The Organic Law 2/2006, of 3 May, of Education, points out in its article 2.1 that the Spanish education system will be oriented, among others, to the achievement of the acquisition of intellectual and technical habits of work, scientific, technical, humanistic, historical and artistic knowledge, as well as the development of healthy habits, physical exercise and sport.

Assessing hygiene and health, moreover, is one of the main objectives of primary education, as stated in Article 17 of the aforementioned Organic Law 2/2006, of 21 May, with such habits of care and body health and incorporating physical education and the practice of sport to promote personal and social development throughout compulsory secondary education.

Similarly, the Organic Law of 9 December 2013, for the improvement of educational quality, points out in its additional provision fourth that the educational administrations will adopt measures for the physical activity and the diet balanced are part of child and youth behavior.

For these purposes, these administrations will promote the daily practice of sport and physical exercise by students and students during the school day, in terms and conditions which, following the recommendations of the competent bodies, ensure adequate development to promote an active, healthy and autonomous life. The design, coordination and supervision of measures to be taken in the educational centre will be undertaken by teachers with appropriate qualifications or expertise in these areas.

To a greater abundance, Article 43 (3) of the Spanish Constitution binds education and health by urging the public authorities to promote health education, physical education and sport, and also to facilitate proper use of leisure.

Poor physical activity and unhealthy or unhealthy habits during childhood and youth are not only dangerous for health but also lead to a low physical form and lower self-esteem, which in school age derives in lower academic performance and finally early educational dropout.

Therefore, along with physical activity, healthy diet, hygiene, and proper sleep and regular sleep are the foundation for reaching healthy adult lives and being able to enjoy a full life.

The link is fundamental, therefore, that unites education with the necessary health care and the fact that habits are conducive to a healthy life. Health provides, along with education, the best opportunities for a society to have adequate levels of well-being.

For the purpose of promoting habits that lead to the development of a healthy life in all its aspects, the Ministry of Education, Culture and Sport proceeds through the present order to create a quality seal. "HEALTHY LIVING", in order to publicly acknowledge those schools, both public and private, that encourage learning of health in the field of education, as well as the assumption of healthy living practices and (a) physical education to enable adequate personal and social development throughout school education; students.

In the preparation of this order the report of the Ministry of Health, Social Services and Equality, as well as the Ministry of Agriculture, Food and the Environment has been collected and the project has been submitted to the of public information.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

Article 1. Object.

This order aims to create and regulate the quality label "SEAL HEALTHY LIFE", for the public recognition of educational institutions, both public and private, supported by public and private funds, which encourage learning of health in the field of education, as well as the assumption of healthy living practices and a physical education that allows for adequate personal and social development throughout the schooling of students.

Article 2. Requirements.

1. The quality label "SEAL HEALTHY LIFE" can be awarded to any teaching center, public and private with public and private funds, which will assume a firm and unequivocal commitment to the development and improvement of quality. education and health, understanding that they contribute to the improvement of the education in healthy habits the educational centers that pursue the fulfillment of some of the following purposes:

a) Foster the role of education in healthy habits as an integral part of comprehensive education, designing, for such purposes, a program of education in healthy habits that includes programming and establishment of educational objectives and of the assessment instruments.

b) Promoting healthy lifestyles and lifestyles, based on the specific needs of the teacher, and especially in the areas of nutrition and healthy nutrition and sport by contemplating the approach gender and equity to avoid health inequalities.

c) Strengthen and improve the healthy behaviors of students, with special emphasis on hygiene and prevention.

d) Strengthen body health and care habits and incorporate physical education and the practice of sport in order to foster the personal and social development of students.

e) Encourage students to acquire skills and competencies that enable them to take care of their bodies at both physical and mental levels, as well as to assess and have a critical performance in the face of information, publicity and attitudes social and social development that can negatively impact their physical, social and psychological development.

f) Know and detect health risk situations, especially related to the use of substances with addictive potential, both legal and illegal, as well as the execution of certain activities which may lead to addictive behaviour, with particular attention to anorexia and bulimia, contrasting its harmful effects and proposing prevention and control measures.

g) Promote understanding and assessment of the importance of preserving the environment by the impact it has on people's health.

h) To foster the responsibility of the students in the daily decisions of the student, and the knowledge of the consequences that they have in their health and the environment that surrounds them.

i) Promote adequate knowledge of sexual and reproductive health and hygiene.

j) Promote the value of research, development and innovation in medical advances and the impact of people's quality of life.

k) Promote the continuing training of teaching staff who provide their services at the centre, in the field of education in healthy habits and in particular on healthy eating and physical activity.

