The Royal Decree 1299 / 2006, of 10 November, that approves the picture of occupational diseases in the Social security system and establish criteria for the notification and registration, contains the picture of occupational diseases currently in force in the Social security system. Since that date, breakthroughs have occurred in research and progress in the field of science and medicine, which have allowed a better understanding of the mechanisms of appearance of some occupational diseases and their links with the work.

The Royal Decree 1299 / 2006, of 10 November, contains the list of occupational diseases in annex 1 and is included as annex 2 the supplementary list of diseases whose professional origin is suspected and whose inclusion in annex 1, as occupational disease, could envisage in the future.

Located in annex 2, code C601, larynx cancer produced by the inhalation of asbestos dust. Likewise, strong scientific evidence have since revealed that there is a clear relationship between laryngeal cancer and asbestos.

For his part, articles 1 and 2 of the Royal Decree 1299 / 2006, of 10 November, determine, respectively, the adoption of picture of occupational diseases and the update of the table of occupational diseases, foreseeing that this upgrade will be made by the Ministry of employment and Social security as well as the addition to annex 1 of the diseases included in the annex 2 regarding the role of occupational disease is noted.

To such effects, is included in annex 1, table (encoding), group 6, within the occupational diseases occupational diseases caused by carcinogens and, in particular, asbestos a new subagent, larynx cancer, listing is also the main activities associated with the subagent. For its part, in annex 2, list of diseases whose professional origin is suspected and whose inclusion in the table of occupational diseases could envisage in the future (codification), larynx cancer produced by the inhalation of asbestos dust, because that happens to be included in the abovementioned annex 1, shall be deleted leading also to the renumbering of the Group 6 of annex 2.

In the process, this Royal Decree has been informed by the Ministry of health, social services and equality and by the National Commission on safety and health at work. In addition, it has been subjected to the procedure of hearing of the social agents.

By virtue, on the proposal of the Minister of employment and Social Security, according to the Council of State and after deliberation by the Council of Ministers at its meeting of December 18, 2015, have: single article. 05 6A0605 - application of asbestos to gun (fireplaces, wallpaper cars and wagons).






 





 





 





06 6A0606 - work of insulation in ship-building and buildings.






 





 





 





07 6A0607 - manufacture of fittings for brakes and clutches, fiber-cement products, of fire-fighting equipment, from filters and carton of asbestos, asbestos and rubber gaskets.






 





 





 





08 6A0608 - disassembly and demolition of facilities containing asbestos.






 





 





 





09 6A0609 - cleaning, maintenance and repair of accumulators of heat or other machines that have asbestos components.

Two. In annex 2, supplementary list of diseases whose professional origin is suspected and whose inclusion in the table of occupational diseases could envisage in the future (codification), group 6 is drawn up in the following way: list group agent code description 6 diseases caused by carcinogens 01 C601 diseases caused by carcinogenic agents not incorporated in previous sections, with the C1 (carcinogenic substances of first category classification (i.e., is known to be carcinogenic to man) and C2 (carcinogenic substances of the second category, for which there is a presumption that can be considered carcinogenic to man) given by the RD 1124 / 2000, of 16 June, amending RD 665/1997 of May 12, on the protection of workers from the risks related to exposure to carcinogens at work.





First final provision. Skill-related title.

This Royal Decree is issued under cover of the provisions of article 149.1.17. ª of the Spanish Constitution, which attributes to the State the exclusive competence in the field of economic regime of Social Security.

Second final provision. Entry into force.

This Royal Decree shall enter into force the day following its publication in the "Official Gazette".
