Within the area of agricultural health, the actions related to plant and forest health, animal health, the functioning of the veterinary and phytosanitary alert networks, the opening of new ones are of utmost importance. markets abroad for agricultural and livestock products, the traceability of agricultural products and the management and authorisation of animal and plant health products, all within the framework of the European Union and through the cooperation with the Autonomous Communities and the productive sectors.

The constant evolution of agricultural activity, carried out in accordance with the guidelines of the common agricultural policy, makes it necessary to continue modernization in the material, technical and human resources of this sector, in which Spain is one of the countries of the European Union which is becoming increasingly technical and professionalised. It is therefore considered essential that the producer sector should have adequately trained staff.

According to these circumstances, it is highly necessary to call for nine fellowships, which will enable university graduates to be trained in an eminently practical way, which will give them extensive preparation, complementary to the one received within her university studies.

Depending on the available budgetary resources, the management and granting of these grants shall be the responsibility of the General Administration of the State, in accordance with the provisions of Article 149.1.13. Spanish. In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

Article 1. Object.

The purpose of this order is to establish the regulatory basis for granting, on a competitive basis, and in accordance with the principles of advertising, transparency, equality and non-discrimination, of training grants practice, for university graduates in the following areas of knowledge:

(a) Plant and Forestry Health and Hygiene with knowledge in prevention and control of agricultural and forestry pests, plant health surveillance networks, authorisation and use of plant protection products; sustainable use of plant protection products; hygiene and traceability in agricultural and forestry products.

b) Animal health and hygiene, with knowledge in the field of health surveillance and control of animal diseases, veterinary health alert networks, traceability and livestock identification, management of by-products and authorisation of animal health products.

(c) Health and Border Controls Agreements, with knowledge on agricultural and livestock external trade, technical criteria and negotiation for the opening of external markets, and controls at inspection points at borders.

Article 2. Characteristics of the scholarships.

1. The scholarships to be convened will be developed within a practical training programme in the field of the competencies of the Directorate-General for Health in Agricultural Production.

2. The grants will be developed at the headquarters of the Directorate-General for Agricultural Production Health.

3. The training programme shall include the

:

a) Participation in workshops and studies on plant and forest health, animal health and agricultural and livestock trade.

b) Participation in the of the of collegiate bodies on Animal and Plant Health, Hygiene and Traceability and in the elaboration of standards.

c) Collaboration in conducting studies for the opening of new markets.

d) Practical application of administrative law, budgetary management in health programmes and sanctioning procedure.

(d) Collaboration in monitoring and monitoring procedures for the registration and authorisation of plant protection and animal health products.

e) Collaboration in the planning and monitoring of livestock health programmes and prevention and control of plant pests.

f) Collaboration in the monitoring and management of certain information of computer applications corresponding to the Health of Agricultural Production and Foreign Trade, as well as, management and updating of the information and contents relating to the Directorate-General on the Department's Web site.

g) Training and collaboration in the drafting of technical reports, documentation management and project monitoring on the basis of national and Community legislation, animal and plant health, agreements health, animal and plant health products, by-products, identification and traceability.

h) Monitoring and updating of administrative procedures, shared folders, electronic headquarters and other matters relating to the Directorate-General for Agricultural Health.

i) Content analysis, development and updating of information related to technical studies of health, hygiene and agricultural and livestock traceability, as well as studies of external markets on sectoral websites.

