Establishing the National School of Administration (ENA) and setting its organisational and operating rules

PRESENTATION REPORT

After the first three decades of existence of the National School of Administration and Magistracy (ENAM), the public authorities had ordered to take stock of its functioning. The proposals of the steering committee set up for this purpose led to the enactment of Decree No. 92-1614 of 20 November 1992.

The decree establishes, on the one hand, the creation of a cycle B within the establishment in place of the Centre for Training and Administrative Development (CFPA) and, on the other hand, the adoption of a set of measures to adapt the training To the objective of modernisation of the state.

Further developments have taken place, including the establishment of the Judicial Training Centre in the Judicial Training Centre (CFJ), an autonomous structure under another jurisdiction.

Today, the context is mostly marked:

-first, by the emergence of a new public management based on strategic management, outsourcing and contracting, managing for results and assessing the performance of administrations;

-secondly, by the need to strengthen the training position of the ENA in the sub-region.

It is therefore necessary to reform the status, organisation and operation of the ENA so that it can adapt to this environment and contribute more to the improvement of the quality of the public service and the influence of its know-how.

It is in this dynamic of reform that a steering committee has been set up. At the end of its work, the Committee concluded, inter alia, with the following conclusions:

-the need to change the status of the ENA to more managerial autonomy so as to enable it to value its assets and seize the opportunities offered in a training sector which has become competitive. Therefore, the present draft decree proposes to transform the ENA into a public administrative institution;

-the extension of the quality of student civil servants to pupils in cycles B;

-opening up new channels to meet the needs that have emerged with the transformations that affect the public sector and its environment.

With this new status, the school will now have the opportunity to perform, on the one hand, a decisive rebalancing between initial training, continuing education and research and, on the other, to stimulate and develop partnerships Necessary with high level schools and training institutes in the field of public administration, as well as private structures and international organisations.

The reform must enable the ENA to improve its training offerings, to develop research projects and to promote its expertise in administrative sciences.

Within this framework, the school is restructured in accordance with its status as a public institution with, in particular, a Board of Directors, a Directorate Committee, a Directorate-General and a Council for Educational and Scientific Guidance.

The pedagogical directorates and the curricula are rearranged for a better management of specific expertise (decentralisation, financial management and human resources, cadastre) which have become unavoidable in the implementation of the Political, economic and financial objectives of the State.

With regard to the competitions, the school now offers candidates who wish to be able to prepare themselves at the level of centres set up for this purpose. Candidates can benefit from remote supervision by relying on information and communication technologies.

This is the economy of this draft decree.

The President of the Republic

Having regard to the Constitution, in particular Articles 43 and 76 thereof;

Having regard to Law No. 61-10 of 07 March 1961 determining the nationality of Senegal, as amended;

Having regard to Law No. 61-33 of 15 June 1961 on the General Staff Regulations, as amended;

In view of Act No. 69-64 of 30 October 1969 on the status of modified Customs staff;

In view of Act No. 81-52 of 10 July 1981 on civil and military retirement pensions, as amended;

Having regard to Law No. 91-22 of 16 February 1991 on the National Education Policy Act, as amended;

In view of Act No. 2011-08 of 30 March 2011 on the status of officials of local authorities;

In view of Decree No. 662-620 of 5 July 1962 regulating the conditions of admission of foreign students who are not domiciled in Senegal, in public education institutions;

Having regard to Decree No. 63-293 of 11 May 1963 laying down the rules for competitions for admission to the various bodies of civil servants;

Having regard to Decree No. 69-179 of 18 February 1969 laying down the age limit for candidates for professional competitions in the civil service, as amended by Decree No. 2002-266 of 06 March 2002;

Having regard to Decree No. 83-1144 of 3 November 1983 on the special status of the framework of officials of cooperation;

In view of Decree No. 84-561 of 15 May 1984 establishing a national commission on the classification of training levels;

Having regard to Decree No. 92-1614 of 20 November 1992 on the organisation and operation of the National School of Administration and Magistrates, as amended;

In view of Decree No. 95-264 of 10 March 1995 on the delegation of powers of the President of the Republic in matters of administration and management of personnel;

Having regard to Decree No. 99-908 of 13 September 1999 laying down the general terms and conditions of employment and remuneration of contract masters, as amended;

Having regard to Decree No. 2002-78 of 29 January 2002 laying down the general conditions of employment and remuneration of contract teachers, as amended;

Decrete:

TITLE I.
GENERAL PROVISIONS

CHAPTER I-APPOINTMENT,
TUTELLE AND SIEGE

Article 1 - A public institution of a "administrative character" shall be established " National School of Administration (ENA).

