Article 8 of Royal Decree 415/2016 of 3 November, for which the ministerial departments are restructured, determines that the Ministry of Education, Culture and Sport is responsible for the proposal and implementation of the policy of the Government in education, vocational training and universities, as well as the promotion, protection and dissemination of the Spanish historical heritage, the state museums and the arts, the book, the reading and the literary creation, cinematographic and audiovisual activities and state archives and libraries, the promotion and dissemination of culture in Spanish, as well as the promotion of cultural cooperation actions and, in coordination with the Ministry of Foreign Affairs and Cooperation, international relations in the field of culture. It is also up to this Ministry to propose and implement the Government's policy on sport.

Subsequently, Article 7 of Royal Decree 424/2016, of 11 November, establishing the basic organic structure of the ministerial departments, has set the basic structure of the Ministry of Education, Culture and Sport that must be developed at the initiative of the Department, in order to establish in an orderly and exhaustive way the basic lines previously established.

In compliance with this mandate, by this royal decree an organic structure is designed to adapt the organization of the Department to the changes produced in recent years, which manifest mismatches of the structure designed in Royal Decree 257/2012 of 27 January, which has been in force until now, and which meant the integration of the Ministries of Education and Culture, as well as the Higher Council of Sports. Thus, the Department of the administrative structure necessary to perform its functions and to achieve its aims in the most efficient way possible, internally promoting the provision of functions through departmental common services that, in its external dimension, contribute to improving the quality of the services provided to the citizens as an inalienable guideline that justifies and guides the action of the Ministry. The new structure of the Ministry is thus in the works of the Commission for the Reform of Public Administrations that culminated in organizational matters with the approval of Law 40/2015, of October 1, of Legal Regime of the Sector Public, a fundamental rule in the organization of the structure of the General Administration of the State, and the mandate is assumed to adapt the structure of the Department to the requirement to develop the public policies that it is responsible for under the principles of responsibility, simplicity, proximity and effective service to citizens, objectivity and transparency, efficiency, agility, economy, sufficiency and strict compliance with the means for institutional purposes.

Likewise, by this royal decree, it is necessary to modify the Royal Decree 1379/1999, of 27 August, of regulation of the Management of Infrastructures and Equipment of Education and Culture, which changes its denomination and regime legal to contribute to the provision of common services of the entire Department and to be adapted to Law 40/2015 of 1 October, as well as Royal Decree 1138/2002 of 31 October, which regulates the Administration of the Ministry of Education, Culture and Sport abroad, with the aim in this case to adapt this administration to the new regime of dependencies of the administrative units approved by this royal decree.

In its virtue, at the initiative of the Minister of Education, Culture and Sport, on the proposal of the Minister of Finance and Public Service and after deliberation of the Council of Ministers at its meeting of the day of March 24, 2017,

DISPONGO:

Article 1. General organization of the Department.

1. The Ministry of Education, Culture and Sport is the Department of the General Administration of the State in charge of:

(a) The proposal and implementation of Government policy in education, vocational training and universities.

b) The promotion, protection and dissemination of the Spanish historical heritage, of the state museums and of the arts, of the book, the reading and the literary creation, of the cinematographic and audiovisual activities and of the archives and State libraries, and the promotion and dissemination of Spanish culture.

c) The proposal and implementation of Government policy on sport.

Also, it is up to this Department to promote cooperation actions and, in coordination with the Ministry of Foreign Affairs and Cooperation, of international relations in education, culture and sport.

2. The Ministry of Education, Culture and Sport, under the top leadership of the Department's head, develops the functions that legally correspond to him through the following higher and managerial bodies:

(a) The Secretary of State for Education, Vocational Training and Universities.

b) The Secretary of State for Culture.

c) The Assistant Secretary for Education, Culture and Sport.

3. The Superior Council of Sports, an autonomous body assigned to the Ministry of Education, Culture and Sport, whose President has the rank of Secretary of State, will exercise the powers conferred on him by Law 10/1990 of 15 October, of the Organic Law 3/2013, of 20 June, of protection of the health of the athlete and the fight against doping in sport, Royal Decree 460/2015, of 5 June, approving the Statute of the Superior Council of Sports, and the other provisions of the legal order.

4. As an organ of political and technical support to the Minister, there is a Cabinet, with an organic level of Directorate General, with the structure set out in Article 14.2 of Royal Decree 424/2016, of 11 November, establishing the organic structure basic of the ministerial departments.

5. They are collective bodies for the advisory or participation of the Ministry of Education, Culture and Sport in matters of education and universities, the following:

(a) The School Board of the State, which relates to the Ministry through the Secretariat of State for Education, Vocational Training and Universities and which will exercise the functions attributed to it by Article 32 of the Law Organic 8/1985 of 3 July, Regulatory of the Right to Education, and Royal Decree 694/2007 of 1 June, which regulates the School Council of the State.

b) The Council of Universities, which is related to the Ministry through the General Secretariat of Universities, and which will exercise the functions attributed to it in Article 28 of the Organic Law 6/2001, of 21 December, Universities.

c) The Council of State University Students, which relates to the Ministry through the General Secretariat of Universities, and which will perform the functions attributed to it in Article 46.5 of the Organic Law 6/2001, 21 December, from Universities.

d) The Higher Council of Arts Teaching, which is related to the Ministry through the Secretariat of State of Education, Vocational Training and Universities and which will exercise the functions attributed to it by Article 45 of the Organic Law 2/2006, of 3 May, of Education, and Article 4 of Royal Decree 365/2007, of 16 March, for which the Superior Council of Artistic Teachings is regulated.

e) The State Observatory of School Coexistence, which relates to the Ministry through the Secretariat of State for Education, Vocational Training and Universities, and which will perform the tasks assigned to it in Article 2 Royal Decree 275/2007 of 23 February 2007 establishing the State Observatory for School Coexistence.

6. The Institute of Spain and the Royal Academies and Academies at national level are administratively related to the Ministry of Education, Culture and Sport.

7. The National University of Distance Education is administratively related to the Ministry of Education, Culture and Sport through the General Secretariat of Universities.

Article 2. Admembership of public bodies.

1. The following autonomous bodies are attached to the Ministry of Education, Culture and Sport:

a) The National Library of Spain, which is governed by its own legislation, the National Institute of the Performing Arts and Music and the Institute of Cinematography and Audiovisual Arts, which are attached to the Ministry through the Secretariat of State of Culture. The holder of the Ministry holds the chairmanship of these autonomous bodies.

b) The Menéndez Pelayo International University, which is attached to the Ministry of Education, Culture and Sport through the General Secretariat of Universities.

c) The National Agency for the Evaluation of Quality and Accreditation (ANECA) and the Spanish Service for the Internationalization of Education (SEPIE), which are attached to the Ministry through the General Secretariat of Universities.

d) The Management of Infrastructures and Equipment, which is referred to as the OA Management of Infrastructure and Education and Culture Equipment and is attached to the Ministry through the Secretariat, the holder of which will hold its presidency. This body will perform the functions assigned by Royal Decree 1379/1999 of 27 August, regulating the management of Infrastructure and Equipment for Education and Culture.

