Act No. 2005-24 of 11 August 2005 authorizing the President of the Republic to ratify the Protocol amending Article 56 of the Convention on the International Civil Aviation, signed in Montreal of 6 October 1989

EXPOSE REASONS

Concerned by the need for greater representation of member states, the Assembly of the International Civil Aviation Organization at its twenty-seventh session adopted, in Montreal on 6 October 1989, the Protocol amending the Article 56 of the Convention on the International Civil Aviation.

The main objective of this amendment is to increase the number of members of the Air Navigation Committee from fifteen to ten.

The Protocol shall be subject to ratification by any Contracting State which has ratified or acceded to the Chicago Convention (which is the case for Senegal). It shall enter into force on the day of the deposit of the one hundred and eighth instrument of ratification in respect of the States which have ratified it.

The ratification by Senegal of the Protocol amending Article 56 of the Convention on Civil Aviation

International, would allow our country to work to improve air navigation in the world.
This is the economy of this bill.

The National Assembly adopted its meeting on Wednesday, 1 August 2005;

The President of the Republic enacts the following legislation:


Sole Article. -
The President of the Republic is hereby authorised to ratify the Protocol amending Article 56 of the Convention on the International Civil Aviation, signed at Montreal on 6 October 1989.

This Law shall be enforced as the law of the State.

PROTOCOL

Amending Article 56 of the Convention relating to the International Civil Aviation signed in Montreal on 6 October 1989.

The Assembly of the International Civil Aviation Organization,

Having met in Montreal on 6 October 1989, at its twenty-seventh session,

Having noted the general desire of the Contracting States to increase the number of members of the Air Navigation Board,

Having considered that it was appropriate to increase from 15 to
Nineteen the number of members of that body,
Having considered it necessary to amend the Convention relating to the International Civil Aviation made at Chicago on the seventh day of December 1944,

Approves, in accordance with the provisions of Article 94 (a) of the aforementioned Convention, the following draft amendment of the said Convention:

" Replace expression " Quize members " By
" 19 members " Article 56 of the Convention;

2. Set to one hundred and eight the number of Contracting States whose ratification is necessary for the entry into force of that amendment, in accordance with the provisions of Article 94 (a) of the said Convention;

3. Decides that the Secretary-General of the International Civil Aviation Organization shall establish in the English, French, Spanish and Russian languages, each of which shall be equally authentic, a protocol concerning the above-mentioned amendment including the Provisions below:

(a) the Protocol shall be signed by the President and the Secretary-General of the Assembly;

(b) be subject to ratification by any Contracting State which has ratified or acceded to the Convention relating to the International Civil Aviation;

(c) the instruments of ratification shall be deposited with the International Civil Aviation Organization;

(d) the Protocol shall enter into force on the day of the deposit of the one hundred and eighth instrument of ratification in respect of the States that have ratified it;

(e) The Secretary-General shall immediately notify all Contracting States of the date of deposit of each instrument of ratification of the Protocol;

(f) the Secretary-General shall immediately notify all States Parties to the said Convention of the date on which the said Protocol enters into force;

(g) the Protocol shall enter into force, with respect to any Contracting State which has ratified it after the said date, as soon as that State has deposited its instrument of ratification with the International Civil Aviation Organization.

Consequently, in accordance with the above decision of the Assembly.

This Protocol has been prepared by the Secretary-General of the Organization.

In witness whereof, the President and the Secretary-General of the twenty-seventh session of the Assembly
The International Civil Aviation Organisation, duly authorised to that effect by the Assembly, have signed this Protocol.

Done at Montréal on October 16, 1989 of the year thousand nine hundred and ninety-nine, in a single document in the English, French, Spanish and Russian languages, each of the texts being equally authentic.

This Protocol shall be deposited in the archives of the International Civil Aviation Organization and certified copies shall be transmitted by the Secretary-General of the Organization to all States party to the Convention relating to The International Civil Aviation in Chicago on December 7, 1944.
