Following the opening of new tranches to navigation in the main embalmed areas of the Guadiana river basin, an update of the limitations and conditions for the exercise of such activity is deemed necessary.

To carry out this objective, a new orderly scheme of reservoirs has been introduced with the zones delimited by UTM coordinates that exposes in a clear way the places where there is some restriction, in this way provides both the user and the monitoring services with the location of the monitoring services.

Essential requirements for public services, events, and special navigation authorizations have been summarized in separate sections, taking into account the growing demand for them.

In the light of the above and under the powers conferred by the Water Act on this watershed body, in particular by Articles 23.1.b), 24.a), 51.a) and 78, and the development of such privileges established by the Regulation of the hydraulic public domain in Articles 51, and 55 et seq., this Presidency, on a proposal from the Commissioner for Water and seen the reports issued by the Autonomous Communities, units of this Agency and Civil Guard Nature Protection Service, resolves:

1. Allow the exercise of daytime navigation, between the sunrise and sunset, in the reservoirs and sections of the Guadiana basin channels indicated in Annex 1 and in paragraph 7, and in the modalities specified therein, without prejudice to limitations, space or time, which may be contained in the following points, provided that the depth available for the practice of navigation or flotation is greater than one metre.

2. The limitations and conditions for the exercise of recreational and recreational navigation refer exclusively to the inland waters of the Guadiana basin. They do not therefore apply to the transitional waters and in particular to the waters of the river Guadiana between the Presa del Chanza and its mouth, as well as those of the ria del Carreras.

3. Windsurfing boards, floats and rowing boats with a length of less than or equal to 2,50 m are considered to be complementary to the bath, subject to the system of common uses of the public hydraulic domain and shall not specify the presentation of a responsible declaration for use. They may only be used in water bodies where bathing is not prohibited. However, in the event of events, due to the condition that occurs in other users, the organizer must present the corresponding responsible statement together with the documentation indicated in point 27 of this resolution.

4. Navigation in any section of unpacked river, which is not included in the approved list, will be reduced to the development of public activities, located in space and time (fishing competitions from boat, routes and descents). (i) the type of vessel, which must be requested at least three months in advance, clearly describing the type of vessel, the type of vessel, the type of water, the type of water, the type of water, activity, indicating the length of the river to be covered, the exact dates or seasons in which it is develop, and the rates to be applied (if applicable), as well as any other relevant facts about the activity. 5. The prior cleaning and disinfection of all vessels as well as the means of floating in events that have been used in waters other than those located in the management area of the Hydrographic Confederation of the Guadiana, are mandatory. In order to prevent the entry of the zebra mussel into the Guadiana basin, which is attached as Annex 2 to this resolution, in terms of application to each case.

6. The Guadiana Hydrographic Confederation has mobile facilities for the cleaning of boats and engines, and for the collection of waste, which can be used upon request, indicating that it is the disinfection of vessels to prevent the invasion of zebra mussel. However, if, for any reason, the Basin Agency cannot, or is not in charge of, provide this service, it shall, on behalf of the declarant, carry out the prior execution of these preventive measures in places eligible for this purpose, provide accreditative certification of their execution.

7. Prohibit all types of navigation in the following areas of navigable reservoirs: The coordinates indicated in the upstream direction in the channels where they are located (except Montijo reservoir which is in the downstream direction) cannot be exceeded.

8. Navigation is allowed with the conditions that are indicated in the following zones:

Spanish area of Alqueva reservoir:

The user's risk and venture navigation is allowed.  In order to facilitate the exercise of navigation in this area, due to the obstacles in this water mass, the Hydrographic Confederation of the Guadiana has developed a Letters of Aid to Navigation, which are available on the page The (www.chguadiana.es) web site and which in no case should replace visual navigation.

Azud de Mérida:

Navigation is allowed on the stretch of the river Guadiana upstream from the tail of the azud de Mérida up to 200 meters before the Villagonzalo baden, except in the immediate vicinity of the intermediate azudes in that section, for which the same safety distance as set out in the following paragraph must be kept.