2. The Museo Nacional del Prado and the Museo Nacional Centro de Arte Reina Sofía, which are governed by their own legislation, are attached to the Ministry of Education, Culture and Sport through the Ministry of Culture. The Minister of Education, Culture and Sport holds the chair of these bodies.

3. The Spanish Agency for the Protection of Health in Sport, which is attached to the Ministry of Education, Culture and Sport, through the Superior Council of Sports, and exercises the powers conferred on it by the Organic Law 3/2013, of 20 June, protection of the health of the athlete and the fight against doping in sport, and the Statute of the Spanish Agency for the Protection of Health in Sport, approved by Royal Decree 461/2015 of 5 June.

Article 3. Secretary of State for Education, Vocational Training and Universities.

1. The Secretariat of State for Education, Vocational Training and Universities shall exercise, in respect of the Units under it, the powers provided for in Article 62 of Law 40/2015 of 1 October 2015 on the Legal System of the Sector Public.

Also, it is up to you to perform the following functions:

(a) The top management of the competencies attributed to the Department in education, vocational training and universities.

b) The ordination, evaluation and innovation of the teachings that make up the Spanish education system.

(c) The fulfilment of the obligations of the public authorities in the field of education, the implementation of vocational training and training programmes and the promotion of equal opportunities in education access to education.

(d) the programming and management of teaching in the field of competence of the Ministry, the development and dissemination of educational guidelines resulting from the rules in force in the field of special regime teaching; as the promotion of vocational training and the basic academic management of its relevant teaching.

e) The design, planning and direction of scholarship policy and study aids.

f) Promoting equality policies, non-discrimination and universal accessibility in the field of their competencies.

g) The impetus and coordination of relations with the Autonomous Communities and local authorities in the field of education.

(h) The functions provided for in the current regulations corresponding to the high inspection of the State.

i) The direction of the policy of teaching staff and the elaboration of the foundations of the legal regime of the teaching public function.

(j) The drawing up of proposals for general provisions on matters falling within their competence, as well as relations and consultations with the Autonomous Communities, universities and legal and natural persons concerned during processing.

k) Own functions as a National Authority linked to the Erasmus + programme or other educational programmes of the European Commission.

l) The direction of international relations in education, vocational training and universities, as well as the follow-up of the European Union's actions in this field; the planning of the administration In the case of education abroad and of Spanish educational establishments of State ownership abroad, as well as the definition of international cooperation programmes, bilateral or multilateral, without prejudice to the competences of the Ministry of Foreign Affairs and Cooperation.

m) The tasks assigned to the Ministry of Education, Culture and Sport in the management of Operational Programmes co-financed by the European Social Fund in the field of education, vocational training and universities.

2. The following management bodies are dependent on the Secretary of State for Education and Vocational Training:

a) The General Secretariat of Universities, with the rank of Undersecretary.

b) The Directorate-General for Territorial Evaluation and Cooperation.

c) The General Directorate of Vocational Training.

d) The General Directorate of Education Planning and Management.

3. As an immediate assistance body to the Secretary of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 14.3 of Royal Decree 424/2016 of 11 November.

Article 4. General Secretariat of Universities.

1. The General Secretariat of Universities shall exercise, in respect of the Units dependent on it, the privileges provided for in Article 64 of Law 40/2015 of 1 October.

Also, it is up to you to perform the following functions:

a) The development of university policy, in coordination with the Council of Universities.

b) The management, programming and management of the actions that are the responsibility of the General Administration of the State in the field of higher education.

c) The coordination of relations with the Autonomous Communities in university matters, through the General Conference of University Policy.

d) The elaboration of the proposals for general provisions in the areas of their competence, as well as the relations and consultations with the Autonomous Communities, the universities and the natural and legal persons concerned during processing.

e) The promotion of collaboration in the field of scientific research, development and technological innovation of universities with other public and private research and innovation agencies.

(f) The planning, coordination and evaluation of the lines of action of the university programmes, except in the areas of R & D + i which will be carried out in collaboration with the Ministry of Economy, Industry and Competitiveness.

2. In particular, the General Secretariat of Universities shall perform the following tasks:

a) The development and promotion of studies and reports on the teaching, research and knowledge transfer activities of universities.

b) The implementation of evaluation, analysis and study activities, as well as those related to innovation and improvement of the quality of university education, and in particular the formulation of the necessary criteria in this field. scope.

c) The development and management of the integrated system of university information, as well as the indicators necessary for the evaluation and monitoring of the Spanish University System, without prejudice to the competences of the Undersecretary for statistical purposes.

d) Planning and monitoring of the financing and cost accounting models of Spanish universities.

e) The coordination of collegiate bodies in university matters.

f) The management of university education, as well as the preparation of the competition rules of the General Administration of the State regarding university education and access to and admission to the university.

g) The development of the European Higher Education Area and the impetus of the actions needed for the adaptation of university degrees.

h) The establishment of the conditions and requirements for the verification and accreditation of official Spanish university degrees, degree, master and doctorate, and for their registration in the Register of Universities, Centers and Titles, referred to the additional twentieth of the Organic Law 6/2001, of 21 December, of Universities, as well as the processing and impulse of the corresponding verification and accreditation procedures.

(i) Those corresponding to the General Administration of the State in respect of the university teaching system and its accreditation, as well as the remuneration of university teachers, and the promotion and promotion of quality of teaching activity.

j) The establishment of the guidelines for the issuance of official university degrees, post-graduate and equivalent, their corresponding registration in the National Register of Titles and the management and custody of the latter.

(k) Recognition of foreign qualifications and qualifications of higher education, post-graduate and equivalent qualifications and the functions that correspond to the Department in relation to the application of the own rules of the recognition of diplomas, for the purpose of exercising the right of establishment and freedom to provide services, and in the field of professional qualifications as a result of the transposition of European Union legislation in this field.

l) Those that correspond to the Department regarding the training of specialists in health sciences, relations with health institutions and the granting and issuance of Spanish titles of specialties in science of health.

m) Those corresponding to the General Administration of the State on the declaration of equivalence, the recognition and approval of other university degrees of their own in respect of the officers, as well as the recognition of civil effects of the titles of the universities of the Catholic Church in accordance with the rules of development of the Agreements between the Spanish State and the Holy See.

n) The programming, coordination and administrative and economic-financial management of aid programs for the training, mobility, improvement and updating of knowledge in post-graduate, doctorate and post-doctorate.

n) The administrative and economic-financial design and management of university loan programs aimed at university students to fund the cost of studies.

o) The programming, coordination and administrative and financial management of aid programmes for the training, mobility, improvement and updating of knowledge of teaching and research staff university and university administration and service personnel.

p) Planning, implementation, dynamisation and management of programmes for the management, modernisation and enhancement of management structures and university infrastructures conducive to consolidation institutions of the universities.

q) The implementation of a comprehensive care system for students and university graduates within the framework of the European Higher Education Area, which responds to their needs and demands in the new educational context and social.

r) The planning, management and management of educational programmes with the outside in the field of university higher education, without prejudice to coordination with the Directorate-General for Planning and Management Educational.

s) The promotion of student mobility within the European Union through the design, planning and, where appropriate, management of action programmes of a national nature or participation in the design and planning of European action programmes, through the SEPIE and in collaboration with the Directorate-General for Education Planning and Management.