Art. 2. The National School of Administration is placed under the administrative supervision of the Prime Minister and the financial supervision of the Minister for Finance.
It has its headquarters in Dakar.

Article 3. - On the authorisation of the Prime Minister and after obtaining the opinion of the Board of Directors, it may, in its fields of competence:

Create appendices in other regions of the country;

Setting up specialised centres for the implementation of specific programmes of higher education on the basis of specific regulations or conventions;

Provide shelter for other higher education institutions on the basis of agreements or protocols established for this purpose.

CHAPTER 2: MISSIONS AND ACTIVITIES

Article 4. - The mission of the National School of Administration is:

-to provide initial training in the cycle A in public management and management of pupils with a vocation to enter the bodies of the senior management of the Public Sector Administration and BPS;

-to provide initial training in the cycle B in public management and management of pupils who are intended to enter the middle management bodies of the Public Sector Administration and BPS;

-to contribute, within the framework of subregional, regional and international cooperation, to the initial training and development of foreign auditors on the basis of specific agreements;

-to provide permanent training for senior and middle managers in the public or private sectors, on its own initiative or at the request of legal persons in accordance with agreed terms and conditions;

-conduct research activities in administrative sciences, public management and other disciplines relevant to its missions.
In the course of its missions, the school can provide services for consideration.

Art. 5. -For the performance of its missions, the Ecole Nationale d' Administration:

1. Provides initial training to students in cycles A and B recruited through direct or professional competitions and, possibly, to the auditors
Foreign. It aims to provide them with the basic knowledge and skills required to fill the jobs for which they have access to the various management bodies of the Administration;

2. Provides permanent training to national or foreign managers in the public, parapublic and private sectors in the course of employment. These listeners are

3. Undertakes research, research activities, studies, programme development, advice, assistance to structures, where appropriate following calls for tenders, as well as production activities and Publication of newsletters, manuals and books.

TITLE II. -ORGANS

Article 6. - As part of its administration, the Ecole Nationale d' Administration includes:

-a Board of Directors;

-a Steering Committee;

-a Branch;

-a pedagogical and scientific orientation council;

-an Disciplinary Board.

CHAPTER I-COUNCIL
ADMIN

Art. 7. - The President of the Board of Directors shall be chosen from among the public servants in operation, graduates in public administration or in public administration, who shall have at least 20 years of experience in a hierarchy at least equal to A1. He is appointed by decree.

The Board of Directors also includes:

-a representative of the President of the Republic;

-a representative of the Prime Minister;

-a representative of the Minister responsible for Finance;

-a representative of the Minister responsible for Foreign Affairs;

-a representative of the Minister responsible for the Interior;

-a representative of the Minister responsible for the Public Service;

-a representative of the Minister responsible for Labour;

-a representative of the Minister responsible for Decentralisation;

-a representative of the Minister responsible for Higher Education;

-a representative of the Minister responsible for trade;

-The Delegate for State Reform and Technical Assistance

-a representative of the trainers appointed by his peers;

-a staff representative appointed by its peers;

-a representative of the school leavers nominated by his peers.

These members shall be appointed by order of the Prime Minister.
The Financial Controller or his representative shall attend the Board of Directors in an advisory capacity.

The Board of Directors may, on an advisory basis, join any qualified person for the matters before it.

Art. 8. The terms of office of the members of the Board of Directors shall be three (3) years, renewable once.

With the exception of that of its President, the term of office of any other member shall cease when the quality which justifies it ceases. It also ends by death or resignation.

In the event of a vacancy, the replacement shall complete the remainder of the term of office of his predecessor.

Article 9. - The President of the Board of Directors shall be entitled to a monthly payment.

The members of the Board of Directors shall be granted a sessional indemnity.
These allowances are fixed by decree.

Article 10. - The Board of Directors determines the broad guidelines for the operation of the school. It is responsible for the adoption of the school's annual budget and action plan.