9. Prohibit the navigation and flotation of less than 200 m of dams, azudes and their intake or drainage organs. In those reservoirs where beacons have been arranged, the navigation in the area between the baling and the dam is prohibited.

10. Prohibit the use of motor-to-blast navigation in the adjacent strips of the reservoirs at a width of 50 m, except for anchorage, stranded or exit. To cross this strip the vessel shall be governed by a trajectory perpendicular to the coast line and always at a reduced speed not exceeding 3 knots (5,5 km/h).

11. Prohibit the mooring of vessels and landing, for any purpose, as well as anchorage and navigation to less than 25 m in the existing islands in all reservoirs.

12. Prohibit navigation at distances of less than 100 m from any bathing area, except in the case of the bag-exit or the exit-board.

13. Prohibit the navigation in all the natural lakes and natural wetlands existing in the territory administered by the Hydrographic Confederation of the Guadiana, with the exception of those and those in which its autonomous legislation corresponding to the navigation as a permitted use. In such cases, the responsible declaration shall be submitted to the competent authority of the competent authority by expressly authorizing the navigation.

14. Navigation of vessels powered by two-stroke carburization engines shall not be permitted.

15. Navigation of motor or sailing vessels of more than 4 metres in length, or of any craft powered by a power engine of 5 hp or more, shall be required to be covered by a compulsory subscription civil liability insurance whose scope and limits are, at least, those laid down in Chapter II of Royal Decree 607/1999 of 16 April 1999 on the regulation of insurance for recreational or sporting vessels. For the risks arising from participation in regattas, tests, competitions of all types and their training, as well as the provision of public services for the rental of any type of vessel, a special insurance must be subscribed intended to cover the civil liability of the interveners, at least for the amounts and with the scope of the mandatory coverage laid down in that Regulation.

16. Limit the power of engines used in the entire basin to a maximum of 240 hp. And, limit the navigation speed of the vessels to a maximum of 16 knots (30 km/h), in any case.

17. The Hydrographic Confederation of Guadiana declines all responsibility for the possible damages and accidents that people and property may suffer from collisions with any type of obstacle existing in the water, either as a consequence of the descent of the levels of the water sheet, either for any other cause occurring in the exercise of the navigation or flotation. In no case will the evolution of levels in rivers and reservoirs be conditioned by the practice of navigation in the rivers and reservoirs.

18. The responsible declaration allows, in accordance with the provisions of article 51bis.3 of the Regulation of the Public Hydraulic Domain, with what is stated in it and under the conditions of this Resolution, the exercise of navigation from the The following day of its presentation in the Guadiana Hydrographic Confederation, without prejudice to the powers of verification, control and inspection of the basin organism. The inaccuracy, falsehood or omission, of an essential character, in any data, manifestation or document accompanying or incorporating the said declaration, or the failure to submit it to this body, shall determine the impossibility of continuing with the exercise of navigation from the moment on which such facts are recorded, without prejudice to the responsibilities, penalties, civil or administrative matters to which there should be.

Once the compatibility with the intended uses for the stored water is proven, protecting its quality and limiting access to the areas of derivation or drainage, the Hydrographic Confederation of the Guadiana will transmit to the interested party within 15 working days of the said declaration with a seal of conformity. The responsible declarations shall be valid for a maximum of one year.

The responsible declaration referred to in Article 3.9 of Law 17/2009 of 23 November (the document subscribed by the person holding a business or professional activity in which he declares, under his responsibility, which complies with the requirements laid down in the regulations in force, which has the documentation that so credits it and which undertakes to maintain its compliance during the life of the activity), on the free access to the activities of services and their financial year, must be submitted with a minimum period of notice of 15 days in order to the compatibility of such uses with the purposes of the public hydraulic domain can be verified.

19. The vessels must bear the corresponding plates on the stribor side, together with the bow and at least 20 cm above the waterline.

20. The responsible declaration allows the exercise of the navigation to the declarant and authorized persons, provided that the corresponding title issued by the competent body is available to his government, with the vessel described in the aforementioned statement. In the case of minors, the parent/guardian shall be responsible for the submission of the declaration.