4. The granting and enjoyment of the scholarships, given their formative character, will not involve any employment or civil service between the grantee and the Ministry of Agriculture, Food and the Environment and will involve the acceptance of the provisions of the on these bases. The amount to be paid to the grantees in no case shall be the consideration of salary or remuneration, but of economic aid for training and shall not be entitled to compensation for the completion of the internship programme. Without prejudice to this, the grantees shall have, for each full year (computed from 1 January to 31 December) a rest period of 22 working days per year, in which they shall not be required to assist the centre in carrying out their duties, This period should be extended if the amount of time spent on the annual calculation is lower. 5. Each of the scholarships called for involves integral training in a specific subject, which involves carrying out studies and practical training. At the end of the training programme, the Ministry of Agriculture, Food and the Environment, through the Directorate-General for Agricultural Production Health, will provide the person concerned with a report from the teaching tutor mentioned in the Article 11 (1), a certificate of specialization and practical training acquired for the purposes of its curriculum vitae. Participation in the training programme shall in no case be of merit for access to the civil service or for the acquisition of an employment relationship with any public administration or entity linked to or dependent on it.

6. The time of participation in the training programmes referred to in this order shall not be taken into account for prior services or for effective services in public administrations.

Article 3. Requirements of the beneficiaries.

Those natural persons with full capacity to act may be beneficiaries of the scholarships provided for in this order:

a) Being Spanish, or national of a Member State of the European Union or of third countries, legal resident in Spain.

b) Spanish language domain. Documentary evidence will only be required in cases where non-Spanish candidates are involved and who are residing in Spain for a period of less than two years.

(c) Being in possession or in a position to obtain, on the last day of the period of presentation of the scholarships, the university degree of graduate, diploma, graduate, technical engineer or superior, doctor, or equivalent qualifications in the subjects and specialties related to the scholarships to be convened at the time of the grant of the grant. Certificates obtained abroad or in non-state Spanish centres must be approved or recognised and have full legal effects on the date of submission of the application.

Article 4. Duration and allocation of grants.

1. The grants will start from the incorporation of the grantees following the notification of the decision granting them, ending on 31 December 2014, and may be extended annually up to a maximum of four years, ending on 31 December 2014. December 2018, upon request of the beneficiary and in accordance with the assessment by the guardian of the work carried out, and provided that there is budgetary availability in the relevant financial year.

2. The amount of these grants per beneficiary will be EUR 1,150 per month for the year 2014, to which the current discounts and legal holds, including the corresponding social security contributions, will apply. This amount may be updated annually, in accordance with the Consumer Price Index for the previous 12 months.

3. In the month following that in which the certificate of compliance has been issued, as set out in Article 11.1, the payment file shall be processed for the corresponding monthly amount. In no case shall the Ministry of Agriculture, Food and Environment be required to produce the payment during the month following the issue of the certificate of compliance.

The payment of the grant may not be made if the beneficiary is not current in compliance with its tax obligations and with social security.

4. The recipients will be included in the General Social Security Scheme, in accordance with the provisions of Royal Decree 1493/2011 of 24 October on the terms and conditions of inclusion in the scheme. 5. Article 5. Applications and deadline for submission.

1. The applications for the grants shall be directed to the holder of the Department, and may be presented in the General Register of the Ministry of Agriculture, Food and the Environment, or in any of the places provided for in Article 38.4 of the Law 30/1992, of 26 November, of Legal Regime of Public Administrations and Common Administrative Procedure.

2. The submission of applications by electronic means will also be permitted, as provided for in Law 11/2007 of 22 June of electronic access of citizens to Public Services.

3. Applications shall be accompanied by the following documentation:

a) Original, or collated or certified copy or with the character of authentic, of the certification of the qualifications obtained during the university career.

(b) Curriculum vitae of the applicant, in a maximum of four sheets, in standard DIN A4 paper, attaching a certified photocopy of the supporting documents of the alleged merits and containing at least the following paragraphs:

1. Academic qualification and qualification obtained.

2. Specific postgraduate training of subjects and studies of specialisation other than their specific qualifications.

3. Practice Experience.

4. Languages.

5. Informatics.

c) Documentation that specifically accredits the various merits alleged. Such documentation shall be original, or collated or certified or certified as authentic.

(d) Documentation relating to compliance with the tax and social security obligations, unless the Ministry of Agriculture, Food and the Environment has been authorised to request the Agency's request to obtain the Agency's State of Tax Administration and the General Treasury of Social Security, information regarding such compliance.