It also deliberates on:

-the organization chart of the administrative services of the school and the pay grid and material benefits of staff;

-the rules of procedure;

-the manual on administrative and financial procedures;

-the annual activity report;

-budget changes;

-borrowings;

-participation in any form of public or private grouping;

-legal proceedings and transactions in order to put an end to litigation;

-the financial account and the allocation of results;

-establishment of annexes to the school;

-the creation of specialised centres;

-accommodation of other institutions;

-acquisitions, disposals and exchanges of real property;

-the signing of partnership agreements or agreements;

-acceptance of gifts or bequests;

-contracts, contracts and contracts which, because of their nature or amount, must be submitted to it for approval;

-the arrangements for the granting of allowances, premiums and other benefits to be allocated to staff;
-assignments to be delegated to the Executive Committee.

Article 11 - The Board of Directors shall meet quarterly, in ordinary session, upon convocation by its Chairman.

It may meet in extraordinary session, within the limit of two meetings per year, at the request of its Chairman, the Director General or at least one third of its members.

The Director General, the representative of the Financial Control and the Accounting Officer shall participate in the meetings of the Board of Directors with a consultative vote.
The Director-General shall provide the secretariat for the meetings. He or she may be assisted by a designated collaborator.

Article 12. - The deliberations of the Board
Of Administration shall be valid only if two-thirds of its members are present. Failing that, a second meeting shall be convened within eight days; on that occasion, the Board of Directors shall deliberate regardless of the number of members present.

Decisions of the Board of Directors shall be taken by a majority of the members present. In the event of a tie, that of its President shall be paramount.

Article 13. - The deliberations of the Board
Of Administration shall be the subject of a record signed by the President and by the Director General. This record also mentions the names and names of the
Members present at the meeting as well as those of the persons invited in an advisory capacity.

The proceedings shall be recorded in a special register and initialled by the President and the Director General.

Excerpts from the deliberations shall be sent within five clear days following the meeting of the Council

The deliberations of the Board of Directors
A decision is binding.

However, the deliberations on the budget, the amending budget decisions, the financial account, the borrowings, the acquisitions and the disposals of real property shall become binding only upon the express approval of the Minister responsible for Or the expiry of a period of 21 calendar days from the date of receipt of the extract of the discharge and the relevant documents by the Minister.

CHAPTER 2-THE EXECUTIVE COMMITTEE

Article 14-The Management Committee shall decide on matters delegated to it by the Administrative Council, with the exception of those relating to the annual action plan, the budget, the financial account and the allocation of results.

The Executive Committee reports its decisions to the Board of Directors. It is composed as follows:

-the President of the Board of Directors, Chairman;

-the representative of the Prime Minister to the Board of Directors;

-the representative of the Minister for the Economy and Finance at the Board of Directors;

-another member of the Board of Directors selected by his peers;

-the Director General.

Article 15. - The Executive Committee shall meet at least twice a year, in the range of meetings of the Board of Directors, upon convocation by its President.

It may also meet, whenever necessary, at the request of the President or the Director General.

Decisions of the Executive Committee shall be taken by a majority of its members present. In the event of a tie, that of its President shall be paramount.

CHAPTER 3: THE GENERAL DIRECTION

Art. 16. -The Director-General of the National School of Administration is appointed by decree, on the proposal of the Prime Minister.

He is selected from among public administration or public management graduates with a minimum of 15 years of experience in a hierarchy at least equal to A1.

The remuneration and benefits granted to the Director General shall be fixed by decree.

Article 17. - The Director General shall have under his authority all staff and services of the establishment. He is an employer.

It shall carry out the activities of the school in the framework of the guidelines laid down by the Board of Directors.

It shall pass all acts and contracts involving
Establishment.

It is responsible for:

-the development of the draft roadmap for
School administrative services;

-the organisation and conduct of studies and traineeships as well as the monitoring of research work;

-the preparation and presentation of the annual activity report of the institution;

-the preparation and implementation of the annual action plan and the budget;

-the implementation of decisions of the Board of Directors;

-the implementation of school commitments;

-the representation of the school in court;

-supervision of the activities of the different bodies of the institution;

-the management of the spaces, infrastructures and premises for common use used by the establishments located on the site;

-the promotion of collaboration with training institutions and

-development in public administration, state administrations and local authorities, enterprises and organisations located in Senegal or abroad;

-the signature and application, as far as it is concerned, of the agreements and protocols provided for in Articles 3 and 4 of this Decree;

-compliance with laws and regulations in the institution.

