Ministry of local governance, development and planning of the territory Decree No. 2015-1703 of October 26, 2015 Decree No. 2015-1703 of 26 October 2015 on the transfer of the management of solid urban waste in the Dakar Region program the coordination unit of the solid waste management of the Ministry of local governance, development and the planning of territory report of PRESENTATION the Dakar Region urban solid waste management program is entrusted to intercommunal agreement CADAK-CAR by the Dakar Agglomerations community and the community of the towns of Rufisque following an agreement signed by their two presidents.
However, all communities local members of the community of the towns of Rufisque took the decision to dissolve this grouping and leave the agreement CADAK-because this situation results, according to local executives, from a recurring observation of failures of management system of solid waste from the Dakar Region and a feeling of dissatisfaction on the governance of the structure. Indeed, there are still orders institutional, organizational, functional and financial constraints that block the operationality of the structures of inter-municipal cooperation of the Dakar Region.
This should be added the unsanitary conditions widespread throughout the region resulting from malfunction of the device of waste collection, of precariousness of the working conditions of the staff, a delay in the payment of invoices by dealers and disputes repeated between them and the agreement CADAK-CAR.
Today, the situation boils down to dissatisfaction of stakeholders that are the State, local communities, providers, cleansing workers and populations.
Furthermore, these two structures intercommunal, created under Act No. 96 - 06 of 22 March 1996 on the Code of local authorities, have not been adapted, by the actors, with the current context marked by the creation of new communities in the Department of Rufisque in 2011 and the erection of rural communities and communes of arrondissement in outlying areas of common law , the entry into force of Act No. 2013-10 December 28, 2013, general code of local authorities.
Faced with this situation, with its harmful and unpleasant consequences for the populations of Dakar, it is proposed, pursuant to article 119 of the general Code of local authorities, to entrust the implementation of the programme of management of solid urban waste in the Region of Dakar, the coordinating unit of the waste management solid of the Ministry of local governance Development and planning of the territory, to ensure properly, the continuity of the public service of cleanliness.
Such is the economy of the draft decree.
The President of the Republic, pursuant to the Constitution;
Having regard to Act No. 72-02 of February 1, 1972 on the Organization of territorial administration, as amended;
Pursuant to law No. 2013-10 December 28, 2013, general local code, amended by Act No. 2014-19 April 24, 2014;
Having regard to Decree No. 2004 - 1093 04 August 2004 on the establishment of the community of Agglomerations of Dakar (CADAK), as amended by Decree No. 2005-876 03 October 2005;
Having regard to Decree No. 2004 - 1094 04 August 2004 on the establishment of the community of towns of Rufisque (CAR), as amended by Decree No. 2005-877 03 October 2005;
Having regard to Decree No. 2014 - 845 06 July 2014 appointing the Prime Minister;
Mindful of Decree No. 2014-853 09 July 2014 on the distribution of the services of the State and control of public institutions, societies and corporations with public participation between the Presidency of the Republic, the Prime Minister's Office and the ministries, amended by Decree No. 2015-299 06 March 2015.
Having regard to Decree No. 2015 - 855 of 22 June 2015 on the composition of the Government.
The report of the Minister of local governance, development and planning, decreed: Article 1. -The program of management of municipal solid waste, funded by the State of Senegal was transferred to the Coordination Unit of the solid waste management of the Ministry of local governance, development and planning.
S. 2 - has this title, the Coordination Unit for the management of solid waste provides the management of operations, planned under the program of management of urban solid waste, including the cleaning of the streets, collection, transportation and landfill of household waste in the whole of local communities to the Dakar Region, and any other project y matter.
S. 3 - resources to the financing of urban solid waste management benefits are made available to the Coordination Unit for the management of solid waste.
S. 4 - the unit for Coordination of the management of solid waste is, as necessary and in the context of conventions duly established, assisted by the State structures in the coordination, monitoring and evaluation of the urban solid waste management program.
S. 5. - all provisions contrary to this order are hereby repealed.
S. 6. - the Minister of economy, finance and the Plan and the Minister of local governance, development and spatial planning are responsible, each in relation to the implementation of this Decree which shall be published in the Official Journal.