4. The application shall be signed by the applicant and shall, in any event, include a statement responsible for each applicant for not being in breach of any of the cases referred to in Article 13 of Law 38/2003 of 17 November 2001. Grants.

5. If the application does not meet the requirements set out in this standard, the person concerned shall be required, by publication in the notice board of the Directorate-General for Agricultural Production Health, and on the website of the Department, to be subsane within the period of 10 days, indicating that if you do not do so, you will be given a withdrawal of your request, after a decision that must be given in the terms provided for in Article 71 of the Law 30/1992, dated November 26.

6. It will be the cause of the rejection of the request not to conform to the terms of the call, as well as the concealment of data, its alteration or any manipulation of the requested information.

7. All documentation will be presented in Spanish, or translated officially into Spanish.

8. The documentation submitted by the applicants who have not been selected, must be collected by the applicant or duly authorized person at the headquarters of the General Directorate of Health of the Agrarian Production, Almagro Street, number 33 of Madrid, for a maximum period of two months from the date on which the final award of the grants is made public. After that period, the documentation which has not been withdrawn shall be destroyed.

Article 6. Assessment criteria.

1. The process of evaluation and selection of applications shall be carried out on a competitive basis and in accordance with the principles of advertising, transparency, equality and non-discrimination.

2. This process will consist of two phase-out phases, a first relating to the evaluation of the documentation provided and a second for those in excess of the previous phase, which will consist of a personal interview by the Commission of assessment.

3. The evaluation and selection of applications, in the first phase of the process, will be carried out taking into account the following merits, depending on the scholarship requested, to which they will be applied at most, the scores indicated, being one hundred the maximum points each applicant can obtain:

(a) The academic file corresponding to your specific qualification (maximum of forty points). Each Honor Matricle will be assigned 10 points, each outstanding 9, and 7 each notable.

b) Knowledge of English (maximum of twenty points). According to the Common European Framework of Reference for Languages, 2.5 points will correspond to Level A1; 5 to Level A2, 10 to Level B1, 15 to Level B2 and 20 to Levels C1 and C2. In the event that the knowledge is established by other parameters, the corresponding equivalence shall be carried out.

c) Knowledge of other official languages in the European Union (maximum of ten points). According to the Common European Framework of Reference for Languages, 1,25 points will correspond to Level A1; 2.50 to Level A2, 5 to Level B1, 7.5 to Level B2, and 10 to Levels C1 and C2. In the event that the knowledge is established by other parameters, the corresponding equivalence shall be carried out.

d) Post-graduate training (masters, doctoral courses) related to the subject of the call (maximum of ten points). 5 points per master exceeded will be allocated, and five for having completed doctoral courses.

e) Having practical knowledge, diplomas, publications and courses related to subjects: health and plant and forestry hygiene, animal health and hygiene, agri-food law, administrative law, communication audiovisual, marketing, economics and agricultural policy, statistics, animal health products, plant protection products, food safety, animal by-products management, traceability and animal identification (ten points). 2.5 points will be allocated for each publication, course, diploma, or accreditation of practical knowledge.

(f) to have completed specialization studies (more than 200 hours), other than their specific qualifications and in relation to the specialty of the grant to which they choose, in one of the following subjects: health and plant hygiene; and forestry, animal health, agri-food law, administrative law, audiovisual communication, marketing, economics and agricultural policy, statistics, animal health products, plant protection products, food safety, management of by-products animals, traceability and animal identification (five points). 2.5 points will be allocated for each specialization study over 300 hours, and 5 for each study over 500 hours.

g) Having practical knowledge in the management of computer tools (databases, spreadsheet, word processor) (five points). 1 point will be assigned by accrediting knowledge in word processing, two in spreadsheet, and two in databases.

4. All candidates who do not exceed sixty points in the first phase will be excluded from this call.

5. The second phase of the assessment and selection process will result in a maximum score of 25 points.

6. The final score of the assessment and selection process will be the sum of the two-phase scores.

Article 7. Instruction and resolution.