(t) The promotion of mobility in the international field outside the Community of students and university graduates in coordination with other specialized agencies and institutions, through the SEPIE and in collaboration with the Directorate-General for Education Planning and Management.

3. They depend on the General Secretariat of Universities, the following Units with organic level of Subdirection General:

(a) The Technical Cabinet, as an organ of support and immediate assistance to the General Secretariat of Universities.

(b) The General Secretariat for Coordination and University Monitoring, which shall exercise the functions assigned to the General Secretariat in paragraphs (a), (b), (c), (d) and (e) of paragraph 2.

(c) The Subdirectorate-General for Academic Management of University Teachings and University Professors, who shall exercise the functions assigned to the General Secretariat in paragraphs (f), (g), (h) and (i) of paragraph 2.

(d) The General Subdirectorate of Titles, which shall exercise the functions assigned to the General Secretariat in paragraphs (j), (k), (l) and (m) of paragraph 2.

(e) The General Training Subdirectorate of the University Teacher and Student Care, who shall perform the functions assigned to the General Secretariat in paragraph 2 (n), (n), (o), (p), (q), and (r).

4. The College of Spain in Paris depends on the Ministry of Education, Culture and Sport through the General Secretariat of Universities.

Article 5. Directorate-General for Evaluation and Territorial Cooperation.

1. It is for the Directorate-General for Evaluation and Territorial Cooperation to perform the following tasks:

(a) Relations of coordination, collaboration and cooperation with the Autonomous Communities, Local Corporations and other Public Administrations, in the field of education, and the promotion of the exchange of information and projects of good practice between the different educational administrations, as well as the planning, management and monitoring of the territorial cooperation programmes and the cooperation and cooperation agreements with the Autonomous Communities in that scope.

b) Assistance and support to the Sectoral Education Conference and other bodies of cooperation between the State and the Autonomous Communities in the field of non-university education.

(c) Coordination and support for the peripheral units of the Department in Ceuta and Melilla, the programming and management of teaching, the processing of transport and school dining aids, planning of needs Infrastructure and educational equipment in Ceuta and Melilla, in collaboration with the Management of Infrastructure and Equipment of Education and Culture, the operating system of the teaching centers and the coordination of personnel policy teaching in the field of territorial competence of the Ministry of Education, Culture and Sport.

d) The establishment of guidelines and minimum modules for concerted education.

e) The elaboration of the basic legal regime of foreign centers teaching in Spain, without prejudice to coordination with the Directorate General of Education Planning and Management.

f) The management of the state register of teachers.

g) The basic academic management of non-university teaching and the promotion of the rules on access systems and admission procedures to the university, in coordination with the General Secretariat of Universities.

h) The establishment of guidelines for the issuance of official Spanish titles and the management of the Central Register of Non-University Titles and the Register of Academic and Professional Titles.

(i) the approval of the equivalence of ratings of qualifications and foreign studies, in the field of their competences, and the approval and validation of such qualifications in the field of their competences.

j) The elaboration of the basic regulations in the field of educational concerts, the establishment of the guidelines and the economic module of distribution of public funds for the support of concerted centers.

k) The development of the foundations of the legal system of the teaching public function and the coordination of the policy of the teaching staff.

(l) monitoring of the provisions and acts of the Autonomous Communities in university and non-university educational matters, and the adoption or proposal of measures arising from the exercise of the functions of high inspection of the State in the field of education.

m) The exercise of the educational inspector function in the field of the Department's competencies.

n) The coordination of actions related to foreign language teaching and language and bilingual teaching programs.

n) The development and promotion of research, innovations, studies and reports on education and the realization and editing of publications and materials on education, according to the Department's editorial program.

o) Support and innovation programmes aimed at the compensation of inequalities, educational inclusion, attention to disadvantaged sectors in the field of education or care for other areas of social interest.

p) Programming and management of actions and plans to promote equal opportunities in access to education.

(q) The coordination of the policies of general evaluation of the education system and the implementation, in collaboration with the corresponding agencies of the educational administrations, of the evaluations that I attribute to the Ministry of Education Education, Culture and Sport the current regulations.

r) The coordination of the participation of the Spanish State in international evaluations and participation in the elaboration of international indicators of education without prejudice to the powers of the Secretariat in statistical matters. Monitoring and participation in the actions of the European Union and other international bodies, as well as in the international cooperation programmes, developed in the sphere of competence of the Directorate-General, without prejudice to the functions corresponding to the Directorate-General for Education Planning and Management, in collaboration, where appropriate, with SEPIE in the field of its competences.

s) The elaboration of the State System of Indicators of Education, and the carrying out of research and studies evaluating the educational system and the dissemination of information that offer both actions.

t) The development and dissemination of curriculum materials and other supporting documents for teachers, design of models for the training of teaching staff and the design and implementation of specific programmes, in collaboration with Autonomous Communities, intended for the scientific and didactic updating of teachers.

u) The elaboration and dissemination of materials in digital and audiovisual support in all areas of knowledge, in order to make information and communication technologies an ordinary instrument of work in the classroom for teachers of the various educational stages.

v) The implementation of specific training programmes, in collaboration with the Autonomous Communities, in the field of application in the Information and Communication Technologies classroom.

w) The maintenance of educational resource portals and the creation of social networks to facilitate the exchange of experiences and resources among teachers.

2. The following units with an organic level of Subdirectorate General are dependent on the Directorate-General for Territorial Evaluation and Cooperation:

(a) The Subdirectorate-General for Territorial Cooperation, which shall exercise the functions conferred on the Directorate-General in paragraphs (a), (b), (c), (d), (e) and (f) of paragraph 1.

(b) The Subdirectorate-General for Academic Management, which shall exercise the functions conferred on the Directorate-General in paragraphs (g), (h), (i), (j) and (k) of paragraph 1.

(c) The Subdirectorate-General of Inspection, which shall exercise the functions assigned to the Directorate-General in paragraphs 1 (l) and (m) of paragraph 1.

(d) The National Centre for Education Innovation and Research, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (n), (n), (o) and (p).

(e) The National Institute of Educational Evaluation, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (q), (r), (s) and (t).

(f) The National Institute of Educational and Training Technologies of the Teacher, who shall perform the functions assigned to the Directorate-General in paragraph 1 (u), (v) and (w).

Article 6. Directorate-General for Vocational Training.

1. It is for the Directorate-General for Vocational Training to perform the following tasks:

(a) The academic organisation of vocational training courses in the education system, in its various forms of offer, including dual vocational training, and the establishment of training qualifications professional and specialization courses.

(b) The coordination relationships in the field of vocational training and lifelong learning and cooperation with the Autonomous Communities and Local Corporations, as well as planning, management and monitoring of programmes and conventions with educational administrations in the field of vocational training and lifelong learning, all in coordination with the Directorate-General for Evaluation and Territorial Cooperation.

c) The establishment of guidelines for the issuance of official Spanish vocational training certificates.