He chairs the Academic and Scientific Guidance Council and the Disciplinary Board of the School.

He shall be assisted by a Secretary-General who shall act in the event of absence or incapacity.

Article 18. - The Secretary-General shall be chosen from among public administration graduates with experience at least equal to 10 years in the A1 hierarchy. He shall be appointed by decree, on
Prime Minister's proposal.

It coordinates the administrative activities of the school. It shall carry out the management and control activities delegated to it by the Director General.
Compensation and Benefits to the
Secretary-General shall be fixed by decree.

Article 19. - The Director General is also assisted by:

-a Director of the Initial Training;

-a Director of the Permanent Training;

-a Director of Research and Cooperation;

-a Director of Administrative and Financial Affairs;

-an Accounting Officer.

Directors shall be appointed by order of the Prime Minister on the proposal of the Director General.

The arrangements for the organisation of the Directorate-General shall be fixed by order of the Prime Minister.

Article 20. - The Accounting Officer shall be appointed by order of the Minister for Finance. He is a Senior Accountant and is the Head of the Accounting Service.

The Accountancy Branch is responsible for the execution of revenue, expenditure and treasury operations.

CHAPTER 4-EDUCATION AND SCIENTIFIC GUIDANCE

Article 21. - The Academic and Scientific Guidance Council is chaired by the Director-General of the School. It also includes:

-a representative of the Minister responsible for Foreign Affairs;

-a representative of the Minister responsible for trade;

-the Director of General Affairs and
Territorial administration;

-the Director-General of the State Information Technology Agency;

-the Director General of Public Accounts and the Treasury;

-the Director General of Customs;

-the Director of Employment;

-the Director-General of Higher Education;

-the Director General of the Public Service;

-the Director-General of Taxes and Domains;

-the Director General of Labour and Social Security;

-the Director of Local Government;

-the Secretary General of the National School
Administration;

-the Director of Initial Training;

-the Director of the Permanent Training;

-the Director of Research and Cooperation;

-a representative of trainers;

-the president of the friendly students of the school.

The Council for Educational and Scientific Guidance may, in an advisory capacity, join any qualified person for the matters referred to it.
The Secretary-General provides the secretariat of the Council for Educational and Scientific Guidance.

Article 22. - The pedagogical and scientific orientation council determines the pedagogical and methodological orientations of the school and deliberates on issues relating to curricula and teaching methods, as well as to the education system.

The training programmes shall be fixed by the Prime Minister.
The Steering Committee adopts the recommendations of the pedagogical and scientific committees, evaluates
All training and research systems, and defines the axes of evolution of these. It is consulted on the choice of trainers.

Article 23. - The Teaching and Scientific Guidance Council shall meet at least once a year upon convocation by its President.

It may meet, whenever necessary, at the request of the Director General or one third of its members.

The Director-General shall submit to the Council
Of Administration of the report of the work of the Education and Scientific Guidance Board.

Decisions of the pedagogical and scientific guidance board shall be taken by a majority of its members present. Its deliberations shall be valid only if the majority of its members are present. Failing that, a new meeting shall be convened within the following eight clear days; in this case, it shall be validly deliberate regardless of the number of members present.

In the event of a tie, that of its President shall be paramount.

CHAPTER 5-THE DISCIPLINARY BOARD

Article 24. - The Disciplinary Board shall decide on the errors committed by the pupils and shall propose the appropriate sanctions provided for in the rules of procedure.

Article 25. - The Disciplinary Board shall be chaired by the Director General. Its composition, powers and procedures shall be laid down in the rules of procedure of the school.


TITLE III. -FINANCIAL REGIME

Article 26. - The implementation of the ENA budget shall be carried out by the Director-General and the Accounting Officer.

The Director-General shall be the administrator and the authorising officer of revenue and expenditure. He may delegate his duties as administrator of credits.

The Accounting Officer proceeds with the recovery of revenue and the payment of expenses. It prepares the financial statements of the institution.

Revenue and expenditure transactions are described in accordance with the rules of public accounting.

Article 27. - The ENA resources include own resources and grants.

Own resources include:

-the products of the registration fees;

-the products of the sale of publications;

-income from furniture and real estate;

-products derived from the services provided;

-donations and bequests;

-income from securities and funds invested;

-repayments of loans and advances;

-miscellaneous, accidental or exceptional products.