1. The Directorate-General for Agricultural Production, the Ministry of Agriculture, Food and the Environment, will be responsible for the instruction of the procedure for granting the grants.

2. The assessment committee referred to in Article 8 shall, in the light of the dossier, and in accordance with the criteria referred to in Article 6, evaluate the applications and issue a report specifying the outcome of the assessment carried out.

The instructor, in the light of the file and of the report of the collegiate body, shall make the proposal for a provisional decision to grant the grants, duly substantiated, to be notified to the interested parties by means of publication in the notice board of the Directorate General of Health of Agrarian Production and on the Department's website, and will give a period of 10 days to present claims. Proceedings may be waived where they do not appear in the proceedings or take into account other facts or other arguments and evidence which are adduced by the parties concerned. In this case, the proposed resolution will have the ultimate character.

3. Examined by the Commission on the assessment of the arguments put forward by the parties concerned, if they were related to the assessment carried out, the proposed final decision will be made by the instructor.

4. The proposal for a definitive resolution shall be notified to the persons concerned who have been proposed as beneficiaries by publication in the notice board of the Directorate-General for Health of Agricultural Production and on the website of the Department, so that within a maximum of ten days they will communicate their acceptance. This proposal shall express the ratio of applicants for whom the award of the grants is proposed in order of punctuation and shall include a list of alternates, also ordered in accordance with the score obtained, in the case of communication of acceptance of the grant, waiver or non-incorporation to the Directorate-General for Health of Agricultural Production within the time limit laid down in Article 10 (1) (a) of the successful tenderers.

5. Information on the instruction of the grant procedure, such as the lists of calls to the various stages, dates, schedules and any other relevant ones, as well as the full text of the resolution will be displayed on the board Notice of the Ministry of Agriculture, Food and Environment and on the website of the Department, for a period of not less than fifteen working days. In case of the possibility of consultation via electronic means would be announced by the same procedure.

6. The applications for scholarships will be resolved by the Minister of Agriculture, Food and Environment, notified to the successful bidders and published in the bulletin board of the Directorate General of Health of Agrarian Production, and in the Department's website, within the maximum period of six months from the date of publication of this order.

Article 8. Commission of Valuation.

1. For the implementation of the proposal for the award of grants on applications submitted in the different areas of knowledge, a valuation committee shall be set up, consisting of the following members:

(a) An official who holds a twenty-nine-level job with the Directorate-General for Agricultural Production Health, who will act as president with a vote of quality.

b) A vowel for each of the Subdirections in which the trainees are to perform the training.

c) An official of the General Secretariat for Support and Coordination of the General Secretariat of Agriculture and Food, who will act as secretary, with voice and vote.

The members of the Commission shall be appointed by the Director-General of Agricultural Production Health.

2. The constitution and operation of this Commission will not entail any additional expenditure.

Article 9. Resources.

The final decision referred to in Article 7 puts an end to the administrative procedure, which may be either appealed for in replacement or be directly contested in the court order. administrative-litigation.

According to Articles 116 and 117 of Law 30/1992, of 26 November, against that resolution, the Minister for Agriculture, Food and the Environment may be brought before the Minister of Agriculture, Environment, within a period of one month from the day following that of its notification or publication, if there has been an express resolution, or three months otherwise, counted, for the applicant and other interested parties, from the day on next to the one in which the alleged act occurs.

Article 10. Obligations of the beneficiaries.