21. During the exercise of the navigation the user must be in possession of the responsible declaration, certificate of the vessel and, if necessary, certificate of the motor and insurance policy of civil liability, as well as of the necessary certification in your case for the handling of the vessel.

22. Nautical motorbikes are considered to be vessels propelled by an untraborb engine of explosion. However, when an area where an explosion-engine navigation is permitted with another bounded for the celebration of any authorised sporting event, the navigation of non-sea-side motorbikes outside the sporting event shall not be permitted.

23. To establish the charges for the use of the hydraulic public domain for the exercise of navigation and flotation in accordance with the provisions of Article 112 of the Recast Text of the Water Law. This is defined as:

Taxable: Navigation in reservoirs and channels of the public hydraulic domain.

Taxable base: The length and system of displacement as defining parameters of the degree of intensity of the use of the public domain and profit that derives from it. The rateable value of each of the categories has been obtained from the market value of the watercraft and flotation means (Annex 3).

Rate Type: 5 per 100.

The accrual of this fee will be produced by the initial grant and will become payable annually. For periods less than year, it shall be applied for quarterly minimum periods in proportion to the values set out in the following tables:

24. The Guadiana Hydrographic Confederation, at the request of the interested parties, may authorize the navigation in events, activities or services which, even if they do not comply with the limitations of this resolution, are considered sufficiently motivated and compatible with the objectives which the same aims, which may lead to the acceptance by the applicant, prior and express, of the particular circumstances of the authorisation. The application in such cases shall be made at least three months in advance of the date or dates intended for the performance of the activity.

25. For the purpose of navigation for research purposes, surveillance, rescue, technical work for the construction of public works of general interest and for the tasks of the Basin Agency, the responsible declaration for the effects shall be presented to initiate the procedures for the allocation of registration, in compliance with the provisions of Article 58 of the Regulation of the Public Hydraulic Domain. These vessels are exempt from the limitations set out in this resolution except as set out in point 14 concerning the prohibition of sailing with two-stroke engines. Similarly, it is exempt from the payment of the charge for the use of public domain. These vessels shall not be subject to the restrictions per mode of navigation established for each reservoir.

26. The Public Service for the Rental of Ships shall accompany the statement responsible for:

Memory, which will describe the type of activity to be performed.

Rates to Apply (if applicable).

Planned onboarding and beacon zones, as well as any other relevant circumstances about the activity.

If an area within the public domain or its serfdom/police zones is to be permanently occupied, the corresponding administrative authorization shall be requested which shall be independent of the presentation of the declaration. responsible for the exercise of navigation.

In addition, the zone for the exit and access sleeves of the vessels must be placed on both sides, at least 25 m in length, regardless of the bathing areas. For this purpose, the standard spherical type of 40 cm in diameter, referred to in the document "Navigation aid systems (level 2)" of the Ministry of Public Works, in paragraph 4.2.2 of this document, shall be used.

The users of the vessels must have sufficient titration for the handling of the same in any case.

27. In the event of events, the statement responsible for the following information must be accompanied:

Memory of the event that includes a situation plan indicating the areas of the reservoir or section of the river in which the navigation will be carried out, as well as the points of embarkation.

Characteristics of the participating vessels (length, sleeve, power) and number.

It will be specified whether disinfection is carried out or monitored by the Basin Agency (if the organizer has the means to do so).

The application will be submitted in advance of at least 15 days prior to the event.

28. Failure to comply with any prohibition or limitation set out in the above points by users shall mean the opening of the appropriate sanctioning file, with the imposition of the penalties and indemnities that are legally applicable.

29. Users must have sufficient qualifications to enable them for the handling of vessels. The qualifications required according to the modality, length and power will be those established by the Merchant Navy of the Ministry of Development, both for recreation and professionals.

30. The operator and users respond to the fact that their vessels comply with current legislation regarding the stability of the vessels, security elements that they must have and good conservation status for those vessels.

31. Vessels must be provided with the necessary safety and rescue elements for occupants (life jackets and lifters of live colours, acoustic and light signals, etc.).