(d) The approval of the equivalence of qualification scales for foreign qualifications and studies of vocational training and the approval and validation of foreign studies in the field of vocational training.

e) The resolution of convalidations and equivalences of Spanish studies with the vocational training of the Spanish education system.

f) The elaboration of the training offer applicable to the department's management in the field of vocational training, the operating system of the integrated centres of competence of the Department, as well as the support and coordination of the peripheral units of the Department in this field and the collaboration in the planning of the needs of teaching staff, infrastructure and educational equipment, in coordination with the Directorate General of Evaluation and Territorial Cooperation.

g) The development of studies, technical work and reports, and the elaboration and implementation of plans for innovation, improvement and promotion of vocational training, as well as measures promoting equality policies, discrimination and universal accessibility.

(h) Information and advice and design of strategies for guidance and vocational training, as well as the maintenance of the portal and social networks to facilitate the exchange of information, experiences and resources in the field of vocational training.

i) The closing operations for the 2007-2013 programming period of the European Social Fund.

(j) The academic organisation of adult education and the development of the training offer applicable to the management of the Department in this field, as well as the management of the Centre for Innovation and Development of Distance Education (CIDEAD) and of specific distance offers for adults.

k) The development of studies, reports and technical work, as well as the design and development of measures that guide learning throughout life, both through activities of regulated and non-regulated teaching.

l) Participation and collaboration in international programmes for adult education, vocational training and lifelong learning, without prejudice to the functions of the Directorate General Planning and Educational Management, in collaboration, where appropriate, with SEPIE in the field of its competencies.

m) The updated development and maintenance of the National Catalogue of Professional Qualifications.

n) The development of the necessary support instruments for the assessment and accreditation of professional skills acquired through work experience and non-formal training pathways.

n) The elaboration and coordination of actions and regulations for the adoption and development of the Spanish Qualifications Framework.

o) The observation of the evolution of Professional Qualifications in their practical integration into the National System of Qualifications and Vocational Training.

2. The following units are dependent on the General Directorate for Vocational Training at the organic level of Subdirección General:

(a) The Subdirectorate-General for Guidance, Vocational Training and Vocational Training Dual, which shall carry out the tasks assigned to the Directorate-General in paragraphs (a), (c), (d), (e), (f), (g) (h) and (i) of paragraph 1 and, in the field of of their powers, the functions of paragraphs (b) and (l) of paragraph 1.

(b) The General Sub-Directorate for Lifelong Learning and Distance Learning, which shall exercise the functions assigned to the Directorate-General in paragraphs 1 (j) and (k) of paragraph 1 and, in the field of its powers, the (b) and (l) of paragraph 1 (b)

(l).

(c) The National Qualifications Institute, which shall exercise the functions assigned to the Directorate-General in paragraphs (m), (n) and (o) of paragraph 1.

Article 7. Directorate-General for Education Planning and Management.

1. It is up to the Directorate-General for Education Planning and Management to perform the following tasks:

(a) The coordination, promotion and monitoring of international cooperation and international relations in the field of education, vocational training and universities, in particular with the European Union, and in particular the assistance to the Minister in the preparation of meetings of the Council of Education Ministers of the European Union, without prejudice to the powers of the Ministry of Foreign Affairs and Cooperation.

b) The planning, management and management of the education services abroad in the Ministry of Education, Attachingand Directorates of existing Programs in different countries, of the Educational Administration in the abroad, and the Spanish schools of state ownership abroad. The development of the legal system of educational action abroad, without prejudice to the powers of the Ministry of Foreign Affairs and Cooperation. The authorization of the creation of private teaching centers abroad.

c) The planning, management and management of educational programs with the outside, without prejudice to the coordination with the actions with the exterior that are carried out in the field of the General Secretariat of Universities.

g) The exercise of the programming, management and control functions as the Intermediate Body of European Social Fund assistance in the 2014-2020 programming period and successive, without prejudice to the closure operations of the European Social Fund. 2007-2013 programming period corresponding to the Directorate-General for Vocational Training.

(h) The administrative and economic-financial management of the state system of grants and aid to the study and other specific aid not subject to such a system, as well as monitoring, monitoring and evaluation of compliance with the obligations for beneficiaries of grants and public aid.

n) The management of the technical unit and the permanent secretariat of the University Observatory of Scholarships, Study Aid and Academic Performance.

2. The following general sub-addresses depend on the Directorate-General for Education Planning and Management:

(a) The Subdirectorate-General for International Cooperation and Educational Foreign Promotion, which shall exercise the functions assigned to the Directorate-General in paragraphs (a), (b), (c), (d) and (f) of paragraph 1.

(b) The Subdirectorate-General for Scholarships, Aid to Study and Educational Promotion, which shall exercise the functions assigned to the Directorate-General in paragraphs (h), (i), (j), (k), (l) (m) and (n) of paragraph 1.

(c) The General Subdirectorate for Programming, Management and Control of the European Social Fund in the field of education, which shall exercise the functions conferred on the Directorate-General in paragraph 1 (g).

Article 8. Secretary of State for Culture.

1. The Secretariat of State of Culture shall exercise, in respect of the Units dependent on it, the powers provided for in Article 62 of Law 40/2015 of 1 October.

Also, it is up to you to perform the following functions:

a) The top management of the competencies attributed to the Department in the field of culture.

b) The promotion, protection and dissemination of Spanish historical heritage, state museums and visual arts.

c) The promotion and dissemination of Spanish culture.

d) The promotion of cultural industries.

e) The defense and protection of intellectual property.

f) The promotion of the book and the reading and the Spanish letters.

g) The promotion, protection and dissemination of state archives and libraries.

h) The modernization and management of the cultural institutions of the Administration

General of the State and, in particular, of museums and state-owned archives.

i) The promotion, protection and dissemination of performing arts, music, dance and circus.

j) The promotion, protection and dissemination of cinematographic and audiovisual activities of production, distribution and exhibition.

k) The elaboration, in collaboration with the Management of Infrastructure and Equipment of Education and Culture, of the plan of cultural infrastructures of the State.

l) The direction of international relations and cooperation in the field of culture, as well as the follow-up of the European Union's actions in this field.

2. The following management bodies depend on the Secretariat of State for Culture:

a) The General Directorate of Cultural Industries and the Book.

b) The Directorate General of Fine Arts and Cultural Heritage.

3. As an immediate assistance body to the Secretary of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 14.3 of Royal Decree 424/2016 of 11 November.

4. For the advice of the Secretary of State for Culture there will be a State Advocate, organically integrated in that of the Department.

Likewise, there is a Delegated Intervention of the General Intervention of the State Administration in the field of the Secretariat of State, organically integrated in the Department's Delegate Intervention.

Article 9. Directorate-General for Cultural Industries and the Book.