1. The grantee who accepts the awarded grant acquires the following commitments:

(a) To be incorporated in the General Directorate of Health of Agrarian Production, within the maximum period of fifteen working days, counted from the notification of the granting resolution.

b) Fulfill the basis of the call and other rules resulting from the application as a result of the call, as well as respect the confidentiality of the information handled, in the terms established in the legislation in effect.

c) Submit certification that you do not have a contagious disease or physical defect that prevents you from carrying out the studies and work that implies the acceptance of the grant.

d) Meet a weekly day of 37.5 hours. Such compliance shall be established by the time-control system established for the purpose by the Directorate-General for Health of Agricultural Production.

e) Accept and comply with the Rules and Rules of Internal Rules of the Center where you are training.

f) Comply with all tasks assigned to you.

g) Do not give up the scholarship until a minimum of six months from the grant of the grant. In addition, the grantee undertakes, in the event of a waiver, to communicate in advance, on the basis of an informed request, the waiver of the grant, as provided for in Article 14.

2. Comply with the obligations which, in general, are laid down in Article 14 of Law 38/2003 of 17 November.

Article 11. Period and form of justification for the work covered by the grants.

1. The General Subdirectorate-recipient of the trainees shall appoint a training tutor, who is responsible for the orientation and development of the training plan which shall certify monthly that the trainee has completed the tasks assigned to him or her. in accordance with Article 10.2 of this Order.

2. Within three months of the completion of the comprehensive programme for the practical training of the grant, the person concerned shall send to the Directorate-General for Agricultural Production a memory of the set of work carried out together with the report. of the person responsible for their training.

3. The above mentioned memory and report will be an essential requirement for the issuance of a certificate of proof of the theoretical and practical training acquired.

Article 12. Failure to fulfil obligations.

1. If any of the causes laid down in Article 37.1 of Law 38/2003 of 17 November are produced, or if the beneficiary does not carry out the tasks assigned to it in time and forms the tasks assigned or does not comply with any of the obligations laid down in the Article 10, shall result in the termination of the right to the collection of the grant and, where appropriate, the reimbursement of the amounts received, in the terms and conditions laid down in Title II of Law 38/2003 of 17 November.

2. In accordance with the provisions of Article 37.2 and 17.3.n) of Law 38/2003 of 17 November, if the non-compliances are due to unjustifiable absences from the centre where they are formed, the deductions shall be made in the monthly amount. corresponding to the proportional portion corresponding to the days of absence.

3. Article 13. Modification of the incompatibilities resolution and regime.

1. Any alteration of the conditions under consideration for the grant of the grant, and in any event the concurrent obtaining of other contributions outside the permitted cases in the regulatory rules, may result in the modification of the grant resolution.

2. The perception of the scholarship is incompatible with any other grant, grant or aid, for the same purpose.

Article 14. Resignations and suspension.

1. If, during the period of duration of the grant, any grantee, on the basis of a substantiated application, has waived the grant, the latter may be awarded to one of the appointed alternates. The grant of the scholarship must be written in writing, at least fifteen working days in advance, and will result in the deprivation of the scholarship for the remaining time.

If undue amounts have been received, the grantee will be obliged to return within 15 working days from his/her perception, proceeding in the event that the refund is not made, as provided for in the The effect of the aid, in Law 38/2003, of 17 November, General of Grants.

2. The Director-General for Health of Agricultural Production may, after having been instructed to do so, suspend the effects of the grant in the case of force majeure occurring to the recipient of the grant.

Article 15. Extension of the grants.

1. The grantee may, at least one month before the end of the period of enjoyment of the grant or the extension provided for in Article 4 (1), make an application for an extension, with the following documentation:

a) Request for prorogation.

b) Memory recording the work done and the results achieved and the objectives to be achieved during the requested extension.

c) Favorable report of the Training Tutor to which the trainee is attached, specifying the work done and the planned work, as well as their dedication, adaptation and level of collaboration.

2. Such request for extension shall be informed by each Subdirector-General, who shall instruct the extension procedure and shall raise the relevant motion for a resolution.

3. The Minister for Agriculture, Food and the Environment shall deliver and notify the resolution on the request for the extension within the maximum period of three months.

The expiry of the maximum period without having been notified of the legitimate resolution to the interested parties to understand the request for the extension of the extension by administrative silence.

