The Technical Regulation on the Control and Certification of Seeds of Fodder Plants, approved by Order ARM/3370/2010, of 27 December, establishes the requirements that must be fulfilled in the process of production of the seeds of fodder plants, in accordance with the provisions of Council Directive 66 /401/EEC of 14 June 1966 on the marketing of fodder plant seed.

The General Technical Control and Certification Regulation of Semillas and Plants of Vivero, approved by Order of 23 May 1986, establishes the general system of control and certification for the production and use of seeds and nursery plants, as well as the establishment of rules for the movement and trade of such plants, in accordance with the different Council Directives on the marketing of seed and nursery plants.

Council Directive 66 /401/EEC has been amended by Commission Implementing Directive (EU) 2016/317 of 3 March 2016 amending Directives 66 /401/EEC, 66 /402/EEC, 2002 /54/EC, 2002 /55/EC, Council Directive 2002 /56/EC and 2002 /57/EC as regards the official label of seed packages.

Commission Implementing Directive (EU) 2016/317 of 3 March 2016 amending Directives 66 /401/EEC (Forages), 66 /402/EEC (Cereals, maize and sorghum), 2002 /54/EC (Beetroot), 2002 /55/EC (Horticulture), 2002 /56/EC (Potato) and Directive 2002 /57/EC (oilseeds and textiles). However, it is only necessary to transpose the part concerning the Forrajeras Directive into the Technical Regulation on the Control and Certification of Fodder Plant Seeds, and the part concerning the "label number" of the final non-certified seed, by the addition of that mention in the General Technical Control and Certification Regulations of Seed and Plant of Vivero, because in the other species of seeds is already included in the corresponding Technical Regulations the mentioned mention to the "number of the label".

Thus, the aforementioned mention is provided in the Technical Regulation of Control and Certification of Cereal Seeds, approved by the Order ARM/3368/2010 of 27 December, in point (a) of Chapter VIII, in relation to the Regulation General of Control and Certification. The General Technical Regulation on the Control and Certification of Seeds and Plants of Vivero, approved by Order of 23 May, in paragraph 20 of Chapter V, indicates that the official labels will contain, among other data, the number of the label.

In the same way, the relationship with the General Technical Regulation of Control and Certification of Semillas and Plants of Viveros is provided for in the Technical Regulation of Control and Certification of Seeds of Maiz, approved by the Order ARM/3369/2010 of 27 December 2010 in point (a) of Chapter VIII of Chapter IV of Chapter IV of the Technical Regulation on the Control and Certification of Seeds of Sorgo, approved by Order ARM/3374/2010 of 27 December 2010; Chapter VIII of the Regulation of the Technical Control and Certification of Beetroot Seeds, approved by Order of 1 July of 1986; in Section X.2 of Chapter X of the Technical Regulation of Control and Certification of Seeds of Horticultural Plants, approved by Order of 1 July 1986; in Article 5 of the Technical Regulation of Control and Certification of Patata of Sowing, approved by Royal Decree 27/2016 of 29 January; in point (a) of Chapter VIII of the Technical Regulation of Control and Certification of Seeds of Oil Plants, approved by Order ARM/3371/2010 of 27 December; and in point (a) of Chapter IX of the Technical Regulation of Control and Certification of Textile Plant Seeds, approved by Order ARM/3372/2010 of 27 December 2010.

In this way, this rule incorporates the aforementioned part of the Commission's Implementing Directive 2016 /317/EU of 3 March 2016 into the internal legal order through the corresponding amendment of the Regulation. Technical Control and Certification of Seeds of Foraging Plants, and of the General Regulation of Control and Certification of Seeds and Plants of Vivero.

In the preparation of this provision, the Autonomous Communities and the representative entities of the sectors concerned have been consulted.

In its virtue, according to the State Council, I have:

Article one. Modification of the Technical Regulations of Control and Certification of Seeds of Foraging Plants, approved by the Order ARM/3370/2010, of December 27.

The following text is added in point (A) of Annex III to the Technical Regulation for the Control and Certification of Seeds of Fodder Plants, approved by Order ARM/3370/2010 of 27 December 2010:

"(a) For seeds of prebase, base and certified category: below" Lot number "is added" and officially attributed order number ".

b) For commercial category seed: following "Lot number" is added "and officially attributed order number".

c) For seed mixtures: following "Lot number" is added "and officially attributed order number". "

Article two. Amendment of the General Technical Control and Certification Regulations of Seed and Plant of Vivero, approved by the Order of 23 May 1986.

Article 26.b) of Chapter V of the Technical Regulation on the Control and Certification of Seeds and Plants of Vivero, approved by Order of 23 May 1986, is amended as follows:

One. In point (a), the following indent is added below the 'Reference number for the field or lot': 'Officially attributed order number'.

Two. In point (b), the following indent is added to the 'Field or lot reference number': 'Officially attributed order number'.

Final disposition first. Incorporation of European Union law.

By this order, Article 1 of Commission Implementing Directive (EU) 2016/317 of 5 January 2016 amending Council Directive 66 /401/EEC on the approximation of the laws of the Member States relating to the protection of the the placing on the market of fodder plants and, as regards non-final certified seed, Articles 2 to 6, inclusive, of the same.

Final disposition second. Entry into force.

This order will take effect on April 1, 2017.
