Decree No. 2008-43 January 25, 2008 order No. 2008-43 January 25, 2008 on the powers of the Minister of the public service, employment, labour and professional organizations.
The President of the Republic, pursuant to the Constitution, particularly articles 43, 53-76;
Having regard to Decree No 2007 - 826 19 June 2007 appointing the Prime Minister;
Considering Decree No. 2007 - 1493 12 December 2007 establishing the composition of the Government.
Mindful of Decree No. 2008-01 of January 3, 2008 on the allocation of services of the State and control of public institutions, national companies and companies with public participation between the Presidency of the Republic, the Prime Minister's Office and ministries;
On the proposal of the Prime Minister, enacts as follows: Article 1. -Under the authority of the Prime Minister, the Minister of public service, employment, labour and professional organizations prepares and implements the policy defined by the head of State in the areas of public service, employment, labour, representation and the protection of workers and employers, as well as social security.
It is responsible for the administration of public officials under the general status of officials as well as non-State servants.
He represents the State within the international technical bodies for public service and social security.
It ensures the implementation of a dynamic public service policy. It ensures the productivity of public administrations and that the administration of the State is at the service of the development of the country.
It fosters a good home for users. It ensures the timeliness of responses to citizens. It implements the KPIs within administrations.
It ensures the quality of the dialogue between the State and its agents.
It prepares the legislation and regulations relating to labour relations and ensures their respect, including through the activities of the Labour Inspectorate.
It ensures working conditions, especially women, and ensures, in relation to the Minister of family, women's entrepreneurship and microfinance that children do not work in conditions contrary to the legislation in force.
It ensures the quality of relations between employees and employers in the double perspective of the protection of the tavailleurs and the competitiveness of the economy.
It is the guarantor of the free exercise of trade union rights in respect of the texts that govern. He is the interlocutor of the professional organizations of employees and employers and promotes the dialogue between these two categories of organization.
It implements employment policies to improve the functioning and the transparency of the market of labour, excluding the specific tasks assigned to the Minister responsible for employment of young people.
It might have as required of all competent State structures in employment.
He is responsible for the monitoring and the proper functioning of social security institutions.
It is implementing a policy of development of the social security of workers.
S. 2 - Decree No. 2007-989, September 7, 2007 on the powers of the Minister of public service, employment, labour and professional Organisations is repealed.
S. 3 - the Prime Minister and the Minister of public service, labour, employment and professional organizations are responsible, each in relation to the implementation of this Decree which shall be published in the Official Journal.