Grants include:

-the participation of the State;

-the participation of foreign states;

-participation by national, foreign or international bodies.

Article 28. - The expenses of the ENA include:

-operating expenses;

-investment expenditure;

-loans and advances.

Operating expenditures include:

-staff costs;

-the expenditure of small equipment and routine maintenance on the operation of the services;

-transfer expenses.

Capital expenditures include:

-investments made on own funds;

-investments made on grants and competitive funds;

-mixed investments.

Loans and advances include loans and advances to staff members in accordance with the regulations. The amounts and the arrangements for recovery shall be fixed by the Administrative Council.

TITLE IV. -STAFF

Article 29. -To carry out its missions, the ENA has its own staff governed by the Code of Labour and administrative staff of the State

Article 30. - The allowances and benefits of staff, with the exception of management staff, shall be fixed, on the proposal of the Director General, by

Article 31. - The Director-General shall appoint to all functions for which no other authority has received any appointment.

TITLE V. - COMPETITION FOR MAINTENANCE

CHAPTER I. -THE PROVISIONS COMMON TO THE MAINTENANCE COMPETITIONS

Article 32. - Subject to the provisions of Articles 4 and 5 of this Decree, the ENA shall recruit through direct and professional competitions.

The number of places open for each competition shall be fixed by the order of the Prime Minister published at least two months before the first test.

Applications must be submitted to the institution at least thirty days before the start of the first event of the corresponding competition.

S. 33. - No candidate can present himself more than three times at the entrance examination at the Ecole Nationale d' Administration.

Article 34. - The list of candidates allowed to run for each competition shall be fixed by the Prime Minister at least fifteen days before the start of the first test.

Article 35. - The members of the Selection Board shall be appointed by order of the Prime Minister on the proposal of the Director General of the ENA.

Each jury consists of a president, a vice-president and members chosen from among the agents of the state, the trainers of educational institutions
As well as those who have a recognized competence in the disciplines taught at the ENA.

The Vice-Chairperson shall replace the Chairman of the Board in the event of a duly noted impediment by the Director General in his capacity as Head of Centre.

Article 36. - The tests of each competition shall be chosen by the chairperson of the selection board from among the subjects proposed by the members of that jury, on the basis of the programme provided for that purpose.

Tests other than those of specialization may be common within the framework of each cycle.

The programmes of the competitions shall be fixed by decree of the Prime Minister after the opinion of the Education and Scientific Guidance Council. They shall be published to the candidates at the latest at the opening of the competitions.

Article 37. - Copies of the candidates, in the written tests, are anonymous. Each copy shall be marked by two markers chosen from among the members of the jury.

Article 38. - Any score less than or equal to 08/20, obtained in a competition test, is eliminatory.

A candidate is declared eligible only if he or she has obtained a general average of at least 10/20.

A candidate is admitted only if he or she has obtained a general average of at least 10/20.

Article 39. - At the end of each competition, the jury president proclaims the admission of the candidates and displays the results.

It shall draw up a report to the Director-General of the ENA, which shall communicate the final conclusions to the Prime Minister, the Board of Directors and the Council for Educational and Scientific Guidance.

Art. 40. -The list of successful candidates shall be fixed by the Prime Minister.
In proportion to the deficiencies and resignposts which occurred before the end of the first month of schooling and duly noted by the Director-General of the ENA, a fixed amending order for each competition, the additional admissions, according to the order of merit Candidates ranked on the waiting list established by the Board
Competent.

CHAPTER 2-PROVISIONS
PARTICULARLY IN DIRECT COMPETITIONS
AND PROFESSIONALS

Paragraph 1. -DIRECT COMPETITIONS

Article 41. - Only one direct competition per cycle can be organised in the same year.

CYCLE A SECTION I

Article 42. - The direct competition for cycle A is open to candidates:

-holders of at least a master's degree or a diploma classified at least in hierarchy A3 by the minister in charge of the civil service;

-and at least 18 years of age and at least 33 years of age on 1 January of the year of the contest, without prejudice to the conditions of age provided for by Law No. 61-33 of 13 June 1961 or Act No. 2011-08 of 30 March 2011, as the case may be.

