Ministry of the communications and of the economy digital Decree No. 2014-12 January 9, 2014 Decree No. 2014-12 January 9, 2014 appointing the President and members of the College of the Telecommunications Regulatory Authority and the stations (ARTP) report of PRESENTATION pursuant to Act No. 2011-01 of February 24, 2011 on telecommunications, the Telecommunications Regulatory Authority and the stations (ARTP) code is composed of a College and a branch.
As a member of the college of the ARTP is incompatible with some other function paid or unpaid, any national elective mandate, any function of Government as well as any direct or indirect ownership interest in one or more enterprises of one of the regulated sectors. Members of the College may not have a commercial relationship with the ARTP.
The College is composed of seven members, appointed by decree for an irrevocable non-renewable five-year term. The President of the College is appointed by Decree of the President of the Republic among these seven members. It is at the same time the President of the regulatory authority.
By way of derogation, two among first members other than the President, are appointed for a non-renewable term of three years.
The members of the College are appointed by decree after public call for applications provided by the governmental authority on the basis of criteria of moral integrity, qualification and professional experience in the technical, legal, economic and financial fields pertaining to regulated sectors.
To replace the outgoing members whose mandate ended on November 29, 2013, the Ministry of Communication and the digital economy has relied on a recruiting firm specializing in the selection of the members of the new College in accordance with the provisions of the Act.
Thus, selected candidates have the best profiles compatible with the positions required in College.
This is the object of this Decree.
The President of the Republic given the Constitution, particularly articles 43 and 76;
Pursuant to law No. 2011 - 01 of February 24, 2011 on Telecommunications Code.
Having regard to Decree No. 2013 - 1218 September 1, 2013 appointing the Prime Minister;
Considering Decree No. 2013 - 1223 of 02 September 2013 concerning the composition of the Government.
Having regard to Decree n ° 2013-1225, September 04, 2013 bearing allocation of services of the State and control of public institutions, the State and corporations control of public institutions, societies and corporations with public participation between the Presidency of the Republic, the Prime Minister's Office and ministries;
The report of the Minister of Communication and the digital economy.
Decrees: Article 1. -Mr. Abu Abel THIAM, journalist, expert in Communication and public Retaions, is appointed for a period of five (5) years non-renewable, President of the College by the Telecommunications Regulatory Authority and positions.
S. 2. - are appointed as members of the College of the regulatory authority of Telecommunications and posts, for a period of five (5) years non-renewable, people whose names follow: Mr Modi Coumba GADIAGA, lawyer Amadou LY, expert in telecommunications Lexes SALL, positions Ms. Ada Hagne DIA expert, specialist in administrative and financial management art. 3 - appointed member of the college of the regulator of Telecommunications and posts, for a period of three (3) years non-renewable, people whose names follow: Mr. Manel Amadou FALL, Economist Colonel Sheikh Birahim THIOUNE, specialist in radio arts. 4. - the Prime Minister, the Minister of Communication and the digital economy and the Minister, Secretary General of the Presidency of the Republic are responsible, each in relation to the implementation of this Decree which shall be published in the Official Journal.