Article 16. Advertisement of the scholarships.

In accordance with the provisions of Article 18 of Law 38/2003 of 17 November, and Article 30 of its Rules of Procedure, adopted by Royal Decree 887/2006 of 21 July, the publication in the "Official State Gazette" of the Grants awarded shall be made during the month following each calendar quarter.

Article 17. Financing and maximum amount of expenditure.

The financing of the scholarships to be convened in this order, as well as the payment of the employer's contribution to the Social Security, will be carried out by the budget of the Ministry of Agriculture, Food and Environment, through budget implementation 23.19.412D.788 "Training grants" of the General Budget of the State in force at the time of its granting. The maximum amount of scholarships called is 1,150 euros per month.

The commitments of expenditure arising from the call for grants may not exceed the existing budgetary resources at the time of the grant of the grants.

Additional disposition first. Applicable rules.

In all the provisions of the present order, it will be applicable to the Law 38/2003, of 17 November, General of Grants and in its Rules of Procedure, approved by Royal Decree 887/2006, of July 21, as well as in the Law 30/1992 of 26 November, and how many existing rules will apply.

Additional provision second. Call for scholarships.

1. For the financial year 2014, the granting of nine grants of the regulated in this order, under the principles of publicity, transparency, competition, objectivity, non-discrimination, effectiveness in the compliance with the objectives set out in this order and efficiency in the allocation and use of public resources.

The distribution of the scholarships is as follows:

a) Three in the area of knowledge of Plant and Forest Health and Hygiene with knowledge in prevention and control of agricultural and forestry pests, plant health surveillance networks, authorization and use of products plant protection; sustainable use of plant protection products; hygiene and traceability in agricultural and forestry products.

b) Three in the area of knowledge of Animal Health and Hygiene, with knowledge on health programmes for surveillance and control of animal diseases, veterinary health alert networks, traceability and livestock identification, management of by-products and authorisation of animal health products.

c) Three in the area of knowledge of the Health Agreements and Border Controls, with knowledge on agricultural and livestock foreign trade, technical criteria and negotiation for the opening of external markets; and checks at border inspection points.

2. Grants may be awarded to those referred to in Article 3 of this order for the performance of the activities provided for in this order, within the period referred to in Article 4.

3. Applications shall be submitted in the model of the Annex within a maximum of 15 working days from the day following the date of publication of this order in the 'Official Gazette of the State', accompanied by the documentation referred to in the Article 5.3.

4. The instruction in the procedure shall be carried out in accordance with Article 7, in accordance with the weighting criteria laid down in Article 6.

5. The maximum period for resolving and notifying the decision of the procedure shall not exceed six months from the date of entry into force of this order.

The expiry of the maximum period without having been notified of the legitimate resolution to the interested parties to understand the application for grant of the grant for the administrative silence.

The resolution will be notified to those interested in the terms provided for in Articles 58 and 59 of Law 30/1992, of November 26, and shall be made public as provided for in Article 18.1 of Law 38/2003, of 17 November.

6. The maximum amount to be awarded in the grants is EUR 124,000.00.

The financing of the aid, as well as the payment of the employer's contribution to social security, will be carried out under budget implementation 23.19.412D.788, from the General Budget of the State for 2014.

7. As regards the obligations of the grantees, justification, compatibility, monitoring and control, it shall be in accordance with the provisions of this order, and in Article 17.1 of the Regulation of Law 38/2003 of 17 November, General of Grants, approved by Royal Decree 887/2006 of 21 July.

8. This call shall have effect from the day following that of its publication.

Single repeal provision. Regulatory repeal.

Order APA/225/2007, dated 26 January, is hereby repealed, establishing the regulatory basis for the award of professional training grants for higher graduates in the area of animal health.

Final disposition first. Competence title.

This order is dictated by the provisions of article 149.1.13. of the Spanish Constitution, which attributes to the State exclusive competence in the field of bases and coordination of the general planning of the activity economic.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