Article 43. - The application for the direct competition for Cycle A includes:

-a recent identity photo with, on the back, the first name (s) and the name of the candidate;

-a fact sheet provided by the school, duly completed and signed by the candidate;

-a handwritten application addressed to the Director General of the ENA, drawn up on free paper, dated and signed by the candidate;

-a notarized photocopy of the national identity card;

-a certified copy of the required diploma or a valid certificate of achievement;

-a certificate of Senegalese nationality, the
Candidate who has acquired the Senegalese nationality by decision of the public authority for less than five years before providing proof of that nationality;

-a criminal record extract, bulletin no. 3, dating back less than three months;

-a certificate of access and medical examination issued by the competent authorities, dating back less than three months, indicating that the person concerned is suitable for administrative service, and that he is unharmed from any conditions of leave of absence from Long duration;

-receipt of payment of registration fees;

-a stamped envelope bearing the exact address of the candidate.

Article 44. - The tests for the direct competition for cycle A include a screening test, three eligibility tests and two admission tests.
The screening test is a psychotechnical test lasting up to two hours.

The eligibility tests are:

-a general culture test; duration:

4 hours; coefficient 1;

-a test of public law; duration: 4 hours; coefficient 2;

-a test of political economy or public management; duration: 4 hours; coefficient 2.

Admission tests are:

-a summary trial; duration: 4 hours; coefficient: 2;

-an interview with the board dealing with a subject drawn from the fate of one of the eligibility materials. The purpose of this interview is to assess the candidate's knowledge, motivation, psychology and behaviour. This test consists of a 30-minute preparation followed by a 10-minute presentation, followed by a 15-minute interrogation; coefficient: 3.

SECTION II. -CYCLE B

Article 45. - The direct competition for cycle B is open to candidates with a Bachelor's degree from
No more than 3 years, at least 18 years of age and at most 33 years of age at the date of the opening of the competition, without prejudice to the conditions of age laid down for the
Appointment by Law No. 61-33 of 15 June 1961 or No. 2011-88 of 30 March 2011, as the case may be.

Art. 46. - The tests for the direct competition for cycle B include a screening test, two eligibility tests and one admission test.
The screening test consists of a test
Psychotechnical, lasting a maximum of two hours.

The eligibility tests consist of:

-a summary of text on a subject of general culture; duration: 4 hours; coefficient: 4;

-a dissertation on a subject of general culture, duration: 4 hours; coefficient: 3;

The admission test consists of an interview with the jury dealing with a subject of general culture drawn to fate. It is designed to assess the knowledge and personality traits of the candidate related to his or her psychology, behaviour and motivation. It consists of a 30-minute preparation, followed by a 10-minute presentation, followed by a 15-minute interrogation; coefficient: 3.

Paragraph 2. -COMPETITIONS
PROFESSIONALS

Article 47. - Professional competitions are open by cycle and by section.
There is no more than one professional competition per cycle and per section and per year.

CYCLE A SECTION I

Article 48. - The cycle A professional competitions are open:

-State officials and local authorities belonging to the hierarchy B at least;

-officers of the armed forces, who hold a degree classified at least in hierarchy B by the minister in charge of the civil service;

-employees in the BPS who are employed in a position whose degree is recognized and classified at least in the hierarchy by the Minister in charge of the Public Service.

The above officers must be at most 53 years of age at the date of the opening of the competition without prejudice to the condition of age provided for in Decree No. 69-179 of 18 February 1969, amended and totalizing at least five years of effective service. Tenure in the parent body at the time of application.

Agents of the State may submit to professional competitions only with the authorisation of the competent authority and, for others, on an express request from their employer with a commitment to reintegrate and reclassify the persons concerned. Successful completion of training.

Article 49. - The application package for cycle A professional competitions includes:

-a recent identity photo with, on the back, the first name (s) and the name of the candidate;

-a fact sheet provided by the school, duly completed and signed by the candidate;

-a handwritten request on free paper addressed to the Director General of the ENA, dated and signed by the applicant, specifying the section chosen;

-a notarized photocopy of the national identity card;

-an updated, dated and signed curriculum vitae;

-an administrative certificate signed by the Appointing Authority, indicating the number, the hierarchy, the rank and the seniority of the latter in the Public Service;

-an act of appointment in the applicant's body of belonging;

-receipt of payment of registration fees;

-a stamped envelope bearing the exact address of the candidate.

The Candidator File shall be forwarded by the hierarchical route.