32. The owner of the vessel must be able to prove that he has certification that he/she accredits the characteristics of the vessel, in which it is indicated: mark, model, number of series, length, sleeve, capacity and maximum permissible power. It may be issued by the Maritime Inspectorate (Ministry of Public Works) or any authorized inspection entity, by the seller, by the manufacturer or by a competent technician, indicating in the latter case the post or position and title. Must be in possession of the declarant at the time of exercising the navigation

33. Repeal the resolution of 4 February 2013 of the Hydrographic Confederation of Guadiana, on limitations and conditions for the exercise of sports or recreational boating in inland waters of the Guadiana basin.

34. This resolution shall enter into force on the day following that of its publication in the Official Gazette of the State.

Ship disinfection protocol to prevent entry of zebra mussel (Dreissena polymorpha) in the Guadiana basin

The zebra mussel (Dreissena polymorpha) is a native species of the waters of the Black and Caspian Sea. Due to its invasive nature and the serious environmental and economic damage it may produce, it is necessary to take preventive measures to prevent its entry into the Guadiana basin.

In particular, regarding the disinfection and cleaning of vessels or materials that may come from areas already infested, since this species has the possibility to move in the larval state in the waters that remain in boats, vehicles or trailers, and even in fishing gear or other utensils.

A. Motor boats.

A. 1 Cleaning of the exterior elements of the vessel, trailer and vehicle. All parts of the vessel, trailer and vehicle which have been in contact with the water, as well as the containers or departments used as nurseries, must be cleaned for the storage of waste water or water from the river. Any remainder that may have been able to adhere to the hull or the engine of the watercraft shall be removed by hot water. The minimum temperature of the washing water must be 60 ° C and preferably must be chlorinated water. The water used in the cleaning of the vessel cannot in any case go to water courses or sewerage networks, it must be collected in tanks or poured directly onto the filter ground.

The use of hydrolysators that meet the following characteristics is recommended:

Pressure: 160 minimum bar.

Working temperature: 60 °C minimum.

Instant Heater.

Flow: 600-1,200 l/h.

A hose of sufficient length to reach all parts to wash with comfort. Power: preferably gasoil, to ensure the operation of any site without the need for electrical power.

If disinfection at the place of entry of the vessel is not possible with a mobile cleaning and disinfection equipment, the nearest fixed disinfection station shall be used. Fumigate with disinfectant solution (1 ml/l must be added, i.e. about 20 drops of bleach per litre of water) the least accessible areas of the vessel.

A. 2 Cleaning and refreshing the engine cooling circuit. The cleaning should be done with a system that ensures the circulation of hot water (60 ° C) by the engine cooling system. There are mainly two types: Immerse the engine in a container with hot water, for small engines. Circulate hot water to pressure through the cooling circuit, directly, if possible, or with the help of special pieces that facilitate this work. At the end of the navigation, refresh the cooling circuits of the engines with clean water. To this end, a small acceleration is recommended before stopping the engine to increase the speed of circulation of the water and the temperature of the engine, thus causing the larvae to die. The engine is then removed from the water and rinsed with clean water.

B. Motor-free boats. Before the vessel is put into a river, it will ensure that the boat or the piragua is completely dry and clean, in order to avoid the transfer of mussel larvae and the introduction of adults. In the place where disinfection is carried out, the water shall be emptied from the inside of the pyrowater or boat. If the pyrowater is insufferable, the interior of the hull must also be emptied. The vessel shall be carefully inspected to remove any remaining attached to the hull.

Fumigate with disinfectant solution (1 ml/l must be added, i.e. about 20 drops of bleach per litre of water) the least accessible areas of the vessel.

C. Sailing boats. The process of disinfection and cleaning of the sailing vessels shall be the same as that of the rowing boats, and if the auxiliary motor is available it shall be cleaned and renovated as set out in paragraph A. 2.

D. Windsurfing and float tables. In events, the surfboards, in their different modalities, or the various means of flotation (float tubes, ducks, catamarans ...) will be subjected to disinfection and cleaning in an analogous way to the boats to rowing.
