Law n ° 2013-01 of 6 June 2013 authorising the President of the Republic to ratify the Agreement establishing a Joint Cooperation Commission between the Government of the United Arab Emirates and the Government of the Republic of Senegal, adopted in Abu Dhabi On 10 November 2010.


EXPOSE REASONS

In order to strengthen the existing relations of cooperation and friendship between Senegal and the United Arab Emirates, the Foreign Ministers of the two countries signed, in Abu Dhabi on 10 November 2010, the Agreement establishing a Joint Cooperation Commission between the Government of the United Arab Emirates and the Government of the Republic of Senegal.

Both parties are committed to this Agreement, to:

-Strengthen the excellent friendly relations between the two countries;
-Promote relations of cooperation of common interest (justice, security, education, training, information, culture, sports, transport, environment, etc).

In order to achieve the above objectives, both Parties agreed to the establishment of a Joint Cooperation Commission chaired by the Ministers of Foreign Affairs or their representatives.

The Commission meets annually, alternately, in Dakar and Abu Dhabi, and monitors the implementation of the Agreements, Conventions, Protocols signed between the two countries.

This Agreement, concluded for a period of five years renewable by tacit renewal, shall enter into force on the date of the exchange of instruments of ratification after each country has completed constitutional procedures Required for its application.

In view of the importance of the opportunities offered by cooperation with the United Arab Emirates, the ratification of this Agreement is of great importance to Senegal.

This is the economy of this Act.


The National Assembly adopted, on Tuesday, 28 May 2013;
The President of the Republic enacts the following legislation:

Sole Article. -The President of the Republic is authorized to ratify the Agreement establishing a Joint Cooperation Committee between the Government of the United Arab Emirates and the Government of the Republic of Senegal, adopted in Abu Dhabi on 10 November 2010.

This Law shall be enforced as the law of the State.

AGREEMENT ESTABLISHING A JOINT COOPERATION COMMISSION BETWEEN THE GOVERNMENT OF THE UNITED ARAB EMIRATES AND THE GOVERNMENT OF THE SENEGAL REPUBLIQUE

The Government of the Republic of Senegal on the other hand:

Hereinafter referred to " The Parties ";
Driven by a desire to strengthen the friendship between the two countries;
Desiring to expand and promote bilateral relations between the United Arab Emirates and Senegal in all areas:

Have agreed as follows:


Article 1. -A Joint Cooperation Commission is hereby established. Commission ", chaired by the Ministers of Foreign Affairs or their Representatives and composed of officials from both countries.

The Commission's aim is to strengthen cooperation between the two countries in all areas.

Art. 2. -The Commission is responsible for the launch of general cooperation and coordination programmes between the two countries, in all areas, including political, economic, commercial, cultural, judicial, security and other fields. For the benefit of both countries.

Article 3. -The Commission is responsible, inter alia, for creating the legal framework necessary for the achievement of the objectives, having regard to the promotion of cooperation between countries in various fields, in particular:

A. Cooperation in the economic and social fields and the launching of investment projects
Spouses;

B. Support for cooperation in the fields of justice, security, education, training, information, culture, sport, transport, the environment and any other field of activities of common interest;

C. Facilitating the exchange of data and experience and the holding of bilateral consultations in the service of cooperation between the two countries.

Art. 4. -The Commission monitors the implementation of the Agreements, Conventions, Protocols, Memorandum of Understanding and the Executive Programmes signed between the two countries.

Art. 5. -The Commission meets every year alternately in the capitals of the two countries.

It shall be chaired by the Minister for Foreign Affairs of the host country or his Representative. Meetings of the Commission shall be preceded by preparatory meetings at the level of senior officials and experts; however, the Commission may meet in extraordinary session as appropriate.

The Joint Committee may invite the Representatives of the Chambers of Commerce and Industry, as well as the areas of the two countries, to participate in the above-mentioned meetings. The dates of such meetings shall be determined by mutual agreement through diplomatic channels.

Article 6. -The Joint Committee may set up ad hoc committees to examine all common areas of cooperation between the two countries and to determine the scope of their work.

All minutes of meetings of the ad hoc committees shall be submitted to the Commission for approval.

Art. 7. -The Ministers of Foreign Affairs of the two countries are responsible for the coordination, preparation and follow-up of the meetings of the Joint Committee as well as those of the ad hoc committees.

Article 8. -This Agreement shall enter into force on the date of the exchange of instruments of ratification after each country has completed the constitutional procedures required for its application. This Agreement shall remain in force for a period of five years renewable by tacit renewal for the same period of time unless one Party notifies the other of its intention to denounce it. Such denunciation shall take effect six months after the date of notification.

One or the other Party may propose to amend this Agreement and such an amendment shall take effect by mutual agreement and by the same procedures described above.

Done at Abu Dhabi on 10 November 2010 in the Arabic, French and English languages, all texts being equally authentic.

In the event of a dispute arising out of the interpretation provided for in this Agreement, the English text shall prevail.