Article 50. - The tests for the A-cycle competitions include four eligibility tests and two admission tests.

The eligibility tests are:

-a general culture test; duration:

4 hours; coefficient: 1;

-a test of public law; duration: 4 hours; coefficient: 1;

-a test of political economy or public management; duration: 4 hours;

-coefficient: 1;

-a section-related test; duration: 4 hours; coefficient: 2.

Admission tests are:

-a summary note on a second section; duration: 4 hours; coefficient: 2;

-an interview with the board: dealing with a matter drawn from the fate of one of the eligibility materials. The purpose of this interview is to assess the candidate's knowledge, motivation, psychology and
Behavior. This test consists of a 30-minute preparation followed by a 10-minute presentation, followed by a 15-minute interrogation; coefficient: 3.

SECTION II. -CYCLE B

Article 51. - Professional competitions in cycle B are open by section:
-State agents, and local authorities belonging to hierarchy B or C;

-to members of the Armed Forces, who hold a degree classified in hierarchy B or C by the Minister responsible for the Public Service;

-to non-public servants of the State, local authorities and the parastatal sector holding a job whose diploma required to access it is classified in hierarchy B or C by the Minister responsible for the civil service.

The above staff must, at most, be 53 years of age on the date of the opening of the competitions without prejudice to the condition of age provided for by the decree
N ° 69-179 of 18 February 1969, amended and have at least four years of effective service in the hierarchies considered at the time of their application.
Art. 52. -The professional competitions in cycle B include three eligibility tests and one admission test.

The eligibility tests consist of:

-an essay on a subject of general culture; duration: 4 hours; coefficient: 2;

-a test involving a subject of public law or political economy; duration: 4 hours; coefficient: 2;

-a section test; duration: 4 hours; coefficient: 3.

The admission test consists of an interview with the jury, dealing with a subject drawn by lot. It aims to appreciate the knowledge and the features of the
Personality of the candidate related to his or her psychology, behaviour and motivation. It consists of a 30-minute preparation, followed by a 10-minute presentation, followed by a 15-minute interrogation; coefficient: 3.

TITLE VI. -STATUS, STUDY
AND INTERNSHIPS OF THE STUDENTS

Art 53. - Candidates received in the competitions will acquire the quality of students from the Ecole Nationale d' Administration.

The students from the direct competitions will definitely choose one of the open sections and, where appropriate, an option in public session, in order of merit according to the ranking established by the competent committee, under the supervision of the management of Establishment.

Students who have selected the Customs Section must provide a certificate of fitness issued by a physician approved by the Customs administration.
Students from the direct competition of cycle A are assimilated to civilian trainees and receive the treatment of the index corresponding to that of the trainee of the body.

Article 54. - Students from the direct competition of cycle B are treated as trainee administrative secretaries and receive treatment related to the index corresponding to that of a trainee in the body.

Students from professional competitions are placed in the position of internship for the duration of their training.

Pupils and listeners participate in the teaching expenses and maintenance costs according to the terms and conditions laid down by the School Board of Administration.
During their education, students may receive traineeships, travel or other allowances, according to the rates and procedures established by the Prime Minister, upon the proposal of the Director General and after the opinion of the Board of Directors.

The common law system of cycle A is the internat.

Article 55. - The studies include common courses and lessons specific to each section.

The lessons are delivered by selected trainers based on their technical skills and professional experience.

The obligations of the trainers shall be laid down in a specification laid down for that purpose.

Article 56. - The duration of initial training is twenty-four months.

Subject to the provisions of this Decree, the organisation of studies and the organisation of traineeships shall be laid down in the rules of procedure.

Article 57. - The strike is forbidden to students at the ENA.

Article 58. - The pupil's behaviour during his or her education shall be evaluated in accordance with the rules laid down in the rules of procedure.

TITLE VII. -EXAMINATIONS FOR COMPLETION OF STUDIES

Article 59. - A jury is established for each graduation exam.

Article 60. - The Director General of the ENA is the head of the examination centre.

Article 61. - Board members shall be appointed by order of the Prime Minister on the proposal of the Director General of the School.

The jury shall consist of a chairperson, a vice-president and members selected from the trainers of the ENA, those of other institutions of higher education, as well as persons competent in the subjects of the programmes.

The Vice-Chairperson shall replace the chairperson of the selection board in the event of a duly noted impediment by the head of the examination centre.

