Ministry of Interior Decree No. 2014-36 of 13 January 2014 Decree No. 2014-36 of 13 January 2014 exceptional revision of the electoral lists for the local elections of June 29, 2014.

REPORT of PRESENTATION local elections originally scheduled March 16, 2014 was postponed to the date of June 29, 2014, following the promulgation of Act No. 2013-09 of December 28, 2013, extending the mandates of regional advisors, Councillors and rural councillors elected March 22, 2009.

Gold, according to the provisions of the electoral Code, particularly articles L37 and L39, exceptional revision is determined before each general election to allow, on the one hand, those who were not registered to do so and, on the other hand, allow young people who will be eighteen (18) years to no later than the election day to register also.

Linked to the revision will be done, cumulatively for their mission, by the distribution of voter registration cards administrative commissions established pursuant to order No. 18672 December 04, 2013, the Minister of the Interior.
However, for reasons of calendar and in accordance with the provisions of article R20 du Code electoral, this revision will last twenty-three (23) days, from the sixteen (16) January to seven (07) February 2014.

For the same reasons, the voter has three (03) days to bring an appeal against the decision of the administrative commission before the District Court President, who has three (03) days and two (02) days to transmit its decision to the person concerned, and to the administrative authority.
If on the contentious period following the publication of provisional lists from the revision, it will be held on ten (10) days with five (05) days for the receipt of the appeal, three (03) days for instruction and two (02) days for the transmission by the judge.

From provisional lists of revision, after treatment of the cases arising from the litigation, will be integrated into the electoral file.
This is the purpose of the present draft decree.

The President of the Republic saw the Constitution;

Having regard to the electoral Code;

Having regard to Act No. 2013 - 09 December 28, 2013, extending the mandates of regional councillors, municipal councillors and rural councillors elected March 22, 2009.

Having regard to Decree No. 2013 - 1218 September 01, 2013 appointing the Prime Minister;

Considering Decree No. 2013 - 1223 of 02 September 2013 concerning the composition of the Government.

Mindful of Decree No. 2013-1225, 04 September 2013 on the distribution of the services of the State and control of public institutions, national companies and companies with public participation between the Presidency of the Republic, the Prime Minister's Office and the ministries, as amended;
The joint report of the Minister of the Interior;

Orders: Article one:-there shall be established an exceptional revision of the electoral lists throughout the national territory for the local elections of June 29, 2014.
This revision takes place from January 16 to February 7, 2014.

S. 2 - administrative commissions of distribution of voter registration cards created by the prefects and sub-prefects based on order No. 18672 December 04, 2013, of the Minister of the Interior opening a period of distribution of voter registration cards from December 16, 2013 to March 15, 2014, realize, cumulatively for their mission, the outstanding of the lists of electors revision transactions.

S. 3 - these commissions will proceed to:-the registration of new voters: applicants must be at least eighteen (18) years of age on the date of June 29, 2014. This registration is made on presentation of the national ID scanned;
-support of requests for changes in electoral district or address of the residence of the elector: any electoral district or home address change request leads the withdrawal card which is attached to the record.
-write-off of deceased electors, stricken voters of disability by virtue of the law or that no longer wish to be included on the electoral lists: the production of an act justifying the delisting is requested (exhibit of radiation occurred in the event of death or sentenced to deprivation of civil rights). In all cases, the plaintiff must prove that it is voter; It must also present its national digital identity card. The cancelled voter voter's card is removed and attached to the record.
-the investigation of claims of voter registration card duplicate: If this request is made following a loss, a certificate of loss of duly established voter registration card is attached to the file. If the application is running to a rectification of error on the national identity card, voter's card is must be attached to the record;
-the support for the change in status of the military and paramilitary reverted to civilian: in this case, the applicant must submit a certificate of release of the body; voter registration card is removed and attached to the record.

S. 4. - for all operations at the level of the administrative commission, if the home address or place of birth which figure on the national digital identity card is not in the electoral district, the voter is required to prove his attachment to the district by the production of a certificate of residence or the presentation of any other documents which prove the link with the local community.

Transactions for the receipt of applications for registration, modification, change of status and radiation will stop on January 30, 2014 for all administrative committees.

S. 5. - the voter who was the subject of a cancellation of office, for reasons other than death, or one whose registration is challenged, receives notification from the administrative authority. An appeal against the decision may be brought within three (03) days following notification of the administrative decision before the president of the District Court which has three (03) days to decide and two (02) days to transmit its decision to the interested party, to the prefect or sub - prefect.
The warden or the warden shall promptly transmit the decisions of the President of the District Court to the administrative commission. It modifies or writes, accordingly, relevant records.

S. 6 - the commissions work with carnets specialized nature of Act. They are competent in their jurisdiction.

S. 7. - the completion of the revision work is followed by the publication of provisional lists of movements and litigation. This dispute has a duration of ten (10) days with five (05) days for the receipt of appeal, three (03) days for the instruction of the appeal by the President of the District Court and two (02) days for the transmission of decisions of the President of the District Court to the administrative authority.

The application period starts to run from the day following the day of the display of minutes of receipt of the outstanding review from provisional lists.

S. 8 - the keeper of the seals, Minister of Justice, the Minister of the Interior, the Minister of economy and finance and the Chairman of the independent National Electoral Commission (CENA) are responsible, each in relation to the implementation of this Decree which shall be published in the official journal.