1. It corresponds to the Directorate-General for Cultural Industries and the Book, the exercise of the following functions:

(a) The design of policies for the promotion of cultural industries, as well as their development, or coordination when they correspond to specific competencies of the rest of the management centres or public bodies of the Department.

b) The design of policies for action and cultural promotion, as well as their development, or coordination when they correspond to specific competencies of the rest of the departments or public agencies of the Department. Collaboration with other institutions, entities and public or private persons for the development of joint cultural action programs. The promotion of the participation of society in processes of creation, cultural dynamization and obtaining of resources.

(c) Participation in programmes for the promotion of cultural tourism as a strategic element for the development of the cultural sector, in coordination with the bodies of the General Administration of the competent State in Tourism promotion material.

(d) The establishment and management, where appropriate, of the subsidy scheme and aid which is not the specific competence of another management body, in accordance with the objectives set out in the Ministry's programmes.

e) The promotion of cultural patronage through the development of activities aimed at its dynamisation, and participation, together with other bodies of the General Administration of the State responsible for patronage, in the development of measures to promote social participation in the financing of the cultural sector.

(f) The proposal of appropriate measures for the protection and protection of intellectual property and the exercise of the functions that correspond to the Department in relation to the property rights management entities intellectual, with the Secretariat of the two sections through which the Intellectual Property Commission acts, and also the functions attributed to it in the matter of the registration of the intellectual property.

(l) Coordination, impetus and monitoring of international cooperation and international relations in the field of culture, in particular with the European Union and, in particular, assistance to the Minister in the preparation of meetings of the Council of Culture and Audiovisual Ministers of the European Union.

(m) The exercise of the Department's powers in respect of international treaties, international administrative agreements and non-regulatory agreements on culture, as well as advice on participation Spanish in international bodies

n) The design and drive of Spain's cultural promotion abroad.

n) The promotion of programs of international cooperation for the dissemination of Spanish culture, of a bilateral or multilateral nature.

o) Cooperation with the cultural action of the Autonomous Communities, promoting, by common agreement, the cultural communication between them, the knowledge of the plurality and richness of their respective cultural heritages, as well as the exchange of information on their cultural activities.

p) The processing and monitoring of the collaboration agreements of the Secretariat of State with the Autonomous Communities, as well as the follow-up of the acts and provisions of the Autonomous Communities.

q) The promotion of knowledge of the cultural diversity of Autonomous Communities abroad, according to them.

r) The coordination of the European Creative Europe Office, as well as the dissemination and technical advice of the Creative Europe (Subprogramme Culture) and Europe with the Citizens.

2. The following units with organic level of General Subdirection are dependent on the General Directorate of Cultural Industries and the Book:

(a) The General Subdirectorate of Cultural Industries and Patronage, to which the execution of the functions attributed to the Directorate-General in paragraphs (a), (b), (c), (d), and (e) of paragraph 1 corresponds.

(b) The General Subdirectorate of Intellectual Property, which shall exercise the functions assigned to the Directorate-General in paragraph 1 (f).

(c) The General Subdirection of the Book, the Reading and the Spanish Letters, which shall exercise the functions conferred on the Directorate-General in paragraphs (g), (h), (i), (j), and (k) of paragraph 1.

(d) The Subdirectorate-General for International Cooperation and Promotion of Culture, which shall exercise the functions conferred on the Directorate-General in paragraph 1 (l), (m), (n) and (n). These tasks shall be carried out in coordination with the Ministry of Foreign Affairs and Cooperation.

(e) The Subdirectorate-General for Cultural Cooperation with the Autonomous Communities, which shall exercise the functions assigned to the Directorate-General in paragraphs (o), (p), (q), and (r).

Article 10. General Direction of Fine Arts and Cultural Heritage.

1. It is up to the Directorate General of Fine Arts and Cultural Heritage to develop the following functions:

(a) The formation of the Register of Goods of Cultural Interest and the General Inventory of Furniture.

(b) The proposed acquisition of assets of the Spanish historical heritage and of the measures to be taken for their protection and defence.

c) Coordination with the Units of the Ministry involved in the management of assets of the Spanish historical heritage, as well as with the other ministerial departments and, where appropriate, with the other public administrations.

(d) The exercise of the powers that correspond to the General Administration of the State for the application of the legal regime for the protection of historical heritage.

(e) The exercise of powers relating to the operation of the taurine registers, the promotion and protection of bullfighting and the secretariat of the National Committee on Taurus, whose presidency is the responsibility of the holder of the Ministry of Education, Culture and Sport or the authority in which it delegates.

f) The management and promotion of the state owned museums attached to the General Direction of Fine Arts and Cultural Heritage and the exercise of the actions inherent in the ownership of the state museums managed by Autonomous Communities.

g) Coordination with the Ministry's Units with museums or collections of cultural goods, advice on the creation of state museums whatever their ministerial membership, as well as the technical and scientific advice to state owned museums that are dependent on other ministries.

h) The coordination of the Spanish Museum System, cooperation with other administrations and public and private museums in the field of museums, the management of the Register of User Institutions of the Integrated Documentation System and Museographic Management -DOMUS- and the coordination and maintenance of the Digital Network of Museum Collections of Spain.

i) The development of public studies aimed at improving the management of museums attached to the General Directorate of Fine Arts and Cultural Heritage.

j) The elaboration and execution of plans for the conservation and restoration of the real estate of the historical patrimony, without prejudice to the functions attributed to the Management of Infrastructures and Equipment of Education and Culture, as well as cooperation with other public administrations and public or private entities for the development of such plans and their monitoring.

k) The elaboration and implementation of plans for the conservation and restoration of the movable property of the historical heritage, as well as of the funds that constitute the documentary and bibliographic heritage and the cooperation with others Public administrations and public or private entities for the development of such plans and their monitoring.

l) The promotion and promotion of Spanish archaeological research projects abroad.

m) The archiving and systematization of the work done and the documentation available on historical heritage; research and study on criteria, methods and techniques for their conservation and restoration, as well as the training of technicians and specialists in the conservation and restoration of real estate and furniture belonging to that heritage.

n) The promotion of artistic creation and exhibitions and any other dissemination activities of the visual arts.

n) The management of the state ownership and management files attached to the Department, and the advice regarding state ownership files that are dependent on other Ministries.

o) The creation, endowment, and promotion of state ownership files.

p) The coordination of the Spanish Archives System and cooperation with other administrations and public or private entities in the field of archives.

q) The promotion of the conservation of the documentary heritage and its national and international promotion and dissemination.

r) Planning, development, and maintenance of the Department's core file.

s) The development of programs and plans for the promotion and improvement of libraries, as well as the coordination and promotion of library cooperation.

t) The provision of technical services and advice on library matters.

u) The creation, endowment, and promotion of state-owned libraries.

v) Getting, exploiting, and using library data.

w) The coordination and maintenance of the collective catalogue of the bibliographic heritage.

2. The following units with organic level of General Subdirectorate General depend on the General Direction of Fine Arts and Cultural Heritage:

(a) The General Subdirectorate for the Protection of the Historical Heritage, which is responsible for the execution of the functions attributed to the Directorate-General in paragraphs (a), (b), (c), (d) and (e) of paragraph 1.

(b) The Subdirectorate-General of State Museums, which is responsible for the execution of the functions attributed to the Directorate-General in paragraphs (f), (g), (h) and (i) of paragraph 1.