Article 62. - For cycle A, the exit scan
Has two written tests and one oral test:

-the first written examination shall cover one of the subjects taught during the twenty-four months of training; duration: 4 hours; coefficient: 1;

-the second written test consists of the preparation of a summary note or a report on a file relating to one of the subjects taught in the twenty-four months of schooling; duration: 4 hours; coefficient: 1;

-the oral test relates to a subject drawn by lot by the pupil and relating to one of the subjects taught during the course of schooling; it consists of a preparation of 30 mn, followed by a 10-minute presentation, followed by a 15-minute interrogation extended to All subjects taught during the two years of schooling; coefficient: 1.

Article 63. - The final ranking is by section and option, if applicable.
To be admitted, the pupil must obtain at the end of his training a general average at least 12/20, determined as follows:

If in a section or option students have the same number of points at the end of the calculation above, the one who obtained the highest average of the session notes is ranked first.

In the case of new equality, the average obtained by the end-of-study test will divide them for the
Classification.

After having exhausted this procedure, if there is always equality, the board is based on another criterion in the following order: the average of the traineeships, the memorandum and the behavioural note.

In case of perfect equality, a draw is made.

S. 64. - Initial training students who are admitted after graduation exams are awarded the diploma " Brevet of the Ecole Nationale d' Administration " (B.E.N.A).

The certificate of the ENA shall be signed by the President of the Republic, the Chairman of the jury concerned and the Director General of the School.

Article 65. - The students of the National School of Administration shall be made available to the minister in charge of the civil service or their employer, as the case may be.

Students with a general end-of-study average of less than 12/20 and greater than or equal to 10/20 are appointed, on a proposal by the end-of-study board, to a body in the A3 hierarchy corresponding to their section.
Students from professional competitions with a general end-of-study average of less than 10/20 are reintegrated into their original bodies.

Students from the direct competition whose general end-of-study average is less than 10/20 are excluded, without being required to pay the training costs to the ENA.

Article 66. -For cycle B, for each section, the completion exam consists of two written tests and one oral test.

The first written test consists of a subject relating to one of the common subjects taught during the course of schooling; duration: 4 hours for cycle B; coefficient: 1;

The second written test consists of a practical exercise involving one of the materials specific to the
Section; duration: 4 hours for cycle B;
Coefficient: 2;

The oral test relates to a subject drawn by lot by the student and relates to one of the subjects taught during the course of schooling; it consists of a 30-minute preparation, followed by a 10-minute presentation, followed by a 15-minute interrogation; Coefficient: 1.

Article 67. - The ranking is by cycle and by section. To be admitted, the student must obtain, at the end of his or her education, a general average of at least 12/20 and determined as follows:

Article 68. - The pupils of the initial training of the B-cycle declared admitted at the end of the course of study are awarded a diploma called: Certificate of Completion of Cycle B Studies of the ENA " Jointly signed by the Prime Minister, the Director-General of the ENA and the chairman of the jury.

Article 69. - Students graduating from cycle B of the ENA shall be made available to the minister in charge of the civil service or their employer, as the case may be.

Students from direct competitions in cycles B who have not obtained the general end-of-study average of 12/20 are excluded.

Non-graduate students from cycle B professional competitions with a general end-of-study average of less than 12/20 are returned to their original administration.


TITLE VIII. -TRANSITIONAL PROVISIONS

Article 70. - As a transitional period, they are allowed to run in the direct competition of cycle B, with candidates obtaining the bachelor's degree in 2007 and 2008 and fulfilling the required age requirements.

Prior to the establishment of the Educational and Scientific Guidance Council, the
Competition for entry to the ENA as provided for in Article 36 of this Decree shall be fixed by order of the Prime Minister, on the proposal of the Director General.

TITLE IX. -FINAL PROVISIONS

Article 71. - Any provisions contrary to those of this Decree shall be repealed, in particular those of Decree No. 92-1614 of 20 November 1992.

Article 72. - Minister of State, Minister of Foreign Affairs, Minister of State, Minister of Economy and Finance, Minister of State, Minister of State
The Ministry of State, the Minister of State, Minister of Public Service and Employment, the Minister for Decentralization and Local Government, the Minister of Labour and Professional Organisations and the Minister for Trade, are responsible for each In respect of the execution of this Decree, which shall be published in the Official Journal.
