Royal Decree 506/2013 of 28 June on fertiliser products lays down the basic rules for fertiliser products, which are not regarded as EC fertilisers and the necessary rules for coordination with the European Communities. Autonomous. This provision contains seven annexes, which specify the technical characteristics and other requirements to be met by these products, in order to be usable in Spanish agriculture and gardening.

Its second final provision empowers the Minister for Agriculture, Food and the Environment to amend Annexes I, II, III, IV, VI and VII. Chapter VI sets out the procedure laid down for the adaptation of the Annexes to technical progress and scientific knowledge, both in relation to the practical reality of agriculture and to the incorporation of the Annexes to the Treaty. of new types of fertilizers.

After more than one year in force, it is necessary to update the Annexes, to include new types of products (Annex I) and new residues for the manufacture of fertilizers and amendments (Annex IV), together with the modifications that carry out identification and labelling (Annex II), methods of analysis for these new products (Annex VI) and their margins of tolerance (Annex III).

In the process of drawing up this provision, the procedure laid down in Chapter VI "Adaptation of the Annexes", which is provided for in the previous report of the Committee of Experts, has been followed and the Autonomous communities and representative entities in the sectors concerned.

This order has been submitted to the procedure for information on technical standards and regulations provided for in Directive 98 /34/EC of the European Parliament and of the Council of 22 June 1998 and in the Royal Decree 1337/1999, of 31 July, on the referral of information in the field of technical standards and regulations and regulations relating to the services of the information society.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, according to the State Council, I have:

Single item. Amendment of Annexes I, II, III, IV and VI to Royal Decree 506/2013 of 28 June on fertilising products.

Annexes I, II, III, IV and VI to Royal Decree 506/2013 of 28 June 2013 on fertiliser products are amended as follows:

One. Annex I 'Relation of types of fertiliser products' is replaced by the Annex I of this order.

Two. Annex II, General provisions for identification and labelling, is amended as follows:

(a) In paragraph A. 3 "With respect to other content and characteristics", a new point g is included with the following wording:

"g) In the fertiliser products of groups 2, 3 and 6 using the dried mushroom substrate as the raw material, the electrical conductivity must be declared".

(b) Paragraph A. 5 (g) is replaced by the following:

" g) In the fertilizer products of groups 2, 3 and 6, the trade name, in which no figures or expressions may be used which lead to confusion about the type of product, wealth or content, as well as employment of words or prefixes such as 'biological', 'organic', 'organic fertiliser', 'bio' or 'eco', without the corresponding certificate of conformity issued by the authorised inputs certifying entities in organic farming '.

c) Point B. b) is replaced by the following:

" (b) In the fertilizer products of groups 2, 3 and 6, the trade name, in which no figures or expressions may be used which lead to confusion about the type of product, wealth or content, as well as employment of words or prefixes such as 'biological', 'organic', 'organic fertiliser', 'bio' or 'eco', without the corresponding certificate of conformity issued by the authorised inputs certifying entities in organic farming '.

d) Point B. g) is replaced by the following:

"g) The organic matter content in the products of groups 2 (organic fertilizers) and 3 (organo-mineral fertilizers)."

e) Point B. h) is removed.

Three. Annex III 'Tolerance Margins' is replaced by the text set out in Annex II to this order.

Four. In Annex IV, 'List of biodegradable organic waste', at the end of point 02 01 'Waste from agriculture, horticulture, aquaculture, forestry, hunting and fishing', the following heading is added:

"02 01 99 Waste not specified in another category: depleted and subsequently sanitized substrate of mushroom culture".

Five. Annex VI 'Analytical methods' is replaced by the text set out in Annex III to this order.

Single transient arrangement. Tagged.

In those amendments to this order which could affect the labelling of the products currently marketed, they may continue to be labelled in accordance with the previous regulations up to 12 months after entry into effect of this order.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

Note: The use of preservatives to prevent microbial contamination in fertilizer products falls within the scope of Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012, concerning the placing on the market and use of biocidal products. Substances which do not correspond to product type 6 according to Annex V to that Regulation and which are in the European List of Active Substances or in the Review Programme notified for type 6 may not be used. Similarly, the labelling of the final product to which these preservatives are added must comply with the requirements of Articles 58 and 94 of Regulation 528/2012.

The inhibitors of nitrification and urease listed in the following Tables A and B may be added to the types of fertilizers in group 1 of this royal decree, for which the following is true:

1) at least 50% of the total nitrogen content of the fertiliser must consist of nitrogen forms specified in column 3;

2) must not be among the credit rates mentioned in column 4.

In the case of fertilisers to which one of the nitrification inhibitors listed in Table A has been added, the expression 'with an inhibitor of nitrification' shall be added to the name of its type [(name of the type of nitrification inhibitor) ', as well as its percentage in relation to nitrifiable nitrogen.

In the case of fertilisers to which one of the urease inhibitors listed in Table B has been added, the expression 'with urease inhibitor' ([name of the type of urease) should be added to the name of its type. Urease inhibitor]) ", as well as its percentage in relation to ureic nitrogen.

The person responsible for marketing shall include technical information, as complete as possible, in each package or bulk delivery. This information shall enable the user, in particular, to determine the doses and the periods of application depending on the crop in question.

New inhibitors of nitrification or urease may be included in Tables A and B, respectively, after evaluation of the technical dossiers submitted in accordance with Annex VII.

Tolerance Margins

The tolerances given in this Annex are the permissible differences between the value found in the analysis of the content of an element or of another specific characteristic, with respect to its declared value.

The tolerance margins included in this Annex are negative (default) percentage values in mass.

For all fertilizer products, the permissible tolerance shall be also positive (excess values), in quantities equivalent to twice the amount set for the default tolerances specified in this Annex.
