Decree No. 2008-43 of 25 January 2008

Decree No. 2008-43 of 25 January 2008 on the responsibilities of the Minister for the Public Service, Employment, Labour and Professional Organizations.

The President of the Republic,

Having regard to the Constitution, in particular Articles 43, 53 and 76 thereof;

In view of Decree No. 2007-826 of 19 June 2007 appointing the Prime Minister;

In view of Decree No. 2007-1493 of 12 December 2007 establishing the composition of the Government;

In view of Decree No. 2008-01 of 3 January 2008 on the distribution of the services of the State and the control of public institutions, national societies and public participation societies between the Presidency of the Republic, the Primature and the Departments;

On the proposal of the Prime Minister,

Article 1. - Under the authority of the Prime Minister, the Minister for the Public Service, Employment, Labour and Professional Organisations prepares and implements the policy defined by the Head of State in the fields of civil service, Employment, Labour, Representation and Protection of Workers and Employers, and Social Security.

It is responsible for the administration of public officials under the general status of civil servants as well as non-state officials.

It represents the State in the relevant international technical bodies in the field of civil service and social security.

It ensures that a dynamic public service policy is in place. It ensures the productivity of public administrations and ensures that the administration of the State is at the service of the country's development.

It encourages a good reception of users. It ensures the timeliness of the responses given to the constituents. It puts in place performance indicators within administrations.

It ensures the quality of the social dialogue between the state and its agents.

It prepares labour relations legislation and regulations and ensures compliance with them, in particular through the work of the Labour Inspectorate.

It ensures the working conditions, in particular women, and ensures, in connection with the Minister for Family, Women's Entrepreneurship and the Micro-Finance, that children do not work in conditions contrary to the existing texts.

It ensures the quality of relations between employees and employers in the dual perspective of the protection of the tavailleurs and the competitiveness of the economy.

It is the guarantor of the free exercise of trade union rights in accordance with the rules governing them. It is the interlocutor for professional organisations of employees and employers and promotes dialogue between these two categories of organisation.

It implements employment policies with a view to improving the functioning and transparency of the labour market, excluding specific tasks devolved to the Minister responsible for employment of young people.

It may, as a matter of necessity, have all the employment structures of the State concerned.

It is responsible for the monitoring and the proper functioning of social security agencies.

It implements a policy for the development of the social security of workers.

Art. 2. Decree No. 2007-989 of 7 September 2007 on the powers of the Minister of the Public Service, Employment, Labour and Professional Organizations is repealed.

Article 3. - The Prime Minister and the Minister of Public Service, Labour, Employment and Professional Organisations shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal.
