Ministry of the economy, of finance and of PLAN Decree No. 2015-1985 December 23, 2015 Decree No. 2015-1985 23 December 2015 repealing and replacing article 2 of Decree No. 89-683 of 14 June 1989 on the arrangements of variation in the value of the rate of Chancery report of PRESENTATION Decree No. 2000-584 of 20 July 2000, which amends article 4 of Decree No. 89-682 of 14 June 1989 on the remuneration of officials and staff arrangements in service in diplomatic and consular posts and related services, provides in its provisions for the payment of the emoluments of the staff of embassies and consulates in local currency, unless waived by decision of the President of the Republic on the joint proposal of the responsible ministers in accordance with the local regulations of the foreign exchange.
In this respect, the equivalence between the Chancery and the Bank exchange rate (baseline) can lead fluctuations of the latter linked to the monetary market of actual impact on the purchasing power of expatriate staff, including by a reduction in the amount of his compensation.
To counter this negative impact related to variations in the exchange rate, is usually conducted, in addition to the rate of Chancery in force, applying to the emoluments of the rate of previous Chancery considered most advantageous to avoid any situation detrimental to diplomatic agents.
To annihilate the domino effect at the level of diplomatic representations abroad and a duality in the application of the rate of Chancery on the one hand, and to thwart the issues sometimes damaging consequences of persistent variations in the exchange rate on the other hand, it is appropriate to proceed with the amendment of article 2 of Decree No. 89-683 of June 14, 1989 supra, notably by designing a new range to ensure a real stabilising rates of Chancery.
Such is the economy of the draft decree.
The President of the Republic, pursuant to the Constitution;
Pursuant to law organic n ° 2001-09 of October 15, 2001, relative to the laws of finance.
Mindful of Decree No. 89-682 of June 14, 1989, establishing the regime of remuneration of officials and other servants in service in diplomatic and consular posts and attached services, amended by Decree No. 2000-584 of 20 July 2000;
Having regard to Decree No. 89 - 683 of 14 June 1989 on the arrangements of variation in the value of the rate of Chancery;
Pursuant to Decree No. 2011 - 1880 November 24, 2011 on general public accounting regulations;
Pursuant to Decree No. 2013 - 396, April 8, 2013 on assignment of the cash remuneration for overseas expenditures.
Having regard to Decree No. 2014 - 845 July 6, 2014 appointing the Prime Minister;
Mindful of Decree No. 2014-853 9 July 2014 on the distribution of the services of the State and control of public institutions, societies and corporations with public participation between the Presidency of the Republic, the Prime Minister's Office and the ministries, amended by Decree No. 2015-299 06 March 2015.
Having regard to Decree No. 2015 - 855 of 22 June 2015 on the composition of the Government.
The report of the Minister of economy, finance and the Plan, decreed: Article 1. -The provisions of article 2 of Decree No. 89 - 683 of 14 June 1989 on the arrangements of variation in the value of the rate of Chancery are repealed and replaced by the following: 'Article 2. -The rate of Chancery in force from a diplomatic and consular mission is amended, as often as necessary, when this rate is greater than 15 or less than 2 relative to the rate of Exchange officially practiced in the country concerned.
In this case, the new Chancery applicable rate is equal to the Chancellery of reference rate, current, plus 50% of the percentage of the observed variation. » Art. 2. - all the other provisions of the Decree No. 89-683 of June 14, 1989, laying down the rules of variation in the value of the rate of Chancery, remain unchanged.
S. 3 - the Minister responsible for Foreign Affairs and the Minister of Finance shall be responsible, each in relation to the application of this Decree which shall be published in the Official Journal of the Republic of Senegal.