(c) The Subdirectorate-General of the Institute of Cultural Heritage of Spain, which is responsible for the execution of the functions attributed to the Directorate-General in paragraphs (j), (k), (l) and (m) of paragraph 1.

(d) The General Subdirectorate for the Promotion of Fine Arts, which is responsible for the execution of the functions attributed to the Directorate-General in paragraph 1 (n).

(e) The General Subdirectorate of the State Archives, which is responsible for the execution of the functions assigned to the Directorate-General in paragraph 1 (n), (o), (p), (q) and (r).

(f) The General Sub-directorate for Librarian Coordination, which is responsible for the execution of the functions attributed to the Directorate-General in paragraph 1 (s), (t), (u), (v) and (w).

3. The General Directorate of Fine Arts and Cultural Heritage is attached to the Board of Qualification, Valuation and Export of Property of Spanish Historical Heritage.

Article 11. Deputy Secretary for Education, Culture and Sport.

1. The Sub-Secretary for Education, Culture and Sport holds the ordinary representation of the Ministry and the management of its common services, as well as the exercise of the powers referred to in Article 63 of Law 40/2015 of 1 October, and in general, the exercise of the following functions:

a) Support and technical advice to the Minister in the elaboration and approval of the Department's action plans.

b) The elaboration and coordination of the Department's general plans in the field of regulations, budgetary policy, personnel and remuneration, assets, buildings and infrastructure, information technology and communications, economic programming and budgetary control.

c) The impetus, coordination, support and supervision of the Department's general provisions development activities, as well as the efforts related to its publication.

(d) The direction, impetus and management of the functions related to the handling of the affairs of the Council of Ministers, the Government's Delegation Committees and the General Commission of Secretaries of State and Undersecretaries.

e) The promotion and coordination of the relations of the Ministry of Education, Culture and Sport with the courts, with the other Departments of the General Administration of the State, with the Delegates and Subdelegates of the Government and other peripheral organs.

(f) The direction of the inspector's function on the departments, agencies and agencies of the Department, especially as regards the staff, procedure, economic regime, facilities and facilities of the departments, without prejudice to the functions corresponding to the educational inspection.

g) Management of administrative services, rationalisation and computerisation, statistics, administrative information and documentation and the dispatch of cases not attributed to competition from other higher bodies of the Department.

e) The functions of assisting the management bodies in the preparation of the procurement files and in the processing of the procedures for the award of contracts and the assistance and support to the table and board of directors Department procurement, as well as the economic-financial processing of these files when it is not attributed to other Units and agencies.

(f) the economic and financial processing of the grant cases and of the agreements, management and other legal acts and businesses where they involve the acquisition of financial commitments by the Department and are not attributed to other Units and organisms.

i) The elaboration of the personnel policy assigned to the Department and, in particular, its planning and management, by means of the forecast of needs; the proposal of offer of public employment, selection and provision; the proposal of changes in the relationship of jobs; the provision and monitoring of staff expenditure, as well as all aspects arising from the application of the rules in this respect, the provision of staff and remuneration and payroll.

(j) The management of the teaching staff of the Department and the procedures for the mobility of teaching staff at national level, in a coordinated manner with the other educational administrations, without prejudice to the functions of the Secretary of State for Education, Vocational Training and Universities.

k) The training of staff, with the exception of teachers, management of social action and the prevention of occupational risks.

l) The relationship with trade union organizations and other representative professional associations.

m) The impetus, coordination and rationalisation of the information and communications technology (ICT) policy of the Ministry and its various bodies, as well as coordination and cooperation with other administrations and bodies of the State in these matters.

n) The impetus of the digital administration of the Ministry and its agencies in accordance with the departmental action plan for digital transformation and the ICT Strategy of the General Administration of the State and its agencies Public, and the provision of information and communications technology services which it is appropriate to provide as an ICT unit of the Ministry of Education, Culture and Sport, in particular the implementation of services declared as shared.

n) The impetus and coordination within the Ministry and its bodies of the National Interoperability and Safety Schemes and measures to ensure the accessibility of electronic services and compliance with the the departmental obligations for the re-use of public sector information.

q) The management of the citizen's attention through the Citizen Information Center and the telematic services developed to this end.

r) The coordination and publication of digital content on the web portal.

s) The organization and management of the department's registry offices.

t) The exercise of the Transparency Information Unit function of the Ministry of Education, Culture and Sport.

u) The management of complaints and suggestions for services provided by the Department, through the Complaints and Suggestions Unit.

3. It is up to the Secretariat for Education, Culture and Sport, the Technical General Secretariat, to exercise the powers provided for in Article 65 of Law 40/2015 of 1 October, as well as those provided for in Article 12 of this royal decree.

4. The following units are also dependent on the Sub-Secretariat for the organic level of Subdirectorate General:

(a) The Budget Office, which shall exercise the tasks assigned to the Secretariat in paragraph 2 (a), (b), (c) and (d), in addition to those corresponding to its specific rules.

(b) The Deputy Directorate-General for Economic and Financial Management, which shall carry out the tasks assigned to the Secretariat in paragraphs (e), (f) and (g) of paragraph 2.

(c) The General Staff, which shall exercise the functions assigned to the Subsecretariat in paragraph 2 (h).

(d) The General Staff Subdirectorate, which shall exercise the functions assigned to the Subsecretariat in paragraphs (i), (j), (k) and (l) of paragraph 2.

(e) The General Subdirectorate of Information and Communications Technologies, which shall exercise the functions assigned to the Subsecretariat in paragraph (m), (n), (n), (o) and (p) of paragraph 2.

(f) The Office of Attention to the Citizen, who shall exercise the functions assigned to the Subsecretariat in paragraphs (q), (r), (s), (t) and (u) of paragraph 2.

5. The following units are also dependent on the Sub-Secretariat with the organic level of Subdirectorate General:

(a) The Technical Cabinet, as an organ of support and immediate assistance to the Assistant Secretary.

b) The Department's General Inspection of Services, which is responsible for the implementation of the departmental services inspection programmes, the coordination of the actions in the field of gender equality for the Equality Units, and the evaluation of the operation of the institutions and bodies dependent or attached to the Department, as well as the other functions assigned in the current regulations.

6. They are attached to the Secretariat for Education, Culture and Sport, with the functions assigned to them by the provisions in force, and without prejudice to their dependence on the Ministries of Justice and Finance and the Civil Service, respectively, the following organs with an organic level of Subdirection General:

(a) The State Advocate in the Department, in which the State of the State of Culture is organically integrated.

b) The Delegated Intervention of the General Intervention of the State Administration, in which the Delegated Intervention in the field of the Secretariat of State of Culture is organically integrated.

Article 12. Technical General Secretariat.

1. The Technical General Secretariat is the steering body of the Department which exercises the powers provided for in Article 65 of Law 40/2015 of 1 October, and in particular the following functions:

a) The elaboration and proposal of the Department's normative plan and the coordination and momentum of its implementation.