Article 3. Requests.

1. Applications for the award of the flag must be filed in the Register of the Ministry of Education, Culture and Sport (c/ Los Madrazo, 15 -17, 28014 Madrid), or by any of the means set out in Article 38.4 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. This process may also be carried out electronically, in accordance with Law 11/2007 of 22 June, on the electronic access of citizens to public services.

2. The Ministry of Education, Culture and Sport will provide a standard application model at the electronic headquarters.

3. Applications must be accompanied by a favourable report from the Education Department of the Autonomous Community in which the Centre or the Provincial Directorates of the Ministry of Education, Culture and Sport are located. management and, where appropriate, a technical memory describing the fulfilment of the requirements laid down in this order.

4. Applications may be accompanied by additional documentation which the teaching centre considers relevant.

Article 4. Instruction and evaluation.

1. The instruction of the procedure shall be carried out by the Directorate-General for Evaluation and Territorial Cooperation of the Ministry of Education, Culture and Sport.

2. In the Ministry of Education, Culture and Sport, a Evaluation Commission will be set up for the award of the distinctive "SALIDA SALIDA" label, which will be integrated by the Director General of Territorial Evaluation and Cooperation, which will preside over it. 3. The Evaluation Commission shall evaluate the applications in accordance with Articles 2 and 3 of this Order and shall submit a proposal for a resolution to the Secretariat of State for Education, Vocational Training and Universities.

4. The evaluating Commission may request from other public administrations the reports it deems appropriate for the best development of its function.

5. The Evaluating Commission shall be governed by the provisions of Chapter II of Title II of Law 30/1992 of 26 November of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

6. The functioning of the Evaluation Commission will be addressed with the personal, technical and budgetary means of the Directorate-General for Territorial Evaluation and Cooperation.

Article 5. Resolution.

1. In the light of the proposal of the Evaluation Commission, the Secretariat of State for Education, Vocational Training and Universities will issue a resolution on the applications for the award of the "LABEL SALUTALE" flag.

2. The maximum period for resolving and notifying applications shall be six months from the date on which the application has entered the register of the Ministry of Education, Culture and Sport. After this deadline, if you do not recuse express resolution, the request is deemed to be estimated.

3. The decisions of the Secretary of State for Education, Vocational Training and Universities may be brought before the Court of Appeal, within one month, in accordance with the provisions of Articles 116 and 117 of the Treaty. 4. The award of the quality label "SEAL SALIDA" will be made public at the electronic headquarters of the Ministry of Education, Culture and Sport.

Article 6. Effects of the concession.

The teaching center beneficiary of the concession may:

a) Expose at its headquarters and premises the distinctive mark granted to the teaching centre.

b) Use the stamp in the documentation of the teaching centre, as well as, where appropriate, in its commercial and advertising relations, in order to comply with the applicable regulations, in particular in the field of advertising.

Article 7. Validity and loss of "HEALTHY SEAL".

1. The validity of the award of the distinctive "SALUTAS SALUTAS" flag to a teaching centre shall be extended on an indefinite basis, provided that the conditions and requirements which gave rise to its compliance are maintained by those centres. concession.

2. Reviews by the Ministry of Education, Culture and Sport may be carried out regularly, and at least every two years, in order to verify whether the requirements justifying the award continue to be met.

3. In any event, the review of the concession shall be carried out in the event of exceptional circumstances, such as the disappearance of the teaching centre or the loss of life or the purpose for which the distinguishing mark was granted. any other that can motivate you. Such a review shall be carried out by the same procedure as the grant.

4. The Secretariat of State for Education, Vocational Training and Universities, after reporting by the evaluating Commission, which, in any case, will seek the arguments it deems appropriate from the teaching centre, and in a reasoned resolution of the effect, may cancel the right to the use of the flag "HEALTHY LIFE" as a result of the non-compliance with the conditions that founded its grant or the exceptional circumstances identified.

Article 8. Information record.

The Secretary of State for Education, Vocational Training and Universities will keep up-to-date and available complete information on the existing concessions of the distinctive "HEALTHY LIFE SEAL" flag and take appropriate measures. for their registration, custody and dissemination.

Final disposition first. Competence title.

This rule is dictated by the provisions of article 149.1.30. of the Spanish Constitution.

Final disposition second. Application of the order.

The Secretary of State for Education, Vocational Training and Universities is hereby authorized to make the necessary resolutions for the execution and development of this order.

Final disposition third. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
