Regulation (EC) No. 1380 / 2013 Council on December 11, 2013, on the common fisheries policy, fundamental objective is to ensure a sustainable exploitation of living fishery resources and of aquaculture in the context of sustainable development, taking into account in a balanced way the economic, environmental and social aspects.

Law 3/2001, of 26 March, maritime fishing from the State, establishes among its purposes the ensure balanced and responsible fisheries exploitation.

The Royal Decree 2200 / 1986, of 19 September, regulation of Arts and types of fishing in the waters of the Canary Islands fishery, has been containing the essential elements of the fisheries regime of the Canarian national fishery, complemented in different orders for certain arts, species or areas.

The future order by which regulate the arts and maritime fishing methods and establishing a management plan for the censuses of the Canarian national fishery vessels, will recast the State normative scattered in the matter, unifying the currently existing legislation in a single legal instrument and repealing various existing orders.

It will be also incorporated provisions contained in the Royal Decree; However, the time elapsed since the promulgation of the standard needed updating and revision in depth of their content and legal security advises recast all the grounds mentioned in a single legislative instrument regulating.

As a result, proceed to repeal, in appropriate range standard, the Royal Decree 2200 / 1986 of 19 September, regulation of Arts and types of fishing in the waters of the Canary Islands fishery.

On the other hand, it is necessary to modify certain minimum sizes authorized for the fishery of the Canary Islands listed in annex III of the Royal Decree 560/1995, of 7 April, which establishes the minimum sizes of certain fish species.

As a result of the meetings held with the affected sector and the scientific community, amending various carvings which had become obsolete by the time given the evolution of the fishery and the advances in the knowledge of these fisheries, and also two new species are incorporated into the listing of which have assigned minimum sizes in the Canary Islands fishery.

This standard is run under the protection of exclusive jurisdiction over maritime fishing which has the State on the basis of rule 19th article 149.1 of the Spanish Constitution.

Carried out the process of communication the European Commission envisaged in article 46 of Regulation (EC) No. 850/1998 of the Council of 30 March 1998 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms.

In the preparation of this standard has been consulted the fishing sector and the autonomous community of the Canary Islands, as well as to the Spanish Institute of Oceanography.

In his virtue, a proposal from the Minister of agriculture, food and environment, according to the Council of State and after deliberation by the Council of Ministers at its meeting of November 27, 2015, have: article 1. Repeal of the Royal Decree 2200 / 1986 of 19 September, regulation of Arts and types of fishing in the waters of the Canary Islands fishery.

Article 2. Modification of the Real Decree 560/1995, of 7 April, which establishes the minimum sizes of certain fish species.

One. The first paragraph of article 1 is worded as follows: «the minimum sizes authorized for different fish species captured by Spanish vessels shall be, for each separate stocks that make up the national fishery, indicated in the annexes of the present Royal Decree, without prejudice to the application of Regulation (EC) No. 850/1998 of the Council of 30 March» «, for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms.»

Two. 3. The following species are included in annex III of the Real Decree 560/1995, 7 April: species local name Canary size (total length in cm) black brunette (Muraena augusti) 56 Murion (Gymnothorax unicolor) 57 first final provision. Skill-related title.

The present Royal Decree is issued on the basis of article 149.1.19. ª of the Constitution, which attributes to the State the exclusive competence in the field of fisheries.

Second final provision. Entry into force.

This Royal Decree shall enter into force the day 30 November 2015.