(b) The study, report and, where appropriate, drawing up of the draft general provisions to be issued or proposed by the Department, as well as its administrative procedures, with the exception of the procedures for consultation public, hearing interested parties and public information provided for in Article 26 of Law 50/1997 of 27 November of the Government.

c) Coordination of reports on regulatory projects in other Departments.

(d) The preparation, report and assistance to the Department's senior organs in relation to the matters to be submitted to the Council of Ministers, the Government Delegation Committees and the General Secretariat Commission of State and Undersecretaries.

e) Actions related to the publication of provisions and administrative acts of the Department in the "Official State Gazette".

(f) The actions resulting from the involvement of the Department in the Committee on the Monitoring of Provisions and Acts of the Autonomous Communities and the coordination of the actions of the various management bodies of the Department for the transfer of functions and services to the Autonomous Communities.

g) The processing and proposal for the resolution of the administrative appeals against the provisions and acts of the Department and, in the absence of the express attribution to another body, of its autonomous agencies.

(h) The processing and proposal for the resolution of claims of patrimonial liability against the Department and, in the absence of express attribution to another body, those made against the public bodies attached to the Ministry whenever its resolution corresponds to the holder of the Department.

i) The processing and proposal for the resolution of the procedures for the review of trade and the declaration of lesivity, when referring to acts of the Department.

j) The processing and proposal for the resolution of the procedures for the exercise of the right of petition.

k) Relations with the courts and courts of justice, for the purposes of referral of the files and documents they request, the receipt of their notifications and the preparation of the execution of their judgments, without prejudice As provided for in the current regulations on representation and defense in the State and other public institutions.

It will also be up to you to move the General Administration of the State-Address from the

Legal Service of the State, the application for the exercise of legal actions before any courts, at the request of the competent management bodies for the reason of the matter.

(l) The follow-up to the questions referred for a preliminary ruling and the proceedings against the European Union which affect the scope of the Department's powers, as well as the representation of the Department in the committees and bodies of inter-ministerial character in relation to the Court of Justice of the European Union, where it is not expressly assigned to other management bodies.

r) The organization and direction of the libraries and documentation centers of the Department.

s) The Protectorate of the State Competition Foundations, without prejudice to the provisions of Law 26/2013 of 27 December, of savings banks and bank foundations.

2. The following Units with an organic level of General Subdirection depend on the Technical General Secretariat:

(a) The Technical Vice-Secretary-General, who shall perform the tasks assigned to the Technical Secretariat in paragraphs (a), (b), (c), (d), (e) and (f) of paragraph 1.

(b) The Subdirectorate-General for Resources and Relations with the Courts, which shall exercise the functions assigned to the Technical Secretariat in paragraphs (g), (h), (i), (j), (k) and (l) of paragraph 1.

(c) The Subdirectorate-General for Statistics and Studies, which shall exercise the functions assigned to the Technical Secretariat in paragraphs (m), (n), (n), (o) and (p) of paragraph 1.

(d) The General Secretariat for Documentation and Publications, which shall exercise the functions assigned to the Technical Secretariat in paragraphs (q) and (r) of paragraph 1.

(e) The General Subdirectorate of the Foundation Protectorate, which shall exercise the function assigned to the Technical General Secretariat in paragraph 1 (s).

Additional disposition first. Removal of organs.

The following General Subdirection organic-level Units are deleted:

a) The General Subdirectorate of Educational Foreign Promotion.

(b) The Subdirectorate-General for Academic Coordination and Legal Regime.

c) The General Subdirection of Qualifications and Recognition of Qualifications.

e) The General Subdirection of Scholarship and Student Care, Guidance and Professional Insertion.

f) The General Subdirectorate for Guidance and Vocational Training.

g) The General Subdirection of Lifelong Learning.

h) The General Subdirection of Promotion of Cultural Industries and Patronage.

i) The General Subdirection of Promotion of the Book, Reading and Spanish Letters.

j) The General Subdirectorate for Foreign Promotion of Culture.

k) The Subdirectorate-General for International Cooperation.

Additional provision second. No increase in expenditure.

The application of this royal decree will be made without an increase in the operating costs of the respective management bodies and will not increase public expenditure.

Additional provision third. Territorial organization of the Department.

The territorial services of the Ministry of Education, Culture and Sport in the cities of Ceuta and Melilla depend on the Department, through the Secretary of State for Education, Vocational Training and Universities.

Additional provision fourth. Functional areas of high education inspection.

The functional areas of the High Inspection of Education integrated in the respective Government Delegations and governed by Royal Decree 1330/1997, of August 1, and other rules that apply to them, are functionally dependent of the Ministry of Education, Culture and Sport, through the Directorate-General for Evaluation and Territorial Cooperation.

Additional provision fifth. Supply of top organ holders and managers.

In the cases of vacancy, absence or illness, the following regime of supply is established for the higher organs and managers of the Department:

(a) The persons holding the Secretaries of State shall be replaced by the persons who hold the Directorates General of their dependency, following the order in which they are first mentioned in this royal decree, unless the hierarchical superior common to all of them expressly establishes another replacement order.

(b) The titular person of the Ministry's Secretariat shall be replaced by the holder of the Technical General Secretariat.

c) The persons holding the General Secretariat of the Universities, the Directorates-General and the Technical General Secretariat shall be replaced by the Deputy Directors-General of their dependency, in accordance with the order in which they are mentioned for the first time in this royal decree, except that the hierarchical superior common to all of them expressly establishes another order of substitution.

Additional provision sixth. Consolidation of ICT Units.

In the exercise of the functions of impulse, coordination and rationalization of the policy in the field of information and communications technologies of the Ministry and its various agencies, the Subdirectorate General of Information and Communications Technologies of the Ministry of Education, Culture and Sport will promote, in collaboration with the competent units of the public bodies attached, the consolidation of human resources, economic-budgetary, technical and related materials.

Additional provision seventh. Regulatory references to deleted organs.

The references that are made in the legal order to the organs that are deleted by this royal decree will be understood to be those that are created, replaced or assume their competences in this same norm.

First transient disposition. Units and positions of lower rank to General Subdirection.

1. The units and posts of lower organic level to Subdirección General will continue to remain and will be paid from the same budgets, until the corresponding relation of the positions of the Ministry Education, Culture and Sport, adapted to the organic structure approved by this royal decree. This ratio of jobs will not be able to generate increased personnel costs.

2. The units and posts of work in the organs removed by this royal decree shall be provisionally attached, by means of a resolution of the Deputy Secretary, until the new employment relationship, to the new organs regulated in this royal decree, depending on the attributions they have assigned.

Second transient disposition. Collegiate Contracting Bodies.

Without prejudice to the provisions of the transitional provision first and until the Ministerial Order to adapt the collective contracting organs to the structure established in the present royal decree is approved, subsistiran with the structure and powers conferred on them by those set out in Order ECD/1982/2012 of 13 September 2012 establishing the Ministry of Education, Culture and Sport and the Board of Contracting of the Ministry of Education, the Secretary of State for Culture.

Transitional provision third. Concentration of economic-financial processing.

