resolution in order to include, within the services offered by this Ministry to the citizens, the telematic payment of the fee for the submission of the application for Spanish nationality by residence and by letter of a nature for sefardies originating in Spain.

Therefore, in accordance with the provisions of the third general provision of Order HAC/729/2003 of 28 March, laying down the general assumptions and conditions for the payment by telematic route of the fees which constitute the resources of the General Administration of the State and its Public Bodies, and prior to the report of the State Agency of the Tax Administration, determined:

First. Amendment of the Resolution of 10 January 2008, of the Secretariat, laying down the application of the procedure for the submission of self-validation and the conditions for the payment by telematic means of administrative fees of the Ministry of Justice.

The Resolution of 10 January 2008, of the Subsecretariat, establishing the application of the procedure for the presentation of self-validation and the conditions for the payment by telematics of the fees The Administrative Department of the Ministry of Justice is amended as follows:

One. A new number 5 is added to the first paragraph of the Resolution in order to extend its object, which is worded as follows:

" 5. In addition, the conditions for the telematic payment of the fee with code 026 are laid down, by way of paragraph 14, "Fee for the application of Spanish nationality by residence and by letter of a nature for sefardies originating in Spain". Spain "."

Two. A third subparagraph is added to the third paragraph, which is read as follows:

" Third. Standard models:

(...)

In case of the fee for lodging the application of Spanish nationality by residence and by letter of nature for Sephardies originating in Spain, the standard model is the one approved by Resolution of 10 November 2015, of the Directorate-General of the Registry and the Notary, approving the model 790 of self-validation of the fee for the submission of the application of Spanish nationality by residence and by letter of a nature for originating sefardies of Spain. "

Three. The eighth paragraph is amended as follows:

" Eighth. Completion of model 790 Administrative fees of the Ministry of Justice.

With regard to the telematic payment of the fees with code 006 and 026, specific instructions published on the website www.mjusticia.es will apply for completion. "

Four. The current paragraph 14 becomes paragraph 15. The new section 14th happens to have the following text:

" 14th. Completion of model 790 of telematic payment of fees code 026, Administrative fees of the Ministry of Justice.

The declarant will complete the form 790 code 026 by accessing it through the Internet portal of the Administration of Justice, following the explanatory instructions of the model itself. You will then request the telematic payment option.

With regard to the conditions for making this telematic payment, the provisions of paragraph 9 ("Specific criteria for the use of telematic techniques") for the telematic payment of fees shall be provided for. For this purpose, any reference that is made to the rate 006 shall be applicable to the rate 026.

The specific instructions published on the website www.mjusticia.es may also be consulted for these purposes. "

Second. Entry into force.

This Resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