Without prejudice to the provisions of the first transitional provision, the Units of the Secretariat of State of Education, Vocational Training and Universities and of the Secretariat that until the entry into force of this royal decree carry out the economic and financial processing of the procedures whose administration is assigned to them, continue to carry out this function on a provisional basis and until, by means of a decision of the Deputy Secretary, their final allocation is determined to the General Secretariat for Economic and Financial Management.

In the resolutions handed down by the Undersecretary, the Units and procedures affected will be specified and the date on which the Subdirectorate-General for Economic and Financial Management will effectively exercise the economic-financial of these procedures.

In no case shall this attribution alter the functions of administrative management of the procedures to be exercised by the Units, nor shall it affect the economic and financial management of those Units to which it expressly reserves this function in this royal decree or has been attributed to them by another provision.

Single repeal provision. Regulatory repeal.

The provisions of the same or lower rank are repealed as long as they oppose the provisions of this royal decree and, in particular, Royal Decree 257/2012, of 27 January, for which the basic organic structure of the Ministry of Education, Culture and Sport.

Final disposition first. Amendment of Royal Decree 1379/1999, of 27 August, of Regulation of the Management of Infrastructure and Equipment of Education and Culture.

Royal Decree 1379/1999, of 27 August, of Regulation of the Management of Infrastructure and Equipment of Education and Culture, is amended as follows:

One. Article 1 is worded as follows:

" 1. The OA Management of Infrastructure and Equipment for Education and Culture is an autonomous body attached to the Ministry of Education, Culture and Sport through the Undersecretary of Education, Culture and Sport.

2. The agency has its own legal personality and ability to act and is governed by the provisions of Law 40/2015 of 1 October, of Legal Regime of the Public Sector, in this royal decree and in the other provisions of application to the agencies self-employed by the General Administration of the State. '

Two. Article 2 is worded as follows:

" Corresponds to the OA Management of Infrastructure and Equipment of Education and Culture, the monitoring, promotion and execution of investments in educational, cultural and administrative infrastructures and equipment in the property owned or managed by the Ministry of Education, Culture and Sport, as well as the management of all these buildings, without prejudice to the powers and functions conferred on others in these areas Public units or agencies of the Department. "

Three. Article 3 is worded as follows:

" The OA Management of Infrastructure and Education and Culture Equipment will develop the following functions:

(a) The planning, programming, promotion and development of investments in educational and cultural infrastructure and equipment of the Ministry of Education, Culture and Sport in collaboration with the Administrative Units competent, excluding those expressly attributed to other Units or agencies of the Department.

b) Planning, programming, boosting and developing infrastructure investments in the Department's administrative headquarters.

(c) The supervision of the projects of the works to be carried out by the Ministry and its public bodies, except those whose regulatory provisions provide for such a function.

d) The development of technical reports and studies on the state of the real estate dependent on the Department, as well as on any other building or solar when required by that.

(e) the preparation of technical reports on compliance with the rules in force in private centres where the teaching of general non-university education is to be provided for the purposes of administrative authorisation; the field of competence of the Ministry of Education, Culture and Sport.

f) The development of technical infrastructure execution jobs.

(g) Monitoring and inspection of the implementation of infrastructure where they are the subject of total or partial funding from the budget of the body, as well as the accreditation of compliance with the requirements for payment of the the grants awarded.

(h) The processing of administrative procedures for the implementation of infrastructure in buildings subject to their competence, in particular those relating to the management of the procurement of specific works for the creation or adaptation infrastructure and, where they are not attributed to other units or bodies, the procurement of the equipment necessary for its operation.

i) The property management of the buildings which, by any title, use the Department, except where it is directly attributed to another Directorate General or public body thereof, in particular legal businesses provided for in Law 33/2003, of 3 November, of the Patrimony of Public Administrations To these effects will have the consideration of unit of the Ministry responsible for the administration, management and conservation of the assets and rights of the Heritage of the State concerned or attached to the Department or the Management and Coordination of Actions with the General Directorate of State Heritage for the proper administration and optimization of the use of real estate, in the terms set out in Article 13 of the aforementioned Law.

(j) The management and formalisation of agreements with public and private entities, provided that they relate to matters covered by the competence of management, as well as the assumption of economic or other obligations which are derived from the subscribed ones and thus be established in them.

(k) The administration of human resources, internal arrangements, staff training, intrend, recording and reporting, general archiving, implementation of the body's general accounts, the preparation of its budget and their modifications and settlement, payment and cash. "

Four. Article 4 (1) is worded as follows:

" 1. The President of the OA Management of Infrastructure and Equipment for Education and Culture is the Assistant Secretary for Education, Culture and Sport. "

Five. Article 5 (1) shall have the following content

" 1. They depend on the President of the OA Management of Infrastructures and Equipment of Education and Culture, the following Units with organic level of Subdirection General:

(a) The Technical Secretariat for Infrastructure, which shall carry out the tasks assigned to the body in Article 3 (a), (b) and (c). It shall also assist the President in the direction and coordination of his or her dependent services and in the dispatch of all matters entrusted to him or in the delegation.

(b) The General Economic and Administrative Subdirectorate, which shall exercise the functions conferred on the body in Article 3 (j) and (k).

(c) The Subdirectorate-General for Works, which shall carry out the tasks assigned to the body in paragraphs (d), (e), (f) and (g) of Article 3.

(d) The General Subdirectorate for Procurement and Heritage Management, which shall exercise the functions conferred on the body in paragraphs (h) and (i) of Article 3. "

Six. Article 6 is repealed.

Final disposition second. Amendment of Royal Decree 1138/2002 of 31 October 2002 regulating the Administration of the Ministry of Education, Culture and Sport abroad.

Royal Decree 1138/2002 of 31 October, which regulates the Administration of the Ministry of Education, Culture and Sport abroad, is amended as follows:

One. Article 1 is worded as follows:

" The Board of Education are technical bodies of the Spanish Diplomatic Missions or Permanent Representations which, in accordance with the provisions of Article 45.3 of Law 2/2014, of 25 March, of the Action and of the The State's Foreign Service, under the hierarchical dependence of the Ambassador, is organically and functionally dependent on the Ministry of Education, Culture and Sport, through the Secretariat of State for Education, Vocational Training and Universities. Department, to which it is appropriate to define the actions and programmes of action, internal organisation and budget allocation, as well as its technical inspection and control, without prejudice to the actions of the Department's inspection of services. '

Two. Article 4 (2) is worded as follows:

" 2. They shall also have the budgetary appropriations entered in the General Budget of the State, through the Directorate-General for Planning and Educational Management of the Ministry of Education, Culture and Sport. "

Final disposition third. Powers of development.

The Minister of Education, Culture and Sport is hereby authorized to take the necessary measures for the development and execution of this royal decree, prior to the implementation of the appropriate legal procedures.

Final disposition fourth. Budgetary changes.

In order to comply with the provisions of this royal decree, it will be carried out in accordance with the provisions of Law 47/2003 of November 26, General Budget, the budgetary modifications that are necessary.

Final disposition fifth. Entry into force.

This royal decree will enter into force on the same day as its publication in the "Official State Gazette".
